3 Purpse f the Three Mile Plan The purpse f the Twn f Frisc s Three Mile Plan is t fulfill a Clrad State requirement. Sectin (e) f the Clrad Revised Statutes states, Prir t cmpletin f any annexatin within the three-mile area, the municipality shall have in place a plan fr that area that generally describes the prpsed lcatin, character, and extent f streets, subways, bridges, waterways, waterfrnts, parkways, playgrunds, squares, parks, aviatin fields, ther public ways, grunds, pen spaces, public utilities, and terminals fr water, light, sanitatin, transprtatin, and pwer t be prvided by the municipality and the prpsed land uses fr the area. As such, this plan is t address land uses and infrastructure imprvement needs if annexatin were t ccur in any f the areas within three miles f the Twn f Frisc s municipal bundaries. This plan prvides infrmatin and analysis fr areas within Frisc s three mile bundary. It als utlines annexatin plicies, prcedures, and requirements. This Three Mile Plan area is a state requirement and shuld nt be cnsidered an intentin f the Twn f Frisc t pursue annexatin f these areas. The 2009 Three Mile plan is intended t cmplement ther Twn plans, including the 2005 Twn f Frisc Master Plan, the 2007 Peninsula Recreatin Area Land Use Plan, etc.) which have been prepared by the citizens and adpted by the Twn Cuncil f Frisc. It is als cnsistent with the Summit Cunty 2009 Ten Mile Basin s Master Plan in its analysis f affrdable husing. Annexatin Cnsideratins Chapter 6 f the Twn f Frisc Twn Cde sets ut plicies and requirements with respect t ptentially annexing lands. The plicies and requirements are as fllws: A. Annex eligible lands fr psitive reasns equitable t the Twn f Frisc, and nt as a matter f right t a petitiner r petitiners. B. Annex eligible lands, where deemed apprpriate, as a means f preserving pen space, encuraging rderly grwth and f prviding additinal living areas and areas fr services fr the Twn. C. Annex nly lands which can be adequately prvided with the necessary municipal services frm the capacity f existing systems, unless expansin f thse systems is planned, and sufficient financing fr the expanded capacity is available. D. Prvide quality municipal services fr the use and benefit f inhabitants f the twn, including inhabitants f 3

4 areas annexed; extend any municipal service utside the twn nly after cnsideratin f the quality f existing service and the existing and prjected demand within the twn, including areas cmmitted t annexatin; and refuse t extend any municipal service utside the twn if the extensin will unreasnably decrease the quality r availability f the service within the twn r therwise adversely affect the rderly grwth and develpment f the twn. E. Annex areas that will maintain the twn bundaries in as regular a shape as pssible fr the efficient prvisin f service and fr effective administratin. F. Annex areas as recmmended in the Frisc Three Mile Plan. G. Annex areas and enter int annexatin agreements that are cnsistent with the Twn Cuncil gals as established frm time t time, and the gals and plicies f the Frisc Master Plan. H. Cnsider in any annexatin where develpment is prpsed, the timing f develpment s as t crdinate with prjected availability f municipal services and facilities. I. Require, as a cnditin f annexatin, the dedicatin f lands fr public purpses within the land area f the territry being annexed. The lcatin f the lands t be dedicated shall be designated by the twn after cnferring with any ther public agency which might have an interest in such sites. If the twn determines that there is n requirement fr land fr a public purpse within the area being annexed, then the twn may require the annexee t pay t the twn a sum f mney in lieu theref. In additin t the plicy and standards set frth in this chapter, any ptential annexatin must cmply with related state and lcal develpment laws including the fllwing: A. Streets. Any existing streets n the parcel t be annexed r any prpsed new streets shall be imprved s that they meet the minimum standards fr the design and cnstructin f street imprvements set frth in the Frisc Twn Cde Chapter 155. The petitiner(s) is respnsible fr cnstructing street imprvements required by the Twn. If the Twn determines that a cmprehensive traffic study is necessary, such study will be perfrmed by a traffic engineer, at the applicant s expense. B. Zning. All annexatin petitins shall be accmpanied by a written zning request in cmpliance with Frisc Twn Cde B, which shall fully explain the uses and intensities f uses prpsed fr the land included in the annexatin petitin. Any request fr zning shall cmply with the Twn's Master Plan gals and implementatin measures and existing rdinances and regulatins. 4

5 Organizatin f the Three Mile Plan The Three Mile Plan utlines the lcatin, character, and existing cnditins f each land area within three miles f Frisc s bundary. The Clrad State Statute als requires that public facilities and utilities such as streets, bridges, waterways, parkways, playgrunds, and terminals fr transprtatin be nted and generally described. The Three Mile distance standard is a requirement f the Clrad State Statute; it is nt an indicatin f Frisc s jurisdictin, but simply an area f influence. Accrding t Frisc s Twn Cde, Chapter 6 Annexatin, Sectin 6-7(3), specific characteristics f each area need t be cnsidered. Such cnsideratins include, but are nt limited t the fllwing: Gelgical hazards Fldplain hazards Mineral resurces Wildlife resurces (flra and Fauna) Histric and archelgical resurces Wetlands Shrt and lng term csts and benefits Utility Services Traffic Studies The abve mentined cnsideratins are addressed under larger subject headings. Sme f the State s requirements are nt applicable t the Frisc area and are nt addressed. If ne f the elements is nt mentined under a subject heading fr a particular area, it is nt applicable. It is imprtant t nte that althugh this plan des highlight annexatin cnsideratins fr areas within three miles f twn limits; frmal annexatin prpsals submitted must meet all f the Twn s annexatin requirements in rder t be cnsidered. (See Annexatin cnsideratins earlier in this reprt alng with Appendix A fr annexatin requirements). Whenever applicable, this plan references ther jurisdictins planning dcuments and identifies stakehlders and agencies that have knwledge f each area. These stakehlders and agencies include Frisc residents, neighbring twns, Summit Cunty Planning & GIS departments, the US Frest Service, Denver Water, Frisc Sanitatin District, the Summit Stage, Frisc Water Department, Frisc Public Wrks, the Lake Dilln Fire Prtectin District, and the Summit Schl District. This dcument is meant t be a supplement t ther twn dcuments and plans, and it is recmmended that these be cnsulted when making decisins regarding annexatin. 3 mile plan 5 5

Thse requirements and cnsideratins include: Rads wuld need t cme int cmpliance with the Twn f Frisc s minimum street design criteria (this culd include, but is nt limited t, rad widening and paving). Utility infrastructure imprvements including water and sewer system upgrades t meet increased demands. Additinal water rights need t be secured by the annexatin petitiner. Additinal Public Wrks Department, Water Department, and Plice Department staff, manpwer, and equipment t maintain quality service levels thrughut Frisc. Additinal real estate investment fees fr the twn 1 % f ttal sales. Ability f newly annexed citizens t vte in Frisc electins and run fr elected psitins. 6

7 Bill s Ranch Area Descriptin Bill s Ranch is lcated suth and east f the Twn f Frisc s municipal bundary. The area is apprximately 91 acres and 119 lts. Summit Cunty has zned Bill s Ranch R-2; which is a lw density residential designatin allwing n mre than 2 dwelling units per acre. This area is wded and has wetlands, pen space easements, undevelped land, and streams interspersed thrughut. There is an eclectic mix f cabin and mdern muntain style husing scattered thrughut Bill s Ranch. 1 Land Use Lw density residential is the current land use fr Bill s Ranch. Accrding t Summit Cunty s mst recent build ut study, Bill s Ranch has 98 units built, 25 vacant lts, and 37 subdivided lts. Accrding t the Cunty, there are als several pen space prperties and easements wned and managed by Summit cunty within the Bill s Ranch neighbrhd. The public space cnsists f stream crridrs, wetlands, and undevelped land and these envirnmental cnditins place restrictins n the develpment f sme f the lts in Bill s Ranch. Transprtatin One can access Bill s Ranch via Highway 9, Miners Creek Rad, Seventh Avenue and Pitkin Street in the Twn f Frisc, and the Summit Cunty Recreatinal/Bike path. The rads as they exist in Bill s Ranch d nt meet Summit Cunty rad standards fr lcal access rads. The rads are maintained by Bill s Ranch Hme Owner s Assciatin and there are n Cunty plans t upgrade the rads mile plan 7

8 The Twn f Frisc wuld require Bill s Ranch streets t meet the Twn s minimum street design standards and criteria prir t annexatin. Frisc Public wrks has stated that this wuld be prblematic due t the fact the existing streets are much less than the 60 feet minimum required. There are tw Summit Stage stps within walking distance f Bill s Ranch: at the Cunty Cmmns building and at Ophir Muntain/Senir Center. Utilities Bill s Ranch is served by gas, electric, telephne, and cable. The Frisc Sanitatin District (FSD) serves Bill s Ranch and sewer mains have been extended thrugh the entirety f Bill s Ranch. Sme prperties are cnnected and sme are nt. The area is served by private/and r shared cmmunity water wells and there are n Twn f Frisc water mains in the area. Any additinal prperties added t the Frisc Water service area are required t btain and turn ver t the Twn additinal water rights t cver the additinal cnsumptin that they incur t the system. Cmmunity Services Bill s Ranch is served by the Lake Dilln Fire District. There are fire prtectins and safety cncerns in Bill s Ranch because f limited r n fire prtectin water supply systems in place and the narrw width f the access rads in Bill s Ranch. 5 Plice prtectin is prvided by the Summit Cunty Sherriff s ffice and the Frisc Plice Department. The Twn f Frisc Plice depart- 6 ment wuld have full jurisdictin in the event f an annexatin. Annexatin f Bill s Ranch wuld add significantly t the Plice Department s service area. Children in Bill s Ranch attend Summit Schl District schls. Annexatin wuld nt affect that status. 7 Open Space, Parks and Recreatin The Bill s Ranch Sub Basin Plan states that there are several high quality wetlands thrughut the Bill s Ranch area. The Summit Cunty RecPath ges thrugh the suthern prtin f Bill s Ranch with a building setback f 25 feet alng this pathway. Adequate access and directinal signage t varius recreatinal trail access pints is articulated as a gal in the Bill s Ranch Sub Basin Plan. As stated previusly, there are several pen space prperties and easements wned and managed by the Cunty within the neighbrhd

9 Cunty Cmmns Area Descriptin The Cunty Cmmns area is lcated east f Bill s Ranch and suth f Highway 9. The Summit Recreatinal/Bike Trail brders the area t the suth. Summit Cunty wns the area which is apprximately 118 acres in size. The area is designated as a Planned Unit Develpment (PUD) which establishes uses, develpment plans and phases fr the area. The Fiester Open Space Easement is lcated between Bills Ranch and Cunty Cmmns. The six acre preserve was dnated as an easement t the Cntinental Divide Land Trust in 1998 by Summit Cunty and is named in hnr f Mark and Rberta Fiester. It is an undevelped buffer 2 pen t the public with walking trails. Land Use There are several buildings n site that cntain gvernment ffices and services including, but nt limited t: the Summit Cunty Library, Summit Cunty Animal Cntrl, Cunty Rad and Bridge, Summit Cunty Cmmunity Develpment Department, the Summit Cunty Cmmunity and Senir Center, and Emergency Services/Ambulance. In additin, Orphir Muntain Village, a 28 unit residential affrdable husing subdivisin is lcated in this area. Saint Anthny s Summit Medical Center, a 95,000 square ft facility pened in 2005 n a prtin this site

10 Transprtatin Peak One Bulevard/Cunty Rad 1004 leading int the Cunty Cmmns is signalized and paved. The Summit Cunty Rad and Bridge Department currently prvides rad maintenance. The Summit Cunty RecPath traverses the parcel east west. 5 Tw Summit Stage stps are lcated n Cunty Rad 1004, ne at the Cunty Cmmns building and the ther at Orphir Muntain/Senir Center. There als is a Summit Stage stp lcated at the Saint Anthny s Hspital cmplex. Utilities The Cunty Cmmns is served with electric, gas, Frisc Water, and the Frisc Sanitatin District sewer. 7 Frisc Sanitatin has indicated that the sewer cllectin system t the Cunty Cmmns, the medical ffice building, and the hspital is capacity limited. The Hspital and Medical ffice building have used 70% f the taps alltted fr this area. Any additinal taps beynd the amunt alltted will require an upgrade t the cllec6 tin system. Cmmunity Services Fire prtectin fr the Cunty Cmmns is prvided by the Lake Dilln Fire District. Plice prtectin is prvided by the Summit Cunty Sheriff s department. Due t the clse prximity t the Frisc Plice statin (1.5 miles) and gd rad access int the site, plice prtectin by the Twn wuld nt be difficult. It wuld add t the Frisc Plice department s service area. 8 Children residing at the Ophir Muntain Village attend schl in the Summit Schl district. If the area were annexed and develped with additinal residential uses, attentin shuld be given t the ptential impact n the schl district. 9 Open Space, Parks and Recreatin The Frisc Peninsula Recreatin Area, lcated acrss Highway 9, serves as a neighbrhd park (with ball fields, a Frisbee glf curse, skate park, and sledding hill, etc.) Miner s Creek Trailhead is lcated within the vicinity. Several US Frest Service trails are accessed via this trailhead. In additin the Summit Cunty RecPath is cnnected t the Cunty Cmmn. 10

11 Dilln Dam Rad Area Area Descriptin 1 The Dilln Dam Rad area is lcated nrth f Frisc alng Lake Dilln reservir and the Dam rad. The US Frest Service and Denver Water manage lands within this area. The site is hilly east f the Dam Rad and becmes steeper n the west side. The Twn f Frisc abuts the suthern prtin f the area and the Twn f Dilln is lcated t the nrth f the area. Land Use The area cnsists f day use activities at the USFS Gibersn Bay Day Use Facility: fishing access, picnicking, scenic viewing, hiking, and public tilets. At the USFS Heatn Bay campgrund there are 72 campsites. These 2 amenities include a picnic area, fishing access, scenic viewing, hiking, and public tilets. The Dam Rad area als includes a trailhead and parking area, and trail t the Old Dilln Reservir. The Lake Hill Cmmunicatins cmpany has a cmmunicatin facility near the Old Dilln Reservir and Frisc has a water tank near the Dilln reservir. 3 mile plan 11 11

12 This area serves as an imprtant recreatinal and buffer area, as well as an imprtant aesthetic resurce fr Frisc and Summit Cunty. It is zned NR-2, Natural Resurces and A-1, Agricultural, by Summit Cunty. 3 The Ten Mile Basin Master Plan has identified a prtin f this area as a ptential site fr affrdable wrkfrce husing. The Ten Mile Basin Master Plan als states that any new develpment n this site wuld need t be cnducted in an envirnmentally sensitive manner, be cmpatible with adjacent uses, and wuld need t maintain access t area trails. It recmmends that any affrdable wrkfrce husing ccurring in this area be encuraged t incrprate a transitin/buffer area between develpment and recreatinal uses t mitigate visual impacts Transprtatin The Dilln Dam Rad serves as the radway access thrugh the area. The Dam rad is an imprtant primary rute fr travel within the COunty and serves as a key alternativerute when I-70 is clsed. A series f lped 5 rads ff the Dam Rad prvide access int Heatn Bay campgrund and t the Gibersn Bay fishing access parking. The Summit Cunty RecPath runs parallel t the Dilln Dam Rad thrugh this area. This area is nt served by the Summit Stage public transprtatin system. 7 8 Utilities The Dam Rad is maintained by Frisc Public Wrks t twn limits just past the entryway int Lake Frest Subdivisin. Thereafter it is maintained by Summit Cunty gvernment. A twelve inch water main runs alng the Dam Rad t the Twn s water tank site east f Lake Frest subdivisin. Additinal water rights wuld need t be secured by the annexatin petitiner. The additinal miles f rad wuld require additinal man pwer and equipment t maintain service levels Frisc Sanitatin has stated that any develpment in this area may require a relief sewer frm the treatment plant t Dilln Dam rad. Cnnectin t Frisc Sanitatin is feasible if a develper agrees t fund a new sewer main treatment plant t Dilln Dam rad and the pumping statins t make it wrk. A larger develpment may require additinal capacity at the treatment plant. The main sewer cllectr running alng and under Summit Bulevard is appraching capacity. 11 Cmmunity Services The Dilln Dam Rad area is nt served under the jurisdictin f Lake Dilln Fire District, but it is part f the District s respnse area. Respnse areas d nt pay taxes int the Lake Dilln Fire District tax cffers. Areas 12 utside f Lake Dilln Fire jurisdictins can be billed fr Lake Dilln Fire respnse services. Plice prtectin is prvided by the Summit Cunty Sherriff s Office. Due t the added service area and distance frm the Frisc Plice Department, annexatin wuld impact the department. If develpment f affrdable husing n this area wuld ccur, the impacts t the Summit Schl District wuld need t be analyzed. Open Space, Parks & Recreatin The existing land uses fr the area are pen space and recreatin. The site prvides pprtunities fr hiking, fishing, camping, bicycling, crss cuntry skiing, and snw sheing

13 Denver Water Lakeshre Prperty Area Descriptin Denver Water Lakeshre prperty is lcated east f Summit Bulevard and nrth f the Summit Middle Schl, alng the shre f the Dilln Reservir. This area is wned by Denver Water, and abuts the Twn f Frisc n its west side. This area cmprises f apprximately 135 acres. The site is predminantly level with an undulating wded area, meadws, and wetlands. Meadw Creek runs thrugh the site. The wetland and shreline areas prvide habitat fr birds, waterfwl, and small mammals. Denver Water has stated that this area is peratinal prperty necessary fr management f the reservir and that this use will remain in perpetuity. This area has imprtant envirnmental features and is a wildlife habitat fr birds and ther animals. The area is als an undevelped buffer between the reservir and Frisc. Land Use This prperty is under the jurisdictin f Summit Cunty and is zned A-1, Agricultural, which allws uses, densities, and standards intended t prtect the existing character, while prviding fr lw intensity use f natural resurces, and limited residential and recreatinal develpment. Surrunding land uses include residential, cmmercial, and pen space. 1 Any develpment f this area must be designed t be sensitive t the existing envirnmental features f the area. The Summit Cunty Recpath runs thrugh the area. Transprtatin 2 3 mile plan 13 13

14 14 A year rund Summit Stage stp is lcated near the Hliday Inn and Ramada Inn. Several infrmal scial paths run thrughut the area. Pedestrian access int the area is prvided ff f Lake Pint circle, 9000 Divide, and Meadw Creek Drive. The Summit Cunty Recpath runs thrugh this area. Utilities The Denver Water Lakeshre prperty des nt have sewer r water infrastructure. Csts f prviding this infrastructure wuld be expensive. Additinal lane miles f rad wuld require additinal man pwer and equipment in rder t maintain levels f service. Additinal water main and water demand culd burden the existing system. As part f any annexatin, additinal water rights wuld need t be secured by the annexatin petitiner. Frisc Sanitatin District has an 18 inch pipe in an easement adjacent t Meadw Creek Drive that culd serve this prperty. Cnnectin is pssible depending n the number f taps. An upgrade wuld be needed n the pumping statin, frce main dwnstream cllectin system, and the treatment plant. Cmmunity Services The Lake Dilln Fire District prvides fire prtectin within the area. Plice prtectin is prvided by the Cunty Sheriff s ffice. There is a safety cncern fr this area as there is limited r n fire prtectin water supply system and/r apprved fire apparatus access rads. The Frisc Plice Department wuld be respnsible fr plice prtectin in the event f an annexatin, pssibly requiring mre manpwer fr the increased service area. 3 4 Open Space, Parks and Recreatin The current land use is pen space/recreatin. The site has trails and is frequented by walkers, hikers, naturalists and fisherman. This area als serves as a natural and undevelped cnnectin t Willw Preserve which is zned as pen space. Eagles Nest/White River Natinal Frest 5

15 15 Area Descriptin This area is nrthwest f Interstate 70 and nrth f the Ten Mile Creek area. It cnsists f Natinal Frest Land, including a natinal wilderness area, the Eagles Nest Wilderness. Several trails exist in the area, accessed frm the Meadw Creek Trailhead (I-70, Exit 201). Wilderness areas are managed by the USFS t prtect and perpetuate their essentially pristine cnditins, and t ensure they are nt measurably affected by human use. N change in its current status as Natinal Frest Land and wilderness area is anticipated. A change in the wilderness status wuld require an act f the United States Cngress. The Frest Service Landwnership Adjustment analysis fr the Dilln Ranger District recmmends that this area be retained by the US Frest Service. The Twn f Frisc intends t maintain this area in its current frm and wrk with ther interested jurisdictins t preserve the area. Land Use The area is zned NR-2, Natural Resurces by Summit Cunty, and its current land use is pen space/recreatin. 2 Utilities N utilities exist in this area. 3 1 Transprtatin The area is nt served by any radways. There is an unimprved rad t the Meadw Creek Trailhead at the suthwestern prtin f the area. There are als tw scenic verlks alng Interstate 70. Mtr vehicles, mtrized equipment, including bicycles, are prhibited within the Wilderness areas. Cmmunity Services This area is within the Lake Dilln Fire Rescue respnse area. Back cuntry areas are served by Summit

16 Cunty Search and Rescue. 4 5 Evergreen Subdivisin Area Descriptin This 17 acre subdivisin is lcated west f Madisn Avenue alng the Summit Cunty RecPath. The Twn abuts the area t the nrth and east, while Natinal Frest abuts the neighbrhd t the suth and west. This area has 39 units built and 5 vacant lts remaining. 1 Land Uses Lw density residential and single family residential hmes are the predminant land use in Evergreen subdivisin. This area is under the jurisdictin f Summit Cunty and is zned R-2, single family residential with allwable densities up t 2 units per acre. Transprtatin Rads in the Evergreen subdivisin are unpaved and cnnect t Twn rads. The Cunty Rad and Bridge De- 16

17 partment prvides maintenance. If annexed, the Frisc Public Wrks Department wuld becme respnsible fr rad maintenance, which wuld add t their service area. Frisc wuld require radway imprvements, including paving and widening t ensure it met the Twn f Frisc s design criteria. The Evergreen subdivisin is within walking distance t the year rund Summit Stage bus stp lcated in frnt f Frisc Twn Hall. 2 Utilities This area is served by the Frisc Water Department thrugh an agreement with the develper that dates frm the 1960 s. Annexatin is feasible but the rad right-f-way as it currently exists is fifty feet. The right-f-way wuld need t be increased t 60 feet and permissin wuld need t be btained frm adjacent prperty wners. Additinal lanes and miles f rad wuld require additinal manpwer/equipment t maintain service levels. Frisc Sanitatin serves this subdivisin and sme prperties are cnnected, sme are nt. The sewer cllectin system is large enugh t serve all the prperties. 3 4 Cmmunity Services The Lake Dilln Fire District prvides fire prtectin within the area, and plice prtectin is prvided by the Cunty Sheriff s ffice. The Ten Mile Basin Master plan mentins that this culd be a pssible area fr affrdable husing. Hwever, the plan als states that there is strng hme wner ppsitin t affrdable husing in Frisc heights and the Hme Owners Assciatin declaratins mentins single family units as the nly unit type permitted. Land Use The area is under the jurisdictin f Summit Cunty and is zned R-2, single family residential. This zning designatin allws single family units at 2 units per acre. This subdivisin abuts Summit Bulevard which is mre cmmercial in nature. It may be f interest fr parcels abutting Summit Bulevard t fit within Summit Bulevard s cmmercial character as cmmercial zning. Pssible future cmmercial uses wuld be reviewed t be cmpatible with adjacent land uses. Transprtatin The majrity f rads in Frisc Heights subdivisin are unpaved, dirt rads. The Summit Cunty Rad and Bridge Department prvides rad maintenance. Prir t annexatin, the Twn f Frisc wuld require radway imprvements including paving and widening t meet minimum radway requirements t meet Frisc s street design criteria. The area has 13 buildable lts in which 5 units have been built and 8 buildable lts remain. Gibersn Preserve is adjacent t these buildable lts. Natinal Frest lands abut the preserve t the nrth, west and east. T- pgraphy varies frm hilly t steep and several streams run thrugh the site. The Clrad Divisin f Wildlife has identified the Gibersn Preserve as an imprtant habitat area fr elk, mule deer, and small mammals and birds. Frisc s nrthwest bundary and the Gibersn Reserve prperties are separated by Interstate mile plan 21

The Gibersn Preserve, 175 acres is under a cnservatin easement held by the Cntinental Divide Land trust. The area is an imprtant undevelped buffer and wildlife habitat area, as well as an imprtant aesthetic and recreatinal resurce fr Frisc and Summit Cunty. Transprtatin The Gibersn prperties abut the Meadw Creek Trailhead at the frntage rad. Access t the prperties is via a private rad, which is unpaved. The Twn wuld require radway imprvements meeting the Twn f Frisc street design criteria prir t annexatin. Since the rad is private, the Frisc Public Wrks Department wuld nt be respnsible fr maintenance in the event f annexatin, unless the rad is dedicated t the twn with the annexatin. 3 This area is in clse prximity t the Summit Stage Transfer Center and near the Twn s bike path system. 4 Utilities N twn wned infrastructure exists in this area. Hiking Trails exist n the sire including the start f the Peaks Trail. This area is zned NR-2, natural resurces, by Summit Cunty. This area has been hit hard by the pine beetle infestatin. 1 Denver Water previusly wned the land under the treatment plat but sld it t the twn. N wetlands study has been perfrmed n the prperty but the assciatin with ten mile creek wuld indicate the pssibility f the existence f wetlands. 2 Land Use The area is zned A-1 Agricultural, by Summit Cunty. The Frest Service land management plan manages the public land in the area under its 2 B prescriptin. These management prescriptins emphasize rural and radednatural recreatinal pprtunities. 3 This is a ppular are t muntain bike, back cuntry ski, hike, camp, and snwshe. There is an unimprved parking area at the trailhead at the end f Frisc s Main Street. The Twn s water treatment facility is lcated within this area. Adjunct land uses are pen space t the nrth, west, suth, while varius residential, and cmmercial establishments exist n the east side f Interstate Transprtatin Access 6 t the site is prvided via a narrw and unpaved access easement n land wned by Denver Water, which als prvides access t the Twn s water treatment facility. Denver Water has installed a lcked gate near the interchange that restricts public access t pedestrians. The Frisc Public Wrks Department maintains the rad. Cntinued use f the area as pen space/recreatin is cnsidered mst apprpriate due t the area s value as a recreatin area, as an aesthetic resurce, and as an undevelped buffer between Frisc and Farmer s Krner Land Use The area is primarily used fr recreatin purpses. It is zned NR-2, Natural Resurces, by Summit Cunty. Transprtatin Highway 9, Cunty Rad 1004 and the Summit Cunty Recreatinal Trail are the transprtatin rutes that prvide access int the area. Several scial trails are lcated thrughut this area. Highway 9 is a state highway and the Clrad Department f Transprtatin prvides rad maintenance. Summit Cunty maintains Cunty Rad 1004 and the paved recreatin trail. The Summit Cunty recreatinal trail als ges thrugh this area. Utilities This area is nt currently serviced with utilities. Cmmunity Services Althugh nt part f the Lake Dilln Fire District service area, the site is lcated in the Fire District s respnse area. Annexatin wuld result in the area s incrpratin int the Fire District s authrity. Plice prtectin alng the Highway 9 Crridr is prvided by the Summit Cunty Sheriff s Office and Clrad State Patrl. Due t the high number f accidents alng the Highway and the sizable distance frm the Frisc Plice Statin, annexatin is likely t significantly increase the wrklad and service area f the Frisc Plice Department. 6 Open Space, Parks & Recreatin The current land uses fr the area are pen space and recreatin. Several sft surface trails run thrughut this area. Mtrized use is allwed n Irn Spring's trail, which is within the area. Tpgraphy n the site is mstly level (0 t 6 percent slpe) t hilly (6 t 15 percent slpe). Land Uses This parcel is under the jurisdictin f Summit Cunty and is zned fr institutinal use. In additin t the schl, the site cnsists f an administrative building, bus strage and maintenance garage, athletic fields, track and tennis curts. A prtin f the Twn s paved pathway netwrk runs thrugh the area within an easement. Adjacent land uses include the Public Service Cmpany Transmissin Statin, the Frisc Public Wrks Department, a warehuse, a mini strage facility, Lagn Twnhmes, a Sanitatin District Lift Statin, and Denver 1

Year-rund Summit Stage bus stps are nearby, at the intersectin f Schl Rad and Summit Bulevard. 32 Ten Mile Canyn Area/I-70 crridrs (frm Frisc t Officer s Gulch) Area Descriptin This area is lcated suthwest f Frisc alng I-70 and is cmprised f wdlands, meadws, wetlands, and canyn walls. It cntains lands managed by the US Frest Service and Summit Cunty, as well as 266 acres f land held in private wnership arund Uneva Lake. 1 Land Use The area is zned NR-2, Natural Resurces, by Summit Cunty. Officer s Gulch is a ppular recreatin area. The area is aesthetically pleasing drive alng I -70 with several avalanche chutes and rck walls all the way t Cpper Muntain resrt. 2 Transprtatin Interstate 70 runs thrugh this area. The Summit Cunty Recreatinal Trail runs adjacent t Interstate in the area. Officer s Gulch area prvides parking and fishing access. 3 4 Open Space, Parks & Recreatin The Ten Mile Canyn area prvides a buffer between Frisc and Cpper Muntain, and is a very scenic area. Officer s Gulch prvides access t trails and als prvides access t fishing and hiking in Officer s Gulch Lake. 10 US Frest Service, 32 11

33 WRNF Peninsula Area Area Descriptin This area, apprximately 602 acres, is public land managed by the US Frest Service. The area is lcated adjacent t the Twn f Frisc s 217-acre Peninsula Recreatin Area. Denver Water als wns prperty (35 acres) alng the lakeshre. It is primarily undevelped frested land and cntains tw campgrunds and a bat launch fr Lake Dilln. In additin, it is a highly ppular place fr recreatinal use muntain biking and hiking in the summer, and crss-cuntry skiing and snwsheing in the winter. 1 2 Land Uses The area is primarily undevelped land used fr recreatinal purpses, including camping within the tw designated campgrunds. The Peak One campgrund is lcated ne mile dwn the Peninsula Area rad. There are three lps with a ttal f 79 campsites. The tilet facilities are flush systems and each site has a cncrete base picnic table, pedestal grill and a fire ring. The Pine Cve campgrund is lcated immediately adjacent t the reservir shreline at the nrthern tip f the area. It cnsists f a gravel surface day-use parking area and paved parking fr vernight camping (55 spaces). A few tables and fire rings are prvided adjacent t the parking spaces but are nt assigned t specific spaces. The campgrund is very ppular with RV campers because f the hard level parking surface and the prximity t the bat ramp and shreline. The area als has the Dickey Fishing Access parking area. It is used as fishing access and cnsists f a gravel 10-car parking lt. Histrically Crwn Pint has been pen t special grups under permit. In the summer, the area is used fr large grup camping, and muntain bike races. The Crwn Pint rad is gated mst f the year t prhibit public mtrized access. Tw Belw Zer als perates dinner sleigh rides thrughut the winter in this area. The area is zned NR-2, Natural Resurces, by Summit Cunty. The Frest Service 3 Land Management Plan manages the area under its 1A prescriptin. 1A emphasizes develped recreatin in existing and prpsed campgrunds, picnic grunds and trails. 3 mile plan 33 33

The nearest water lines run t the ball fields n the Twn s peninsula prperty and sewer lines extend t the Twn s facilities n the peninsula prperty. 9 Cmmunity Services The Summit Cunty Sheriff s ffice has jurisdictin ver the area. The area is part f the Lake Dilln Fire District s jurisdictin. 10 Open Space, Parks & Recreatin As mentined previusly, the area serves as a highly utilized recreatin area. Muntain bikers and hikers use several trails during the summer mnths. During the winter, the area is used as prtin f the Frisc Nrdic Center and several crss-cuntry ski trails and snwshe trails traverse the area. The Twn f Frisc and the USFS are currently wrking n establishing a twenty-year special use permit t allw the Twn and area residents t cntinue t utilize the area s winter recreatinal amenities. 11 It is nt anticipated there will be any change in the USFS Peninsula area s current status. The Frest Service Landwnership Adjustment Analysis fr the Dilln Ranger District recmmends its land in the area be retained as public land. The Twn f Frisc intends t wrk with ther parties t preserve the area

35 APPENDIX A Regulatry Requirements f the Annexatin Prcess The fllwing is a brief verview f annexatin requirements frm the Frisc Twn Cde. Chapter 6, Sectin 4. Statement f plicy. It shall be the general plicy f the Twn f Frisc in respect t annexatin t: A. Annex eligible lands fr psitive reasns equitable t the Twn f Frisc, and nt as a matter f right t a petitiner r petitiners. B. Annex eligible lands, where deemed apprpriate, as a means f preserving pen space, encuraging rderly grwth and f prviding additinal living areas and areas fr services fr the Twn. C. Annex nly lands which can be adequately prvided with the necessary municipal services frm the capacity f existing systems, unless expansin f thse systems is planned, and sufficient financing fr the expanded capacity is available. D. Prvide quality municipal services fr the use and benefit f inhabitants f the twn, including inhabitants f areas annexed; extend any municipal service utside the twn nly after cnsideratin f the quality f existing service and the existing and prjected demand within the twn, including areas cmmitted t annexatin; and refuse t extend any municipal service utside the twn if the extensin will unreasnably decrease the quality r availability f the service within the twn r therwise adversely affect the rderly grwth and develpment f the twn. E. Annex areas that will maintain the twn bundaries in as regular a shape as pssible fr the efficient prvisin f service and fr effective administratin. F Annex areas as recmmended in the Frisc Three Mile Plan. G. Annex areas and enter int annexatin agreements that are cnsistent with the Twn Cuncil gals as established frm time t time, and the gals and plicies f the Frisc Master Plan. H. Cnsider in any annexatin where develpment is prpsed, the timing f develpment s as t crdinate with prjected availability f municipal services and facilities. I. Require, as a cnditin f annexatin, the dedicatin f lands fr public purpses within the land area f the territry being annexed. The lcatin f the lands t be dedicated shall be designated by the twn after cnferring with any ther public agency which might have an interest in such sites. If the twn determines that there is n requirement fr land fr a public purpse within the area being annexed, then the twn may require the annexee t pay t the twn a sum f mney in lieu theref. 3 mile plan 35 35

Prir t submitting a petitin fr annexatin, the petitiner shall meet with the Twn f Frisc Cmmunity Develpment Department t discuss the general cncept fr the prpsed annexatin. B. Submissin f annexatin petitin, map, draft annexatin agreement and infrmatin. The petitiner shall submit: (1) A petitin, draft annexatin agreement and paper cpy f the map in cmpliance with the requirements f the general statutes f the State f Clrad gverning the annexatin f the land. The required map shall be at a scale sufficient t clearly shw the details required by statute; (2) The infrmatin addressing the requirements fr annexatin impact reprts as set frth in the State statutes; (3) Infrmatin cncerning the characteristics f the area, including but nt limited t the fllwing: (a) Gelgic hazards. (b) Fldplain hazards. (c) Wildlife hazards. (d) Mineral resurces. (e) Wildlife resurces (flra and fauna). (f) Histrical and archaelgical resurces. (g) Wetlands. (4) Infrmatin addressing the shrt-term and lng-term csts and benefits t the area prpsed fr annexatin and t the Twn; (5) A written applicatin fr utility service, including the fllwing preliminary infrmatin: (a) Descriptin f the area prpsed t be served. (b) Descriptin f the prpsed develpment. (c) Prpsed timing f the develpment. (d) Prbable flw requirements. (6) Such ther infrmatin r studies as may be requested by the Cmmunity Develpment Department, including but nt limited t a cmprehensive traffic study. C. Cmpleted annexatin petitins, tgether with required fees, shall be filed with the Twn Clerk, wh shall then refer the petitin t the Twn Manager as a cmmunicatin. The Twn Manager shall then, withut undue delay, refer the petitin t the Twn Attrney, wh shall advise the Cuncil f the legal sufficiency f the petitin. If the petitin is fund t be inaccurate r incmplete the Twn Attrney shall s advise the petitiner r his representative. When the petitin is fund by the Twn Attrney t be legally sufficient, the Twn Cuncil may initiate the annexatin prceedings in accrdance with State statutes. D. The Cmmunity Develpment Department will frward the petitin and all accmpanying dcuments t: (1) The Sanitatin District/Public Wrks Department. The twn will frward the applicatin t the Sanitatin District. If, after review f the petitin and accmpanying materials, the Sanitatin District Bard indicates favrability t serve, then an engineering feasibility study will be made at the applicant s expense. The study will 36

37 include, amng ther things, estimates and recmmendatins bearing n water rights dedicatin and cnstructin f public imprvements. If, after review f the study, the District Bard agrees t prvide service, and the Twn Public Wrks Directr recmmends in favr f serving the subject prperty, then apprpriate general r specific prvisins memrializing and utlining the nature f the service shall be cntained as necessary in an annexatin agreement. (2) All ther standard twn referral agencies. E. After review by all referral agencies the Cmmunity Develpment Department shall refer the petitin, zning request and any ther develpment applicatin requests t the Planning Cmmissin. The Planning Cmmissin shall hld a public meeting t review the petitin, and shall review the zning request and ther develpment applicatins in accrdance with the prcedures set frth in the Frisc Twn Cde fr the respective request and applicatins. F. In reviewing the annexatin petitin and accmpanying dcuments, the Planning Cmmissin shall determine the nature and extent f any prblems and benefits which are likely t ccur as a result f the prpsed annexatin and, after such investigatin, shall make its findings knwn t the Twn Cuncil in the frm f a recmmendatin. In cnducting this investigatin, the Planning Cmmissin may cnsult with any ther public agencies and may require frm the petitiner such infrmatin as the Cmmissin determines is necessary r advisable in arriving at a recmmendatin. Any issues that may have becme evident during the Planning Cmmissin s review shuld be addressed in the written annexatin agreement. G. The Planning Cmmissin shall, withut undue delay, transmit its recmmendatins n the petitin fr annexatin t the Twn Cuncil, in writing, accmpanied by any additinal infrmatin r agreements which resulted frm the Planning Cmmissin's review. The Planning Cmmissin shall recmmend apprval r disapprval f the annexatin fr stated reasns. H. Befre final passage f an rdinance accmplishing any annexatin, the petitiner shall depsit with the Twn f Frisc such bnd, mneys and/r executed agreements as shall, in the pinin f the Twn Cuncil, are adequate t ensure the perfrmance f cmmitments agreed t shuld the annexatin is cmpleted.
