1 German Wings: Cnditins f Carriage Fr the purpses f this dcument: We, us and ur refers t German Wings, the Carrier Yu, yur refers any persn wh has bked a ticket wh is t be carried r is carried by the Carrier The authrised agent refers t Superbreak Mini Hlidays Ltd wh have made the bking with the Carrier n yur behalf 1. Infants Infants wh are under 2 n the day f departure can nly travel if: They are secured n the lap f the adult accmpanying them with an additinal lp belt, which ur staff will explain hw t use. They ccupy their wn windw seat next t the adult accmpanying them and if the infant is secured in a special child restraint system explicitly apprved by Germanwings. Please nte that in this case we charge the full children s flight fare. We d nt prvide the required child restraint system, which yu must prvide yurself. A child restraint system can nly be used if it is prduced at the desk during check-in and determined t cnfrm t the child restraint systems apprved by Germanwings. If this is the case, the child restraint system is cnsidered as free baggage in terms f Pint 9 2. Expectant Mums Pregnant wmen may travel up t and including the 36th week f pregnancy if they present a dctr s certificate which cnfirms the stage f their pregnancy. This limit must als be respected n the return flight. 3. Special Assistance Irrespective f the need f ntificatin n an individual basis and unless an arrangement has expressly been made t the cntrary, the fllwing rules apply: Passengers with special needs may nt sit next t emergency exits fr safety reasns. We can nly carry a maximum f ne Passenger per flight whse disability requires the presence f an accmpanying persn, unless the Passenger travels with their wn accmpanying persn wh is there fr this purpse. A persn cannt be classed as an accmpanying persn if he r she is respnsible fr accmpanying mre than ne Passenger. Passengers fldable wheelchairs will be carried in additin t the free baggage allwance (Pint 9), at n extra charge. Hwever, it is nt pssible fr us t carry wheelchairs with wet batteries that are nt sealed r leak-prf. If yur wheelchair runs n a battery, please nte that wheelchairs r ther battery-perated mbility aids with a leak-prf dry r gel battery can nly be carried if the battery is nt cnnected and ready fr use and if the battery terminal is prtected against shrt circuits and islated. The battery must als be securely attached t the wheelchair r mbility aid. As a rule we can carry a maximum f five passengers with wheelchairs per flight. We can nly carry larger grups f passengers with wheelchairs where specific arrangements have been made with us. Fr Passengers wh have n mbility, r wh cannt walk withut help, r cannt climb the steps int the aircraft r cannt walk lnger distances, wheelchairs are prvided at the airprt. It is nt pssible t transprt ill peple wh must lie hrizntally, i.e. wh wuld require a stretcher, n ur flights. Please understand that nly ne guide dg can be accmmdated per flight. Guide dgs are carried free f charge and must be pre-registered fllwing bking by cntacting the airline. 4. Carriage f Animals The Carriage f Animals is nly pssible with ur express permissin. We will nly grant permissin fr the transprt f cats and dgs. If we grant permissin, we will nly transprt animals under the fllwing cnditins: Yu must ensure that animals t be transprted are accmmdated in a suitable clsed, watertight and bite-prf transprt bag, which may nt exceed 25.5 x 40 x 40 cm in size and 8kg

2 (including animal) in weight. Yu must ensure that yu have all the health and vaccinatin certificates, imprt permits and ther dcuments required by the cuntries yu are travelling t r thrugh. The animal must have enugh rm t stand up, turn rund and lie in a natural psitin. Only ne animal is allwed per bag and persn. Otherwise, the animals will nt be accepted fr carriage. Carriage f animals can als be subject t further requirements, which yu can btain frm us n request. Even when we have accepted t carry an animal, the animal and its transprt bag and fd are nt cunted as free baggage. This means yu must pay a specific charge in accrdance with German Wings charges - a up t date Table f Charges is available n German Wings website. We can nly carry animals in the cabin. Accmpanying dgs (guide dgs), wh are accmpanying handicapped Passengers will be carried free f charge in additin t the nrmal Free Baggage allwance. Passengers wh wish t travel with a guide dg must infrm the Germanwings Reservatin Centre in advance cntacting the airline. In rder t make sure that all f the necessary measures are taken yu must als check in at least tw hurs befre the planned departure time f yur flight. Please als nte Pint 3. We are nt respnsible fr an animal, whse exprt, imprt r health certificatin dcumentatin r ther dcuments, which are necessary fr the imprt r transit f the animal int a cuntry, state r territry, are incmplete r nt in rder. Yu and the Passenger wh is travelling with the animal, are liable and respnsible fr all fines, csts, lsses and bligatins which incur t us r are impsed n us thrugh such incmplete dcumentatin. 5. Seat Selectin Yur seat is allcated when yu check in. We hereby advise yu that yu have n right t influence the chice f seat nr can yu ccupy a seat ther than the ne allcated t yu. We d, hwever, reserve the right t refuse reservatin requests and t reallcate at any time the seats allcated in accrdance with the abve pint if we deem it necessary fr reasns f flight safety, security r perating reasns, r if the infrmatin abut the passenger in questin prvided, as requested when reserving the seat, is incrrect r incmplete. If yu are thus deprived f a reserved seat, we will refund yu the reservatin fee, as lng as yu are nt slely r predminantly respnsible fr the seat being refused. 6. Scheduled Departure Times Flight times given in schedules can change between the date f their publicatin and the date f departure. We cannt guarantee them. Please nte when planning yur jurney, that we are a pint-t-pint airline ffering direct cnnectins at lw prices. Cnnecting flights and the services which accmpany them are therefre nt ffered by us. Shuld yu still wish t cmbine mre than ne f ur flights, r cmbine ne f ur flights with a flight frm anther airline, yu d s at yur wn risk. 7. Check-in and Barding In general the check-in desks pen tw hurs befre the scheduled departure time (fr flights frm Tel Aviv:three hurs). We recmmend that yu arrive at check-in tw hurs befre departure. Passengers wh have nt arrived at the check-in desk and presented themselves t the check-in staff by at the latest 30 minutes befre the scheduled departure f their flight (fr flights frm Tel Aviv: 45 minutes) will n lnger be able t be checked-in. If yu have bked a ne-stp flight we recmmend that yu use the specially marked transfer desks when yu check-in again at the airprt where yu catch yur cnnecting flight, if such a transfer desk is available. One-stp passengers will as a rule be given pririty treatment at a transfer desk and as such will be checked in mre quickly. Ntwithstanding the rules in the abve special check-in times and restrictins n checked luggage d apply.

3 Fr passengers wanting t check in at a special check-in terminal utside the airprt (e.g. City Air Terminal CAT at Wien Mitte statin). The necessary time that passengers must be at the check-in terminal by and have made themselves knwn t the check-in persnnel when checking in is lnger than at ur check-in desks at the airprt and will be made available fr each specific lcatin. This is why these terminals are generally pen all day irrespective f the specific flight time. Please be aware f this when yu plan yur jurney t these special check-in terminals as there may be restrictins n checked luggage, which may nt be carried as free baggage as in Pint 8 In the interest f passenger safety we tk immediate actin after the terrr attacks in the USA n 11th September We intrduced the strng rules issued by the British Department f Transprt, Lcal Gvernment and the Regins (DLTR) fr British airprts and airlines, which lead t mre frequent, strnger safety measures. Please nte that this may lead t certain delays. All passengers including children and infants must prduce a valid fficial pht-id dcument when they check in. This als applies regardless f natinal immigratin requirements fr dmestic flights and flights t and frm states within the Schengen agreement. Fr internatinal flights natinal immigratin and exit regulatins must als be cmplied with and the necessary identity dcuments and any ther required dcuments and visas prvided Withut such dcuments yu will nt be allwed t check in fr yur flight. We ask fr yur understanding fr the fact that in the case f ne-stp flights the required checks are carried ut befre each flight segment individually and are limited t the requirements f that individual flight segment nly. The names n the identity dcument and n yur Flight Ticket (Bking Cnfirmatin) must be the same. Only Passengers wh have made a bking can be checked in. Yu can nt make a change (passenger change) at a later date. Passengers and their Baggage will be subjected t a thrugh security screening by us. We are therefre entitled in accrdance with Pint 11 search yu and yur Baggage. Certain items may nt be carried int the cabin r are prhibited frm being transprted in the aircraft in any way. Yu shuld therefre clsely bserve these particular cnditins set ut in Pint 10 when packing yur Baggage. This will make ur jb easier and will spare yu any truble at check-in. When necessary we will have t ask yu t transfer items frm yur Cabin Baggage int a piece f yur Checked Baggage r even cmpletely refuse t check in yur Baggage. Barding: At check-in yu will find ut frm which gate yu can bard the aircraft and at what time yu must be at the gate at the latest. Please nte that at every airprt there are security and cntrl prcedures t pass thrugh befre the gate area can be reached, and that we have n cntrl ver hw lng these prcedures can take. We recmmend that yu g thrugh the security check as sn as pssible, since waiting times can vary accrding t the prevailing circumstances. Cnsequences f being late: We reserve the right t cancel yur reservatin if yu d nt keep t the check-in deadline r yu d nt arrive at the gate by the time 8. Baggage Allwances Hand/cabin baggage: Frm 6 Nvember 2006 new rules fr hand baggage will apply fr all departures within the Eurpean Unin. Frm that date nwards each passenger will be able t take ne piece f hand baggage n bard weighing up t 8kg and measuring nt mre than 55 x 40 x 20 cm. In additin t the current restrictins n hand baggage, there will frm nw n be restrictins gverning the carriage f liquids and gels brught alng by the passenger r purchased befre the security-check in hand baggage:

4 All liquids (such as tiletries and csmetics, gels, pastes, creams, ltins, mixtures f liquids and slids, perfumes, pressurised cntainers, cans, water bttles etc) as well as wax and gel-like substances may nly be carried n bard in amunts less than 100ml r 100g. These liquids r substances must be packed in clsed cntainers in a transparent, re-sealable plastic bag (max. cntents 1 kg). It is the passenger s respnsibility t purchase this bag befre departure. They are available in many supermarkets, e.g. as freezer bags. It is currently nt pssible fr passengers t btain r purchase the required bags frm Germanwings check-in. Prescriptin medicines and baby fd may still be carried in hand baggage. The passenger must prve that such medicines and/r baby fd are needed during the flight. Prducts and bags which d nt meet the requirements r are nly sealed with a rubber band r similar will unfrtunately have t be surrendered by passengers Please always shw yur plastic bag at security when yur hand baggage is being screened. In rder t pass thrugh the airprt as quickly as pssible, yu are strngly advised t pack any liquids r gels which are nt essential fr yur jurney n bard the aircraft in yur checked baggage if pssible. As a matter f curse, liquids frm the Travel Value / Duty Free shps which have been purchased after yu have passed thrugh security are still allwed n bard. Germanwings shall nt be liable fr any items which passengers are prhibited frm carrying in their hand baggage fr security reasns and are required t surrender at the security checkpint. Please nte that these limitatins nly apply t articles being carried in hand baggage and nt fr luggage t be checked in. Checked-in Baggage Excess baggage surcharge: there is n bligatin fr us t carry checked luggage if the individual item f luggage r the passenger s ttal checked luggage exceeds 20 kg. If capacity is available, hwever, we generally accept checked luggage up t a maximum f weight f 50 kg per passenger, if the individual item f luggage des nt weigh mre than 32 kg. In particular cases we require prir cnsultatin. Infants yunger than tw years f age, wh are carried in line with Pint 1 fr a flat-rate service fee, are nt cnsidered as passengers as in lines ne and tw and are nt included in the weight restrictins laid dwn there. If we accept t carry excess luggage, alngside the baggage surcharge, in line with Pint 8 we levy a flat-rate excess baggage surcharge ( XM ) per cmmenced 5 kg and part theref f excess luggage fr checked baggage weighing up t a maximum f 40 kg per passenger. Yu can reduce the flat-rate excess baggage surcharge by 50% ( XB ) if yu register the excess baggage up t tw hurs befre the scheduled time f departure, either nline r by phning the Germanwings call centre, and pay the surcharge using the methd stated there. an additinal excess baggage surcharge per kil, if the ttal weight f checked luggage exceeds 40 kg per passenger ( XBAG ). Surcharge fr bulky luggage: fr the transprt f checked luggage, which is nt secured in cases r ther similar cmpact receptacles, we levy special surcharges instead f the baggage surcharge in accrdance with Art. and the excess baggage surcharge in accrdance with Pint 8. There is n bligatin fr us t carry bulky luggage. As a rule, hwever, if capacity is available, we will accept checked bulky luggage, if it is itemised as a type in the Table f Charges is available n German Wings website and if the surcharge laid dwn has been paid. In individual cases we require prir cnsultatin. Please find the respective surcharge fees in the Table f Charges is available n German Wings website r by cntacting ur call centre r check-in desks. The fees applicable are always thse fees published n the day f the respective flight. Fr bligatry prir registratin fr services incurring charges the applicable fees are thse published n the day f registratin. The fees laid dwn are per leg and are thus calculated separately fr the utward flight and the return flight. When bking flights with a cnnectin all legs between the first pint f departure and the final destinatin are cunted as ne leg.

5 9. Baggage Restrictins Yur Baggage must nt cntain Items which culd be used t endanger the aircraft r peple r prperty n bard. These are individually listed in the Dangerus Gds Regulatins f the Internatinal Civil Aviatin Organisatin (ICAO) and the Internatinal Air Transprt Assciatin (IATA). Items, whse carriage is frbidden wing t the natinal legislatin r fficial regulatins f a cuntry, via which r t which the aircraft is flying. Items which are justifiably judged by us as unsuitable fr carriage in the type f aircraft being used fr the flight, because they are dangerus, r because f their weight, dur r cntent, their size r shape r because they are in any way delicate, fragile r perishable, r because they will unacceptably affect the cmfrt f ther Passengers.

7 10. Right t Refuse Baggage Firearms and explsives, handguns, autmatic weapns, ammunitin including blanks, gun sights, firewrks, flares, smke canisters and fire-crackers. Firearms fr sprting and cmpetitin purpses and a maximum f 5 kg f ammunitin may be carried in Checked Baggage when it is declared at check-in and apprpriately packed. The regulatins f the ICAO and IATA apply here. Special check-in times apply in this case, which yu shuld enquire abut with us befrehand. Weapns, such as antique firearms, swrds, knives and similar items can als be accepted as Checked Baggage at ur discretin. They are, hwever, nt allwed in the aircraft cabin. Yur checked luggage must nt cntain any cash, jewellery, precius metals, cmputers r ther electrnic equipment, negtiable dcuments, dcuments f financial value r ther valuables, fragile bjects, ptical aids r perishables, keys, medicines, classified business dcuments, prttypes r mdels, passprts r ther identity cards and passes. We will nt carry wheelchairs unless they have sealed and leak-prf batteries (see als Pint 3), we als will nt carry extra xygen fr persnal use, stretchers, prams r mtrs. Apart frm the exceptins mentined in Pint 8 we will refuse t carry r carry further the items described in Pint 9. If all r part f yur luggage is nt transprted as a result f the circumstances described in Pint 9 we cannt be held respnsible fr the cst f string and/r delivering thse items f luggage. The cst f string and/r delivering such items will be charged t yu in a separate invice. We can refuse t carry Baggage when we justifiably cnsider it t be nt suitably and securely packed in a cntainer fit fr the purpse. Infrmatin relating t packaging and unsuitable cntainers can be prvided n request. 11. Right t Search Fr reasns f flight safety and security we can ask t search and examine yu and t search, examine and x-ray yur Baggage. If we cannt cntact yu, yur Baggage can be searched in yur absence. This happens in rder t ascertain whether yur Baggage cntains an item described in Pint 9, r a firearm, piece f ammunitin r ther weapn which was nt declared t us in accrdance with Pint 9. If yu d nt cnsent t such a request we can refuse t carry yu and yur Baggage. If a search r examinatin causes damage r injury t yu r an x-ray r examinatin damages yur Baggage, we are nly liable fr such damages, if we have caused them thrugh negligence f ur duties. 12. Cllectin and Delivery f Checked-in Baggage Yu must cllect yur Baggage as sn as pssible at the destinatin r a stpver. If yu d nt cllect yur Baggage within a reasnable time, we will charge a strage fee in accrdance with ur Tariffs. We have the right t give Checked Baggage t the hlder f the Baggage Check, if issued, and the Baggage Identificatin Tag, withut further checks as t this persn s entitlement t the Baggage. This is unless circumstances have been made knwn t us which give us cause t dubt the entitlement f the Baggage Check hlder t the Baggage. If a persn wh requests a piece f Checked Baggage cannt prduce the Baggage Check, if issued, and the Baggage Identificatin Tag, in rder t identify the Baggage, we will nly issue

8 the Baggage t this persn if he r she can prve t ur satisfactin their entitlement t the Baggage. 13. Cnduct n Bard Aircraft and at Airprt and Safety General If it is ur bjective pinin that yu cnduct yurself n bard in such a way that yu endanger the aircraft, any persn r prperty n bard, r that yu bstruct the crew in the perfrmance f their duties r yu fail t cmply with any instructins f the crew, including instructins relating t smking, alchl r the use f drugs, r if yu behave in such a way which may cause bjectin, disturbance, damage r injury t ther passengers r crew, we may take such measures as we deem necessary t prevent such behaviur frm cntinuing, including physical restraint. Yu can be remved frm the aircraft and yur further carriage may be refused. Yu can be prsecuted fr ffences cmmitted n bard the aircraft. Electrnic Equipment Fr safety reasns we may limit r prhibit the use f electrnic equipment, including but nt limited t mbile telephnes, laptps, recrding equipment and radis, CD players, electrnic games r transmitting devices, including radi cntrlled tys and walkie-talkies. The use f hearing aids and heart pacemakers is permitted. Alchlic Drinks The cnsumptin f alchlic drinks brught n bard by Passengers is nt allwed. 14. Refusal t Carry and Remval f Passengers 15. Aircraft We can refuse t carry, r t carry any further, yu r yur luggage, if we have reasn t believe n the basis f certain facts that yu have nt paid in full any flight fares r ther further charges levied by us; this is necessary t bserve current legal regulatins, r rders and regulatins f authrities; carrying yu r yur Baggage culd endanger the health r safety f thers r culd interfere with the physical welfare f ther Passengers r the crew; yur physical r mental state, including if under the influence f drugs r alchl, pses a risk r a danger t yu, t ther Passengers, the crew r the prperty f thers; yu have cmmitted an ffence as described in Pint 13 n a previus flight and we have reasn t suspect that yu culd repeat such behaviur; yu have refused t cperate with a security check; yu have nt paid in full any Flight Fares, taxes, charges r ther fees levied by us; yu are nt in pssessin f valid travel dcuments, yu wish t enter a cuntry which yu are nly entitled t travel thrugh r fr which yu have n valid travel dcuments, yu destry yur travel dcuments during the flight r yu refuse t hand ver yur travel dcuments t the crew in exchange fr a receipt when asked t d s; yu are unable t prve that yu are the persn named in the Flight Ticket (Bking Cnfirmatin); yu fail t fllw ur instructins relating t flight safety r security. We will take all necessary measures t carry yu and yur Baggage withut delay. In rder t achieve this t the best pssible satisfactin f ur Passengers, in particular t avid flights being cancelled, we have the right in exceptinal circumstances t allw a flight t be perated by anther Airline n ur behalf and/r with anther aircraft. 16. Our Liability General The liability f ther Airlines wh are invlved in yur jurney is unaffected by the regulatins set ut in this Article and is gverned by their wn terms r applicable legal prvisins.

9 In n case des ur liability exceed the amunt f prven Damage. We are nly liable fr indirect r cnsequential Damage if we have caused these intentinally r thrugh grss negligence. This des nt apply t indirect r cnsequential Damage arising frm death, injury r health damage t a persn, which arse frm negligence f ur duties. The terms f the Cnventin remain unaffected. If the Damage was caused by r cntributed t by the actins f the persn wh suffered the Damage, we may be exnerated whlly r in part frm ur liability in accrdance with applicable law. This als applies if the persn wh suffered the Damage failed t bserve their bligatins in respect f damage limitatin. We are liable nly fr Damage ccurring n ur flights r n flights f anther airline wh is prviding n ur behalf in place f us the flight fr which the passenger bked with us. Furthermre, if we issue a Flight Ticket fr carriage n the flights f anther Airline r accept Baggage fr carriage n the flights f anther Airline, we are slely acting as agent fr that Airline. Nevertheless, in the case f Checked Baggage yu have the right t claim cmpensatin fr Damages against the first r last Airline in a cnsecutive series f carriages as yu see fit. We are nt liable fr Damage arising frm ur cmpliance with any laws r gvernment regulatins, rders r requirements r fr Damage which ccurs when yu r the Passenger d nt cmply with them. Unless caused intentinally r thrugh grss negligence, we are nt liable fr errrs r missins in flight schedules r ther publicatins f flight times, nr fr infrmatin given by ur Authrised Agents, emplyees r ther representatives, relating t flight departure r arrival infrmatin r the peratin f flights. Any exclusin r limitatin f ur liability shall apply t and be fr the benefit f ur Authrised Agents, emplyees r ther representatives and any third party, whse aircraft is used by us, including the third party s Authrised Agents, emplyees and ther representatives. Unless expressly stated t the cntrary, the cnditins f this Sectin als apply withut restrictin t the specific cases set ut belw. Persnal Injury r Death If a Passenger is killed, wunded r in any ther way injured while n bard the aircraft r while barding r disembarking, ur liability is based upn - the EC Cuncil Regulatin 2027/97 f n air carrier liability while carrying passengers and their luggage by air, as drafted in Regulatin (EC) N. 889/2002 f the Eurpean Parliament and the Eurpean Cuncil dated in the case f internatinal flights, it is extended accrding t the terms f the Cnventin and these Cnditins f Carriage. Fr claims up t the amunt in Eurs equivalent t 113,100 SDR per passenger we will nt take advantage f any exneratin f ur liability, even if we can prve that we r ur staff tk all necessary measures t avid the Damage r that it was impssible fr these measures t be taken. Hwever, insfar as we are able t prve that the injured party is respnsible fr causing the damage in whle r in part, we shall be exnerated f liability. Furthermre, the exclusins set ut in the Cnventin and in applicable natinal law apply in full. We shall hwever nt be liable fr further damages if we prve that the damages d nt result frm the fault, negligence r illegal behaviur f us r ur staff, r that they exclusively resulted frm the fault, negligence r illegal behaviur f a third party. In the case f such Damage we will withut delay, and in any event nt later than 15 days after the identity f the natural persn(s) entitled t cmpensatin has been established, make such advanced payments as may be required t meet the immediate financial needs f that/thse persn(s) n a basis prprtinal t the

10 hardship suffered. In the event f death this advance payment will be at least the equivalent in Eurs f 18,096 SDR per Passenger. This advanced payment is in n way an admissin f liability by us and may be ffset against any subsequent sums payable if we are later held liable. The advanced payment is nt returnable unless it is ascertained that the Passenger is als partly r fully respnsible fr the Damage r if it is subsequently prven that the persn(s) wh have btained the advanced payment caused r cntributed t the Damage by negligence r the persn(s) wh received the payment was/were therwise nt eligible fr it. If we carry a Passenger whse age, mental r physical cnditin is such that carriage pses a danger t the Passenger his r herself, we shall nt be liable fr any kind f persnal injury r damage (including Death), insfar as it is caused by this cnditin. Passengers fr whm carriage culd pse a risk n these grunds must infrm us befrehand s that we can check whether and under what circumstances they may be carried withut danger. Damage t Baggage Our liability fr damages thrugh destructin, damage and lss f Baggage and f bjects f persnal prperty belnging t passengers is in accrdance with the Regulatin (EC) f the Cuncil dated abut the liability f airline cmpanies fr the carriage f passengers and their luggage by air transprt, as wrded in the Regulatin (EC) n. 889/2002 f the Eurpean Parliament and the Cuncil dated , supplemented in the case f internatinal travel as defined by the terms f the Agreement and these Cnditins f Carriage. If Checked Baggage is destryed, damaged r lst while it was n bard an aircraft f therwise in ur charge, we will nt be liable fr damages if we prve that the damage was nt caused by the negligence, fault r illegal behaviur f us r f ur staff r that it was exclusively caused by the negligence, fault r illegal behaviur f a third party. In ther cases, in particular in the case f damage t baggage nt checked in and the persnal prperty f passengers, we shall nly be liable insfar as the damage was caused by ur fault r the fault f ur staff. In any case we reserve the right t prve that the persn suffering damages was whlly r partly respnsible fr causing the damages, and in prviding such prf we shall be free f liability. Furthermre we shall nt be liable if and as far as the damage is caused by the nature f the baggage r an inherent defect theref, means the lss r damage f items, which may nt be cntained in baggage in accrdance with Pint 9, such as fragile r perishable items cntained in checked baggage, ptical aids, cmputers r ther electrnic equipment, jewellery, silver items, mney, dcuments f financial value, securities r ther valuables, keys, medicines, business dcuments r samples, passprts r identity dcuments; unless we have given express permissin in exceptinal cases fr the carriage f the cncerned items cntrary t the regulatins in Pint 9. is caused by items in the passenger s baggage. If these items cause damage t the baggage f anther passenger r t ur prperty, the passenger must cmpensate us fr all damage and expenses the air-freight carrier incurs. This limitatin t liability des nt apply if we r ur staff caused the damage intentinally r thrugh grss negligence. Furthermre ur liability shall be limited: in the case f transprt slely within the Federal Republic f Germany and fr internatinal transprt within the area cvered by the Mntreal Agreement t an amunt in eurs equivalent t 1,131 SDR per passenger, in ther cases fr Checked Baggage t the amunt f 27,35 per kilgram and fr baggage nt checked in t the amunt f 547,08 per passenger. The limitatins t liability mentined in the abve d nt apply, if Yu prve that the damages were caused by an actin r negligence n the part f us r f ur staff, carried ut either with the intentin t cause damage r negligently and in the knwledge that damages wuld prbably ccur, r

11 Yu have indicated t us when yu checked in yur baggage an amunt f mney which was equivalent t the higher level f interest attached by yu t yur baggage being delivered t yur destinatin, and yu have paid the supplement which we charged fr this; in this case we will be liable fr the amunt f mney which yu indicated, unless we prve that yur interest in the baggage being delivered was in fact lwer than that indicated by yu. Lss and Damages caused by delay, nn-carriage and cancellatin Insfar as we have t cmpensate lss and damages caused by delay t carriage f Passengers r Baggage by air, ur liability is limited t a maximum amunt equal t the equivalent in Eurs t 4,694 SDR per Passenger r if nly Baggage is affected by the delay, the amunts listed in Pint 16 We shall hwever be freed frm liability fr damages caused by delay if we prve that we r ur staff tk all reasnable measures t avid the damages r that it was nt pssible t take such measures. These regulatins apply accrdingly, insfar as we have t cmpensate lss and damages caused by nncarriage f Passengers r Luggage r by cancellatin f a flight. Insfar as cmpensatry services are prvided fr in these cases by Regulatin (EC) n. 261/2004 f the Eurpean Parliament and Cuncil dated these will be included in the calculatin f any cmpensatin claim. 17. Damage t r Lss f Checked-in Baggage The acceptance f baggage by the wner f the baggage receipt at the time that the baggage is handed ut is sufficient prf that the baggage was handed ut in a gd state and in accrdance with the carriage agreement, unless yu prve the cntrary. If yu wish t make a claim fr damage cmpensatin r a cmplaint relating t damage sustained by checked baggage, yu must infrm us as sn as yu have discvered the damage, and in any event nt later than seven (7) days after claiming the baggage. If yu wish t make a claim fr damage cmpensatin r a cmplaint relating t delayed checked baggage, yu must infrm us within twenty-ne (21) days frm the day when yur baggage was nce again in yur pssessin. All ntificatins f this type must reach us in written frm. A damage reprt registered at the airprt des nt replace the need fr a written statement t be sent t Germanwings. 18. Time Limits t bring a Claim A claim fr damage cmpensatin f any kind in the case f internatinal carriage must be made within a 2 year perid frm the day n which the aircraft landed at the destinatin r frm the day that the aircraft shuld have arrived, r frm the day n which carriage stpped. The methd f calculating the perid f limitatin shall be determined by the law f the curt hearing the case. This is als the case fr natinal air carriage when enfrcing claims that are by their nature gverned by the Mntreal Cnventin.
