The berths are designed t accmmdate Pst Panamax and Cape size vessels. Tw cntainer terminals, each having a capacity f 1.3 millin TEU s and tw cntainer terminal each having a capacity f 1.5 millin TEUs. Tw SPMs t handle VLCC tankers fr IOCL and HMEL. Three berths are fully mechanized and peratinal alng with supprting infrastructure fr unlading f vessels. Furth berth is getting mechanized. APSEZ has its wn dedicated 64 km private duble lane rail netwrk which is capable f handling duble stack cntainer trains. Plicies APSEZ aims t handle millin tns f carg by the year Security Plicy We are cmmitted t prvide a safe and secure wrking envirnment t all its emplyees, prt users, carg, ships and its persnnel. This will be achieved by establishing and maintaining the required security measures t prevent unlawful acts against peple, carg and marine assets. We shall strive t detect and deter unauthrized entrants and criminal activities in prt facilities and react timely and crrectly when such activities are encuntered. Bunkers: A maritime term referring t fuel used abard the ship. In the past, fuel cal stwage areas abard a vessel were in bins r bunkers. Calendar day: A Calendar day time perid is cnsidered frm midnight t midnight (i.e t 2359hrs). Carg: All gds, materials, merchandise, r wares carried n bard an aircraft, ship, train, r truck. CB: Cntainer Berth. CBM (CM): Abbreviatin fr Cubic Meter. CBM measurement is L x B x H. CFS: Abbreviatin fr Cntainer Freight Statin. A shipping dck where carg is laded ( stuffed ) int r unladed ( stripped ) frm cntainers. Generally, this invlves less than cntainer lad shipments, althugh small shipments destined t same cnsignee are ften cnslidated. Cntainer relading frm/t rail r mtr carrier equipment is a typical activity. These facilities can be lcated in cntainer yards, r ff dck. BPTS I Page 5

7 Cld mve: The vessel's engine and steering gear shuld be available fr use at all times during the maneuvre. If it is fails during berthing / un-berthing / shifting prcess, it will be treated as cld mve and charged as per tariff. CT: Cntainer Terminal. Deadweight Tnnage (DWT): Apprpriate seasnal deadweight. Detentin fr carg n equipment: Additinal charges will be applicable n shippers r cnsignees fr delaying carrier s equipment beynd allwed time. Demurrage applies t carg; detentin applies t equipment. Draft: Vertical distance between the vessel s water line and the lwest part f its hull. Dunnage: Any material r bjects utilized t prtect carg. Examples f dunnage are blcks, bards, burlap and paper. ETA: Expected Time f arrival. Exprt: Shipment f gds t a freign cuntry. FCFS: First Cme First Served. Freight Frwarder: A persn whse business is t act as an agent n behalf f the shipper. A freight frwarder frequently makes the bking reservatin. In the United States, freight frwarders are nw licensed by the FMC as Ocean Intermediaries. FRT: Freight Tnes: CBM r MT whichever is higher. Individually calculated fr the packing list. GT: Grss Tnnage. Internatinal Ship and Prt Facility Security Cde (ISPS): It is an amendment t the Safety f Life at Sea (SOLAS) Cnventin (1974/1988) n minimum security arrangements fr ships, prts and gvernment agencies. Having cme int frce in 2004, it prescribes respnsibilities t gvernments, shipping cmpanies, shipbard persnnel, and prt/facility persnnel t detect security threats and take preventative measures against security incidents affecting ships r prt facilities used in internatinal trade. IWPM / OWPM: Inward Pilt Mem / Outward Pilt Mem. Idling: If a vessel is alngside the berth withut carrying ut any carg peratins. Kg: Kilgram. LOA: Length Overall. Used t satisfy the requirements f a letter f credit, in the absence f an express requirement t the cntrary. P&I: Prtectin & Indemnity. PANS: Pre-arrival ntificatin f security. Per day: 24hrs calculated frm cmmencement f the mentined activity. Any perid part theref will be cnsidered as full day and charged accrdingly. POC: Prt Operatin Center. Pririty Berthing: Ousting Pririty: If a vessel having an usting pririty fr a given berth, then the wrking vessel at that berth will be remved frm the berth t accmmdate the vessel having usting pririty. The vessel wrking n the berth will hwever be remved nly when it is safe t d s. Pririty: If a vessel having a pririty fr a given berth arrives, then she will berthed ahead f ther vessel waiting fr that berth nce the berth falls vacant. Overriding Pririty: If a berth has been alltted t a specific carg/receiver, then these vessels will have pririty n that berth. Hwever if a vessel with verriding pririty arrives and requires the use f that berth, she will be berthed ahead f ther waiting vessels having the same carg/receivers. R/R: A shrtening f the term, Rll On/Rll Off. A methd f cean carg service using a vessel with ramps which allws wheeled vehicles t be laded and discharged withut cranes. Als refers t any specialized vessel designed t carry R/R carg. TEU: Twenty feet Equivalent Unit. is an exact unit f carg capacity ften used t describe capacity f cntainer ships. Timings: All timings will be based n Piltage Certificate which is signed by the vessel s Master. TPH: Tns per hur. Trans-shipment Prt: Place where carg is transferred t anther carrier. VCN: Vessel Call Number. Warehuse: A place fr the receptin, delivery, cnslidatin, distributin, and strage f gds/carg. Warping: Physical shifting f the vessel ahead / astern n the same berth. 9 Types f Ships: Bulk Carriers: All vessels designed t carry hmgeneus carg in bulk, such as fertilizers, re, cal, minerals and grains. Freighters: Break-bulk vessels bth refrigerated and unrefrigerated, cntainerships, partial cntainer ships, rll n/rll ff vessels, and barge carriers. A general carg vessel designed t carry hetergeneus mark and cunt carges. Barge Carriers: Ships designed t carry barges; sme are fitted t act as full cntainer. General Carg Carriers: Break-bulk freighters, car carriers, cattle carriers, pallet carriers and timber carriers. A vessel designed t carry hetergeneus mark and cunt carges. Cellular Cntainer ships: Ships equipped with permanent cntainer cells, with little r n space fr ther types f carg. Partial Cntainer ships: Multipurpse cntainer ships where ne r mre but nt all cmpartments are fitted with permanent cntainer cells. Remaining cmpartments are used fr ther types f carg. Rll n/rll ff vessels: Ships specially designed t carry wheeled cntainers r trailers using interir ramps. Tankers: Ships fitted with tanks t carry liquid bulk carg such as: crude petrleum and petrleum prducts, chemicals, Liquefied gasses (LNG and LPG), wine, mlasses, and similar prduct tankers. Free pratique: means permissin fr Ship/vessel t enter int the prt limits, embark r disembark, discharge r lad carg r stres. Free Pratique is granted by Public health fficer (PHO). Quarantine: Quarantine means the restrictin f activities and/r separatin f suspect persns wh are nt ill r f suspect baggage, cntainers, ship/vessel r gds frm thers in such a manner s as t prevent the pssible spread f infectin r cntaminatin. IV. Berthing Plicy 1. Berthing Objective 2. Ratinale 1.1 The bjective f the Berthing Plicy at Adani prt is t prvide well-defined, transparent, and nn-discriminatry guidelines fr the allcatin f berths at the Prt, based n vessel pre-ntificatin, arrival, and administrative cmpliances. 2.1 The aim f this BPTS is t prvide the user with relevant infrmatin fr planning f a vessel call at the prt and the charges that are likely t be incurred. 10 3. Berthing scheme: First cme First serve (FCFS) The Prt, as a general rule, adpts the plicy f First Cme First Serve (FCFS) basis. Cntainer vessels are generally accepted basis their berthing windws as agreed between the Shipping Line and the cncerned Cntainer Terminal. Fr all carg vessels, the fllwing criteria will be used by the Prt fr determining the berthing pririty: 3.1 The vessel has duly submitted the required Declaratin / Infrmatin / PANS (ISPS) prir vessel s arrival / statutry cmpliance f gvernment directives as issued frm time t time. Vessel agents are required t declare their vessels thrugh APMS. All vessels related details are t be updated in vessel definitin and vessel registratin. The details shuld be entered as per the vessel s particular. In case any infrmatin is incmplete r missing in APMS, the vessel s applicatin fr berth will nt be accepted. 3.2 Vessel wner / agent have paid in advance all the charges as per the PAA raised by the prt. The first PAA will be generated basis the berth hurs expected by the agent subject t a minimum berth stay f 24 hurs. In case the vessel cmpletes her carg peratin in less than 24 hurs, the additinal berth hire charges will be adjusted in the final invice. 3.3 Vessel has given at least 5/3/2/1 days ntices f Expected Time f Arrival (ETA), except vessels calling frm nearby prts r the vyage duratin is arund 1 day, which are required t prvide ne day ntice. 3.4 Vessel which has physically arrived within the prt limits r at defined psitin and registered herself with Prt Marine Cntrl giving all the vessels particulars. Physical arrival means the time f arrival f vessel int Prt Limits r at defined psitin. 3.5 Senirity f a vessel will be cunted basis the time f her physical arrival, filing f IWPM, Carg readiness, clearance frm cncerned department such as Dry Carg, Liquid and Cntainer with respect t carg readiness, receipt f pipe check list, verificatin f packing list and Terminal readiness whichever is later and applicable fr that vessel. 3.6 Cntractual agreements in place: Custmers wh have entered int lng term cntracts with the Prt will be given pririty in berthing as per their cntractual terms & cnditins. Prt will nt be liable fr payment f any damages / claims / delays / detentins / demurrages etc. t vessels, whse berthing is delayed due t berthing f junir vessels which have been given pririty in berthing as per their cntractual agreements. 3.7 In case f pipe exprt vessels, senirity will nly be cnsidered fr vessels if 80% Let Exprt Orders f each type/size/ diameter f pipe is available in the Prt fr lading. If carg is fund t be less than the afrementined quantity, such vessels will nt be cnsidered / discussed in Prt berthing meeting and senirity f such vessels will nly be cnsidered upn meeting the afrementined nrms. Similarly fr ther exprt carges, senirity will nly be cnsidered prvided 80% with LEO f the carg is inside the Prt. 3.8 Vessels which have been prperly declared befre 1000 hrs will nly be cnsidered fr allcatin f berth during the next 24 hrs. Vessels which have been declared later than 1000 hrs will be cnsidered fr berthing in the next Berth Planning Meeting r earlier if a suitable berth is available. BPTS I Page 9

11 4. Berth alltment criteria. BERTHING POLICY Berth-1, 2, 3 & 4 Berth-5,6,7 & 8 Berth-9,10,11 & 12 MICT, AMCT, AICTPL and ACMTPL WB-1 WB-2 WB-3 WB-4 Pririty fr Liquid carg. Berth n. Cntainer and RR vessels are accepted basis their berthing windws as agreed between the Shipping Line and the cncerned Cntainer Terminal. Ousting pririty berth fr M/s Castal Gujarat Pwer Limited vessels. Pririty berthing fr M/s Castal Gujarat Pwer Limited (CGPL) vessels arriving as per binding frecast. In case, there are n M/s Castal Gujarat Pwer Limited vessels waiting fr the berth, then M/s Adani Pwer Limited vessels gets pririty in berthing. M/s Adani Enterprise Limited (AEL) vessel will have pririty berthing at WB-3 hwever if there is a vessel wrking at WB-4, she will be first accmmdated at WB-3 fllwing the utward f WB-3 vessel. Hwever, if a M/s Castal Gujarat Pwer Limited vessel makes a request fr pririty berthing f its vessel at WB-2 berth, then M/s Adani Pwer Limited vessel will get pririty in berthing n WB-3 ver M/s Adani Enterprise Limited vessels frm the time f arrival f M/s Adani Pwer Limited (APL) vessel till WB-2 berth becme available fr use f M/s Adani Pwer Limited vessel. First Cme First Serve (FCFS) Ntes: 4.1 Tankers arriving frm within Gulf f Kutch shall give a minimum f 24 hrs ntice f Arrival (NOA) with an indicatin f the IWPM filing time with 3 hurs accuracy. 4.2 If the vessel (as per pint n-4.1) arrives utside the 3 hurs windw r files her IWPM utside the 3 hurs windw, it will be cnsidered fr berthing nly after 24 hrs. 4.3 The prt has capacity and necessary infrastructure t handle 2 steel vessels and 3 bulk vessels at any given time. Decesin t accept additinal vessels will be taken n case t case basis by prt peratin. 4.4 Pririty berthing will be given fr M/s Welspun Crp Ltd (Exprt Steel Carg), M/s Indian Farmers Fertilisers Cperative Ltd. (Fertiliser). These vessels will be accmmdated at any f the berths at T-2 and T-3 Terminal subject t berth parameters. 4.5 The Prt shall nt be respnsible fr any delay in piltage, berthing, ingress r egress fr any reasn whatsever. 4.6 The prt will nt be liable fr payment f any damages / claims / delays / detentins / demurrages etc. t vessels, whse berthing is delayed due t berthing f junir vessels which have been given pririty in berthing as per their cntractual agreements. 12 4.7 A vessel missing her turn at MMPT must prvide her readiness within 6 hrs. In-rder t retain senirity fr berthing. As regards West Basin, the berthing plicy as mentined abve will be enfrced as the Prt has t cmply with cntractual agreements. 5. Pririty berthing guidelines fr vessels: Fr Tankers: Pririty berthing fr tankers will nly be accepted if they will be ccupying the berth fr-less than 26 hurs. The time will be cunted frm first line ashre t all cast ff. 5.1 Pririty berthing will be allwed fr up t 2 vessels at a time n FCFS basis. 5.2 Pririty berthing is nly applicable fr dedicated Liquid carg berths. 5.3 Any vessel requesting pririty berthing is required t give at least 24 hrs ntice basis ETA at Mundra Prt limit. N request fr pririty berthing will be accepted, if the ntice is less than 24 Hurs. 5.4 Once a vessel has requested pririty, the same can be cancelled r withdrawn up t 12hrs befre her arrival ETA at the Prt Limit withut attracting pririty cancellatin charges. 5.5 Pririty cancellatin charge f will be levied as per tariff in case the vessel cancels her pririty berthing less than 12 hrs frm her last declared ETA. 5.6 If a vessel berths withut superseding any ther vessel, pririty berth charges will nt be applicable t the vessel. 5.7 Prt will nt keep berth vacant fr any pririty vessel and senirity sequence will be maintained as usual till arrival f pririty pted vessel. The vessels pririty starts frm her arrival time and accrdingly she will be given first preference amngst the waiting vessels. The vessel s ETA must be updated every 06 hrs in the last 24 hurs. 5.8 The next vessel seeking pririty will be accrded the same 26hrs after un-berthing f 2nd pririty vessel. 5.9 The vessel which avails pririty berthing will be required t pay 100% additinal berth hire as applicable as per prevailing Prt Tariff. In case f vessels having imprt as well as exprt carg, the fllwing will apply: Vessel s berth stay cannt exceed 26 hurs as given abve If there is anther vessel waiting fr berth, the pririty vessel will shift ut n cmpletin f the carg fr which pririty berthing had been sught The vessel, berthed n pririty, after shifting ut will re-berth as per her new senirity as per BPTS In case a vessel which is berthed n `pririty terms' is unable t cmplete the carg peratins and sail ut within 26 hurs, then Layup berth hire charges as per prt tariff will be applicable in additin t 100% pririty berth hire charges mentined in BPTS. In case the vessel is delayed beynd 26 hurs fr the fault f the vessel, the Prt reserves the right t shift the vessel t anchrage at her cst, subject t anther vessel waiting fr ccupying the berth. The vessel / agent / shipper / cnsignees agree t give an undertaking t pay the charges fr pririty berthing in advance. Pririty will be accrded as per Prt's discretin. In case f any dispute, the Prt's decisin will be final. BPTS I Page 11

13 5.11 Preferential berthing fr Naval / Cast Guard Ships: Naval vessels, Indian Cast Guard vessels and ther Gvt. vessels will be accrded preferential berthing subject t berth availability Gvernment Carges: The Prt permits pririty berthing fr vessels carrying gvernment carges (as may be declared frm time t time). Pririty berthing is als granted t lng term cntractual partners. 6. General guidelines fr all Vessels 6.1 The vessel's engine and steering gear shuld be available fr use at all times during the maneuvre. If a vessel s engine r steering fails during any pint f the berthing / un-berthing /shifting maneuvre, it will be treated as cld mve and will be charged as per Prt tariff. Nte: If vessel engine fails during utward Piltage and cld mve charges becme applicable t such vessels, the vessel may be required t wait at anchrage until payment cnfirmatin fr cld mve charges is received frm the vessel wners. 6.2 Any vessel deficiency must be reprted t the prt well in advance thrugh t Prtpscenter prtpscenter@adani.cm r thrugh VHF n Channel 77 t Mundra Marine Cntrl prir berthing / un-berthing / shifting warping peratins. Nn reprting f such deficiency will attract charges as per BPTS vessel depending upn the type f deficiency. Hwever if the prt is frced t grant usting pririty t any vessel fr whatsever reasn, all related charges including but nt limited t viz. shifting, time lst, equipment idling etc will be payable by the vessel requesting usting pririty. 6.6 A 90 minute ntice will be given t vessels fr reaching PBG (Pilt Barding Grund). Any vessel which requires mre time than the abve ntice has t infrm Prt Cntrl well in advance thrugh her agent r via VHF as defined in the ALRS ( Mundra Prt Ch 77) 6.7 If fr any peratinal reasns r Prt cnvenience, a junir vessel is berthed by superseding the senirity f ther vessels, the junir vessel will revert back t her riginal psitin in the senirity list if she is shifted ut t anchrage. 6.8 By making an applicatin fr, an accepting, the berth r ther services and facilities in the prt, the Vessel and the agent agrees t be bund by the prvisins f the General Terms and Cnditins fr Services, Facilities and general tariff charges as issued and amended frm time t time by the Prt. Frm ne berth t anchrage and re-berth A warping mvement means: Physical shifting f the vessel ahead / astern n the same berth A turnarund mvement means: Un-berthing the vessel frm its berth and re-berthing it at the same berth n a different side. 12. Free time allwed t vessels prir carg cmmencement and after cmpletin A vessel shuld be ready fr cmmencement f carg peratin in all respect within 3 hurs frm the time she is all fast alngside the berth. In case the vessel cannt cmmence her carg peratin within 3 hurs, layup berth hire / Idling charges as per Prt Tariff shall be applicable A vessel wanting t ver stay beynd the allwed 3 hrs after carg cmpletin shall make a request fr ver stay at least 2 hrs prir vessel s sailing time. Such a request will be accepted n case t case basis prvided there is n vessel waiting fr the use f the berth and the Prt has nt planned any maintenance activity n the berth. The Prt s decisin n such request wuld be final. In case, the Prt refuses permissin t ver stay, the vessel will have t vacate the berth. The vessel will revert t nrmal berth hire nce the vessel agent makes a request fr use f shre equipment In case, a vessel is n layup berth hire / Idling due t vessel equipment failure and anther vessel arrives and requires the use f that berth, the vessel will be shifted ut t anchrage n vessel s / wner / agent accunt.. 20 13.3 The prt may turn dwn a vessel request fr berth stay n layup berth hire / Idling if it will result in cascading impact n ther arriving vessels The prt shall remve a vessel frm the berth n vessel accunt if, the vessel is unable t meet prt s prductivity nrm due t failure f her equipment and the prt is nt in psitin t prvide shre resurce. The shifting f the vessel frm berth will hwever be dne nly if anther vessel arrives and requires the use f that berth Prt will nt charge layup berth hire charges n vessel which stay n the berth after carg cmpletin if vessels are receiving bunker / freshwater. This will be subject t the fllwing cnditins: i. There are n vessels waiting fr that berth. ii. The cncerned terminal / Marine department shuld nt have planned any maintenance activity n that berth. iii. The request fr additinal berth stay shuld be made at least 3 hurs prir carg cmpletin s that ther vessel mvements at ther berths are nt adversely affected. iv. The cncerned vessel will get pilt nly after ther planned vessel mvements have been carried ut. effrts will hwever be made nt t unduly delay these vessels. 14. Imprt / Exprt vyage in same VCN 14.1 As a general rule after cmpletin f discharge peratins, a vessel has t vacate the berth fr ther vessels waiting at the anchrage. If the same vessel is fixed fr lading, her arrival time fr lading peratin will be cnsidered nly after she has cmpleted her previus carg and is thereafter ready t lad carg in all respects. In case a new VCN is issued upn request, the secnd call will be treated as a fresh call and all marine dues will be applicable t the vessel. 15. Anchrage charges: 15.1 Anchrage charges will be applicable, frm the time f vessel drpping anchr till the time the pilt bard the vessel fr berthing, fr all vessels anchring within Prt limits ther than the belw. i. Thse vessels which are gverned by individual lng term Marine services cntracts. ii. SPM vessels which will cntinue t be charged as per their cntracts r the full anchrage rates. iii. Anchrage charges shall be charged n hurly basis. 16. Swapping f Senirity Swapping f berthing-senirity between vessels may be permitted by the Prt prvided the agent r agents f the affected vessels and /r the respective carg interests jintly request the Prt fr exchange f senirity in the pre scribed applicatin frm and agree t indemnify the Prt against any claims whatsever may arise there frm. The agency which intends t swap the senirity f its vessels must take int cnsideratin ther agents whse vessel will be adversely affected due t swapping f senirity. LOA / Prductivity f vessel being swapped will be cnsidered befre accepting the swapping request. 19. Shifting f vessels N Charges shall be levied fr shifting f a vessel fr Prt Cnvenience. Prt Cnvenience "is defined t mean the fllwing: 19.1 If a wrking carg vessel at berth r at mring pint is shifted fr prt t undertake hydrgraphic survey wrk, dredging, repair and maintenance f berth, r such ther similar activities whereby shifting is necessitated, such shifting shall be cnsidered as shifting fr prt cnvenience.
