Hwever, the infrmatin in the advisry circular des nt replace the requirement fr participants t cmply with their bligatins under the Civil Aviatin Rules, the Civil Aviatin Act 1990 and ther legislatin. Advisry circulars reflect the Directr s view n the rules and legislatin. They express CAA plicy n the relevant matter. They are nt intended t be definitive. Cnsideratin will be given t ther methds f cmpliance that may be presented t the Directr. When new standards, practices, r prcedures are fund t be acceptable they will be added t the apprpriate advisry circular. Shuld there be any incnsistency between this infrmatin and the rules r legislatin, the rules and legislatin take precedence. 3 Intrductin T be eligible t perate in New Zealand under Part 91 an aircraft must have been issued with an airwrthiness certificate (r a flight permit fr a micrlight). Civil Aviatin Rule Part 21 Subpart H prescribes the requirements fr the issue f airwrthiness certificates t aircraft. Airwrthiness certificates are issued in fur categries; standard, restricted, special and prvisinal. Only aircraft in the standard r restricted categry are eligible fr hire r reward peratins under Part 91 and nly aircraft in the standard categry are eligible fr air transprt peratins under Parts 121, 125 r 135. Aircraft are nly eligible t be issued with an airwrthiness certificate in the standard r restricted categry if they have been type certificated in New Zealand r type certificated in a freign cuntry and subsequently type accepted in New Zealand. Type certificates and type acceptance certificates are issued and changed under Part 21 including Subpart B that cvers type certificatin f prducts (aircraft, aircraft engines, r prpellers) in New Zealand type acceptance f freign type certificated prducts imprted int New Zealand Subpart D that cvers changes t type certificates and type acceptance certificates. This advisry circular gives guidance fr applicants wishing t apply fr the issue f, r the change t, a type acceptance certificate. Refer t AC21-7 Prduct Certificatin Type Certificates fr infrmatin n applying fr r amending a type certificate. 29 January

4 Type Acceptance Certificates General Type acceptance is a prcess invlving validatin f a freign type certificate. There shuld be n difficulties btaining type acceptance f a freign type certificate that has been issued in the nrmal categry r equivalent by a recgnised natinal airwrthiness authrity, such as frm Australia, Canada, USA r Eurpe. Their design standards and airwrthiness certificatin prcesses are familiar t CAA. If an imprter is cntemplating imprting an aircraft with a type certificate frm a cuntry that CAA has had n previus experience, such as frm Asia, Africa, Central America, r Eastern Eurpe, yu shuld cnsult with CAA prir t making an applicatin. Once issued, any subsequent aircraft f that type cvered by the type acceptance certificate are eligible fr the issue f an airwrthiness certificate under Part 21 Subpart H. All aircraft must g thrugh the entry prcess fr the issue f an airwrthiness certificate. See advisry circular AC21-2 fr further details. Fr the issue f a type acceptance certificate, rule requires the applicant t shw that the aircraft cmplies with a set f airwrthiness and envirnmental standards specified in Part 21, Appendix C. Effective dates fr type acceptance certificates Fr type acceptance certificates, rule accepts the effective date f the applicable standards as the date assigned in the freign type certificate, r an equivalent dcument, unless the Directr specifies anther date in writing. The Directr will nly specify ther dates where the freign prcedures wuld make the level f standards incnsistent with thse that apply fr New Zealand type certificatin. Design Standards Standard Categry Fr the issue f a standard categry type acceptance certificate the set f airwrthiness and envirnmental standards are prescribed in Part 21, Appendix C (a) and include FAR Parts 23 t 36 inclusive airwrthiness standards that are fund by the Directr t cmply with the Internatinal Civil Aviatin Organisatin (ICAO) Annex 8 requirements; and prvide levels f safety equivalent t the basic airwrthiness standards f the FAR Parts In additin, Part 21 Appendix C (c) details the requirement t prvide a flight manual as part f the design standards fr an aircraft. Equivalent Airwrthiness Standards Althugh the basic design standards are the FARs, the Directr accepts as equivalent the standards, which were in frce at the time the type certificate was issued. The Directr als accepts as equivalent British r Eurpean design requirements, r their earlier versins. Sets f standards accepted by the Directr as being equivalent standards fr the issue f a standard categry type acceptance certificate are listed in Appendix 3 t this advisry circular. When an applicant applies under each f these standards the flight manual requirements f Part 21, Appendix C (c) shuld als be applied. 29 January

5 The paragraph under Part 21, Appendix C (c) means that if the riginal design standards which an aircraft was apprved under fr the freign type certificate did nt require a Flight Manual, and therefre there is nne referenced under the freign type certificate, then a suitable dcument t be adpted in New Zealand must be prvided. Fr example, the FAA did nt require Flight Manuals t be apprved fr light aircraft until arund (Instead, any mandatry infrmatin r flight limitatins were prvided t the pilt in the frm f instruments markings and placards). Hwever, the aircraft type certificate hlder still prvided a pilt s manual in sme frm, which was ften called the Owner s Manual r smething similar. CAA usually just adpts this dcument as the Flight Manual in New Zealand. If the aircraft des nt have such a handbk, fr example if it is very ld, then CAA can help in the selectin f a suitable dcument. If there is n Flight Manual as part f the freign type certificate, we recmmend the applicant just state that fact n the applicatin and request assistance frm CAA with identificatin r prductin f an alternative Flight Manual. An applicant fr type acceptance will nt nrmally have t cnsider whether the design standards fr the freign type certificate are acceptable, prvided the freign type certificate was either issued by a recgnised cuntry, r it has been previusly validated by ne f the recgnised natinal airwrthiness authrities, such as the FAA. Changes t Type Acceptance Certificates Changes t type acceptance certificates are cvered by Part 21 Subpart D. Part 21 Subpart D states that applicatins fr changes t a type acceptance certificate are treated as applicatins fr a new type acceptance certificate. This is because there is n hlder f a type acceptance certificate and the nly reasn a change wuld be likely t be required wuld be t add an additinal mdel t an existing certificate. Originally, the Directr issued a new certificate and type acceptance reprt fr each new applicatin. Current plicy is that a type acceptance reprt is issued t cver each freign type certificate, and includes all applicable mdels and variants listed n that freign type certificate. The reprt is amended t a later revisin number t add new mdels r serial number ranges. Type Acceptance Certificate Applicatin General A type acceptance certificate is issued n the basis f the supply f the data specified in Part 21 Subpart B. It is nt necessary fr an example f the aircraft type t have been imprted. An applicatin fr a type acceptance certificate is t be made n CAA frm 24021/02. This frm is available frm the CAA website. Any persn r rganisatin may apply fr a type acceptance certificate, including a freign persn r rganisatin such as the manufacturer r type certificate hlder. The supprt f the freign type certificate hlder will always be required hwever, due t the nature f the data required t be supplied. The type acceptance certificate is issued in respect f the aircraft type itself, there is n certificate hlder as such. The type acceptance certificate is issued t validate a freign type certificate in New Zealand. Fr this reasn, an actual certificate is nt nrmally prduced. Hwever, where the applicant is the type certificate hlder, a certificate can be prduced fr display purpses. All charges assciated with the issue f the type acceptance certificate will nrmally be inviced t the applicant. CAA will invice anther client if it receives a written request and that client has agreed in writing t accept the charges. 29 January

6 Engines and prpellers Part 21 Subpart B prvides fr type acceptance f prducts, which includes engines and prpellers. A type acceptance applicatin fr an aircraft can include the engine and prpellers, r they can be the subject f a separate type acceptance applicatin. Freign type certificate Type acceptance in New Zealand is based n the State-f-Design freign type certificate. The reasn fr this is s that CAA has the mst direct supply f cntinuing airwrthiness data. The State-f-Design natinal airwrthiness authrity shuld als be able t prvide the best supprt f the type certificate. Prduct type details The freign type certificate and exactly which mdels the type acceptance certificate is t cver shuld be carefully specified by the applicant. The nly restrictin n the number f mdels that can be included is that they must all be included n the same freign type certificate. The data supplied, including flight manuals, must cver all the mdels. The categry f type acceptance granted will usually fllw the categry shwn n the freign type certificate, subject t a review f the certificatin basis by CAA - Aircraft Certificatin Unit. Type acceptance applicability is usually determined by the cverage f the manuals supplied. Therefre, it may be nt nly mdel and variant but als serial number specific. Supply f data Data supprting the applicatin shuld be supplied at the time f the applicatin, r, if it is nt available at that time, a cvering letter shuld give the details f when the data will be available. If the applicant is nt the type certificate hlder, CAA will cntact the type certificate hlder and request the data needed. Any csts impsed by the type certificate hlder fr the prvisin f type data must be met by the applicant. The applicant shuld supply with the applicatin riginals r phtcpies f the type certificate type certificate data sheet (except FAA r EASA, which are available n the net) cmpliance summary dcuments fr airwrthiness and envirnmental certificatin details f any exemptin granted, equivalent safety findings r special cnditins applied riginals f the flight manual maintenance manual parts catalgue service infrmatin fr the aircraft, engine and prpeller. Fr all data, including aircraft and cmpnent manuals, CAA prefers electrnic frmat, r access t a website database. 29 January

7 An inherent part f type acceptance is cntinued supprt f the aircraft and cmpnent dcumentatin. This will inevitably require the supprt f the respective type certificate hlder. There is a frm available n CAA website CAA frm 2171 fr the use f the respective type certificate hlders as an agreement t supply updates f manuals. Where the applicatin is fr a mdel n a freign type certificate, and anther mdel n the same type certificate has already been type accepted, CAA shuld be cnsulted befre requesting data frm the type certificate hlder as sme r all f the data requirements may already be held by CAA. Fr larger aircraft certificated under FAR Part 25 Transprt Categry r an equivalent it is desirable t supply additinal data that may subsequently be required fr ther CAA certificates r apprvals. Examples f such additinal data are included in Appendix 1 t this advisry circular. Validatin visit In line with CAA plicy, in respnse t the requirements f ICAO Annex 8 Airwrthiness f Aircraft, a mre in-depth review is cnducted where either CAA has nt had any recent cntact with a manufacturer, type certificate hlder, r natinal airwrthiness authrity f the State-f- Design, r where the type has new r unusual features r a very recent certificatin basis. It wuld invlve a validatin visit by certificatin specialists frm CAA t the type certificate hlder and/r manufacturer if different. This is an pprtunity fr CAA t becme familiar with the aircraft and the apprval prcess and paperwrk, as well as establishing cntacts with the type certificate hlder. CAA has fund it essential t have a gd wrking relatinship fr technical queries and cntinuing airwrthiness infrmatin. Such a visit is prvided fr under sectins and f the Implementatin Prcedures fr Airwrthiness under CAA /FAA Bilateral Airwrthiness Safety Agreement. In accrdance with the Civil Aviatin Charges Regulatins any such wrk verseas must be paid fr by the applicant, including travel and accmmdatin csts and expenses. Training Where a new aircraft type is being intrduced int service in New Zealand which will require significant apprval actin and subsequent regulatry versight by CAA, then training will be required t be prvided t CAA staff wh will be invlved in apprval f the aircraft fr air transprt peratins. This wuld include a full type-rating curse fr a flight peratins inspectr fr each type a general familiarisatin curse (typically 1-2 weeks) fr a mechanical systems airwrthiness inspectr an avinics familiarisatin curse fr an avinics systems airwrthiness inspectr. Ideally this shuld be prvided in advance f the aircraft entering service. 29 January

It applied nly t aircraft certified under FAR Part 23 standards in frce n r after 13 March Airwrthiness certificates were nt issued under SFAR 41 after 17 Octber The standards f SFAR 41 will be accepted by the Directr as equivalent standards, fr aircraft issued with amended r supplementary type certificates by the FAA under SFAR 41, if airwrthiness certificates have been issued t the aircraft by the FAA fr weights abve punds, the additinal requirements f SFAR 41 sectin 4(c) are cmplied with the exceptin f SFAR 41 sectin 5(b)(1) is nt applied fr weights abve punds, the applicant prvides evidence that FAR (a) in frce n 6 March 1995 is cmplied with. The Directr may already hld the necessary evidence r may have accepted the set as equivalent. In ther cases the Directr may have previusly decided that a set f standards des nt meet the requirements fr acceptance in the standard categry. Fr example, Eastern Eurpean and Sviet airwrthiness standards pre-1990 have never been accepted as equivalent by any f the recgnised western natinal airwrthiness authrities. Restricted Categry Fr the issue f a type acceptance certificate in the restricted categry an applicant shuld shw that the aircraft cmplies with a set f acceptable airwrthiness standards. Part 21 Appendix C (b) prescribes acceptable airwrthiness standards fr the restricted categry as any f the Federal Aviatin Regulatins prescribed in Appendix C (a)(1) excluding thse requirements that the Directr finds inapprpriate fr the purpse fr which the aircraft is t be used; r a set f airwrthiness design standards that the Directr finds apprpriate fr the purpse fr which the aircraft is t be used. Restricted categry type acceptance certificates may be issued fr the fllwing purpses peratins under Part 91 agricultural aircraft peratins under Part 137 special purpse peratins, such as helicpter external lad peratins under Part January

14 Aircraft with a restricted categry type acceptance certificate will nly be eligible fr the issue f an airwrthiness certificate in the restricted categry fr the purpse the type acceptance certificate was issued. This may include the abve but may nt include air transprt peratins under Parts 121 and 135. British Civil Airwrthiness Requirements Acceptable British Civil Airwrthiness Requirements include BCAR Sectin S Small Light Aerplanes BCAR Sectin S applies t aerplanes with a maximum ttal weight f 390 kg a wing lading at maximum ttal weight nt exceeding 25 kg per square metre a maximum fuel capacity f 50 litres a maximum f tw ccupants Aircraft certificated under this standard are nly certificated fr Day-VFR nn-aerbatic peratins as specified in the flight manual, and will be limited t nn-hire r reward peratins under Part 91 as will be specified n the airwrthiness certificate. The level f safety prvided fr the ccupants will be assessed when applying limitatins n a restricted categry aircraft.
