Fve of these are wthn a 100-klometre radus of Hldeshem. Two are n the Hldeshem regon. TWO WORLD HERITAGE CHURCHES AND THEIR ART TREASURES St Mchael s Church St Mchael s wooden celng St Mary s Cathedral Hldeshem Cathedral Museum Hldeshem boasts two World Hertage churches UNESCO smultaneously awarded St Mary s Cathedral and St Mchael s Church, together wth ther artstc treasures, ther World Hertage status back n St Mchael s s one of the most beautful early Romanesque churches n Europe. One of the church s most strkng nteror features s the huge wooden celng datng from the 13th century. The nave celng s constructed of 1,300 oak panels and shows the Tree of Jesse. The church s ground plan s strctly symmetrcal, whch makes t one of the key works of Romanesque art. There has been a buldng on the ste of St Mary s Cathedral snce the 9th century. It s one of the oldest cathedrals n Germany and s consdered the heart of the cty of Hldeshem accordng to the legend of the 1000-year-old rose on the cathedral s apse. The UNESCO Commttee decded to nclude St Mary s Cathedral on the World Hertage lst prmarly because of the bronze castngs of Bernward s Column and the Bernward Doors, once ordered by Bshop Bernward, and the Cathedral Treasury. The Cathedral Museum houses a fascnatng exhbton of outstandng examples of ecclesastcal art from the cathedral s collecton that enjoy UNESCO World Hertage status (page 8). An nteractve, multmeda exhbton n the UNESCO Vstor Centre also awats vstors. Programme of events for the 100-year annversary of Bauhaus In June 2011, the Fagus Factory workng hertage ste n Alfeld, the frst ndustral buldng n the Modernst style, was ncluded on the World Hertage lst. The buldng was desgned by the founder of the Bauhaus movement, Walter Gropus t was the famous archtect s frst large buldng. The Fagus Factory represents an archtectural concept, whch at the tme was the frst to consder the need for lght, ar and clarty, and used glass and steel n the manner of Neues Bauen (new buldng). The lvng monument s stll fulfllng ts orgnal purpose as a producton plant to ths day. The company has been makng shoe lasts for more than 100 years. HILDESHEIM S CATHEDRAL TREASURY Bernward s Column Hldeshem Cathedral Museum Hldeshem Cathedral Museum A fascnatng dscusson between the past and the present: the permanent exhbton n the Cathedral Museum spans the ages to brng together tradtonal and contemporary art. Important concepts that are ntertwned throughout the hstory and culture of the cathedral, cty and bshoprc are examned through the most exquste peces. In addton to ecclesastcal artwork from the Mddle Ages through to the present day, an mpressve collecton of contemporary works has been assembled, especally graphc art and bronze sculptures. The centrepece and most valuable collecton of the Hldeshem Cathedral Museum s of course the Cathedral Treasury, whch manly orgnates from the 11th to 13th centures. The oldest pece n the collecton the Relquary of Mary has even been dated to the early 9th century (wth later addtons). The Cathedral s nne-metre-hgh Renassance rood screen s equally mpressve. Its sandstone relef carvngs encapsulate the key tenets of Chrstan fath n lavsh scenes from the Old and New Testaments. The rood screen forms the fascnatng backdrop to the Klang-Raum seres of concerts. Here you can experence 1,200 years of European hstory whch shaped the cty s unmstakeable cultural and poltcal profle. Not far from here s the Ruthe teachng and research estate, spannng around 240 hectares where the Rver Innerste meets the Lene near Sarstedt. The estate provdes an nsght nto dfferent types of modern and sustanable agrculture. GEO600 Beehve stens from Pot country Owng to ts rch hstory n pottery producton, the area between the Lene and Weser rvers also became known as pot country and was one of Germany s centres of stoneware producton. The Dungen Pottery Museum dsplays permanent and specal exhbtons. The ste features a reconstructon of a stoneware kln based on archaeologcal fnds that can be seen by pror agreement. GEO600: Ruthe teachng and research estate: Kultur/Lehr_und_Foschungsgut DUINGEN POTTERY MUSEUM Dungen Pottery Museum, Toepferstraße 8, Dungen, For ten years now, the gallery n Stammelbachspecher n Hldeshem has been showng a vared annual programme of contemporary art. The exhbton features works from regonal, natonal and nternatonal artsts, such as works by Klaus Staeck, Martn Kppenberger, Jonathan Meese, Danel Rchter, Sgmar Polke, Paul McCarthy and Mke Kelley. The Kehrweder tower, whch was once part of the cty s fortfcatons, s home to another collecton of contemporary art belongng to the Kunstveren Hldeshem art assocaton. Art and cultural events also take place at Rasselmana. The assocaton uses a former steel works for exhbtons, concerts and dance performances. The buldng and ts ndustral charm regularly attract vstors and artsts to Hldeshem. An nsder s tp no more, the gallery hostng nternatonal exhbtons n the former bull s stall at Bodenburg Palace s now a popular attracton. Culture n the Glasshouse can be seen n Derneburg s former greenhouse. A vared programme of events, ncludng readngs, exhbtons, concerts and comedy, provdes entertanment n addton to the café facltes. Two establshments enrch what the muncpalty of Nordstemmen has to offer: Kunsthaus Nordstemmen and the Art Factory. 11 for those nterested n culture HOLIDAY MAGAZIN HILDESHEIM 2019 CONTEMPORARY ART IN SCHLOSS DERNEBURG Schloss Derneburg, wth ts pagoda roof, s the dstnctve symbol of Derneburg. In the 12th century the former fortfed castle became the property of Margrave Herman of Wnzenburg and hs brother. It came nto the possesson of the Bshoprc of Hldeshem as a result of expropraton and served as a monastery for varous Chrstan orders for almost seven hundred years. After ts closure at the start of the 19th century, Kng George III of England gfted t to Count Ernst Fredrch Herbert zu Münster. In the md-19th century, hs son Georg Herbert zu Münster commssoned the renowned court archtect from Hanover, Georg Fredrch Ludwg Laves, to redesgn the former monastery as a stately home. Laves desgns also ncluded an extensve Englsh-style landscaped garden. In 1950, the Münsters sold the majorty of the estate to the State of Lower Saxony. Twenty-four years later, the artst Georg Baseltz purchased the stately home and used t as hs home and studo for 32 years. In 2006, he sold t to the Amercan art collector Andrew Hall. Hall transformed the palace nto a prvate museum. The left wng contans the famous tled room of 1752, whose walls are completely covered wth 680 emblem tles (n Italan, French and Latn) from the former baronal faence pottery factory n Wrsbergholzen. The palace s orangery s one of the few completely preserved, md-19th century orangeres n the whole of Lower Saxony. Wrsbergholzen Palace: PLACES AND CASTLES IN HOLLE There are several palaces and castles to explore n the Holle muncpalty: One of the most well-known palaces s Schloss Derneburg (page 11). Bad Salzdetfurth Kurpark PICTURE-PERFECT PARKS AND GARDENS Cty walls of Hldeshem IDYLLIC FORESTS AND RIVERS There are many enchantng and dyllc parkland estates to dscover throughout the Hldeshem regon. Walshausen Park, near Bad Salzdetfurth, s home to mghty beeches, chestnuts, oaks and lmes, as well as dyllc ponds. It s open to vstors from 10 a.m. to 6 p.m. on Frdays between 1 May and 31 October. You can let your sprts soar as you take a relaxng walk through the fve-hectare Kurpark (Spa gardens) n Bad Salzdetfurth, and enjoy the health benefts at the same tme. The 250-year-old nhalatora fll the ar wth salt, just lke beng at the seasde (pages 28-29). One of the oldest monastery gardens n Lower Saxony can be found n Hldeshem. The Magdalena Gardens were created n 1224 and are surrounded by hstorc ramparts and dtches. Dekholzen s also an dyllc spot. The two arms of the Beuster, a trbutary of the Rver Innerste, jon here formng a stream. A footpath along the Beuster, dotted wth benches, runs through the vllage for qute a stretch. There are also extensve forested areas rght outsde Hldeshem, connectng the surroundng vllages and towns. Two rvers and a canal wend ther way through the Hldeshem regon: the Lene, the Innerste and the branch canal connectng the harbour n Hldeshem wth the Mttelland canal. The waterways are popular wth walkers, cyclsts and joggers. The Rver Innerste passes through Hldeshem and encounters two nature reserves just beyond the cty: a long walk upstream through the Am roten Stene nature reserve, to the courtyard café at the Marenburg estate, s very appealng. Part of the lake s used for bathng n summer. Palm trees, umbrellas and loungers on the sand at the JoBeach really gve you that holday feelng. Cool drnks are avalable from the beach bar and for sportng fun on dry land, try the volleyball court. LOOKOUTS WITH A VIEW The tower on the Tosmar s located n the Dekholzen vllage of Söhre. There s a fantastc vew from here. A popular vewng pont on the Galgenberg n Hldeshem s the Gelbe Turm, or Yellow Tower, complete wth observatory. The bggest reflectng telescope n the south of Lower Saxony provdes a fascnatng nsght nto the starry skes. The Galgenberg n Hldeshem s also home to the Bsmarck tower. Seventy seven steps lead up to the 20-metre-hgh outdoor vewng platform, from whch there s a superb vew of the cty and the surroundng forests. At metres tall, the steeple of St Andrew s Church, the hghest church steeple n Lower Saxony soars hgh above the roofs of the cty. Three hundred and sxty-four steps lead ft vstors to the vewng platform at a heght of 75 metres. The effort of the clmb s rewarded by a fabulous vew across the whole cty and surroundng countrysde. WATER SPORTS ON/IN THE LAKES AND WATERWAYS Paddle boardng on Lake Hohnsen n Hldeshem Paddle boardng s paddlng whle standng up on a board. Ths popular sport benefts the whole body as the board always wobbles slghtly. But don t worry, once you ve taken the frst few strokes wth the paddle, you wll soon fnd your balance. Paddleboards can be hred on Lake Hohnsen n Hldeshem. Canoes are also avalable for hre. If you want to cover greater dstances by canoe, try the courses of the Innerste and Lene rvers. Varous companes hre out canoes and offer guded tours, wth or wthout a pcnc. The 13-klometre stretch of the Innerste between Alfeld and Gronau s a famly-frendly tour for begnners. Dependng on how fast you paddle, the tour takes four to Canoe tour on the Innerste rver fve hours. Experenced canoests can also use the whte water rapds on the Bschofsmühle n Hldeshem. The man-made channel, close to the cty centre, can be adapted to canoests abltes and s sutable for both novce paddlers and for demandng tranng sessons. Spectators can enjoy watchng the German Canoeng Assocaton s annual rankng compettons. Beyond Hldeshem, the lakes n the Sarstedter-Gftener See recreaton area, are perfect for surfers and salors. Crazy golf n Bad Salzdetfurth Crazy golf s a varaton on mn golf, played on artfcal grass courses. UNESCO World Hertage Ste Fagus Factory The Lene-Hede Bcycle Path covers 410 klometres from Echsfeld to Hamburg, 55 of whch run through the Hldeshem regon. From here cyclsts enjoy fantastc vews of the Lene Valley or can vst pcturesque half-tmbered towns and numerous attractons along the way, such as the UNESCO World Hertage Ste Fagus Factory n Alfeld. There are also shelters and rest stops along the way. The Innerste Bcycle Path, on the other hand, has a strong focus on the varety of scenery. Along 105 klometres from ts source n the Upper Harz Mountans to where t jons the Lene, cyclsts experence a cross-secton of scenery, from the Central Uplands, va the foothlls, to the flat rver plans. As the name suggests there are numerous cultural beacons and monuments to vst along the way. The 800 klometres of the Cultural Route lnk the far reaches of Hanover s hnterland. It partly uses exstng long-dstance cycle paths, such as the Weser Bcycle Path, the Aller Bcycle Path and the Lene-Hede Bcycle Path. Cyclsts can cycle the whole Cultural Route n 15 day stages of 40 to 50 klometres each. Four stages run through the Hldeshem regon. THEMED CIRCULAR TRAILS IN THE REGION Henneckenrode Fve sgned hkng trals wth the Hödeken, or hobgobln, emblem cover 100 klometres through the Seben Berge, the Harz foothlls and Sack Forest. The Hödeken s a mythcal creature from the Lene Uplands. Named after hs felt hat ( Hüdekn or Hütchen n German), whch he nvarably wears, the Hödeken once carred messages between Hldeshem and Wnzenburg. A belt of forest walks takes you from Ottbergen, va Wendhausen, to Wöhle. The 22-klometre Convent Hkng Tral follows the border between the former Kngdom of Hanover and the Duchy of Brunswck, from Lamsprnge Abbey to Bad Gandershem and the Brunshausen Convent. The 85-klometre- long Va Rega s the hstorc lnk between the seats of Medeval German kngs and emperors n the northern Harz foothlls. It takes hkers from the royal court n Brüggen, through the Seben Berge and the Sack Forest, va the Palace of Köngsdahlum, to the Palace of Werla. Behnd the Hldeshem Forest, the Rennsteg Tral partly runs along the Va Rega through the Seben Berge and partly through the Sack Forest to Wnzenburg. The Rennsteg s a 48-klometre-long, hstorc courer route. It starts n the courtyard of Hldeshem Cathedral. Ith-Hls hkng tral Hkers on the Ith-Hls hkng tral wll dscover romantc castles, hstorcal cultural stes, half-tmbered towns, look-out rocks, lakes and mysterous aves. You can hke the whole Ith-Hls Tral n seven ndvdual stages. The 80 klometres whch run through the south of the Hldeshem regon cross rdge trals to spectacular clffs and natural hstorcal features, wth far-reachng vews over the countrysde. The Ith-Hls Tral has been gven the Wanderbares Deutschland (Hkeable Germany) award and thus recognsed as a qualty tral. PILGRIMS ON TRAILS Snneswald Forest Adventure Path Forest adventure paths The Fchtelwald (Spruce Path), on the Kapellenberg n Ottbergen s an adventure tral for adults and chldren, dotted wth all knds of skll and nature-knowledge-based actvtes. Experence the forest wth all your senses on the Snneswald Forest Adventure Path, on the Schlehberg n Alfeld. Desgned to appeal to all ages, the Snneswald s a sensory forest contanng boxes, hearng tubes, wnd chmes, tree telephones and much more. Brunswck s Way of St James s a revtalsed hstorc plgrm s tral whch once ran along the famous Hellweg man road from east to west. The tral crosses the Hldeshem regon n two sectons (full sgnpostng planned for ths year). Between Brunswck (Braunschweg) and Hldeshem, t runs through the muncpaltes of Söhlde and Schellerten, and between Hldeshem and Höxter through Dekholzen, Sbbesse and Alfeld. FOLLOW THE ROSES THROUGH HISTORY Kehrweder tower Hldeshem Market Square Rose Route Vstors can trace the cty s 1,200 year-long hstory on the Rose Route, whch s marked by lttle pavng stones mprnted wth a rose. The tral runs from the hstorc Market Square, past churches and hstorc buldngs, nto the half-tmbered dstrct and to the UNESCO World Hertage Churches. Every year hundreds of thousands of toursts admre the hstorc Market Square. Ths s due to the dedcaton of the ctzens of Hldeshem. Thanks to ther fnancal support, the old half-tmbered buldngs n the heart of the cty were fathfully reconstructed. Partcular attenton was pad to the famous Butchers Guld Hall on the Market Square and the adjonng Bakers Guld Hall, both reconstructed accordng to the orgnal plans. The Tempelhaus, whose archtecture shows sgns of orental nfluences, s also eye-catchng. The World Hertage Vstor Centre Hldeshem (page 2) s located n ths former arstocrat s house. The ornate façades of the Rolandstft and Wedekndhaus, and the Stadtschänke, the Rococohaus and the Wool Weaver s Guldhall opposte, conceal modern buldngs. The buldng s name s no less strange than ts appearance: the half-tmbered buldng on St Andrew s Square, whch juts out over the street, bore the same name 500 years ago. A stroll through the past the narrow alleys, lush roses and lovngly restored half-tmbered buldngs s a wonderful way to spend some tme. Fnally, the rose stones lead you along the old cty walls and through romantc streets lned wth half-tmbered buldngs, to the UNESCO World Hertage Churches, St Mary s Cathedral and St Mchael s Church (page 6). All vstors to Hldeshem should defntely take some tme to wander through the half-tmbered dstrct between Brühl and Keßlerstraße. Bad Salzdetfurth features well-mantaned 17th and 18th century half-tmbered buldngs along the Rver Lamme (pages 28 and 29). The hstorc half-tmbered town of Elze has also been of great mportance to the development of the Hldeshem regon t was here that the Carolngans founded the msson from whch the Bshoprc of Hldeshem developed n 815. Tran rdes on the hstorc state ralway: The 1928 hstorc state ralway tran runs through the Hldeshem regon. On selected dates, the tran travels between the Derneburg, Bockenem and Bornum statons. The tmetable can be found at Half-tmbered buldngs n Hldeshem Machtsum Post Mll 427 mll stes n 29 dstrcts In addton to the watermlls n Alfeld, Lamsprnge, Sarstedt, Sehlem and Wrsbergholzen, the wndmlls n Asel, Wallenstedt and Machtsum also form part of the Lower Saxony Mll Route. The mlls n the muncpalty of Söhlde, the former mll captal of Europe, are of partcular mportance. Fourteen proud examples stll stand here today, two of whch now form part of the Mlls Route: the Museum Mll of 1880, whch s also the Regstry Offce, and the former Behrens Lme Mll of 1862, the last Dutch qucklme wndmll n Germany whose nternal workngs have been preserved. Guded tours are possble by arrangement on German Mll Day (Wht Monday). Nettlngen s also home to ts own mll, a 400-year-old watermll. In addton to an engne-drven mll wheel, t stll has the orgnal, water-drven works. Two addtonal mlls have survved to ths day n Nordstemmen: the Old Mll, a former corn mll, and an hstorc wndmll. 3,500 klometres and over 100 half-tmbered towns The German Half-Tmbered Houses Route stretches from the Rver Elbe n the north, va Upper Lusata all the way to Lake Constance, wth one secton runnng through the Hldeshem regon. The 700-year-old half-tmbered town of Alfeld was one of the smallest members n the Hanseatc League. Alfeld joned the Saxon League of Towns n In the 14th and 15th centures, the cty became wealthy through tradng n beer, hops, lnen and lnen thread. The half-tmbered town of Bockenem m Ambergau s also a Hanseatc town. The seemngly harmonous group of half-tmbered buldngs emerged after a dsastrous fre n The best half-tmbered buldng n the town, the Tllyhaus, was spared. CAMPING AND CARAVANNING The Bergmühle camp ste s located between the Innerste rver, the forest and the felds. Parents can relax n the shadow of an old watermll whlst the chldren let off steam n the playground or splash around n the water. Derneburg lake camp ste, close to the A7 motorway, s perfect for takng a break on your journey. 46 HOLIDAY MAGAZIN HILDESHEIM 2019 general terms of agency GENERAL TERMS OF AGENCY These General Terms and Condtons apply for contracts concluded between the customer and the Hldeshemer Marketng Gesellschaft mbh, represented by tourst-nformaton Hldeshem (TI), as agents for travel servces such as accommodaton and cty tours. 1 Concluson of contract (1) The booker/user (customer) sends a bndng order for the concluson of an agency contract to us for the desred servces (events) usng electronc bookng/commssonng va the TO- MAS nformaton and reservaton system. At the same tme, ths entals the bndng order of the customer to the contract partner of the contract arranged by us (organser) for the concluson of the agency contract; nsofar we are authorsed by the organser to accept declaratons and conclude contracts on hs behalf. (2) If the order s not sent electroncally va the TOMAS portal, ths consttutes a non bndng nqury. The customer s order s then made on the bass of documents sent to hm by us. (3) Concludng a contract does not requre any specfc form. The declaratons can be made n wrtten, verbally, by telephone, by fax, by e-mal or usng any other electronc means. For orders that are submtted to us electroncally, we wll acknowledge the recept of the order mmedately; ths acknowledgement, however, does not consttute a confrmaton of the agency contract. (4) The agency contract s not offcally concluded untl we ssue our confrmaton. (5) There s no travel contract n the sense of the Travel Contract Act between the customer and us. We act only as the agent to close the contract between the customer and the organser. The mutual rghts and oblgatons of the contract concluded apply exclusvely to the customer and the organser. The agency contract concluded wth the bookng apples to that bookng only. As a result, t s not possble to combne dfferent travel servces. An ndependent, separate agency contract must be concluded n each case. The agency contracts concluded are also separate from one another. The rghts and oblgatons ensung reman unaffected by one another. 2 Regstraton lablty If the customer regsters other persons other than hm/herself for the event, he/she s responsble for the contractual oblgatons of all the persons regstered nsofar as he/she has made a separate declaraton as such at the tme of regstraton. 3 Contractual oblgatons of the agency agreement (1) Our contractual oblgatons depend on the contract concluded wth the customer as an agency contract takng nto account these General Terms and Condtons and consst of carryng out the actons necessary to perform the agency contract, the correspondng advsng and the provson of the necessary travel documents, nsofar as these are not provded by the organser drectly to the customer. (2) Insofar as we provde the customers wth advce, we are lable only wthn the scope of the law and the contractual agreements between the customer and us for the correct selecton of the nformaton source and the correct communcaton to the customer. The same apples for the provson of nformaton. An nformaton contract above and beyond ths wth a contractual prmary oblgaton for provson of nformaton comes about exclusvely as a result of an express agreement between the customer and us. 4 Supplementary provsons for the provson of accommodaton (1) General terms and condtons 1. The prce charged for the travel arrangements s to be pad drectly to the organser. 2. The mutual rghts and oblgatons of the contract concluded between the customer and the organser also apply here only accordng to the agency contract provded by us. The General Terms and Condtons of the organzer apply nsofar as these have been ncluded n the contract. 3. The other provsons ncluded n ths secton apply only for the provson of rooms of the commercal and prvate organsers that are connected to our bookng system and for the accommodaton that s booked usng ths system. The organsers lsted on the TOMAS portal are all connected to the bookng system. We act as agents for the accommodaton of these organsers only. These supplementary provsons do not apply to any other agency actvtes. 4. The General Terms and Condtons of the organser apply nsofar as effectve n the contract and the followng supplementary provsons only n addton. (2) Arrval tme, no-show 5. The organser concerned s only oblged to hold the reservaton for the accommodaton booked untl 6 pm on the day of arrval, nsofar as no other arrval tme has been arranged between the customer and the organser. In the event of a no-show, the organser s enttled to gve the accommodaton booked to a thrd party; n ths case, the customer loses hs/her clam to the accommodaton. Ths does not apply f the customer has ndcated a later arrval at the tme the order was placed or f the order s placed on the same day as the day of arrval. 6. If the accommodaton booked s not assumed by a thrd party, the organser s enttled to clam a flat rate of up to 80% of the arranged travel prce. The flat rate depends on the type of accommodaton booked and the addtonal servces requested. 7. The flat rate charged depends on the clam of the organser towards the guest wth the deducton of hs regularly saved expenses. The customer s enttled n any case to brng evdence to reduce ths clam. (3) Wthdrawal (cancellaton), rebookng 8. The customer can wthdraw from the contract (cancellaton) wth the organser at any tme. 9. The cancellaton s free of charge for the customer up to 30 day before the begnnng of the trp. After that, the organser s enttled to calculate the charges for the no-show. 10. Requests for rebookng or cancellatons can be forwarded to us n wrtng. If t s possble for us to accommodate the wshes of the customer, he/she wll receve a separate confrmaton. Otherwse, the customer wll be nformed that the request was rejected. For rebookng or cancellaton, we wll charge a fee of 5.00 for each contract arranged and affected by the rebookng. Insofar as the orgnal contract has to be cancelled partally or n full by a rebookng, the organser s enttled to charge the damages flat rate for cancellaton or no-show. Ths wll be charged n addton to the rebookng fee. 46

47 general terms of agency HOLIDAY MAGAZIN HILDESHEIM Supplementary provsons for the provson of events that are provded n the form of guded tours (1) Guded tours depend on a mnmum number of partcpants. We take ths nto consderaton n our role as agents. Here, we act merely as the agent for the contract to be concluded between the tour gude as the organser and the customer for the tour n queston. Ths contract can only be concluded when the mnmum number of partcpants has been reached. Herenafter, these wll be referred to as closed guded tours. (2) Excepted from ths are the regular cty tours offered by Hldeshemer Stadtführer Glde e.v., whch are mentoned separately n the agency agreement or n the descrpton of the servces provded. In ths case, we are also only the agents. The contract for the guded tour concerned s then completed between the customer and the Glde, whch has ts members conduct these guded tours. Herenafter, these wll be referred to as open tours. (3) Non-attendance, wthdrawal (cancellaton) 11. The customer can wthdraw from (cancel) tours wth the tour gude or us at any tme. Closed tours can only be cancelled up to one day before the begnnng of the event free of charge. Thereafter or f the customer s a no-show, the customer s oblged to pay the prce of the guded tour n full. Any fees pad to us n advance (e.g. admsson fees) or for fees pad to us for the organser wll be rembursed to the customer f sad servces were cancelled n tme. 12. The fee to be pad to the tour gude for these servces becomes due wth the concluson of the agency contract. Any admsson fees unless otherwse expressly arranged as an excepton are to be pad by the customer on locaton and are not ncluded n the event prce. 13. We are authorzed to accept fees arranged wth the customer from the customer n the name of and for the account of the tour gudes we represent or the Glde. The customer receves a wrtten recept as proof of payment to the tour gude. The tour gude s enttled to provde servces only upon producton of the recept by the customer. 14. The tour gude engaged s not oblged to conduct the guded tour, even for closed guded tours, personally. He/she s at lberty to desgnate a substtute, even wthout pror notce. All the tour gudes used by our agency have to fulfl our qualty requrements. The tour gude s oblged to desgnate only the persons accepted by our agency as a substtute. 6 Complants (1) Any complants or other clams resultng from the contracts for whch we acted as agents are to be made drectly to the contract partner of the agency contract. A notce made to us wll not suffce to honour any deadlnes, nor are we authorzed to accept such notces for the organser nor are we oblged to forward such documents to the organser. On the bass of the agency contract closed wth the customer, we are only oblged to supply the customer wth all the nformaton and documents that are mportant to hm/her to assert the clam or complant (2) We are also not oblged to advse the customer on hs/her clams aganst the organzer or to notfy hm/her of any deadlnes that have to be observed. 7 Lablty, lmtaton of lablty (1) We are not lable for any clams that result from the agency contracts we provde. Ths also apples to the any defcences n the servces provded and any njury or property damages that the customer has occurred n connecton wth the event provded, nsofar as we have not expressly declared our lablty. (2) Ths does not affect a lablty resultng from the agency contract concluded between the customer and us. For damages due to slght neglgence by us or one of our legal representatves or vcarous agents, these damages wll be lmted to foreseeable damages typcal for contracts and three tmes the sum of the event prce. For damages that are not the result of the volaton of major contract oblgatons, the lablty s lmted to ntent and gross neglgence. Lablty resultng from the agency contract for personal njury remans unaffected. 8 Statute of lmtatons / deadlnes (1) Any customer clams resultant from the agency contract concluded wth us are to be ndcated wthn one month (deadlne). The deadlne begns wth the customer s knowledge of the reason for such a clam, but at the earlest wth the end of the agency contract term of the agency contract. (2) Ths does not apply f the customer s not at fault for mssng the deadlne. (3) Any such clams made aganst the organser do not serve to keep the deadlne. (4) All customer clams aganst us fall under the statute of lmtatons of one year (shortened statutory lmtaton). Exceptons to ths are clams n tort. 9 Data prvacy (1) Ths data s also passed on to our contract partners, such as accommodaton provders and cty gudes, so that we can render the servces we advertse, such as overnght stays and cty tours. (2) Personal data (data that can be used to establsh the dentty of the customer, e.g. name, address, date of brth, telephone number, e-mal or IP address) s only passed on f t s related to the bookng and s necessary to ensure the smooth processng and payment of the bookng. (3) Data provded by the customer s only ever recorded and processed n accordance wth General Data Protecton Regulaton (EUDATAP). Customers can ask for a copy of the nformaton held n relaton to them free of charge, and, f requred, exercse ther rght to assert ts rght to rectfcaton, erasure, blockng, complant, transferablty, as well as objectons and nformaton about the duraton of the storage of the data. If a deleton s requested, t must be noted that ths may conflct wth legal regulatons or bllng / accountng purposes. The request should be sent to nfo@hldeshem-marketng.de. A complant can be made to the competent data protecton authorty of the state of Lower Saxony. (4) Personal data (especally address nformaton) wll never be passed on to thrd partes under any crcumstances. 10 Place of performance, applcable law, legal venue (1) German law apples exclusvely to all legal relatons between the customer and us. (2) For all dsputes resultant from the legal relatons between the customer and us, nsofar as the customer s a busness person, a legal person accordng to prvate or publc law or persons who have ther place of resdence or usual place of resdence abroad or whose place of resdence or usual place of resdence s unknown at the tme of the commencement of a sut, Hldeshem s the exclusve legal venue or, f applcable, the court responsble for the cty of Hldeshem. In other cases, the legal venue wll be determned accordng to the legal regulatons. 11 Severablty Clause Should any ndvdual provsons of these General Terms and Condtons be or become nvald n full or n part, ths does not affect the valdty of the remanng provsons. Insofar as a provson has not become part of the contract or s nvald, the legal condtons apply. 47
