The undersigned, therefore, issues an Order pursuant to section 61 of The Municipalities Act. IT IS HEREBY ORDERED THAT: 1 The Village of Elstow is dissolved and its area is included within the Rural Municipality of Blucher No The former Village of Elstow is designated as a special service area for the purpose of assigning different tax rates, applying different tax tools and providing different service levels within the Rural Municipality of Blucher No The designated special service area is confirmed, as being within the boundaries of the former Village of Elstow, that being in the Province of Saskatchewan, within Township 35, Range 1, West of the Third Meridian, consisting of the south-east quarter of Section 10; that portion of the south-west quarter lying south of the westerly production of the south boundary of the Canadian Pacific Railway Station Grounds shown on Plan No. I5207 and lying east of the westerly boundary of the third street shown as road Plan Nos. I2900 and ; and that portion of the north-east quarter of Section 3 described as Parcel F, Plan No. B0311 and Parcel B, Plan No The Rural Municipality of Blucher No. 343 shall allocate all revenues collected from and on behalf of the special service area to special service area ledger accounts; and all expenses of the special service area shall be allocated to and paid from special service area ledger accounts.

10 2754 THE SASKATCHEWAN GAZETTE, december 24, A statement of revenues and expenditures of the special service area be presented to council annually and any additional time(s) requested by council. 6 The terms and conditions of the restructuring agreement entered into by the Village of Elstow and the Rural Municipality of Blucher No. 343 are as follows: (a) this agreement has been entered into by the Village of Elstow and the Rural Municipality of Blucher No. 343 for the purpose of the dissolution of the Village of Elstow; (b) a municipal council consisting of a Reeve and six (6) councillors will govern the Rural Municipality of Blucher No. 343, pursuant to section 17 of this agreement; (c) the Village of Elstow shall be designated a special service area for the purposes of assigning different tax rates and application of tax tools and providing different service levels; (d) the designated service area being within the boundaries of the former Village of Elstow; (e) this agreement may be amended: (i) by the agreement of the councils which are signatories to the agreement, prior to the application being forwarded to the Minister for approval; and (ii) by the Council of the Rural Municipality of Blucher No. 343 after the Minister s Order, only when an amendment is in the best interests of the ratepayers of the former Village of Elstow and the Rural Municipality of Blucher No (f) the assets and liabilities of the Village of Elstow shall become the assets and liabilities of the Rural Municipality of Blucher No. 343 upon dissolution of the Village of Elstow; (g) cash assets remaining subsequent to settlement of the Village of Elstow s assets and liabilities will be set aside for provision of and benefits within the former Village of Elstow; (h) should it become necessary for the Rural Municipality of Blucher No. 343 to lend funds to the special service area account, the special service area of Elstow shall repay any such funds in equal monthly installments plus interest at the prime rate as determined by TD Canada Trust and may be changed or adjusted as required by the Rural Municipality of Blucher No. 343; (i) all grants received by the Rural Municipality of Blucher No. 343 in recognition of the former Village of Elstow, including the Potash Tax Share, will be set aside for the provision of and benefits within the former Village of Elstow; (j) all expenditures relating to the former Village of Elstow shall be drawn from the funds set aside for the former Village of Elstow, including, but not limited to: (i) administration; (ii) bylaw implementation and enforcement; (iii) custom work; (iv) insurance; (v) items as delineated in section 11 of this agreement; (vi) maintenance and ; and (vii) other items as provided for in The Municipalities Act. (k) the Rural Municipality may authorize the imposition of special levies for the following purposes if required: (i) renewing municipal infrastructure; (ii) remedying and reclaiming contaminated sites; (iii) settling any liabilities of the parties;

11 THE SASKATCHEWAN GAZETTE, december 24, (iv) capital expenditures for machinery or equipment; (v) installation of new infrastructure; and (vi) said special levies on affected properties shall not exceed a period of greater than 10 years or in the case of retiring a debt of the municipality not greater than the term of the debt. (l) the Rural Municipality of Blucher No. 343 will ensure that fire protection are inclusive and consistent with fire protection service agreements currently established by the municipality. The former Village of Elstow shall pay a sum to the Blucher/Lost River Fire District in a manner that is similar to the formula with which the Rural Municipality of Blucher No. 343 provides funds to the district; (m) the Rural Municipality of Blucher No. 343 recognizes, pursuant to The Municipalities Act, the bylaws and resolutions in force in the former Village of Elstow, will continue in force for a period of one year or until they are sooner repealed or others are passed in their place; (n) the current three-year contract for Waste Collection/Recycling Program will be maintained and expensed to the designated Service Area of Elstow; and may be changed or adjusted as required by the Rural Municipality of Blucher No. 343; (o) the administrator for the Village of Elstow, Zelma McAdam, will not continue as an employee of the Rural Municipality of Blucher No. 343, excepting that she applies for any position that may be available and is hired through due process; (p) the Certified Operator will be contracted out; (q) this agreement will come into effect on the date of dissolution as set out in the Minister s Order; (r) upon dissolution, Elstow shall be included within the boundaries of Division One (1) of the Rural Municipality of Blucher No. 343; (s) the Council of the Rural Municipality of Blucher No. 343 may appoint one person to act as an advisory committee for the former Village of Elstow. The advisory committee or its representative shall be given time at each regular council meeting to present issues and information to Council for consideration. Council may set a rate of remuneration for the advisory committee which will be expensed to the former Village of Elstow. 7 All terms and conditions of the restructuring agreement are approved, except for the part of paragraph 11, which includes special levies for capital expenditures for machinery or equipment and the installation of new infrastructure as there is no authority in The Municipalities Act for special levies for these purposes. 8 The dissolution shall take effect on December 31, Tina Douglas is appointed to adjust and settle the assets and liabilities of the Village of Elstow including: (a) the sale of, the disposition of and the conversion into money of sufficient assets to satisfy the liabilities of the village and pay the remuneration of the person appointed by this Order; (b) the allocation of any grants, surplus funds and reserves; and (c) the manner of dealing with the liabilities and pursuant to subsection 63(4) of The Municipalities Act, if there are insufficient realizable assets to satisfy the liabilities of the municipality to: assess, levy, collect and enforce payment of any amount that may be required to satisfy the liabilities of the municipality and all associated expenses and pay the remuneration of the person appointed pursuant to this Order. 10 Remuneration for settling the assets and liabilities be paid to Tina Douglas at a rate of $40.00 per hour of work, and cents/travelled kilometre and reimbursement of related miscellaneous expenses.
