Shps which are nt small shps, exempt shps r have been granted an exemptin under s10 f the Retail Trading Act 2008 may nt trade n the abve days. Small shps Small shps are permitted t trade withut restrictin n public hlidays. Small shps are shps in which: the number f peple that wn the shp des nt exceed tw (r ne crpratin), and the wner r wners f the shp take the prfits frm the business; the ttal number f emplyees engaged by a small shp des nt exceed a ttal f fur regular emplyees, whether wrking at the same time r different times (nt including the ccupier/s, any persn engaged as emergency cver, r a persn wrking utside the nrmal wrking hurs f a persn engaged n a full-time basis); and the wner is nt a crpratin r a directr f a crpratin which/wh is engaged in anther business. 1

Shps which are nt therwise exempt may nly trade n restricted trading days if they have been granted an exemptin under sectin 10 f the Retail Trading Act If yu wish t apply fr an exemptin, please call the ARA team n. Emplyees f a shp which has been granted an exemptin t trade n a restricted day must freely elect t wrk withut cercin, harassment, threat r intimidatin by r n behalf f the emplyer. 2

3 Victria Public Hlidays The fllwing days are declared t be bserved generally thrughut Victria in 2016 fr the Easter and April perid: Public Hliday Gd Friday Easter Saturday Easter Sunday Easter Mnday Anzac Day Date Observed Friday, 25 March Saturday, 26 March Sunday, 27 March Mnday, 28 March Mnday, 25 April Trading Hurs Restrictins There are tw and a half restricted trading days each year in Victria: Gd Friday; Christmas Day; and between am and 1pm n ANZAC Day. On these particular days, nly exempt shps are permitted t pen. Exempt shps Exempt shps are businesses that meet the fllwing criteria: they have 20 r fewer persns emplyed in the shp at any time during a restricted trading day; and the number f persns emplyed by the business and its related entities is n mre than 100 at any time during the 7 days immediately befre the restricted trading day. Exemptins t restricted trading days Certain types f business are exempt frm any restricted trading days. They can pen whenever they wish thrughut the year. The types f business that are exempt are: chemists; petrl shps; restaurants; cafés; takeaway utlets; service prviders; and hire utlets (including vide stres). 3

4 Queensland Public Hlidays In 2016, the fllwing days are bserved as public hlidays in Queensland fr the Easter and April perid: Public Hliday Gd Friday Easter Saturday Easter Mnday Anzac Day Date Observed Friday, 25 March Saturday, 26 March Mnday, 28 March Mnday, 25 April Trading Hurs Restrictins The trading hurs f shps in Queensland are regulated by way f the Trading (Allwable Hurs) Act 1990 supprted by the Trading (Allwable Hurs) Regulatin 2004 and varius trading hurs rders made by the Queensland Industrial Relatins Cmmissin. Restrictins n hurs f trade will depend n the classificatin f shps and, if the shp is classified as a nn-exempt shp, where it is lcated. Shps are classified as: exempt shps; independent retail shps; r nn-exempt shps (als lk t lcatin). Exempt shps The trading hurs f exempt shps are cmpletely unrestricted. Exempt shps are thse that sell certain gds by retail that a reasnable persn wuld expect t be sld r supplied in such shps. These include: antique shps; aquariums and aquarium accessries shps; art galleries; arts and crafts shps; bait and tackle shps; bk shps r newsagencies; bread shps, cake shps r pastry shps;; camping equipment shps; chemists; cnfectinery shps; 4

5 cked prvisins shps (where the prvisins are cked r heated n the premises immediately befre sale); delicatessens; fish shps; flwer shps; fruit and r vegetable shps; funeral directr's premises; hair salns, beauty salns r barber shps; ice-cream parlurs; licensed premises within the meaning f the Liqur Act r Wine Industry Act; marine shps; milk bars; plant nurseries r shps fr selling garden plants and shrubs, seeds, garden and landscaping supplies r equipment and assciated prducts; pet shps; phtgraphic shps; premises which are licensed under the Secnd-Hand Dealers and Pawnbrkers Act; restaurants, cafés r refreshment shps; service statins; shps fr selling mtr vehicle spare parts and/r mtr cycle parts; shps f a class declared by a regulatin t be a class f exempt shp; sap shps; suvenir shps; sprting gds shps; temperance beverages shps; tbaccnists; ty shps; veterinary supplies shps; and vide cassette shps (blank r pre-recrded). Independent retail shps Independent retail shps are required t remain clsed thrughut the whle f Gd Friday and 25 December (Christmas Day). They are als t remain clsed until 1.00pm n 25 April (Anzac Day). Hwever, independent retail shps that are predminantly fd and/r grcery shps are allwed t pen n these days. A business is an independent retail shp if: the business is run by an individual, partnership r a prprietary cmpany (des nt include a related bdy crprate); and the number f peple engaged at any ne time in the shp (including the wner) is nt mre than 20; and the number f peple engaged by the wner f the business in all shps thrughut the state is nt mre than 60 at any ne time; and the business is nt cnducted within a nn-exempt shp; and 5

6 the shp is nt an exempt shp, ffice, a shp selling whlly r partly whlesale prducts r a shp selling mtr vehicles r caravans r stalls in a market. A nn-exempt shp Nn-exempt shps cannt trade n Gd Friday and Anzac day (25 April). Easter Saturday Trading is between 8am and 6pm fr the fllwing areas: Suth-East Queensland Area, Inner City f Brisbane (excluding the Area f New Farm f Inner City f Brisbane), City Heart f Inner City f Brisbane, Area f City Heart f Inner City f Brisbane (Supermarkets) and the Gld Cast and Sunshine Cast Areas. An exempt shp is a shp which: has a flr area nt exceeding 200 square metres and which des nt adjin a building used as a strerm with a flr area greater than ne-half the flr area f the shp; r sells fdstuffs (e.g. a supermarket) with a flr area nt exceeding 400 square metres and which des nt adjin a building used as a strerm with a flr area greater than ne-half the flr area f the shp; r any f the fllwing shps (regardless f size): cafés, restaurants and take-away fd; service statins, licensed under Sectin 17 f the Act, selling a range f gds cmmn t service statins which culd include gds generally stcked by cnvenience stres; hairdressers; shps in ten pin bwling alleys, squash centres and glf curses; antiques (ther than cins r stamps); live fish and aquariums etc.; paintings and crafts; bkshps and newsagents; pharmacies; csmetics; medical and surgical appliances; flrists; nn-alchlic drinks, ice-cream, cnfectinery r light refreshments; pets and accessries; 8

9 plant nurseries; suvenirs; tbaccnists; cash-and-carry whlesale warehuses; shps at hrticultural r agricultural shws; shrt-term charitable, religius r benevlent spnsred shps; agricultural machinery; fine art, either by auctin r n cmmissin; caravans and/r trailers; r any shps that hire ut gds rather than sell them (e.g. vide hire, machinery hire etc.). Nn-exempt Shp Nn-exempt shps are thse that d nt fit within the definitin f exempt shps and which are lcated in shpping districts. Nn-exempt shps in the Greater Adelaide Shpping District, the Glenelg Turist Precinct r the metrplitan area generally (but utside the Central Business District (CBD) Turist Precinct): can trade until 9.00 pm Mndays t Fridays, including part-day public hlidays; can trade until 5.00 pm n Saturdays, including Easter Saturday; and can trade between am and 5.00 pm n Sundays, excluding Easter Sunday; and cannt trade n full-day public hlidays, except fr Easter Saturday. Nn-exempt shps in the Central Business District (CBD) Turist Precinct : can trade until 9.00 pm Mndays t Fridays, including part-day public hlidays; can trade until 5.00 pm n Saturdays, including Easter Saturday; and can trade between am and 5.00 pm n Sundays and all full-day public hlidays (except Gd Friday, 25 December and befre 12 nn n 25 April). Nn-exempt shps in Prclaimed Shpping Districts: can trade until 6.00 pm n all weekdays except Thursday; can trade until 9.00 pm n Thursdays including part-day public hlidays; and can trade until 5.00 pm n Saturdays (except Easter Saturday); and cannt trade n Sundays r full-day public hlidays. Nn-exempt stres which sell hardware and building materials, furniture, flr cverings r mtr vehicle parts and accessries and are lcated in the Greater Adelaide Shpping District r a Prclaimed Shpping District: can trade until 9.00 pm n weekdays, including part-day public hlidays; can trade until 5.00 pm n a Saturday, including Easter Saturday; and can trade frm 9.00 am t 5.00 pm n Sundays and full-day public hlidays (except Gd Friday, 25 December and Anzac Day); and can trade frm pm n Anzac Day. 9

10 Shps utside the Greater Adelaide Shpping District Fr shps which are nt lcated in the Greater Adelaide Shpping District (Central Business District (CBD) Turist Precinct, the Glenelg Turist Precinct and the metrplitan area generally) r a Prclaimed Shpping District, the Shp Trading Hurs Act 1977 des nt apply. These shps can trade whenever they want, including n all public hlidays. 10

11 Tasmania Public Hlidays In 2016, the fllwing days are bserved as public hlidays in Tasmania fr the Easter and April perid: Public Hliday Gd Friday Easter Mnday Anzac Day Date Observed Friday, 25 March Mnday, 28 March Mnday, 25 April Lcal Public Hlidays In additin t the abve hlidays, a number f lcal public hlidays apply in Tasmania. Fr example, certain wrkers in gvernment service in Tasmania are entitled t an additinal Easter Tuesday public hliday. A list f these lcal public hlidays can be fund at: Trading Hurs Restrictins In Tasmania shp trading hurs are regulated by the Shp Trading Hurs Act Large retailers emplying mre than 250 emplyees r businesses that are part f a franchise agreement (entered int r in existence befre the cmmencement f the Shp Trading Hurs Amendment Act (N. 2) 1987.) must nt keep their shp pen at any time (a) n Gd Friday; r (b) befre 12.30pm n Anzac Day. There are n shp trading restrictins n ther types f shps. 11

12 Western Australia Public Hlidays In 2016, the fllwing days are bserved as public hlidays in Western Australia fr the Easter and April perid: Public Hliday Gd Friday Easter Mnday ANZAC Day Date Observed Friday, 25 March Mnday, 28 March Mnday, 25 April Trading Hurs Restrictins In Western Australia, shp trading hurs are regulated by the Retail Trading Hurs Act 1987, which applies t shps lcated suth f the 26th parallel f latitude. Under the Act there are fur types f shps fr the purpse f trading regulatins: small retail shps, special retail shps, general retail shps and filling statins. Small Retail Shps Small retail shps may be pen at any time. A small retail shp is a shp which: is wned by up t six peple (r a bdy crprate with up t six sharehlders); is perated fr the benefit f the persns mentined abve; des nt sell r prvide mtr vehicle gds r services; des nt have mre than 25 emplyees (including the wners but excluding apprentices); and has a valid certificate certifying that it is a small retail shp. Nte that small retail shps must be certified as small shps t be labelled as such. If yu wish t trade as a Small Retail Shp yu must apply fr a certificate frm the Department f Cmmerce. Special Retail Shps Special retail shps may trade between 6.00 am and pm all year. Special retail shps include: newsagencies and bkshps; 12

13 pharmacies; garden nurseries; hardware and hme imprvement shps; vide shps; art and craft shps; suvenir and duty free shps; shps at sprts venues; marine craft shps; mtr vehicle spare parts shps; and shps at internatinal standard htels. Nte that special retail shps must be certified as a special retail shp t be labelled as such. If yu wish t trade as a Special Retail Shp yu must apply fr a certificate frm the Department f Cmmerce. General Retail Shps A general retail shp is any shp that is nt a small retail shp, a special retail shp r a filling statin (a business that sells mtr fuel). General retail shps cannt pen n public hlidays, subject t the exemptins detailed belw.
