1 CONTRACT OF CARRIAGE The fllwing terms and cnditins, alng with the validated ticket, cnstitute a cntract between Hyannis Air Service, Inc. d/b/a Cape Air/Nantucket Airlines (hereinafter referred t as Cape Air ) and ur Custmers. All transprtatin by Cape Air is subject t these terms and cnditins as well as t any terms and cnditins specified n r in any ticket, ticket jacket, E-ticket receipt, web site, r printed schedule. By purchasing a ticket r accepting transprtatin, the Custmer agrees t be bund thereby. A cpy f this cntract may be btained frm any Cape Air airprt ticket cunter r city ticket ffice, thrugh calling the central reservatins ffice at CAPEAIR ( ) r (508) (utside the US and USVI), by accessing ur web site at r by cntacting Cape Air at 660 Barnstable Rad, Hyannis, MA (Attn: Custmer Care). Cape Air: Trade name f Hyannis Air Service, Inc. under which the cmpany des business. Als knwn by the Cape Air IATA designatr 9K. Carry-n Baggage ( carry-n ): Any article r ther Custmer prperty that is carried n an aircraft by a ticketed Passenger. Carry-ut Item: Any small article r ther Custmer prperty that is carried t the aircraft by the Custmer and stwed by a Cape Air agent int the designated baggage cmpartments prir t barding. Persnal items (e.g. small purse, briefcase, and laptp) usually cnstitute carry-ut items when traveling n bard the Cessna 402, Britten Nrman Islander, and Cessna Caravan Amphibian. Checked Baggage: Any article r ther Custmer prperty (excluding Gate Checked Baggage) that is taken int the custdy f and accepted by Cape Air fr transprt Cde Share: An agreement between airlines where a partner air carrier places its tw letter designatr cde n flights perated by Cape Air (9K) t facilitate interline travel. In this situatin, the flight may be marketed under a trade name wned by the partner air carrier but all such marketing will clearly disclse t the Custmer that the flight is perated by Cape Air. Cape Air s cde share relatinships include Cape Air flights sld as American Airlines under the AA cde, Cape Air flights sld as JetBlue under the B6 cde, and Cape Air flights sld as United Express and United Airlines under the UA cde. Cmmuter Bk: Cape Air s frequent flyer ticket prgram which ffers 10 ne-way cupns in ne bk (electrnic r paper depending upn the market) fr a discunted price. CRS: Child safety restraint system, such as an infant- r child-safety seat. Custmer r Passenger: Any persn hlding a cnfirmed reservatin fr travel with the cnsent f Cape Air. Dmestic Carriage: Any carriage ther than that specifically defined as Internatinal Carriage. FAA: Federal Aviatin Administratin. Flight Cupn: A prtin f the ticket that indicates travel pints between which the cupn is valid fr Passenger carriage. Frce Majeure Event. This term includes

Any labr dispute affecting Cape Air s service Any gvernment regulatin, demand r requirement Any shrtage f labr, fuel r facilities f Cape Air r thers; r Any ther fact nt reasnably freseen, anticipated, r predicted by Cape Air. Gate Checked Baggage: Baggage, small enugh t be cleared thrugh airprt security screening, which is brught t the departure gate by the Custmer and then taken int the custdy f and accepted by Cape Air fr transprt. IATA: Internatinal Air Transprt Assciatin Interline: Travel utilizing the services f ne r mre air carriers where the carriers agree t accept each ther s tickets and/r baggage. A cde share agreement is a specific type f interline travel and is included in this definitin. Cape Air has interline agreements with Alaska Airlines (AS), American Airlines (AA), Delta Airlines (DL), Hahn Airlines (HR), JetBlue Airways (B6), and United Airlines (UA). Cape Air has cdeshare agreements with American Airlines (AA), JetBlue Airways (B6), and United Airlines (UA). Internatinal Carriage: Any carriage in which, accrding t the Cntract f Carriage, the place f departure and the place f destinatin, whether r nt there is a break in the carriage, are nt bth situated within the United States; r, they are situated within the United States, but there is an agreed stpver utside the United States. ICAO: Internatinal Civil Aviatin Organizatin Itinerary: Rute f a Custmer s jurney LEO: Law Enfrcement Officer Mass Relay: A service designed fr peple with hearing lss and/r speech disabilities that live r wrk in Massachusetts and use a text based device fr phne cnversatins r want t cmmunicate with smene wh des. Telecmmunicatins Relay is prvided by each State in cmpliance with the Americans with Disabilities Act (1990). Relay prvides peple with easy and cnvenient access t telephne service thrugh prfessinally trained Relay Operatrs. Micrnesia: Includes Guam and the Cmmnwealth f Nrthern Mariana Islands (CNMI) Mntreal Cnventin: The Cnventin fr the unificatin f certain rules fr Internatinal Carriage by air. Generally, an airline itinerary cvered by the Mntreal Cnventin must be: Internatinal carriage n r after Nvember 4, 2003 AND (1) a rundtrip jurney frm a cuntry that has ratified Mntreal, OR (2) a ne-way jurney in which bth the cuntry f rigin and the cuntry f destinatin have ratified Mntreal. Nantucket Airlines: Trade name f Hyannis Air Service, Inc. under which the cmpany des business, herein referred t as Cape Air fr purpses f this cntract f carriage. Nn-Ambulatry Passenger: Passengers wh are unable t walk r mve withut the supprt f anther persn, but wh are therwise capable f caring fr themselves withut assistance thrughut the flight are nn-ambulatry. A Passenger wh uses a wheelchair fr cnvenience is nt cnsidered nn-ambulatry nr is a child r infant merely because f that child s age. If a Passenger can mve himself/herself frm his/her seat t the nearest emergency exit and ascend and descend the aircraft stairs withut the aid f anther persn, the Passenger is nt cnsidered t be nn-ambulatry, regardless f the degree f impairment. N-Shw Passenger: A Passenger wh fails t hnr a segment f his r her travel and fails t cntact Cape Air in advance f departure time t infrm Cape Air that he r she will nt be n the flight. On-line: Air transprtatin whlly n the same air carrier Pet: The usual cnntatin f live dmestic animal cmpanin

6 Oversld Flight: A flight where there are mre Passengers hlding valid cnfirmed reservatins than seats available (excluding seats reserved r held fr crewmembers r ther n-duty Cape Air persnnel perfrming cmpany-required duties). Qualified Individual with a Disability: Any individual wh has a physical r mental impairment that, n a permanent r temprary basis, substantially limits ne r mre majr life activities, has a recrd f such an impairment, r is regarded as having such an impairment, pursuant t 14 CFR Schedule Change: A planned change in advance f the departure date that des nt arise frm a unique event such as a Schedule Irregularity r Frce Majeure Event. Schedule Irregularity: This term includes - Delay in a scheduled departure r arrival f a Cape Air flight, including delays which result in a miscnnectin: Flight cancellatin, missin f a scheduled stp, r any ther delay r interruptin in the scheduled peratin f a Cape Air flight which may r may nt result in a miscnnectin; Substitutin f aircraft type; r Schedule changes that require re-ruting f the Custmer at departure time, because prir ntice f such schedule change had nt been given t the Custmer prir t the Custmer s arrival at the airprt fr check-in n the riginal flight. Schedule irregularity des nt include Frce Majeure events as defined herein. Service Animal: Any guide dg, signal dg, r ther animal trained t prvide necessary assistance t a Qualified Individual with a Disability, r a trained animal that assists law enfrcement fficers in the search f cntraband r ther items, r which prvides assistance with rescue effrts. This definitin includes thse service animals which are required fr emtinal supprt, r psychiatric service animals. Special Drawing Right ( SDR ): A unit f currency, the value f which fluctuates and is recalculated each banking day. These values are knwn t mst cmmercial banks and reprted in sme newspapers. This unit is smetimes used fr Internatinal standards. Rerute: T hnr a ticket, r reissue a ticket fr a different ruting than riginally shwn n the ticket Ruting: The carrier(s) and/r the cities and/r class f service via which transprtatin is prvided between tw pints Ticket: The recrd f agreement, including paper and electrnic ticket frms ( E-ticket ) and ticketless itinerary frms, fr the carrier(s) t prvide transprtatin and related services under certain terms and cnditins t the Custmer named n such recrd and in accrdance with applicable gverning tariffs and regulatins. Travel Pass. A prgram fr frequent travelers invlving the purchase f and ability t stre multiple E-tickets fr future travel. United Express: Trade name wned by United Air Lines, Inc. ( UA ) under which Cape Air perates mutually agreed flights using the UA designatr cde pursuant t a cde share agreement between the carriers United States: The area cmprised f the 48 cntiguus states, the District f Clumbia, Alaska, Hawaii, Puert Ric, the U.S. Virgin Islands, American Sama, Guam, Midway, and Wake Islands. Warsaw Cnventin: The Cnventin fr the unificatin f certain rules fr Internatinal Carriage by air. Warsaw applies fr Internatinal Carriage nt cvered by the Mntreal Cnventin. Applicability General. The fllwing terms and cnditins apply t all transprtatin prvided by Cape Air and apply whether r nt a ticket fr such transprtatin was sld by Cape Air r its authrized agents. By purchasing a ticket r accepting transprtatin, the Custmer agrees t be bund thereby. There are n third party beneficiaries t this cntract

7 Except as therwise prvided within specific fare rule, transprtatin is subject t the cntract f carriage and charges in effect n the date n which the ticket is issued. These Rules are als the tariffs filed by Cape Air in accrdance with certain gvernment regulatins. Mst markets are served by the Twin Engine Cessna 402 ( C402 ). The peratins in Micrnesia are served exclusively by the turbprp 46-Passenger ATR42 ( ATR42 ). Sme f ur smaller cmmunities are served by ur Twin Engine Britten Nrman Islander ( BN2 ). And fr destinatins mst accessible via water and land, we utilize the turbprp Cessna Caravan Amphibian ( C208A ). All schedules are published with the applicable aircraft type, subject t schedule irregularities. Airline Partners. This cntract f carriage applies fr transprtatin nly n Cape Air. Under arrangements with Cape Air, independent carriers may prvide Interline transprtatin and/r Cde Share services. These independent carriers may have different terms and cnditins f carriage which will apply fr travel n these carriers and yu may btain the terms thrugh cntact with these independent carriers. See the sectin entitled Interline, Cde Share and Other Airline Partners fr mre regarding the applicatin f these rules in partner situatins. When Cape Air undertakes t issue a ticket r barding pass, check baggage r make ther arrangements fr transprtatin ver the lines f any ther carrier, Cape Air acts nly as agent fr the ther carrier and assumes n respnsibility fr the acts r missins f such ther carrier. Cape Air, Nantucket Airlines and Other Trade Names Unless as therwise prvided herein, regardless f the trade name r airline cde used fr such flights, this cntract applies fr all cmmercial flights perated by Hyannis Air Service, Inc. Applicable Laws. This Cntract f Carriage is subject t applicable laws, regulatins, rules, and security directives impsed by gvernment agencies. In the event f a cnflict, mandates f gvernmental authrities will prevail. Internatinal Carriage. Services prvided fr internatinal carriage are subject t the prvisins f the Warsaw r Mntreal Cnventins, including thse relating t the limitatin f liability. Any prvisins f these rules that are incnsistent with any prvisin f the applicable Cnventin shall, t that extent nly, be inapplicable t internatinal carriage. Limitatins in Liability/Damages Unless specifically stated therwise herein r required by law, Cape Air is nt liable fr any cnsequential, cmpensatry, indirect, incidental r punitive damages arising ut f r in cnnectin with the perfrmance f its bligatins under this cntract f carriage. Mdificatin f Terms. N emplyee r agent f Cape Air has the authrity t mdify r waive any prvisin f this Cntract, unless authrized by the CEO, President, Senir Vice President r Vice President f the cmpany. Mnetary Amunts. When included, all mnetary amunts, unless therwise specified, appear in U.S. dllars

8 Severability. The invalidity f any prvisin herein by law will nt affect the validity f any ther prvisin which will remain in full frce and effect. Headings and Titles. Headings and titles used in this dcument are fr cnvenience and nt meant t be used t cnstrue r alter cntract terms. Custmer Care The emplyee-wners f Cape Air strive t prvide ur Custmers with a travel experience that is a cut abve the rest. Yur cmplaint will be addressed as sn as pssible, but n later than 60 days after receipt. Cmplaints and cmments abut airline service ther than safety r security issues may als be registered with DOT's Aviatin Cnsumer Prtectin Divisin (ACPD). Yu may call the ACPD 24 hurs a day at (TTY ) t recrd yur cmplaint. Calls are returned Mnday thrugh Friday, generally between 7:30 am and 5:00 pm Eastern time. Yu may send the DOT a letter at Aviatin Cnsumer Prtectin Divisin, C-75, U.S. Department f Transprtatin, 1200 New Jersey Ave, S.E., Washingtn, D.C Fr deaf r hard f hearing Custmers, please be advised that yu may cntact ur Reservatins Office thrugh MassRelay (711 within Massachusetts r TTY/ASCII) r thrugh yur wn state's relay system. Baggage and Claims Baggage will be accepted fr transprtatin frm ticketed Custmers nly. Cape Air will nt accept baggage whse size, weight r character makes it unsuitable fr transprtatin n the aircraft, r when the prperty cannt be accmmdated withut harming r annying Passengers, as determined by the Cmpany. All baggage is subject t inspectin. Gvernment safety and security regulatins apply t Cape Air s carriage f baggage. When bag fees apply, thse in effect at the time f the ticket purchase will be levied during yur travel. Baggage fr Custmers flying n ur 46-Passenger ATR42 perated in Micrnesia as United Express is carried in accrdance with the fees and plicies f ur cdeshare partner (United), subject t the limitatins and exemptins in this Cntract f Carriage. See united.cm fr mre infrmatin and ur Sectin entitled Interline, Cde Share and Cnnecting Itineraries fr a mre detailed verview f plicy applicatin. Baggage Allwance. Standard Allwance

9 Fr each ticketed Custmer, Cape Air will transprt the fllwing. Fr fees that may apply, please see Baggage Fees, Exemptins and Allwance Applicability: Fr Transprt in the Cessna 402, Britten Nrman Islander, and Cessna Caravan Amphibian checked bag nt t exceed 50 lbs. r 62 linear inches (length + width + height = 62 ) plus 1 gate checked bag sufficiently small and lightweight t be cleared thrugh airprt security screening nt t exceed 45 linear inches (length + width + height = 45 ) plus 1 persnal item (e.g. small purse, briefcase, electrnic device) nt t exceed 36 linear inches (length + width + height = 36 ). These aircraft d nt cntain strage space under the seat r verhead in which t safely stw in-cabin items. Accrdingly, persnal, r carry-ut, items must be carried t the aircraft and stwed by a Cape Air agent int the designated baggage cmpartments prir t barding. Fr travel in the Cessna Caravan Amphibian it is preferred that baggage be sft-sided (fabric r leather) and nt rigid. Althugh rller bards are accepted, duffel r gym bags are preferred and imprve ur ability t carry all baggage n bard. Exceptin fr travel between Hyannis (HYA), Nantucket (ACK), Martha s Vineyard (MVY) and New Bedfrd (EWB): Up t 3 small bags (r items suitably secure fr transprt) are accepted in lieu f the 1 st checked bag s lng as all items, when weighed tgether, d nt exceed the maximum 1 st checked bag weight permitted f 50 lbs. The 1 st checked bag fee applies, if any, as if these multiple items were ne checked bag. Travel must be exclusively between these cities fr this rule t apply. Free Carry-ut Items All Aircraft Types In additin t the standard allwance, the fllwing will be transprted free f charge: A wheelchair meeting the requirements f the Cmpany s FAA-apprved perating prcedures stated under sectin Wheelchairs and Other Assistance-Related Devices, A cane, walking stick, crutches r ther assistive devices. An infant r child-safety seat. Fr use n-bard please see Wheelchairs and Other Assistance-Related Devices fr requirements. A strller and/r diaper bag. Cmpliant Prtable Oxygen Cncentratrs r ther related devices Child and Infant Baggage Allwance A child s baggage allwance is the same as that fr an adult Passenger. A child traveling as an infant as defined by the fares and tariffs is nt allcated baggage allwance in additin t that allcated t the accmpanying adult Passenger, unless the infant is traveling n a paid full r discunted ticket (nt n a ticket cvering slely internatinal taxes) and, in accrdance with the rules herein, the partner airline plices apply and include an allwance Excess Baggage, Oversize/Overweight and Other Special Items Excess Baggage Fr each ticketed Custmer, Cape Air will transprt, subject t available space and additinal fees (see Baggage Fees, Exemptins and Allwance Applicability), up t tw (2) additinal bags per Passenger, except fr Custmers traveling n the Cessna Caravan Amphibian where nly (1) additinal bag will be transprted accrding t these terms. Any checked bag, gate checked bag r persnal item that causes a Passenger t exceed the standard baggage allwance in number, size r

10 weight, but which is nt verweight/versized, will be transprted as excess baggage. All excess baggage is carried n a space available basis and is subject t an additinal charge. Any bag that is excess because it exceeds the number f bags permitted as standard bag allwance and/r the weight r size will be subject t cumulative excess charges. Additinal r different charges may apply when levied by a partner airline thrugh interline, cde share r ther airline partner agreements. Overweight/Oversized Bags Baggage cmpartment cnstraints f the aircraft may restrict the weight r the size f the individual bags that may be accepted fr travel. Baggage that is nt accepted fr travel pursuant t this sectin is as fllws: Fr Transprt in the Cessna 402 and Britten Nrman Islander: Individual bags that exceed 70 lbs. in weight r that exceed 62 linear inches (length + width + height = 62 ) in size. Fr general guidance fr planning purpses, althugh there are exceptins fr unusually shaped items (see belw within this sectin) mst large bags are 30 x 20 x 12 (62 linear inches) and are the maximum size we accept due t the size f the baggage cmpartments and cmpartment penings f these aircraft. If the item exceeds the standard baggage allwance in number, size r weight, this item r anther piece f the Custmer s baggage may be required t travel as space is available. Archery equipment (ne bw case cntaining bws, ne quiver with arrws and ne maintenance kit f sufficient strength t prtect items), prvided it is cntained in a hard-sided case which des nt exceed 71 linear inches. Bxes and Cmmercial Cntainers Bxes and cmmercial cntainers which hld persnal r cmmercial effects are carried as Excess Baggage (and, as such, carried space available) and are nt t exceed 50 lbs. r 42 linear inches (length + width + height = 42 ). Each bx (up t a maximum f 2 per Custmer) will be accepted in lieu f ne bag. Baggage fees apply if they wuld have been applied t the bag replaced by the bx.. All ther bag plicies apply t the carriage f bxes and cntainers. Embarges Additinal seasnal r rute-specific baggage restrictins, r embarges, may als apply depending upn the aircraft size and/r the cde share partner plicy in place at any pint in time. Cabin Seat Baggage Fr Transprt in the 9-Passenger Cessna 402, Britten Nrman Islander and Cessna Caravan Amphibian: It is nt permissible t transprt cabin baggage in any aircraft by strapping the item t a Passenger seat. Fr Transprt in the 46-Passenger ATR42: If a Custmer requests that an item, due t its fragile r bulky nature, be carried in the cabin cmpartment f the aircraft as cabin seat baggage, Cape Air will determine, in its sle discretin, whether the item is acceptable fr the safe transprt in the cabin and permitted

12 by Cape Air s perating prcedures t be transprted in this manner. Advanced ntificatin is recmmended and additinal charges may apply. Any cabin seat baggage accepted fr transprt will be secured in accrdance with aircraft perating prcedures and security requirements. Musical Instruments Cape Air accepts n bard as persnal, carry-ut baggage, carry-n baggage r checked baggage (depending upn the aircraft type) musical instruments f any size, character r shape s lng as the size and weight limitatins f the aircraft and aircraft cmpartment are nt exceeded. Musical instruments are carried under the same terms and cnditins (including fees, if any) as any ther baggage. 13 Baggage Fees, Exemptins, and Allwance Applicability US DOT Rules fr Applicable Carrier Fees Whether yur travel is exclusively n Cape Air r cnnecting with a partner airline where the itineraries are bked tgether n the same ticket (aka an interline itinerary ), the DOT rules state that the fees f the 1 st carrier appearing n the ticket f the Custmer s itinerary shall apply t the entire itinerary. See the Baggage Fee Chart belw. Charges apply each way and are cumulative. Regardless f which airline fees apply, Cape Air s Allwance plicies apply, and all bags must meet the size, number and weight restrictins nted in this Cntract f Carriage. Cdeshare Itineraries When the 1 st flight f the itinerary is a Cdeshare flight, the fees f the marketing carrier apply, nt the fees f the actual carrier perating the flight. Fr Cape Air cdeshare flights, this means that the fees f ur majr airline partner will apply t the entire itinerary. In this case, the Allwance plicies f the marketing carrier als apply, hwever these allwances are subject t limitatins nted in this Cntract f Carriage. These limitatins are ften due t the size f the aircraft r t differences in regulatins r perating certificates. Cnnecting Travel n Separate Tickets Fr cnnecting travel nt bked n the same ticket, separate fees and allwances fr each carrier apply t each prtin f the itinerary flwn n that carrier. In cases where Cape Air ffers t check a bag thrugh t a destinatin nt shwn n the same ticket as a curtesy, yu will be subject t pay Cape Air s baggage fees when yu check in at the Cape Air ticket cunter, and may als be required t pay an additinal baggage fee when yu check in with yur cnnecting airline. Custmers may chse t pre-pay baggage fees fr their cnnecting airline flights, but will still be subject t applicable fees fr their Cape Air flights. Baggage Fee Summary Chart Assistive devices, such as mbility devices, strllers, prtable xygen cncentratrs (POC), child safety seats and mre are always free. Exemptins frm Baggage Fees n 9K marketed flights The fllwing are exempt frm ALL baggage fees levied by Cape Air. Additinal r different charges may apply when levied by a partner airline thrugh interline, cde share r ther airline partner agreements. Active Reserve, Guard r retired military persnnel hlding a Veteran s ID Card, including registered dependents with Dependent ID Card All bags n flights between Ft. Lenard Wd (TBN) and St. Luis (STL) Cnditins f Checked Baggage and Baggage Prcedures Must Present Valid Ticket fr Transprtatin Befre Cape Air will accept baggage t be checked r carried n bard, the Custmer must present a valid ticket fr transprtatin n Cape Air r n Cape Air and ne r mre ther carriers with which Cape Air has an interline r cde share agreement. Cape Air has the right t refuse t transprt baggage n any flight ther than the ne carrying the Passenger. Must Observe Check-In Times Baggage must be checked in at the airprt in advance f flight departure. If a Custmer des nt present his r her baggage fr check-in within sufficient time t allw fr nrmal handling prcedures fr that airprt, Cape Air may accept the baggage, but in n event will be respnsible fr any lss that arises frm the delay in delivery f the baggage t the destinatin airprt. Identificatin and Items f High Persnal Value

15 All checked baggage must have, at a minimum, name identificatin n the utside. It is recmmended t include cntact infrmatin fr bth rigin and destinatin (e.g. cell phne number) n the utside and inside f the baggage. Cape Air als recmmends that Custmers maintain n their persn certain small but high value r high persnal value items such as travel dcuments, medicines, mney/credit cards, keys, r jewelry. It is imprtant t remember nt t lck checked baggage, as required by Federal regulatins. Carriage n Cape Air Flights and Cnnectins Checked baggage will generally be carried n the same aircraft as the Custmer unless such carriage is deemed impractical by Cape Air. This impracticability includes baggage which exceeds ttal cmpartment r weight parameters fr the aircraft when taking int accunt all Passengers n bard. In this event, Cape Air will determine in its sle discretin which baggage will be carried n bard with the Custmer and arrangements will be made t transprt the surplus baggage n the next flight r sectin n which space is available. Carry-n baggage space is relatively limited n reginal aircraft when cmpared t the generus cmpartment strage space available n tday s larger jets. Custmers cnnecting nt a Cape Air flight with large carry-n bags are encuraged t check these bags, when pssible, at the ticket cunter f the carrier f the riginating lcatin. Custmers wh arrive at a Cape Air gate with large carry-n bags that exceed the parameters fr carry-ut items (fr the Cessna 402, Britten Nrman Islander r Cessna Caravan Amphibian) r carry-n items (fr the ATR42) must check these bags at the gate prir t barding the flight. Furthermre, peratins, security directives r ther safety cnsideratins may limit the allwable carry-ut r carry-n baggage n a specific flight. Cape Air reserves the right in its sle discretin t determine the suitability and place f strage f any items t be carried in the aircraft. Cape Air may refuse t transprt any baggage that the Custmer refuses t submit fr inspectin. Claiming Baggage Only the hlders f the baggage claim check may claim checked baggage. Cape Air is nt respnsible fr determining that the hlder f the claim check is entitled t the baggage. If baggage claim checks are lst, prf f wnership may be required prir t release f the baggage. Acceptance f baggage by the bearer f a claim check withut filing a written cmplaint will cnstitute evidence f delivery by Cape Air f the Custmer s baggage with all riginal cntents in gd cnditin. Limits f Liability fr Baggage Including Fragile r Perishable Gds Except t the extent the Warsaw r Mntreal Cnventins r ther applicable laws may therwise require, the fllwing prvisins apply: Checked and Unchecked Baggage Fr Dmestic Carriage Liability fr lss, delay r damage t checked baggage, r any baggage r persnal item which is taken int custdy by Cape Air, is limited t the fair market value at the time f the lss, damage r delay and will nt exceed (except fr wheelchair and ther assistive devices) (1) fr n-line travel slely n Cape Air with n cnnecting service, $500 per Passenger; (2) fr interline travel where the Cape Air flight segment is included n the same ticket as a cnnecting flight segment f anther airline with an aircraft f mre than 60 seats, $3500 per Passenger as per federal rules; and (3) fr interline travel where the Cape Air flight segment is included n the same ticket as a cnnecting flight segment f anther airline with an aircraft f 60 seats r less, $500 per Passenger. Cape Air assumes n respnsibility r liability fr

16 lss r damage t unchecked, carry-n baggage, r carry-ut baggage, unless the lss r damage ccurred while in the sle custdy f Cape Air r was caused by the sle negligence r willful miscnduct f Cape Air. Fr Internatinal Carriage (including dmestic prtins f internatinal jurneys) cvered by the Mntreal Cnventin Liability fr lss, delay r damage t checked and unchecked baggage is limited t 1,131 Special Drawing Rights per Passenger (see fr current value). Fr Internatinal Carriage (including dmestic prtins f internatinal jurneys) cvered by the Warsaw Cnventin Liability fr lss, delay r damage t baggage is limited t apprximately $9.07 per pund ($20.00 per kil) fr checked baggage and $400 per Passenger fr unchecked baggage in the custdy/cntrl f the carrier. Fragile, valuable, perishable and ther items nt suitable fr transprt Cape Air recmmends that yu d nt pack fragile, high-value r perishable items in yur checked baggage. If yu chse t pack fragile, high-value r perishable items in r as checked baggage in cnnectin with travel within the United States, Cape Air is nt liable fr the lss f, damage t, r delay in delivery f such items. Fr mst internatinal travel, Cape Air s liability fr destructin, lss, delay r damage t checked and unchecked baggage is limited. Cape Air is nt liable fr damage t a Custmer s carry-ut items r in-cabin prperty that cntains fragile, valuable, r perishable items, unless damage ccurred while in the sle custdy f Cape Air. Custmers are respnsible fr all damage caused by their prperty, whether such damage is t their wn prperty r t sme else s prperty. Fragile, valuable, and perishable items include, but are nt limited t, antiques; antlers; artifacts; bks; cellular phnes; cllectibles; cmputer equipment; dcuments; electrnic equipment; fragile articles; gift cards; glassware; heirlms; irreplaceable items; jewelry; keys; mney; silverware; negtiable papers; ptical equipment and eye/visin devices; perishable items; phtgraphic equipment r items; pttery; prescriptin medicatin; samples; securities; sund reprductin equipment; timepieces; tents and sleeping bags made f clth, plastic, vinyl r ther easily trn material and/r thse having aluminum frames; tls; wrks f art; r, ther similar valuable items and cmmercial effects included in checked baggage with r withut the knwledge f Cape Air. If any such items are lst, damaged, pilfered, r delayed, except fr certain internatinal travel subject t the terms f the Mntreal r Warsaw Cnventins, yu will nt be entitled t any reimbursement under Cape Air s standard baggage liability. Limited Release Tags Cape Air has the right t refuse t accept baggage that des nt meet the standards as nted herein. In cases where Cape Air will accept baggage fr transprt under the cnditin that the Custmer agrees t have affixed t the baggage a limited release tag, the Custmer is hereby n ntice that Cape Air is nt liable fr any damage, lss r delay t such baggage. Nrmal Wear and Tear Cape Air is nt liable fr minr damage such as scratches, scuffs, stains, dents, cuts and dirt resulting frm nrmal wear and tear. Fr clarificatin purpses, damage beynd nrmal wear and tear t specific parts f baggage, such as wheels, straps, zippers, handles, and prtruding parts, is nt excluded frm liability. Unclaimed Bags

17 Cape Air is nt liable fr baggage nt claimed by the Custmer immediately upn arrival. Other Carriers r Services Cape Air s liability is limited t ccurrences n its wn flights nly, except in the case f checked baggage in which case the Custmer has the right f actin against either the first r last carrier in the flwn itinerary. A carrier issuing a ticket r checking baggage ver the lines f thers des s nly as agent and is nt liable fr actins n the part f the perating carrier. Claims Restrictins, Including Time Requirements fr Reprting r Filing Claims. Cape Air assumes respnsibility nly fr thse claims arising frm transprtatin f baggage ver its wn rutes. All claims are subject t prf f actual lss by the Custmer. Actual value fr reimbursement f lst r damaged prperty shall be determined by the dcumented riginal purchase price. This may be demnstrated thrugh presentatin f riginal purchase receipts r evidence f actual value. All bag fees paid fr lst bags that are nt subsequently fund will be refunded. All claims will be accepted fr review by the apprpriately trained persnnel regardless f whether any emplyee f Cape Air believes that the claim will r will nt result in reimbursement. Every Custmer has the right t submit a claim. N actin shall be maintained fr any lss, damage, delay r pilferage f checked baggage, unless apprpriate ntice is given in accrdance with this sectin. If ntice is nt given in accrdance with this sectin r legal actin is nt cmmenced within ne year frm the date f the incident, any such claims will be cnsidered waived. Dmestic Carriage Limitatins and Claims Restrictins Lst, delayed r damaged baggage must be reprted t a Cape Air Custmer service agent, r an authrized agent f an interline r cde share carrier at the final destinatin in the case f an interline itinerary where the final destinatin is the interline carrier s destinatin, within fur (4) hurs f the arrival f the flight n which the lss, damage r delay is alleged t have ccurred. The failure t give such preliminary ntice, absent extrardinary circumstances, will result in waiver f the claim. Any claim fr lss, damage r delay must be submitted in writing within thirty (30) days f the relevant flight. Failure t file a written claim within the time perid specified, absent extrardinary circumstances, will result in waiver f the claim. Internatinal Carriage Limitatins and Claims Restrictins Damaged baggage must be reprted t a Cape Air Custmer service agent, r an authrized agent f an interline r cde share carrier at the final destinatin in the case f an interline itinerary where the final destinatin is the interline carrier s destinatin, immediately upn its discvery and any claim fr damage must be submitted in writing n later than seven (7) days frm the date f receipt f the baggage. Any claim fr delay r lss must be submitted in writing n later than twenty-ne (21) days frm the date n which the baggage has r shuld have been placed at the Custmer s dispsal. Failure t bserve these ntice requirements within the time perids specified, absent extrardinary circumstances, will result in waiver f the claim. N right t any claim against Cape Air related t baggage will lie unless an actin is brught within tw (2) years frm the date f arrival at the destinatin, r frm the date n which the aircraft was scheduled t have arrived, r the frm date n which the carriage stpped. Delayed Bag Delivery and Interim Expenses. Cape Air strives t deliver checked baggage t ur Custmers in the baggage claim area in a timely and efficient manner; that is, s that it arrives befre r at the same time as the Custmer. When n ccasin a bag is missing r remains unclaimed, we will make

18 every reasnable effrt t lcate and return the bag within 24 hurs r less using a cmprehensive system and prcess t track missing baggage and t cmmunicate with affected Custmers. Delivery f Delayed Bag In the event that checked baggage (excluding checked baggage that is Excess Baggage pursuant t the terms herein) des nt arrive befre r at the time the Custmer arrives, Cape Air will deliver such checked baggage t Custmers. (Fr clarificatin purpses, please nte that Excess Baggage which is accepted and carried subject t space availability n the aircraft is nt guaranteed a delivery time and, as a result, is nt eligible fr delayed delivery by Cape Air.) Cape Air will strive t deliver baggage cvered by this sectin in a timely and efficient manner, but delivery times may vary with destinatin because f third party vendr availability, traffic and ther reasns. This delivery may be by Cape Air r by an authrized agent cntracted at Cape Air s expense t prvide such bag delivery. In sme cases, it may be mre expeditius fr Custmers t return t the airprt t claim their baggage and, in this case, Custmers may certainly chse t pick-up their bags at their wn transprtatin expense in lieu f delivery. Interim Expenses Custmers are entitled t reasnable interim expenses resulting frm delayed bags. (Fr clarificatin purpses, please nte that baggage accepted and carried subject t space availability n the aircraft is nt guaranteed a delivery time and, as a result, is never a delayed bag fr purpses f this prvisin.) Custmers must present receipts fr all reasnable expense reimbursements incurred. Reasnable expenses generally are $75 per day fr the first few days the bag is delayed. These guidelines fr reasnable expenses are NOT daily limits r a cap and additinal expenses may be incurred; in such a case, the additinal expenses will be handled n an individual basis up t the limits f liability stated within this Cntract f Carriage. If the delayed bag becmes a claim fr which mnetary cmpensatin is apprpriate in accrdance with this Cntract, interim expenses advanced fr the initial delay will be deducted frm the claim s settlement ttal. Interim expenses are nt available as an additinal remedy fr bags which are lst r damaged and fr which such a claim is reprted and prcessed, withut regard t whether the claim results in cmpensatin in accrdance with this Cntract. Restricted Articles. Many items used every day at hme r wrk are regulated as Hazardus Materials (aka hazmat r dangerus gds. ) These prducts may seem harmless; hwever, when transprted by air they can be dangerus. Vibratins, static electricity, and temperature and pressure variatins can cause items t leak, generate txic fumes r even start a fire. Federal law prhibits hazardus materials frm being included in checked, gate-checked, carry-ut r carry-n (ATR nly) baggage. There are a few exceptins fr sme cmmn persnal care items when carried in limited quantities (such as hairspray, perfume and nail plish), medicines, battery-pwered electrnics and assistive devices. Please refer belw fr mre infrmatin n specific restricted items and any requirements and limitatins that apply t the handful f exclusins fr select persnal items. The list f restricted items in this sectin is nt cmprehensive. If yu have a questin abut a particular item that is nt listed, please cntact ur Reservatins Office fr further guidance. Hazardus Materials General Rule Other than exceptins permitted pursuant t 49 CFR (these exceptins further limited in sme cases due t ur aircraft size r type, r because f limitatins within ur FAA-apprved peratins manuals), any articles deemed a hazardus material pursuant t DOT Hazardus Materials Regulatins (49 CFR ) and/r the IATA Dangerus Gds Regulatins and revisins and reissues theref are nt accepted fr transprt n Cape Air. The carriage f hazardus materials abard Cape Air aircraft in yur baggage r n yur persn is a vilatin f Federal Law with penalties f up t five (5) years imprisnment and fines f up t $500,000. Hazardus materials include, but are nt limited t, explsives, cmpressed gases, flammable liquids and slids, xidizers, txic and infectius substances, pisns, crrsives and radiactive materials. Examples f these prhibited items include: Firewrks and flare guns Prpane tanks Spray cans Defense sprays including pepper spray Fuel Oil-based Paint Flammable glues including rubber cement and sme super glues WD-40 Lighter fluid Strike-anywhere matches Camping devices such as lanterns, stves and heating equipment which use liquid fuel, prpane, butane r similar Mtrcycle r car parts, Generatrs, r Gas-pwered tls r tys unless new, unused and in riginal packaging, cntains n battery and has never cntained fuel Mst self-inflating devices Oxygen bttles Insecticides Husehld cleaners such as bleach and drain, ven and bathrm cleaners Traveling with Electrnic Devices Persnal Electrnic Devices ( PEDs ) Mst cnsumer prtable electrnic devices intended fr persnal use are permitted in checked, gate-checked, carry-ut, r carry-n (ATR nly) baggage including cell phnes, electrnic games, tablets, laptps and cameras. Batteries fr these devices typically d nt exceed the limitatins fr carriage (see sectin regarding Batteries belw). Nte there are imprtant exceptins including Electrnic Cigarettes, Hverbards, and mre utlined within this sectin. Althugh PEDs are permitted in Custmer s baggage, use f these devices is restricted, as gverned by the FAA. Fr Transprt in the Cessna 402, Britten Nrman Islander, and Cessna Caravan Amphibian: All PEDs must be turned OFF frm gate t gate, while the aircraft is in transit. This includes, but is nt limited t, cell phnes, electrnic games, tablets, laptps, cameras, and prtable

20 music devices. Additinally, cell phnes must be OFF while barding and deplaning via the airprt ramp leading t r frm the aircraft. Fr Transprt in the 46-Passenger ATR42: Custmers may use PEDs gate-t-gate subject t the fllwing cnditins: 1. The FCC prhibits the transmissin f signals t r frm any ther device while airbrne (i.e. phne, text messaging). Any PED with transmissin capabilities must have the ability t disable thse functins (i.e. airplane mde r OFF ) t be eligible fr use n bard. 2. During taxi, take-ff, landing, and anytime during the flight if instructed by a crewmember, use may be impeded r restricted as the PED must be stwed r secured in the fllwing manner. Use is at all times subject t crewmember instructins: a. Large PEDs (exceeding 2 lbs./0.9 kg, such as a fullsized laptp) must be safety stwed in an apprved carry-n baggage lcatin b. Small PEDs (2 lbs./0.9kg r less) must be stwed in an apprved carry-n baggage lcatin, r prperly secured by: i. Hlding in ne s hand (i.e. PED cannt be left unsecured n an adjacent seat), ii. Multiple pets frm the same family are permitted n the same aircraft; hwever it is pssible that, due t space r weight cnstraints, the Passenger and pets may nt be able t be accmmdated n any particular flight. Multiple pets frm different families are nt permitted n the same aircraft. Shuld a pet be bked in advance but a Passenger with a Service Animal request t be barded, Cape Air may request the Passenger with the pet t fly n a later flight, if pssible, t accmmdate the disabled Passenger r gvernment fficial with the Service Animal. Must be Accmpanied by Passenger All pets must be accmpanied by a traveling Passenger wh is the wner r a designee wh assumes full respnsibility fr the animal. Cmpliance with Applicable Laws The Custmer must make all arrangements and assume full respnsibility and expense fr cmplying with applicable laws, custms and/r ther gvernmental regulatins, requirements, r restrictins f the cuntry, state r territry t and frm which the pet is being transprted. Upn arrival, health certificates, imprt permits, and ther papers may be required by lcal authrities (particularly and frequently required fr travel beynd the dmestic United States), depending upn the rute ver which the pet is traveling. Service Animals Service animals accmpanying disabled Custmers r gvernment fficials and animals used fr emtinal supprt are accmmdated n all flights at n additinal charge t the Custmer, subject t the plicy herein. Cape Air has the right t refuse, n a permanent basis, any Custmer wh, by reasn f engaging in the abve, causes Cape Air any lss, damage r expense f any kind, r has been disrderly, ffensive, abusive r vilent. Disabled Individuals and Passengers Requiring Assistance It is the plicy f Cape Air t prvide equal pprtunity fr all wuld-be travelers. 31 Barding land-side requires the Custmer t ascend apprximately 12 steps and there are handrails n bth sides f the steps fr self-supprt. Barding via water-side requires the Custmer t step frm a dck nt the airplane pntn, akin t stepping int a bat n the water. Once the Custmer has stepped nt the pntn, the Custmer must then climb a few stairs with the supprt f nly a helping hand as there is n railing fr these stairs. While unlikely, there is the pssibility in sme situatin that the Custmer may be required t crss a sft surface such as sand t reach the aircraft. It is imprtant t nte that amphibius aircraft perate in a seashre and marine envirnment where facilities are ften unavidably slippery r wet. Passengers are urged t use extreme cautin n all dcks, ramps, flats, and when entering and exiting aircraft. Please d nt hesitate t take extra time r seek assistance in mving abut facilities r n and ff ur aircraft, as yur safety and that f ur emplyees is ur highest pririty. Except fr transprt in the 46-Passenger ATR42 aircraft (as nted abve), physical limitatins preclude the use f jet bridges, lifts, barding chairs r ther feasible devices t enplane a Custmer needing assistance. When this happens, Cape Air emplyees will prvide reasnable assistance. This assistance may include, depending upn the limitatins f the aircraft and ramp/dck, steadying a Custmer r prviding a helping hand as the Custmer ascends r descends the step(s), assistance in getting t r frm the seat, and assistance with lading and retrieving carry-ut r carry-n items and ther assistive devices stwed n bard. Emplyees are nt permitted, hwever, t lift r carry Custmers n bard the aircraft, assist with medical services, r assist inside the lavatry (available n bard the ATR42 nly). As the safest seating arrangement fr such Custmer may vary with the situatin and with the aircraft type, Cape Air may ffer t pre-bard the Custmer r may suggest barding the Custmer last fr access t the mst accessible seat. Carriage f a Qualified Individual with a Disability and Nn-Ambulatry Passengers Cape Air will nt require any individual cvered by this sectin t be accmpanied by an attendant unless it is determined that an attendant is essential fr safety. If Cape Air determines that an assistant is essential fr safety, Cape Air may require a Custmer meeting any f the fllwing criteria travel with an attendant as a cnditin f being prvided air transprtatin: A persn wh, because f a mental disability, is unable t cmprehend r respnd apprpriately t safety instructins frm Cape Air persnnel, including the safety briefing required by 14 CFR (a)(3), (a)(4) and (b). Passengers using POCs must be seated in a windw seat unless seated in a rw where there are n ther Passengers seated between the xygen user and the windw. Exit rw/bulkhead seating is nt permitted as the POC may nt be able t be stred prperly. Stwage f Device: During mvement n the surface, takeff and landing, the device must be stwed under the seat in frnt f the user, r in anther apprved stwage lcatin s that it des nt blck the aisle way r the entryway t the rw. Fr transprt in the 46-Passsenger ATR42, Oxygen Cylinders prvided by Cape Air r its vendrs r cdeshare partners may als be utilized. This service is limited and subject t availability. Fr xygen cylinders prvided by a cdeshare partner, please refer t that airline s cntract f carriage fr specific requirements. A service charge may be assessed fr this service. Custmers persnal xygen cylinders cannt be transprted r used nbard any flight as per FAA restrictins. Oxygen cylinders prvided by Cape Air is subject t the fllwing cnditins: Cmpliance with regulatins f all cuntries within the flight itinerary where xygen is t be used; A medical certificate frm the Passenger s physician is prvided t Cape Air certifying the need fr in-flight xygen, stating whether any special cnditins r assistance are required, and prviding the maximum usage per hur and the xygen flw rate per minute at 10,000 feet altitude; Oxygen equipment is available and can be psitined at the barding city f the Passenger requiring it; Passenger must prvide Cape Air at least 48 hurs ntice t request xygen services and will als be required t check-in fr the flight at least tw hurs n Internatinal flights and ne hur n Dmestic US flights befre the planned departure. T the extent pssible, Passengers receiving r requesting in-flight medical xygen service will be given barding pririty n Cape Air in the event f an irregular peratin. Medical Transprt Cape Air des nt prvide air ambulance r in-flight patient care services, and is unable t accmmdate stretchers n bard scheduled flights. In sme Cape Air destinatins (excluding destinatins served by the Cessna Caravan Amphibian), Cape Air may be able t accmmdate stretchers n specified aircraft fr rutine medical transprt, prvided that patient care equipment is nt required fr basic r advanced life supprt during such transprt. Cape Air makes all reasnable accmmdatin fr trained Service Animals and Service Animals used fr emtinal supprt t accmpany Passengers in the aircraft cabin free f charge subject t the cnditins in this sectin. These cnditins are based n limitatins due t the size and nature f the aircraft and the safety and cmfrt f all n bard. Fr travel in the Cessna 402, Britten Nrman Islander and Cessna Caravan Amphibian nly Advance Reservatins Advance reservatins are recmmended because, fr imprtant safety reasns, Cape Air is nly permitted t transprt ne live animal per aircraft unless the animals are frm the same family. Only ne live animal per aircraft may be bked cnfirmed space. Live animals are apprved and carried n a first-cme, first-served basis. A Cape Air agent will determine the apprpriate seating arrangement and will assist with securing the animal n bard. Cape Air will accept as evidence that the animal is a Service Animal such items as identificatin cards, ther written dcumentatin, the type f harness r markings n the harness, tags, r ther credible assurances f the Qualified Individual with a Disability. Service Animals must be prperly harnessed and remain under the direct cntrl f the Passenger. Service animals may nt ccupy a seat. Infants Under tw (2) years f age, infants are accepted at n additinal charge if seated n the lap f an adult Passenger. An FAA r aircraft-apprved infant r child-safety car seat may als be used n bard when a seat is purchased fr the child. Prf f age f the infant Passenger may be required. Fr sme destinatins, including certain internatinal jurisdictins, gvernment taxes may apply fr infant Passengers and must be cllected by Cape Air fr this purpse. Travel by air fr infants less than 7 days f age is nt recmmended and we suggest Custmers cnsult their physicians fr further guidance. Traveling while Pregnant Travel during the ninth mnth f pregnancy is nt recmmended and we suggest Custmers cnsult their physicians fr further guidance. We prefer any wman traveling while pregnant present a certificate frm a dctr stating that the Custmer has been examined and has been fund t be physically fit fr air travel during the specified time, and that the estimated date f delivery is after the date f the flight. Fr travel n bard ur ATR42 aircraft, please refer the cntract f carriage fr ur partner, United Airlines, fr their plicy regarding Passengers Occupying Tw Seats. Fr Transprt in the Cessna 402, Britten Nrman Islander and Cessna Caravan Amphibian: The design f the seat belt system fr these aircraft des nt permit Custmers t sit n r between tw seats and/r use seat belts adjacent t different seats t secure themselves during flight. Fr this reasn, each Custmer must be able t sit in ne seat and use the seat belt intended fr the seat in which he r she is seated. Seat belt extenders, generally extending the length f a seat belt 24 inches, are available n the Cessna 402 fr Custmers wh may need t lengthen the size f the belt. Seat belt extenders are nt generally permitted fr use with the shulder harness belt system installed in the Britten Nrman Islander and the Cessna Caravan Amphibian. The width

40 f each seat and seat belt capacity may be used as a guide when determining whether smene may be safely accmmdated n bard ur aircraft. Fr the Cessna 402, the seat width is 17 inches, seat belts are typically 40 inches in length acrss the lap and the aircraft dr width fr entry is 22 inches. Fr the Britten Nrman Islander, the seating is bench style, the available space fr each Passenger being ½ f the bench seat which is apprximately 18 inches. Seat belts are typically 40 inches in length acrss the lap and the aircraft dr width fr entry is 36 inches wide fr all drs except ne which is 24 inches. Fr the Cessna Caravan Amphibian, the seat width is 18 inches, seat belts are typically 38 inches in length acrss the lap and the aircraft dr width fr entry is 42 inches wide x 50 inches tall. Traveling with Prisners When a law enfrcement agency needs t transprt a prisner with an armed Law Enfrcement Officer (LEO), Cape Air must be ntified 24 hurs prir t the scheduled departure time, r, if nt 24 hurs, as far in advance as pssible. This ntificatin must include (1) the identity f the prisner and (2) whether the prisner is cnsidered highrisk r lw-risk. Fr additinal cnditins f acceptance and requirements fr transprt, please cntact Cape Air. When cnnecting t r frm any flight, including interline and cdeshare partners, the Custmer is respnsible fr ntifying and making independent arrangements directly with the ther airline. Cancellatin f Reservatins Airprt Shw Times and Re-check Requirements. All Custmers must check-in within the guidelines prvided in the belw chart. Check-in may ccur with a Cape Air agent at the Cape Air departure ticket cunter, nline at (cming sn), r with a partner airline with whm we ffer the ability t check-thrugh t yur final destinatin. Custmers wh receive barding passes thrugh r a partner airline must re-check with a Cape Air agent within the time limits in the belw chart. This allws us the time we need t gather infrmatin required t perfrm ur weight and balance, as well as the time needed by airprts t screen all baggage and Passengers prir t barding. If yu are checking bags, failure t bserve these minimum times may result in insufficient screening time by the airprts and yur bag may nt be delivered t us in time fr yur flight.
