2 118 CAP.2111 Beize Agricutura Heath Authority CHAPTER /2001. BELIZE AGRICULTURAL HEALTH AUTHORLTY (QUARAN'I'INE INSPEC'I'ION AND CERTIFICATION FEES) REGULATIONS 121"' Apri, Short tite. 1. These Reguations may be cited as the BELIZE AGRICULTURAL HEALTH AUTHORITY (QUARANTINE INSPECTION AND CERTIFICATION FEES) REGULATIONS. Interpretation. 2. In these reguations, uness the context otherwise requires- "Authority" means the Beize Agricutura Heath Authority estabished under section 3 of the Act; "Quarantine Officer" means an officer authorized by the Authority to cany out quarantine inspections. Export 3. (1) Every exporter of a commercia cargo, or his authorized agent, certification. sha pay to the Authority a fee of BZ$20 per hour of quarantine inspection of such cargo pus the transportation costs of the Quarantine Inspector. (2) Every exporter of a commercia cargo, or his authorized agent, sha pay to the Authority, the foowing fees for the issuance of a Phytosanitary Certificate for such cargo- THE SUBSIDIARY LAWS OF BELIZE Printed by the Government Printer. (4) The fees prescribed by subreguation (2) (a) and (b) sha be paid before the quarantine inspection. 4. (3) The owner or a captain of a vesse without a Beize based agent sha make payments directy to the Quarantine Inspector conducting the quarantine inspection. (4) The owner of a vesse, his authorized agent or the captain of the vesse sha aso pay the transportation costs of the Quarantine Inspector, in the case ofpayments made under subreguation (1) (4). (1) Every imported commodity or product isted in the Schedue sha be inspected by a Quarantine Inspector to determine if a Landing Permit sha be issued for the commodity or product. of commoditica, Schedue. 6 122 CAP.2111 Beize Agricutura Heath Authority (2) The importer of a commodity or product referred to in subreguation (), or his authorized agent, sha pay to the Authority the foowing fees for the quarantine inspection- Weight or Cassification of Commodity or Product Fee BZ$ (a) commodities or products with an approximate weight of one hundred (1 00) pounds but not exceeding one thousand (1,000) pounds... (6) non-reguated (ow risk) commodities or products with a weight exceeding one thousand (1,000) pounds... (c) reguated (high risk) commodities or products with a weight exceeding one thousand (1,000) pounds... THE SUBSIDIARY LAWS OF BELIZE (3) Where a Landing Permit is not issued for a commodity or product under subreguation (), such commodity or product sha be confiscated, destroyed, or returned to the country of origin at the owner's expense, by the Authority. (4) A non-governmenta organization or statutory body importing a commodity or product referred to in subreguation (1) for non-commercia Printed by the Government Printer. (3) hor the purposes of this reguation, the expression "noncommercia purposes" means the importation of commodities or products for purposes other than for sae to the genera pubic. 7. (1) Every owner of a commodity or product isted in the Schedue Intransit and which is in transit through Beize, or his authorized agent, sha pay to the commodities, Authority, the foowing fees for the quarantine inspection of such commodity etc.. Schedue. or product- Cassification of Commodity or Product Fee BZ$ (a) ow risk commodity or product per container or vesse (b) high risk commodity or product per container or vesse. (2) The fees prescribed by subreguation (1) sha be paid to the Authority. (3) Every owner referred to in subreguation (), or his authorized agent, sha aso pay the other expenses of the Quarantine Ufficer. Out of port 8. (1) Every container or vesse, carrying any commodity or product inspections. isted in the Schedue, whichneeds quarantine inspection at a private warehouse Schedue. or storage faciity and for which Customs entry forms have been stamped "VISUAL INSPECTION REQUIRED", sha not be aowed to eave any air or seaport uness accompanied by a container appication fiom the Authority and a Quarantine Inspector. Schedue. (2) The importer of a commodity or product isted in the Schedue, or his authorized agent, sha pay to the Authority a fee of BZ$20 per how for the inspection of such commodity or product, pus the transportation costs of the Quarantine Inspector. (3) The fee prescribed by sub-reguation (2) sha be paid to the Authority. Offences and 9. (1) Any passenger who makes a fase decaration on a Customs penaties. Decaration Form, pertaining to the importation of pants, animas and their products and by-products, commits an offence and sha be iabe to a spot fine of fifty doars (BZ$50). Schedue. (e) contravenes or fais to compy with any of the provisions of any import permit referred to in paragraph (d), commits an offence. (3) Every person who commits an offence under sub-reguation (2), sha be iabe on summary conviction to a fine not exceeding five thousand doars or to a period of imprisonment not excee&ng two years, or to both such fine and period of imprisonment. 10.
