1 RV SITE RENTAL AGREEMENT AND WAIVER OF LIABILITY Please call r inf@sgadventures.cm fr any questins cncerning this reservatin. All reservatins are cnsidered cnfirmed at the time f bking. Please nte that the terms f this Rental Agreement are nn-negtiable. A cpy f the RENTER s driver s license will be made and kept n file with this rental agreement. 1. CHECK-IN/CHECK-OUT TIMES. Guest may check-in at any time after 4:00 p.m. n Guest's Arrival Date, and the Guest shall check-ut n later than 11:00 a.m. n the Guest's Departure Date. A minimum fee f $10.00 per half-hur will be charged t the renter s card fr checkut after 11:00 AM unless previus arrangements have been made thrugh the ffice. 2. RESCHEDULING THE RESERVATION. Guest may reschedule the Reservatin at any time up until seventy-tw (72) hurs prir t Guest's arrival (based n a check-in time f 4:00 p.m.), and Guest shall be charged a rescheduling fee f ten dllars ($10.00). In the event Guest reschedules the Reservatin, Guest shall have up t twelve (12) mnths frm the riginal arrival date t reschedule his/her stay. Guest hereby acknwledges that the rescheduled reservatin shall be fr the Rental Prperty and fr the same number f nights. Guest hereby acknwledges and understands that it is the respnsibility f Guest t be infrmed f weather cnditins; and Guest further acknwledges that rescheduling due t inclement weather is at the sle discretin f SOUTHERN GAP OUTDOOR ADVENTURE. 3. CANCELLATIONS. If the Reservatin is cancelled by Guest at any time prir t furteen (14) days f Guest's arrival, Guest shall be charged a $20.00 cancellatin fee. If the Reservatin is cancelled by Guest between furteen (14) days and seventy-tw (72) hurs f Guest's arrival (based n a check-in time f 4:00 p.m.), Guest shall be charged an amunt equal t ne (1) night's rental. If the Reservatin is cancelled within seventy-tw (72) hurs f Guest's arrival r Guest is a "n shw", Guest shall be charged the entire rental amunt f the Reservatin. If the amunt paid by Guest is less than the amunt t be charged t Guest as set frth herein, Guest shall be assessed the balance. 4. REFUNDS. Guest hereby agrees and acknwledges that Guest shall nt be entitled t a refund in the event Guest departs befre the end f the Reservatin r in the event Guest arrives late r des nt arrive fr the Reservatin. Guest further hereby agrees and acknwledges that there will be n refund nr relcatin in the event Guest is disappinted with the Rental Prperty. Furthermre, there shall be n refund r cmpensatin fr the ccurrence f any and all events ut f the cntrl f SOUTHERN GAP OUTDOOR ADVENTURE, including but nt limited t, weather cnditins, pwer utages, and water utages. Furthermre, Guest shall nt be entitled t a refund in the event Guest is required t vacate the Rental Prperty due t a vilatin f lcal, state r federal law r the plicies f SOUTHERN GAP OUTDOOR ADVENTURE. 2 5. DAMAGES. Guest shall be slely respnsible fr any prperty damage, accident r injury t any persn r lss sustained by any persn, including lss f mney, jewelry and ther items f persnal prperty, arising ut f r in any way related t Guest's use f the Rental Prperty r the items f persnal prperty prvided by SOUTHERN GAP OUTDOOR ADVENTURE and/r the wner f the Rental Prperty. Guest shall inspect and be familiar with prper use and applicatin f such items prir t using them. Guest hereby agrees t indemnify and hld SOUTHERN GAP OUTDOOR ADVENTURE and/r the wner f the Rental Prperty harmless frm any and all claims including thse f third parties, arising ut f r in any way related t Guest's use f the Rental Prperty r the items f persnal prperty prvided therein. 6. AGENCY DISCLOSURE. SOUTHERN GAP OUTDOOR ADVENTURE serves as the agent f the wner f the Rental Prperty. SOUTHERN GAP OUTDOOR ADVENTURE shall represent and act at all times in the best interests f the wner f the Rental Prperty. Furthermre, SOUTHERN GAP OUTDOOR ADVENTURE reserves the right fr randm inspectins t insure that all plicies and prcedures are fllwed. All infrmatin prvided by SOUTHERN GAP OUTDOOR ADVENTURE regarding the Rental Prperty has been prvided by the wner f the Rental Prperty and is believed t be accurate, but cannt be guaranteed. Guest acknwledges that the wner f the Rental Prperty may remve the Rental Prperty frm the rental prgram with SOUTHERN GAP OUTDOOR ADVENTURE. Guest further understands that availability f the Rental Prperty cannt be guaranteed, and SOUTHERN GAP OUTDOOR ADVENTURE may find it necessary t mve Guest t a cmparable rental prperty. 7. VISITORS. A Visitr f the Guest(s) may ccupy the prperty n a temprary basis nly. Visitrs may nt ccupy the prperty beynd 10:00 pm r stay vernight withut being registered with SOUTHERN GAP OUTDOOR ADVENTURE. Each rental prperty has a maximum ccupancy and at NO time shuld said prperty be ccupied by mre than allwed number f guest stated. N huse parties, weddings r ther events are allwed. Shuld evidence f misuse r vilatin be discvered at any time, the Guest(s) f recrd will be charged accrdingly r immediately evicted withut refund. 8. USE OF RENTAL PROPERTY. Guest shall ccupy and use the Rental Prperty in a manner that shall nt disturb r ffend neighbrs f the Rental Prperty. The use f firewrks is strictly prhibited, and any vilatrs f this prvisin shall be asked t vacate the Rental Prperty immediately. Refer t Exhibit A fr a list f campgrund rules. 9. TELEVISION RECEIVERS. Yu will be prvided with a satellite televisin receiver upn check-in. SOUTHERN GAP OUTDOOR ADVENTURE cannt guarantee what prgrams r events will be available nr the receptin f lcal netwrks. Rental prperties with a satellite r cable prvider generally have a basic package, which des nt include the ptin f rdering pay- per-view mvies and/r events. In the event Guest rders a pay-per-view mvie and/r event, Guest shall be assessed fr the cst f the mvie(s) and/r event(s), tgether with a service charge f $ Satellite signal and receptin and cable receptin is nt always reliable, especially during extreme weather, and cannt be guaranteed. If assistance is needed t hk-up r reprgram a satellite receiver, a SOUTHERN GAP OUTDOOR ADVENTURE emplyee can assist yu. Hwever, SOUTHERN GAP OUTDOOR ADVENTURE will nt be respnsible fr any damages that culd result frm this curtesy. Failure t turn-in receiver bx and/r Page 2 f 6

3 receiver equipment will result in a charge t the Guest s card fr full replacement value f the lst/stlen item. 10. INTERNET Internet service is prvided at all rental prperties; hwever, the speed f the service is nt guaranteed. The passwrd fr said service will be given t yu at time f check-in r by calling the ffice. Please nte that all internet services are nt secured. Shuld guest be fund illegally using, dwnlading, cpying, and/r distributing cpyrighted material ver the netwrk then guest shall be subject t any and all actins impsed by service prvider fr cpyright infringement cst. 11. LOST AND FOUND. SOUTHERN GAP OUTDOOR ADVENTURE shall nt be respnsible fr any persnal belngings that are lst, stlen, r left behind by Guest r any member f Guest's party. Any persnal items fund in r arund the Rental Prperty shall be held fr thirty (30) days. After the thirty (30) days, any unclaimed items will be discarded r dnated unless the wner f the item cntacts SOUTHERN GAP OUTDOOR ADVENTURE and claims the item. The item will be returned t said individual at his/her expense. SOUTHERN GAP OUTDOOR ADVENTURE will nt be respnsible fr any lst items r damage t the items during shipping. 12. REPAIRS. Guest hereby agrees that SOUTHERN GAP OUTDOOR ADVENTURE r its agents may make necessary repairs and/r maintenance arund the Rental Prperty. Furthermre, SOUTHERN GAP OUTDOOR ADVENTURE des nt guarantee against mechanical failures that may ccur with electrical, sewer, r water hk-ups. In the event a system is inperative, Guest shall cntact SOUTHERN GAP OUTDOOR ADVENTURE immediately. SOUTHERN GAP OUTDOOR ADVENTURE shall make every effrt t have the repairs dne quickly and efficiently, r SOUTHERN GAP OUTDOOR ADVENTURE shall mve Guest t a different rental prperty, if pssible. Guest(s) wh have an after-hurs emergency can call All nn-emergency issues shuld be reprted t SOUTHERN GAP OURDOOR ADVENTURE ffice at during regular business hurs. Fr any medical related emergency, call AGE REQUIREMENT. Guest is at least eighteen (18) years f age and acknwledges that he/she may be asked t prvide prf f age at the time the Reservatin is made. Guest is respnsible fr all ther guests and visitrs f the Rental Prperty during the Reservatin. If Guest is nt eighteen (18) years r lder, SOUTHERN GAP OUTDOOR ADVENTURE reserves the right t terminate the Reservatin withut a refund. 14. GARBAGE REMOVAL. All garbage must be bagged and remved frm inside f the Rental Prperty. Bagged garbage may be placed near the pedestal at yur RV spt between the hurs f 10:00 AM and 11:00 AM each day. An emplyee f SOUTHERN GAP OUTDOOR ADVENTURE will cme arund and cllect the bagged garbage. If garbage is generated after the 11:00 AM pick-up time, Guest shall be respnsible fr dispsing f the excess garbage. Guest may use the dumpster lcated at SOUTHERN GAP OUTDOOR ADVENTURE rental ffice t dispse f excess garbage withut any charge. Guest acknwledges that leaving garbage utside the designated cntainer(s) may attract unwanted animals. 15. SMOKING/NON-SMOKING Page 3 f 6

4 All prperties are nn-smking. Smking utside is allwed unless therwise stated. Please be neat in dispsing f cigarette butts, d nt discard them arund the prperty, driveway r yard. 16. ACKNOWLEDGEMENT OF RISKS. The undersigned Guest further understands and acknwledges that there are certain risks f physical injury, prperty damage, and inherent ptential dangers f the activities cnducted within (r upn) the Suthern Gap Outdr Adventure. The undersigned Guest further understands and acknwledges the risks and dangers assciated with his/her use f the Suthern Gap Outdr Adventure premises, facilities, and equipment, and that such use has inherent dangers f persnal injury and prperty damage. The undersigned Guest further accepts sle respnsibility fr risks and dangers which include, withut limitatin, the ptential fr serius bdily injury, permanent disability, paralysis and lss f life, disfigurement, lss f r damage t equipment/prperty, expsure t extreme cnditins, harmful physical cnflicts with ther guests, animal attack, snake bites, insect bites/stings, allergic reactins, lightning strikes, dangers arising frm adverse weather cnditins, falling, fires and burns, dangerus rad r trail cnditins, water hazards, land hazards, equipment failure, defective equipment, inadequate safety measures, criminal activity f ther guests, pr lighting, and ther undefined nt readily freseeable and presently unknwn risks and dangers ( Risks ). Guest expressly assumes the Risks f any and all damage and injury f any kind r type which may result frm any surce whatsever during his/her time n the premises f Suthern Gap Outdr Adventure. 17. PAYMENT BY CREDIT CARD. Guest hereby authrizes SOUTHERN GAP OUTDOOR ADVENTURE t charge my credit card the ttal amunt due at the time f reservatin. CREDIT CARD AUTHORIZATION: I UNDERSTAND AND CONSENT TO THE USE OF THE CREDIT CARD PROVIDED WITHOUT ORIGINAL SIGNATURE ON THE CHARGE SLIP, THAT A PHOTOCOPY OF THIS RENTAL AGREEMENT WILL SERVE AS ORIGINAL. AND THAT THIS CREDIT CARD AUTHORIZATION CANNOT BE REVOKED AND WILL NOT TERMINATE UNTIL 90 DAYS AFTER LEASED PREMISES ARE VACATED. By reading and accepting this Rental Agreement, Guest acknwledges that he/she has read, fully understands, and agrees t all f the abve. Page 4 f 6

5 EXHIBIT A Campgrund Rules In rder t make yur stay and the stay f ur ther guests a great experience, please bserve the fllwing friendly camping practices: All campers and visitrs must register at the ffice befre entering. Check ut time is 11 a.m. Please check ut at the campgrund ffice when leaving. All day visitrs must leave the campgrund by 10 p.m. N refund fr early departure. Speed limit thrughut the campgrund is 5 mph. Please watch fr pedestrians, bicyclists, ATVs and mtrcycles. Quiet hurs are frm 11 p.m. t 7 a.m. Nise shuld be kept t a minimum during this time. Please respect yur neighbrs. The Bathhuse has fur family friendly shwers. Children must be accmpanied by an adult while in the Bathhuse this includes laundry and vending areas. Cabins are nn smking. Charges will be added t yur credit card upn check ut fr the cleaning f linens, curtains and furniture up t $250 if yu vilate this plicy. N muddy bts inside the cabins. N muddy clthing n the furniture and beds. We are a pet friendly place, but pets must be n a shrt leash and must be cleaned up after at all times. N mre than tw pets allwed per site. Please d nt leave yur pet unattended. Pets are nt allwed in the Bathhuse. An additinal cleaning fee f $50 will apply if yur pet is hused in the cabins. Alchlic beverages are nt permitted in cmmn areas. Please d nt park n the grass r n vacant campsites r in vacant RV sites. Use radways t travel t and frm yur campsite. Tw vehicles are allwed per site. If space is needed fr extra vehicles, verflw parking is available. N cltheslines may be strung utside. Washing vehicles/rvs/atvs/utvs/mtrcycles/bikes r mechanical repairs t them, including changing the il, is prhibited n site. It is against state law t dump grey water r sewage n the grund. It is t be dispsed f at the dump statin n site as shwn n the campgrund map. An airtight hse cnnectin is required fr sewer hk up f RVs. Generatrs f any kind are prhibited. Campfires are permitted, but nly in established fire rings. It is nt permitted t mve fire rings. Never leave a fire unattended. Children under the age f 18 cannt have a fire unless an adult is present. D nt burn trash, plastic, r anything ther than wd in fire rings. The wner r management f Suthern Gap Outdr Adventure is nt respnsible fr lss, damage r claims fr damage t prperty f campers due t fire, theft, accidents r ther causes. Disregard fr any f the abve rules will be sufficient reasn t terminate a guest s stay withut refund. Management reserves the right t change these rules as circumstances require. 6 Fllw these basic guidelines t ensure the safety f yu and animals with respect t wildlife: D NOT feed wildlife under any circumstances. Feeding wildlife creates an expectatin that they can receive fd frm yu (and ther campers) in the future. This can make them persistent and smetimes vilent, and may attract wildlife t yur site. Avid cntact with wildlife. While it is certainly tempting t apprach wildlife, this can be very dangerus. Keep safe viewing distances. When watching wildlife, make sure t keep a safe distance. Avid attracting wildlife t yur campsite with the fllwing methds: Keep fd secured in airtight cntainers. Nt nly will it be fresher, it will attract less unwanted attentin frm wildlife. Keep yur fd ut f reach f wildlife. Keep yur campsite clean. Cllect any fd packaging and fd scraps in a waste bag and dispse f the waste in the campgrund's receptacle befre yu leave the camp r turn in fr the night. D nt feed wildlife. Nt nly will they becme mre aggressive tward yu, they will be mre likely t be a nuisance fr campers wh use the site after yu. D nt take fd inside yur tent. While it's tempting t have that midnight snack n hand, it will attract wildlife. Page 6 f 6
