1 Patnt Licnsing Standards Committ TFH, JAB suggstions August 2, 2016 Scop Th Patnt Licnsing Standards Committ will crat industry-wid standards of conduct for businsss and profssionals who ngag as principals or agnts in th practic of licnsing patnts. Ths standards will: Enhanc th businss cultur and conduct surrounding IP licnsing transactions; Enhanc th lvl of xprtis of thos ngagd in th businss of IP licnsing transactions; Protct th valu of IP for ownrs ranging from invntors to ntrpriss; Improv th fficincy of IP licnsing transactions through stablishd bst practics; and Rduc transactional costs and managmnt xpnss rlatd to IP licnsing. Th Committ aims to dvlop standards that stablish durabl businss modls in th patnt licnsing industry, whil rmaining a flxibl framwork that can accommodat th nds of particular transactions and th volution of futur laws, rgulations, and court opinions. Th goal, in dvloping th standards, is to prsrv and nhanc fficint and thical practics that promot montization of intllctual proprty in a way that bnfits all markt participants whthr thy b ownrs or purchasrs of patnt rights, individual invntors or innovating businsss, intrnal practitionrs or outsid profssionals. Th standards will includ rquirmnts for thical conduct in patnt licnsing, communication protocols, and industry-accptd businss practics. Th Committ will dvlop standards that apply to thos who rgularly ngag in licnsing patnts, whthr or not thy also produc th articls mbodid by th patnts. Th focus will b on obsrvabl bhaviors that ar masurabl and uniformly applicabl across th industry.. Work Products Th Committ nvisions dvloping th following componnts: 1. Th LES Patnt Licnsing Standard, to b approvd by ANSI. This primary documnt will outlin th spcific bhaviors and guidlins for licnsing which must b adoptd to achiv crtification. This st of documnts will b non-mandatory, uniform tmplats for common transaction-rlatd documnts, which will srv as a hlpful rsourc and rfrnc for crtifid or accrditd ntitis. This scondary documntation may b dvlopd jointly with th Amrican Intllctual Proprty Law Association, and may includ som or all of th documnts in Appndix A blow. Furthr, an individual or ntity can bcom crtifid by adopting th standards into an applicabl policy or applying for crtification with rquird documntation or commitmnts, and/or bcom accrditd by going through an stablishd procss such as an valuation or audit.
