Appicant: ADRAM, nc., 2627 E. St. Vrain, Coorado Springs, Coorado Location: The project site is ocated approximatey 0.9 mie upstream of the mouth of in Summit County, Coorado, and within Sections 25, 26, and 36, Township 5 South, Range 77 West. Purpose: The purpose of the project is a grave and pacer mining operation, extracting god, sand, and grave. The grave wi be used for road improvements and recamation. Project Description: The appicant proposes to mine 9.7 acres of which 2.7 acres are wetands. The 9.7 acres wi be mined in four areas of the appicant's 160 acres. One acre of the 2.7 acres of wetands wi be mined and wi remain as akes, each to be about 1/3-acre in size. Due to the irreguarity of pacer god deposits, not a of the 2.7 acres of wetands is ikey to be disturbed. n site o. 1, where the wash pant is to be ocated, wetands are ocated adjacent to the streambed but not in the 1.3 acres area to be mined. n site o. 2, approximatey 0.41 acre of the 3.2 acres to be mined is wetand. Approximatey 5,298 cubic yards of materia wi be excavated and redischarged into the wetands. Site o. 2 wi contain 2 of the 3 proposed akes. n site o. 3, approximatey 0.21 acre of the 1.4 acres to be mined is wetand. Approximatey 2,714 cubic yards of materia wi be excavated and redischarged into the wetands. This site is aso panned to be a wash pant ocated out of the wetand area. n site o. 4, approximatey 1.12 acres of the 3.8 acres to be mined are wetands. Approximatey 14,474 cubic yards of materia wi be excavated and redischarged into the wetands. This site wi contain ake o. 3. The akes wi be excavated to a depth of 8 feet and remain as depressions. The top 12 to 24 inches of soi wi be stripped by a sma dozer and stockpied in a non-erosive configuration outside the wetand areas. Setting ponds wi be constructed in non-wetand areas with protective 2-foot berms to prevent surface drainage from entering the stream. The method of backfiing and grading wi be accompished by using a crawer type dozer. Larger materia (3 to 12 inch) wi be backfied, first grading up to the smaer materia of ess than 1/4 inch. The backfi wi be brought up in two-foot ifts to insure compaction. After the topsoi has been respread, it wi be seeded and revegetated according to the suggestions of the Soi Conservation Service Report on the mining area. There are two stream crossings panned in the mining pan, ocated in Sites 2 and 4. These wi be permanent cuverted crossings foowing the specifications of the U.S. Forest Service. This aspect of the project quaifies under the nationwide permit for minor road crossing. Each crossing wi require approximatey 96 cubic yards of materia.

Requests for pubic hearings sha state, with particuarity, the reasons for hoding a pubic hearing. A permit issued by the Department of the Army does not give any property rights either in rea estate or materia or any excusive privieges and does not authorize any injury of private property or invasion of private rights, or any infringement of Federa, State or oca aws or reguations, nor does it obviate the necessity of obtaining State or oca assent to the work authorized. The decision whether to issue a permit wi be based on an evauation of the impact of this activity on the pubic interest under authority of Section 404 of the Cean Water Act (33 USC 1344). Evauation of the probabe impacts, inc11ding c 1 1m1d=>tive impacts, which the proposed activit)' may have on the puhh,--- interest requires a carefu weighing of a those factors which become reevant in each particuar case. The benefits which reasonaby may be expected to accrue from the proposa must be baanced against its reasonaby foreseeabe detriments. The decision whether to authorize a proposa, and if so the conditions under which it wi be aowed to occur, is therefore determined by the outcome of the genera baancing process. That decision shoud refect the nationa concern for both protection and use of important resources. A factors which may be reevant to the proposa must be considered incuding the cumuative effects. Among those are conservation, economics, aesthetics, genera environmenta concerns, wetands, cutura vaues, fish and widife vaues, food hazards, foodpain vaues, and use, navigation, shore erosion and accretion, recreation, water suppy and conservation, water quaity, energy needs, safety, food and fiber production, minera needs, considerations of property ownership, and, in genera, the needs and the wefare of the peope. For activities invoving 404 discharges, a permit wi be denied if the discharge does not compy with the Environmenta Protection Agency's 404(b)(1) guideines.
