Nicle Palmer Dave Martineau 1. The meeting was called t 7:00p.m. Pastr David Tietje frm St. Jhn s UCC ffered a prayer. He als thanked Cuncil & Brugh staff fr installing the N Parking signs arund the church, which adds safety fr his parishiners & ther mtrists. All present participated in the pledge t the flag. 2. Mr. Muss made a mtin t apprve the August 7 th, 2017 Meeting Minutes; Mrs. Frutiger secnded. All were in favr; mtin carried. One crrectin was necessary t the August 14 th, 2017 Meeting Minutes. Under Cmmunicatin, it shuld be added that Mrs. Barley is nw Chairpersn f the Parks & Recreatin Cmmittee. Mr. Muss made a mtin t apprve the August 14 th minutes with this crrectin; Mrs. Frutiger secnded. All were in favr; mtin carried. 3. VISITORS AND PUBLIC COMMENTS the fllwing addressed Cuncil: Dave Dennish frm Kaltreider-Benfer Library thanked Cuncil fr past library cntributins & supprt. He gave an verview f 2017, saying 74% f Brugh residents have library cards. Last year, the Brugh s cntributin t the library was $6,000, which cnverts t.94 per capita. The library is striving t increase that, a realistic gal ver the next few years is 2-3% per capita. Mr. Dennish stated the Cunty Library System will benefit frm a capital campaign prgram and they have prmised t give mney twards Kaltreider- Benfer s expansin in a few years. Mr. Klinedinst shared a prpsal frm tday s meeting between himself, the Public Wrks crew, Skip Missimer frm the Municipal Authrity and Slicitrs regarding the library and wh wns the underlying land. It was discussed what prtin f the land the Municipal Authrity wanted t give t the Brugh; hwever, nne f it is beneficial t the Brugh. Mr. Klinedinst was mre interested in the parking area by the Rec building (at the tp by the twer). The Municipal Authrity agreed t give that parking area t the Brugh and the rest t the library via an easement agreement. The agreement will include plwing and parking details. Mr. Klinedinst stated the Brugh can cntinue t plw that area t have access t it; Mrs. Price & Brett Pattersn agreed. The parking area fr the Splash Pad wuld nt be affected. Jeff Shue said rad repair wuld als be included in the easement agreement fr Myers Lane and the lane beside the basketball curt, s that all parties are in agreement, ging frward. Jeff recmmended all the necessary Variances be utlined first befre a

2 subdivisin/land develpment plan is submitted. Brugh Cuncil agreed t waive any fees except thse that the Brugh has t pay t anther vendr. Kathy Hrne stated and/r questined: The recent Bss Baby mvie was very well attended. She hpes there will be mre activities like this. She enjyed serving refreshments with Kelly & Kathy Henshaw. When will pthle n East Bradway (dwn frm square) be fixed? Mrs. Price cntacted Kevin Eck last week abut it. He talked t PennDOT wh has till mid- Octber t repair it (befre paving seasn is ver). ADA markings n the crsswalks arund twn she stated the signs are nt cmpleted r visible per State law. She wanted t knw when this will be dne. Mrs. Price & Jeff Shue walked every crsswalk in the Brugh t be sure they met State requirements. The signal/crsswalk in the square is cntrlled by PennDOT. PennDOT has a plan that shws what signage & markings the Brugh needs per ADA requirements. Mrs. Hrne stated the square is fine, but the crsswalks, especially thse n Bradway & Main Street nly have signs & nt the cmplete and/r crrect markings & ther State Law signage. Jeff Shue maintains the minimum PennDOT requirements were fllwed & cmpleted. Mrs. Hrne and her husband, Cuncilman Hrne believe the Brugh is nt in cmpliance with State requirements; they nly did the minimum, but nt necessarily what is safe fr pedestrians. Mrs. Hrne asked everyne t be in remembrance f the 9/11 tragedy (16 years ag tday) 4. PUBLIC SAFETY Mr. Muss: Fire Cmpany Reprt Ben Rdkey reprted fr the mnth: 16 calls this mnth using 22 pieces f apparatus & 60 persnnel Fire lss ccurred at Martin Street die cmpany fire--$$ nt knwn yet 9/23 Crab feed State grant that pened n 9/1/2017 Le Fire has submitted their applicatin fr debt reductin A few new members ne junir firefighter, ne Fire Pliceman and ne firefighter wh is a Natinal Guard fireman Le Fire was never included in the discussins f the pssible merger between Dallastwn, Yrk Twnship & Ye Fire Cmpanies. Ambulance Reprt distributed EMA Reprt Laura Kirk distributed her reprt. Of nte, the Emergency Operatins Plan will be renewed sn. State Plice Lt. Nicle Palmer reprted year-t-date numbers: 64 thefts; 14 burglaries (can be prevented by residents securing their prperty, cars) 107 crashes; 26 DUI s 31 drug pssessins 23 simple assaults; 6 aggressive assaults (nt preventable by Plice) 13 sexual assaults 2 rbberies 4 verdse deaths; 2 verdse saves Mr. Hrne stated speeding in the alleys is still a prblem and he has heard f car burglaries in the area. Mr. Klinedinst had sme stlen merchandise left ON his prperty & als had sme f his prperty stlen. He asked Lt. Palmer if the trpers can fllw-up with these incidents t infrm the victim. She will relay this t the trpers.

3 Ging frward, Lt. Palmer will give Mrs. Price quarterly incident reprts that will list where incidents take place, s if there are rental prperties n the list, landlrds can be ntified. 5. MAYOR KOPP S REMARKS AND RECOMMENDATIONS Mayr Kpp will present the Red Lin Service Award at the Octber meeting, which will be held at the Cmmunity Building. 6. SOLICITOR S REPORT Mr. Craley reprted that tday he attended the ArthurLee, LLC zning appeal (regarding the 80 lt width at Nrth Main Street). He will update Cuncil when there is a decisin. 7. ENGINEER S REPORT Jeff Shue reprted: Security reductin fr Village Realty after identifying items that need addressed n a plan, a develper psts a bnd. Village Realty is very near cmpletin f the prject n Cuntry Club Rad & are asking fr a partial reductin f $108,086. This leaves the Brugh hlding a bnd fr remaining imprvements in the amunt f $42, Jeff cncurs with & recmmends this reductin. Mr. Klinedinst made a mtin t reduce the bnd fr Village Realty by $108,086, leaving a remainder f $42, Mrs. Barley secnded. All were in favr; mtin carried Rad Prject near cmplete; final payment request shuld cme in Octber He wrked with Mrs. Price in applying fr the grant as discussed last mnth. This will prvide the Brugh with a gd inventry f the strmsewer cllectin (where they are & the cnditin f them) when pssibly applying fr PENNVEST lans. In ding s, mney des nt need t be taken frm the paving prject budget. 8. ORDINANCES Mr. Craley presented the fllwing which have been advertised & are ready fr Cuncil s actin: Ordinance Alternative Dispsitin (Quality f Life) uses a ticketing prgram & avids citatin with District Justice fr certain vilatins. Mr. Muss made a mtin t apprve this Ordinance; Mrs. Frutiger secnded. Mr. Klinedinst & Mr. Hrne stated they cannt apprve this because they feel all peple are nt ging t be treated equally fr the vilatins. Mtin carried with Mr. Hrne & Mr. Klinedinst ppsing. Ordinance Intergvernmental Cperatin Agreement fr Chesapeake Bay Pllutant t cmply with nitrus & phsphrus reductin. Mrs. Barley made a mtin t apprve this Ordinance; Mrs. Frutiger secnded. Mtin carried, with Mr. Hrne adamantly ppsing, stating we have n chice in this matter & he des nt agree with it. Mst Cuncil agreed with Mr. Hrne; hwever, this is the best-case scenari & will prbably result in the Brugh spending less mney than if they were nt in the MS-4 Prgram. Ordinance Rules & Regulatins fr Fairmunt Park adding a sectin t Chapter 16 t prescribe rules & regulatins which can then be enfrced. Mr. Muss made a mtin t apprve this Ordinance; Mrs. Frutiger secnded. All were in favr; mtin carried. Advertise Map Amendment Mr. Craley reprted n the decisin t advertise the map amendment fr the prperty at 730 Suth Main t rezne it frm Residential Outlying t Cmmercial. Draft amendments were sent t Yrk Cunty Planning Cmmissin & Red Lin Planning Cmmissin fr review. Yrk Cunty recmmended TO adpt it; Red Lin recmmended NOT t adpt it. Mr. Craley stated there is a prvisin in the Municipalities Planning Cde that requires a 30-day ntice be sent t all prperty wners in the area prpsed fr rezning. This wuld invlve the McCleary estate, r the heirs f the estate and must be dne 30 days prir t the hearing. The 30-day ntice des nt allw enugh time befre the Octber Cuncil meeting unless Cuncil wishes t advertise & hld a special meeting. Mrs. Price des nt believe a special meeting is necessary, that this can wait until the Nvember 13 th Cuncil meeting. Mrs. Frutiger made a mtin t advertise the map amendment fr a hearing n Nvember 13 th, Mrs. Barley secnded. Discussin was held:

4 Mr. Hrne adamantly ppses the rezning because, shuld Rutter s purchase the piece f land, he feels a larger stre will create mre traffic & mre cngestin in an already-busy intersectin. A larger expanded stre will nly benefit Rutter s & will be a nightmare fr the residents nearby, adding that Rutter s des nthing t give back t the twn. Management is nt willing t cut the hurs back either, s the nearby residents deal with the issues 24/7. Mr. Henshaw ppses the rezning als; he feels a larger stre is nt necessary in that area. Tim Rutter was present and maintains that the additinal parking will eliminate the cngestin in frnt f the stre. Dave Martineau, Rutter s Cunsel, stated mre gas pumps will mean less cngestin & with the prpsed entrance mved away frm the intersectin, the traffic at the signal light wuld be safer. Enclsed dumpsters will take care f the trash prblem mentined by residents. He feels Rutter s has addressed a lt f residents cncerns. Mr. Craley stated whether r nt Rutter s makes charitable cntributins t the twn has nthing t d with the zning map amendment befre Cuncil fr actin tnight. A vte was taken n the mtin; mtin carried with Mr. Henshaw & Mr. Hrne ppsing. The Public Hearing will take place at the beginning f the Nvember 13 th Cuncil meeting. 9. PARKS AND RECREATION Mrs. Barley reprted: Brugh was apprved fr the Greenway Grant; ttal grant amunt is $515,600 Street Fair went well Sept. 20 th Hmecming parade Fire Plice are scheduled fr that Oct. 14 th Fall Fest vlunteers needed!! Oct. 30 th Hallween Parade (Rain date 11/1) Bss Baby mvie event went well Signage fr the Ordinance enfrcement will be installed in the park Cameras in the park have been installed Garden prject in the park things are grwing. It was a nice trial prject, but it s undetermined if it will cme back next year. June circus it was nt well-advertised; hwever, Mrs. Price stated it will nt be held again anyway. The cmpany did give the Brugh mney twards July 4 th firewrks. Rail Trail gates have been paid fr & received; they will be painted & installed s vehicles cannt get arund them. Chapel Church Agreement--$1,000 depsit (refundable) fr use f their basketball curts 10. MUNICIPAL SERVICES Mr. Minnich reprted: Jeff Herrman frm Municipal Authrity: 9/13 water shut ffs fr delinquent bills Water Treatment Plant is running smthly despite recent thunderstrms causing electrical prblems. Infrmatin n surcewater prtectin, water & sewer regulatins, etc. will be added t the Brugh website. Basketball curts Mr. Hrne stated he heard cmplaints abut the trash prblem. He thught it was the Brugh s jb t maintain, as they have fr years. Mrs. Price said we have been; hwever, it s nt Brugh prperty. She asked it t be psted with N Trespassing signs, but n respnse was received. Smking & trespassing is a prblem after park hurs. As sn as the subdivisin plan ges thrugh, the Brugh can wrk ut an agreement with the library. In the interim, a shrt-term lease agreement with the Municipal Authrity culd be created s the Brugh s Ordinances can be enfrced n the curts.

PUBLIC WORKS Mr. Klinedinst reprted: Mrs. Barley received a call frm the Red Lin Elks because several parking spts were taken frm them (because f the sight restrictin/safety issues at Franklin Street). The Elks asked if they culd have a handicapped parking space in frnt f their building. Cuncil agreed with this; hwever, it will nt be an exclusive handicapped space just fr the Elks use. Rad repair gather ideas fr 2018 budget (f nte, Railrad Lane is n the list) Pine Street cars have been parked in the N Parking zne. Mrs. Price said Dave McCy is ff right nw, but she will have Jhn Persing lk int it. Signs n the new municipal lt shuld be installed t stp thru traffic and/r make it a ne-way drive. Hw much mney has been cllected frm this lt? Cuncil wuld like a breakdwn; Mrs. Price will get this. Charles & Gay Street sidewalks Barnes & Barnes will be n site this week t repair/replace three sidewalks. The Brugh will then place liens n thse prperties. East Avenue residence will replace their sidewalk; they just needed mre time t raise the mney. Chestnut Street residence pured cncrete & did nt repair t specificatins. Suth Main Street tw vendrs n the empty lt; can anything be dne? They have their transient license, s the Ordinance wuld need t be changed t get them t leave. Trees n West Bradway that are hanging nt cars Shade Tree Cmmittee was decmmissined. Mr. Craley said Sectin 25:106(1A) f the Ordinance puts the respnsibility n the hmewner. The Brugh can give a ntice first, then issue a fine r cut it dwn. Public Wrks crew can als trim the trees as a winter prject. The Cde Bk regulates 9 n the curb/sidewalk and 14 n the street, s they will be cut t this r clse enugh t allw fr snwplwing equipment t pass. All were in favr; mtin carried. 12. PLANNING, ZONING & REDEVELOPMENT Mr. Hrne reprted: N Planning Cmmissin meeting this mnth. Redevelpment Cmmittee did mre walk-thrughs f Brugh streets t see where repairs are needed, parking pssibilities, etc. Melanie talked t residents t get feedback they like the Splash Pad, farmers market, Fd Truck Fridays. They als expressed interest in a dg park in the Brugh, but there are prs & cns t this. Anyne can jin in n the walks. Mr. Hrne wuld like t cntact the wners f The Mill t attend a Wrk Sessin in hpes f remedying truck traffic & parking prblems n Taylr Avenue. Mrs. Price t cntact them. Mr. Henshaw reprted Ben Garner is interested in buying the ld aut parts stre and wuld be interested in changing the façade f the building. He asked if Brugh culd ffer a lw r n-interest lan fr the prject. Mrs. Price said althugh the façade grant prgram has expired, sme type f lan culd be dne. Cuncil agreed & Redevelpment can wrk with Mr. Garner. 13. ADMINISTRATION Mrs. Frutiger reprted: MMO fr Plice Pensin is $0 Catherine Meyer Award nminee is Muriel Slenker Nvember 2 nd Brugh Banquet at Cmmunity Building Catherine Meyer Award t be given that night. Cmmittee fr unin cntract talks will be Mr. Muss, Mrs. Frutiger & Mr. Hrne Budget meeting will be held Octber 6p.m.
