11 Executive Summary State Context The Albania Parliament promulgated the new Air Code on the 22nd of December 2008 and was amended by law Nr 10484, date The Air Code was drafted with the assistance of EUROCONTROL under Aviation Safety & Air Traffic Control Programme (ASATC) and was reviewed by EC under European Common Aviation Area Agreement activities. The Air Code was announced by the decree of The President of the Republic of Albania on the 12th of January 2009, and entered in force after the publication in the state official gazette. The Air Code enhances the legislation framework in order to better cope with ICAO, EUROCONTROL and SES Requirements in Albania. In addition, the new Air Code explicitly defines the CAA as a pure regulator with substantial administrative and financial autonomy from the Government. The work for drafting of the new regulations and/or updating the existing ones, based on the Air Code, has started and according to the provisions of the new Air code a two year period is foreseen for the update of the existing regulations and drafting the new ones as necessary. Pursuant to the Air Code, the law Nr date as amended by low Nr date defines the provisions for the organisation and the function of the Albania Civil Aviation Authority The Civil Aviation Authority main activities are the rulemaking and the oversight in all the fields of civil air transports in the Republic of Albania according to the Air Code. The Civil Aviation Authority (CAA) is nominated as the only NSA in the Republic of Albania and its ANS Oversight Department is established to carry out all the tasks relevant to NSAs in line with SES Legislation. NSA staff has received the necessary training and more personnel has been recruited and trained to support on the oversight and supervision of the existing ANSP, National Air Traffic Agency (NATA). ESSIP Objective Implementation Significant progress has been achieved during 2013 toward the completion of applicable ESSIP Objectives. Most of the SRC Objectives have already been completed. For the time being the Military has not any ATM Regulatory or Service Provision function, but the fact that Albania is a member of NATO since 4 April 2009, requires the necessity to implement the FUA Regulation, also published by Minister Order Nr. 10 dated CAA, NATA and Military representatives are meeting regularly to define the modalities of the FUA implementation. For some Objectives, like COM11, implementation of VoIP, the Service Provider NATA is collaborating with the FAB Blue Med Partners with the aim of common procurement and FAB wide implementation. 15 Introduction The Local Single Sky ImPlementation documents (LSSIPs), as an integral part of the ESSIP/LSSIP mechanism, constitute a five-year plan containing ECAC States actions to achieve the Implementation Objectives as set out by the ESSIP and to improve the performance of their national ATM System. The LSSIP document Year 2013 describes the situation in the State at the end of December The LSSIP documents are structured into 6 chapters to better differentiate the Stakeholder(s) accountable for the information contained in each of them: Chapters 1 to 5 present the key players in the State, and sets the institutional and geographical scenes to help the reader understand the specifics of the State and interpret the rest of the document correctly. It also presents a short description of the main national and regional projects in which the national Stakeholders are involved. Chapter 6 contains high-level information on progress and plans of each ESSIP Objective. The information for each ESSIP Objective is presented in boxes giving a summary of the progress and plans of implementation for each Stakeholder. The conventions used are presented at the beginning of the section. Note: Chapter 6 is completed with a separate document called LSSIP Level 2. This document consists of a set of tables organised in line with the list of ESSIP Objectives. Each table contains all the actions planned by the four national stakeholders to achieve their respective Stakeholder Lines of Action (SLoAs) as established in the ESSIP. 17 Chapter 1 - National ATM Environment 1.1 Geographical Scope International Membership Albania is a Member of the following international organisations in the field of ATM: Organisation Since ECAC 1997 EUROCONTROL 2006 European Union EASA Working Arrangements 2007 Working Arrangements 2009 N/A ICAO 1990 NATO Geographical description of the FIR(s) The geographical scope of this document addresses the Albanian FIR, Tirana FIR. Tirana FIR 1 is surrounded by FIRs of 4 States, namely Skopje FIR, Athens FIR, Brindizi FIR, and Belgrade FIR. 1 Albanian FIR borders are subject to international laws and respective agreements provisions. 18 1.1.3 Airspace Classification and Organisation The Republic of Albania airspace (Tirana FIR) is divided into two sections: lower airspace and upper airspace. The separation between them is at flight level FL285. The lower limit of the Tirana FIR is ground level (GND), and the upper level is FL660. All air routes published in AIP from flight level FL110 to flight level FL285 are defined as lower air routes and all air routes above flight level FL285 to flight level FL660 are defined as upper air routes. All air routes (lower and upper) are classified as class C. The lowest flight level operated in the air routes in Tirana FIR is FL110. The following controlled airspaces are placed in Tirana FIR: The Control Zone of Tirana Aerodrome (Tirana CTR) is from the ground level (GND) up to an altitude of 2500 feet MSL. Tirana CTR is classified in class D. The Terminal Manoeuvring Area (Tirana TMA) from flying altitude 2500 feet MSL up to flight level FL195 Tirana TMA is classified in class C. The Controlled Airspace (Tirana CTA) from flight level FL110 up to flight level FL285 Tirana CTA is classified in class G from flight level FL110 up to FL195 except for the air routes and the controlled area (part of TMA ). From flight level FL195 up to FL285 it is classified in class C. 19 1.2 National Stakeholders The main National Stakeholders involved in ATM in Albania are the following: - Ministry of Transport and Infrastructures; - Albanian Civil Aviation Authority; - Albcontrol, Air Navigation Services Provider of Albania; - Air Force Headquarters; - Accident/Incident Investigation Body. Their activities are detailed in the following subchapters and their relationships are shown in the diagram below. 20 Albanian Civil Aviation Authority (CAA) The Civil Aviation Authority (ACAA) is a public and self financed entity, under the Minister in charge of Civil Aviation and responsible for ATM safety regulation in Albania. The establishment of a self financed and independent Authority has been guaranteed through Law Nr date as amended by law Nr date for the Civil Aviation Authority. The ACAA as a regulator is institutionally separated from the ANS service provider, Albcontrol sh.a, which is a joint stock company. The Decision of Council of Ministers, Nr 548 dated 29/08/2007 nominated the CAA as the only National Supervisory Authority for Albania in order to assume the tasks assigned to this authority under the SES Framework Regulation, Regulation (EC) No 549/2004 of the European Parliament and the Council. Albcontrol is providing air navigation services in accordance with the national, international standards and European best practices of air navigation. ANTA sh.a. (previous name) was established as state-owned enterprise in It was transformed into a joint stock company under the name of National Air Traffic Agency on February the 3rd, This company manages and controls the airspace of Albania (FIR) in accordance with the international standards of air navigation. ALBCONTROL, is the new name in order to be closer to the state and national identity, to better represent the services it provides and to be closer it s European sister companies, since the 15th of November ALBCONTROL is a 100% state owned joint stock company, property of the Ministry of Commerce, Economic Development and Enterprise. Lockheed Martin Skyline System Not planned as the Systems was installed in 2011 On 3 May 2011 a new air traffic control facility was inaugurated in Albania as part of the National Airspace Modernization Project. It was implemented in partnership with US-based Lockheed Martin. It consisted in the improvement of Air Traffic Management (ATM) infrastructure and included upgrades to communications, navigation and surveillance systems. The Project also entailed installing an ILS (instrument landing system), a new communications system, a new transmitter, and secondary surveillance radar. As a concessionaire company TIA ShPK is in charge of airport activities including Ground Handling for 20 years. Tirana International Airport has a new passenger terminal, newly build and renovated airport infrastructure, new parking and new cargo facilities that offer passengers, airlines and clients an outstanding service Airport(s) covered by the LSSIP APO SloAs are contained in the following objectives: ENV, APO, ITY-ADQ and SAF11. In addition to the Annex B of the ESSIP Plan edition 2013, it is up to the individual State to decide which additional airports will be reported through LSSIP for those objectives. N Accident/incident Investigation Body Technical investigations The Chapter 8 of the Albanian Air code deals with the Accident and Incident Investigation in Civil Aviation. The Article 93 requires the establishment of a National Body, by the Council of Ministers, to investigate all the accidents and incidents within the territory of Albania. Council of Minister Order Nr. 686 date Establishing the national body of investigation of air Accident/Incident in civil aviation is the legal act representing the transposition of the Council Directive 94/56/EC and fulfil the requirements of the Article 93 of the Air Code. The National Accident and Incident Investigation Body have unrestricted authority over the conduct of the investigation. It appoints an investigator-in-charge for each investigation. The investigation includes: The gathering, recording and analysis of all available information on that accident or incident; If appropriate, the issuance of safety recommendations; If possible, the determination of the causes; and The final report of the investigation Collection, Evaluation & Processing of Data In order to carry out this function, the National Accident and Incident Investigation Body plans to use the tools developed in the frame of the programme for the European Co-ordination Centre for Aviation Incidents Reporting System (ECCAIRS). Also within NSA the ECCAIRS system is already implementing and functioning with analysing the occurrences that are collected by the Service Provider and transmitted to the NSA Civil-Military Accidents/Incidents The National Accident and Incident Investigation Body conduct investigations only in cases when a civil aircraft is involved in any accident or serious incident. The military aircraft accidents and/or incidents are conducted in compliance with the military procedures. There are no formal arrangements defined into the legislation to deal with the cases when both military and civil are involved. In such cases an ad hoc investigation body composed of subject matter experts is created by a joint order of civilian-military authorities and any other third party involved. On 22nd of April 2008, eight States (Albania included) of South East Europe, the United Nations Mission in Kosovo (UNMIK), the European Commission, the Stability Pact for South Eastern Europe, and the Regional Co-operation Council, agreed to formally launch the Support Programme ISIS. ISIS is the re-orientation of the SEE-FABA initiative and its aim is for implementing SES in South East Europe. During this year several specific activities have been performed under the ISIS framework with the intention for supporting the participant States in fully achieving the EU standards in the ATM field. In August 2011 it was signed the Memorandum of Understanding between Republic of Albania, Republic of Macedonia and Republic of Kosovo, signed in Ohr Macedonia. This MoU describes the mechanisms and processes to be undertaken by State NSA-s for the very important processes which is the Safety Oversight of the Service Provider. Sharing resources and knowledge in the ANS field and performing Safety Audits in the region is the main scope of this MoU to be in compliance with the safety regulatory requirements. In May 2012 it was signed the Memorandum of Understanding between the Civil Aviation Agency of Montenegro and the Civil Aviation Authority of Albania.
