1 Skidmre Cllege Guidelines n UAS - Unmanned Aircraft Systems (drnes) Fr the purpses f these guidelines, we will refer t drnes by the current Federal Aviatin Administratin title f UAS (Unmanned Aircraft Systems). What fllws are the current Skidmre Cllege guidelines cncerning the use f all UAS n cllege-wned prperty. What types f devices fall under the categry f an Unmanned Aircraft System (UAS)? Any cntrivance invented, used, r designed t navigate r fly in the air is cnsidered t be an Unmanned Aircraft System (UAS). The list f items includes, but is nt limited t: drnes; single, dual, and multi-rtr devices; mdel aircraft; rckets; prjectiles; and even ballns and kites. Can I legally use a UAS n any cllege-wned prperty? Yes, but Skidmre has adpted a number f guidelines n the use f UAS at the cllege. On May 4, 2016, the FAA has issued an interpretatin n the permissible use f UAS at educatinal institutins. Hwever, the cllege has implemented much stricter guidelines n the use f UAS at Skidmre Cllege that expand the restrictins put in place by the FAA. If I meet all the current FAA criteria fr flying a UAS, is it permissible t fly my UAS n cllege-wned prperty? N, with ne exceptin. Assuming smene meets all the current FAA criteria fr being able t fly Unmanned Aircraft Systems (UAS), the use f these devices is prhibited n mst cllege-wned prperty. The single exceptin t this guideline is the Skidmre Cllege baseball field n Dentn Rad. Hbbyists may use Unmanned Aircraft Systems (UAS), n the Skidmre Cllege baseball field, nly if they have prir written permissin (via ) frm bth the Skidmre head baseball cach and the Skidmre Directr f Athletics. UAS must be flwn at all times within the fenced-in cnfines f the baseball field. If I get permissin, are there any ther restrictins n flying Unmanned Aircraft Systems at Dentn baseball field? Yes. Anyne wh receives advance written permissin (via ) t fly an Unmanned Aircraft Systems (UAS) at Dentn Field must als abide by the fllwing restrictins: Registratin f the UAS is nw required by law. Yu must register yur UAS with the FAA befre yu perate it utdrs. T perate the cntrls f a small UAS under Part 107, yu need a remte pilt certificate with a small UAS rating, r be under the direct supervisin f a persn wh hlds such a certificate. Yu must be at least 16 years ld t qualify fr a remte pilt certificate, and yu can btain it in ne f tw ways:

2 Yu may pass an initial aernautical knwledge test at an FAA-apprved knwledge testing center. If yu already have a Part 61 pilt certificate, yu must have cmpleted a flight review in the previus 24 mnths and yu must take a small UAS nline training curse prvided by the FAA. Yu are respnsible fr ensuring a drne is safe befre flying. Fr example, yu will have t perfrm a preflight inspectin that includes checking the cmmunicatins link between the cntrl statin and the UAS. Line f sight the persn authrized t fly the Unmanned Aircraft Systems (UAS) must, at all times, maintain line-f-sight at all times. Line-f-sight is defined as: 1. The aircraft must be visible at all times t the peratr. 2. The peratr must use his r her wn natural visin (which includes visin crrected by standard eyeglasses r cntact lenses) t bserve the aircraft. 3. Peple ther than the peratr may nt be used in lieu f the peratr fr maintaining visual line f sight. Under the criteria abve, visual line f sight wuld mean that the peratr has an unbstructed view f the mdel aircraft. T ensure that the peratr has the best view f the aircraft, the statutry requirement wuld preclude the use f visin-enhancing devices, such as binculars, night visin gggles, pwered visin magnifying devices, and gggles designed t prvide a first-persn view frm the mdel. Such devices wuld limit the peratr s field f view thereby reducing his r her ability t see-and-avid ther aircraft in the area. Ntificatin f Campus Safety is required. Please call Campus Safety at t let them knw the date and times yu will be flying the UAS at Dentn Field. Other restrictins in additin t line f sight, the hbbyist must adhere t the several guidelines while flying Unmanned Aircraft Systems (UAS) n cllegewned prperty. The UAS: Must be flwn strictly fr hbby r recreatinal use, r within the limitatins f sectin 336 prvisins n use f UAS fr educatinal institutins. Must display the name and cntact infrmatin f the peratr. Shall nt be flwn within 200 feet f any ppulated areas. Shall nt be flwn ver 400 feet abve grund level (AGL). Shall nt create an undue hazard t unaffiliated persns r prperty. Shall nt enter any ther prperty, belw 400 feet (AGL), withut written permissin frm the landwner.

3 Shall nt fly in public until yu are prven airwrthy and capable f cntrlling the flight f the UAS. Shall nt weigh mre than 5 punds, fully laded. Shall nt carry any hazardus substance r any weapn. Shuld always be perated in accrdance with a cmmunity-based set f safety guidelines and within the prgramming f a natinwide cmmunity-based rganizatin. Respecting the privacy f all persn s nt directly invlved in flying the UAS. D nt intentinally view r recrd anyne withut their prir permissin. As with ther activities n campus, any injury r prperty damage caused by the UAS shuld be prmptly reprted t Campus Safety. Additinally, the FAA als impses the fllwing restrictins n hbbyists, which may apply t areas designated by the cllege as permissible: When flwn within 5 miles f an airprt, the peratr f the UAS prvides the airprt peratr and the airprt air traffic cntrl twer with prir ntice f the peratin. Nte: The Skidmre Cllege baseball field n Dentn Rad is 5.6 miles frm the nearest airprt, s this restrictin des nt apply). Avid flying near any full-scale aircraft. Ask fr assistance frm flight cntrllers if needed. The aircraft is perated in a manner that des nt interfere with, and gives way t, any manned aircraft. Any persn perating a UAS and nt fllwing these guidelines shuld be immediately reprted t Skidmre Cllege Campus Safety ( ). Skidmre Cllege reserves the right t deny any persn r grup frm flying Unmanned Aircraft Systems (UAS) n Skidmre-wned prperty at any time. 4 Additinal relevant infrmatin Summary f recent FAA interpretatins: On May 4, 2016, the FAA mdified Rule 336 t clarify its interpretatin f the rule as it relates t the educatin use f UAS s. The FAA s new interpretatin is as fllws: A persn may perate an unmanned aircraft fr hbby r recreatin in accrdance with sectin 336 f the FAA Mdernizatin and Refrm Act f 2012 (FMRA) at educatinal institutins and cmmunity-spnsred events prvided that persn is (1) nt cmpensated, r (2) any cmpensatin received is neither directly nr incidentally related t that persn s peratin f the aircraft at such events; A student may cnduct mdel aircraft peratins in accrdance with sectin 336 f the FMRA in furtherance f his r her aviatin-related educatin at an accredited educatinal institutin (usually nt applicable at Skidmre). Faculty teaching aviatin-related curses at accredited educatinal institutins may assist students wh are perating a mdel aircraft under sectin 336 and in cnnectin with a curse that requires such peratins, prvided the student maintains peratinal cntrl f the mdel aircraft such that the faculty member s manipulatin f the mdel aircraft s cntrls is incidental and secndary t the student s (e.g. the faculty member steps-in t regain cntrl in the event the student begins t lse cntrl, t terminate the flight, etc.). In additin, Rule 336 has been mdified as fllws: Hbbyist Use f UAS t Cnduct Demnstratins: The FAA nw includes peratin f UAS t cnduct demnstratins at accredited educatinal institutins r at ther cmmunity-spnsred events prvided the aircraft is nt being perated fr cmpensatin, in furtherance f a business r incidental t a business. Therefre, a mdel aircraft hbbyist r enthusiast lawfully may fly UAS at accredited educatinal institutins r ther cmmunity-spnsred events t prmte the safe use f UAS and encurage student interest in aviatin as a hbby r fr recreatinal purpses prvided the hbbyist receives n cmpensatin f any frm (including hnrarium r reimbursement f csts), r an such cmpensatin neither directly nr indirectly furthers the hbbyist s business r peratin f the UAS and he r she fllws the prvisins f sectin 336. Student Operatin f Mdel Aircraft (UAS) fr Educatinal Purpses: The FAA fund that the use f small unmanned aircraft by students at accredited educatinal institutins as a cmpnent f science, technlgy and aviatinrelated educatinal curricula r ther cursewrk such as televisin and film prductin r the arts mre clsely reflects and embdies the purpses f "hbby r recreatinal" use f mdel aircraft and is cnsistent with the intent f sectin 336 f the FMRA. Accrdingly, the FAA cncludes that student use f UAS at accredited educatinal institutins as a cmpnent f their science, technlgy and aviatin related educatinal curricula, r ther cursewrk

5 such as televisin and film prductin r the arts, is "hbby r recreatinal use" within the meaning f the FMRA. The student is, hwever, respnsible fr meeting and cmplying with all ther elements required fr lawful mdel aircraft peratins pursuant t Sectin 336 f the FMRA, including the student nt receiving any frm f cmpensatin (including reimbursement f csts, hnrarium, etc.) directly r incidentally t his r her peratin f the mdel aircraft. Faculty Use f Mdel Aircraft (UAS): The FAA recgnizes that faculty participatin in the student's learning experience ften is an integral cmpnent f the student's educatinal experience and that faculty shuld be able t participate in and cntribute t the unmanned aircraft activities in which students can engage as hbbyists. Hwever, a faculty member engaging in the peratin f an unmanned aircraft, as part f prfessinal duties fr which he r she is paid, wuld nt be engaging in a hbby r recreatinal activity. Rather, the faculty member is being cmpensated fr his r her teaching r research activity, including any UAS peratin arising frm r related t the faculty member's teaching a curse r cnducting research. Likewise, a student perating UAS fr research n behalf f a faculty member is assciated with the faculty member's prfessinal duties and cmpensatin and, thus, is nt hbby r recreatinal use by the student pursuant t sectin 336. Student peratin f UAS fr the prfessinal research bjectives f faculty renders the peratin nn-hbby r nn-recreatinal. Accrdingly, a faculty member cnducting research may nt rely n sectin 336's cncept f "hbby r recreatinal use" t either perate a UAS r direct student UAS peratins in cnnectin with such research. Nevertheless, faculty teaching a curse r curricula that uses unmanned aircraft as a cmpnent f that curse may prvide limited assistance t students perating unmanned aircraft as part f that curse withut changing the character f the student's peratin as a hbby r recreatinal activity r requiring FAA authrizatin fr the faculty member t perate. The FAA finds that de minimis limited instructr participatin in student peratin f UAS as part f cursewrk des nt rise t the level f faculty cnducting an peratin utside f the hbby r recreatin cnstruct. This limited circumstance wuld apply t curses at accredited institutins where the peratin f the unmanned aircraft is secndary t the design and cnstructin f the aircraft, such that the primary purpse f the curse is nt perating an unmanned aircraft. Fr example, an instructr teaching an engineering curse in which cnstructin and peratin f UAS are ne part f the curriculum wuld be able t cnduct limited UAS peratins. In that case students wuld fly UAS t test the validity f design r cnstructin methds t shw mastery f the principles f the curse. The faculty member's UAS

6 peratin wuld be secndary t the purpse f instructing engineering curses. In cntrast, this limited circumstance wuld nt apply t a curse related t UAS flight instructin. In that case, the student's primary purpse fr taking the curse is t learn t fly a UAS and flight wuld be expected t be demnstrated n a regular basis. In that case, the faculty member's UAS peratin is clsely tied t his r her purpse f instructing hw t fly a UAS. Under the existing laws, the FAA definitin f hbby is strictly defined as a pursuit utside ne s regular ccupatin engaged in especially fr relaxatin. Recreatin, is als defined by the FAA as refreshment f strength and spirits after wrk; a means f refreshment r diversin. While it is legal fr hbbyists t fly UAS fr hbby r recreatinal purpses nly, Skidmre Cllege has set strict limits n where and when apprved hbbyists may fly UAS n cllege-wned prperty (see belw). *Nte: Drnes are als cmmnly referred t as: UAV (Unmanned Aerial Vehicle); RCA (Radi Cntrlled Aircraft); ROA (Remtely Operated Aircraft); and SAO (Small Airbrne Objects).
