6 General Interest Item 3: Register Now for Leaders Forums on Review Panel s Report LGNSW is organising a series of Leaders Forums across NSW on the Independent Local Government Review Panel s final report, Revitalising Local Government. The Revitalising Local Government report has far-reaching implications for the future of Local Government in NSW and it is critical that Local Government steers the outcomes. These Forums will provide an opportunity to deliberate on the findings and recommendations of the report. They will be instrumental in framing Local Government NSW s (LGNSW) response to the report and to whatever positions the NSW Government adopts in the short and long-term future. 9 General Interest Item 6: New Climate Risk Workshop Date Announced LGNSW is holding another Climate Risk workshop in Sydney s CBD on the evening of Tuesday 18 March 2014 to assist councillors and senior management understand and plan for climate risks. As decision makers within councils and leaders within communities, councillors across NSW need to understand new and emerging environmental risks and liabilities. Many regions have recently responded to floods of new magnitudes, while others are experiencing water concerns under extended drought conditions. 10 General Interest Item 7: Applications Now Open for NSW Crown Reserve Funding The NSW Government is inviting applications from managers of NSW s public reserves for targeted funding for weed and pest control and showground maintenance under the Public Reserves Management Fund Program. The Public Reserves Management Fund Program (PRMFP) provides financial support to develop, maintain and improve public reserves. More than $135 million has been allocated by the NSW Government through the PRMFP over the last ten years. Round 1 In round one of the 2014/15 program, funding is open only to the following activities: Showground managers any type of eligible activity Other reserve managers pests and/or weeds management activities. The first round of the PRMF is to be finalised by June Round 2 Applications Applications for the first round of the 2014/15 PRMFP opened on 17 February 2014 and close on 17 March 2014 (5pm). 11 General Interest Item 8: Review of Urban Water Regulation in NSW Position Paper The NSW Government has released a position paper to seek stakeholder feedback on its Review of Urban Water Regulation in NSW. The purpose of the review, which is led by the Metropolitan Water Directorate in the Department of Finance and Services, is to address aspects of the current regulation of urban water services in NSW and develop a consistent and holistic approach that appropriately manages risks to public health, the environment and consumers. The position paper suggests that regulatory responsibilities continue to be shared between the Water Industry Competition Act (NSW) 2006 (WIC Act) and the Local Government Act (NSW) 1993 (LG Act), and allow amendments to the WIC Act to be prioritised, including the following key reforms: Introducing entity licensing Licensing and scheme approval will be separated so that entities are licensed, as opposed to schemes. Licences will be company-wide, enabling entities to provide services anywhere in NSW. Introducing a risk based approach The WIC Act will be refocused to regulate utility like services and high risk schemes. Reducing regulatory gaps As metropolitan council-led schemes are currently unregulated, those schemes that are utility like or high risk will be brought under the WIC Act and required to be operated by a licensee, minimising public health risks. Regional council-led schemes will continue to be regulated by the NSW Office of Water under the LG Act. Existing section 68 schemes under the LG Act Existing private schemes that already have approval under section 68 will no longer need to obtain approval under the WIC Act. However, if the scheme triggers one of the scheme approval thresholds, existing section 68 approved schemes may opt to transition over to the WIC Act. All other existing section 68 schemes will continue to be regulated by local councils under the LG Act. Strengthening customer protection Retailer of last resort arrangements will be strengthened, and a new operator of last resort framework will be created. Enabling a broader regulatory framework in the future Possible options for reforms under the LG Act are to be considered along with the recommendations of concurrent Local Government reviews by the NSW Government at a later stage including: Regulating stormwater schemes under sections 60 and 68 of the LG Act to ensure public health risks are mitigated; Regulating metropolitan council-led schemes (not captured under the WIC Act) under section 60 of the LG Act; Implementing a risk based framework for low to medium risk recycled water and stormwater harvesting schemes; and Introducing fees and penalties for council-led schemes and ensuring that penalties for section 68 schemes are adequate to encourage compliance. The proposed approach was informed by stakeholder feedback on the review s 2012 discussion paper entitled Joint review of the Water Industry Competition Act 2006 and regulatory arrangements for water recycling under the Local Government Act LGNSW made submissions on the discussion paper, as well as on last resort arrangements in the WIC Act (see fact box). NSW Seniors Week is an annual celebration featuring hundreds of events delivered in partnership with government, community and commercial organisations. NSW Seniors Week gives seniors an opportunity to experience something new. With events held across the state covering art, technology, entertainment, health, wellbeing, sport and more there is something for everyone to enjoy. NSW councils are well placed to develop and implement activities for the seniors in the community. Providing the opportunity for seniors to try a new activity during NSW Seniors Week can lead to year round involvement in the community. 13 Environment Item 10: Sustainable Roads Forums Upcoming Dubbo Forum Sustainable Choice successfully launched its 2014 series of Sustainable Roads Forums in Lismore, with the second Forum to be held in Dubbo on Tuesday 4 March. Lismore Sustainable Roads Forum The first in a series of regional Sustainable Roads Forums was held in Lismore on Tuesday 11 February. Cr Jenny Dowell, Mayor of Lismore City Council, opened the forum held at the council s Materials Recycling Facility (MRF). The Forum was a success and coincided with the launch of Lismore City Council s new glass recycling facility, due to open within a couple of months. The Forum included three keynote speakers and a number of sustainable suppliers showcasing available innovation and technologies. The Forum also received media coverage (see fact box). 15 Legal Item 12: Consultation on the Proportionate Liability Model Provisions The Standing Council on Law and Justice (SCLJ) has been developing Model Provisions for proportionate liability. Proportionate liability was first introduced into NSW in 2002 as part of national civil liability reforms to address rising insurance costs. Proportionate liability means that if two or more wrongdoers contribute to a plaintiff s loss, they are only liable to pay compensation for the proportion of the damage they caused. The Department of Attorney General and Justice is consulting on the model provisions to inform assessment of whether they should be wholly or partly adopted in NSW. The Model Provisions and decision regulation impact statement are available on the SCJL website (see fact box). The program offers a broad range of basic knowledge and skills needed for effective professional practice, balancing planning law and policy with impact assessment and design factors. The program ranges from the legal framework to planning instruments and policies, specific elements of the assessment process, and the workings of the Land and Environment Court.
