1 CHAPTER FOUR RECOMMENDED NOISE COMPATIBILITY PROGRAM MEASURES This chapter provides the detailed descriptios of the recommeded Part 150 oise abatemet, lad use maagemet, ad program maagemet measures for the Lambert-St. Louis Iteratioal Airport (Lambert Airport) Part 150 Noise Compatibility Program Update (2010 Part 150 Study Update). The chapter is divided ito six sectios: Sectio 4.1 presets the basis of the Noise Compatibility Program (NCP) Update measures; Sectio 4.2 summarizes the recommeded NCP measures; Sectio 4.3 presets the NCP map; Sectio 4.4 icludes the estimated program costs ad fudig sources; ad Sectio 4.5 provides the NCP implemetatio schedule ad idetifies the resposible implemetig parties. Sectio 4.6 provides supplemetal iformatio for each NCP measure formatted i idividual tables for the use of the FAA reviewers ad the officials resposible for implemetig each measure. The recommeded program cosists of measures draw from the previously approved 1997 Part 150 Study Update 1 (1997 NCP), which are listed i Appedix F, 1997 Noise Compatibility Program, as well as from the evaluatio of alteratives coducted for this study. The alteratives aalyses are preseted i Appedix G, Noise Abatemet Alteratives; Appedix H, Lad Use Alteratives; ad Appedix I, Program Maagemet Alteratives. The aalyses cotaied i this 2010 Part 150 Study Update was coducted accordig to the guidace provided i Title 14 of the Code of Federal Regulatios (14 CFR) Part 150, which calls for the periodic reevaluatio ad submissio of the oise coditios at a airport. The year 2015 was selected as the future year for aalysis based o a provisio i the guidelies that states the future year should be five years from the date of submissio to the FAA for review ad approval (2010 plus five years). The approval of the NCP by the Federal Aviatio Admiistratio (FAA) does ot commit the FAA or the St. Louis Airport Authority (STLAA) to the costs or the implemetatio schedule listed i this documet. The iformatio provided here is a plaig tool to assist the STLAA ad other muicipal departmets as well as the FAA to implemet the NCP measures that are ultimately approved by the FAA i its Record of Approval (ROA). 1 Lambert-St. Louis Iteratioal Airport Part 150 Noise Compatibility Program Update, Techical Report, City of St. Louis Airport Authority, prepared by Aviatio Plaig Associates, Ic., a Parsos Brickerhoff Compay, (Volume Oe-dated August 1995, Volume Two-dated Jauary 1996). 2 4.1 BASIS OF THE NOISE COMPATIBILITY PROGRAM RECOMMENDATIONS The evaluatios of oise ad lad use plaig techiques assessed durig the coduct of this 2010 Part 150 Study Update were guided by a Techical Advisory Committee (TAC) ad Commuity Advisory Committee (CAC). The membership of these committees icluded airport users, stakeholders icludig FAA represetatives, airlie represetatives, ad local elected officials ad the plaig ad zoig staff from jurisdictios surroudig Lambert Airport. The aalyses ad fidigs of this study update were preseted to the public at a series of Public Iformatio Workshops where the STLAA ad cosultat team obtaied iput ad commets. The existig oise mitigatio program has reached maturity ad the oise exposure cotours have decreased i size ad area over recet years. Therefore, the oise abatemet recommedatios will maitai ie of the eleve approved Noise Abatemet (NA) measures from the 1997 NCP, which will cotiue to miimize the effect of aircraft oise over established commuities. The 2010 Part 150 Study Update recommeds slight modificatios to five of these ie measures to update the termiology ad coditios, ad the remaiig two measures are either recommeded to be withdraw or o loger applicable. The lad use maagemet measures recommeded i this 2010 Part 150 Study Update are based, i part, o the previously approved lad use maagemet measures cotaied i Lambert s 1997 Part 150 Study Update ad a assessmet of the implemetatio of the previously approved mitigatio programs. The 65 Day-Night Average Soud Level (DNL) oise exposure cotour has decreased i size sice the approval of the 1997 Part 150 Study Update ad the STLAA has bee successful i its implemetatio of a volutary acquisitio program, soud isulatio program, ad limited avigatio easemet program. Therefore, it is practical to recommed a all-ecompassig set of prevetative lad use measures to address potetial future developmet i areas iside ad outside of the 65 DNL oise exposure cotour where aircraft overflights cotiue. The resposibility for cotrollig ad maagig the developmet ad redevelopmet of lad outside the airport boudary is the resposibility of local jurisdictios. As such, it is icumbet upo jurisdictio officials to moitor ad pla for ew developmet i a maer that is compatible with aircraft operatios. The STLAA remais committed to providig assistace to the local jurisdictios who wish to udertake compatible lad use plaig. November 2010 Page 4-2

3 Accordig to a FAA lad use guidace maual, Lad Use Compatibility ad Airports, 2 the FAA recogizes that aircraft oise does ot stop at the 65 DNL oise exposure cotour. 3 While the FAA ca provide assistace ad fudig to ecourage compatible lad developmet aroud airports, it has o regulatory authority for cotrollig lad uses that would protect airport capacity. The FAA recogizes that state ad local govermets are resposible for lad use plaig, zoig ad regulatio, icludig that ecessary to provide lad use compatibility with airport operatios. However, pursuat to the Federal Airport ad Airway Developmet Act, as a coditio precedet to approval of a FAA-fuded airport developmet project, the airport sposor must provide the FAA with writte assuraces that appropriate actio, icludig the adoptio of zoig laws have bee or will be take, to the extet reasoable, to restrict the use of lad adjacet to or i the immediate viciity of the airport to activities ad purposes compatible with ormal airport operatios icludig the ladig ad takeoff of aircraft Therefore, the FAA ecourages airport sposors ad local govermets to work together to establish local lad use cotrols i areas adjacet to a airport ad withi the flight corridors that exted beyod the 65 DNL cotour. The local lad use plaig policies ad cotrols recommeded i this Part 150 Study Update are discretioary ad are provided for the cosideratio of all local jurisdictios. Each idividual local jurisdictio is resposible for the adoptio, implemetatio, ad eforcemet of ay of the prevetative lad use measures. 2 3 Lad Use Compatibility ad Airports: A Guide for Effective Lad Use Plaig, FAA Airports Divisio, Souther Regio Office, Atlata, Georgia, Jacquelie Sweatt-Essick, et al, July The City of Ferguso is itedig to pursue the developmet of a seior citizes housig complex usig Federal grat fuds that may iclude moies from the U.S. Departmet of Housig ad Urba Developmet (HUD). The City of Ferguso is outside of the 65 DNL of the Future (2015) Baselie/NCP oise exposure cotour. HUD ad the FAA use the same oise metric ad threshold to defie areas impacted by sigificat levels of oise. HUD regulatios (24 CFR Part 51 - Evirometal Criteria ad Stadards) set forth the followig exterior oise stadards for ew housig costructio assisted or supported by the departmet: 65 Ld* or less - Acceptable Exceedig 65 Ld but ot exceedig 75 Ld - Normally Uacceptable (To achieve a acceptable status, appropriate soud atteuatio measures must be provided) Exceedig 75 Ld - Uacceptable * Ld Day-Night average soud level (DNL) is the 24-hour average soud level, i decibels (db), obtaied after the additio of 10 db to the soud levels occurrig betwee 10:00 pm ad 7:00 am. HUD's regulatios do ot cotai stadards for iterior oise levels. Rather a goal of 45 db is set forth ad the atteuatio requiremets are geared toward achievig that goal. It is assumed that with stadard costructio ay buildig will provide sufficiet atteuatio so that if the exterior level is 65 Ld or less, the iterior level will be 45 Ld or less. November 2010 Page 4-3

4 4.2 NOISE COMPATIBILITY PROGRAM RECOMMENDATIONS The recommedatios for this NCP Update are summarized i this chapter i two formats: a summary table ad detailed plate illustratios for each idividual measure, icludig previously approved measures that are recommeded to be withdraw from the updated NCP. Table 4-1 describes the recommeded measures i a summary format, idetifies the primary party resposible for implemetatio, estimates the potetial costs to the various stakeholders (airport, local govermet, ad users), ad the implemetatio status. Measures are orgaized by category as follows: Noise Abatemet Measures (umbered NA-1 through NA-10) focus o operatioal procedures that could potetially reduce oise at the source (e.g. flight locatio, ruway use cofiguratio, ad flight procedures). Lad Use Measures (LU-1 through LU-14) focus o actios to remediate existig icompatible lad uses or actios to prevet the developmet of ew icompatible lad uses i areas that are sigificatly impacted by aircraft oise. Program Maagemet Measures (PM-1 through PM-3) address admiistrative ad maagemet actios to ehace the STLAA s ability to respod to public cocers about aircraft oise ad overflights, as well as to work closely with lad use maagemet agecies to maitai compatibility betwee the airport ad developmet i the airport eviros. Table 4-1 summarizes the 23 measures recommeded for the 2010 Part 150 Study Update, which icludes 17 previously approved measures that are beig cotiued or modified, 1 measure to be withdraw from the Program, ad 5 ew lad use measures. No ew oise abatemet measures are recommeded, although some modificatio to existig oise abatemet measures is recommeded. Table 4-1 does ot iclude the previously approved measures that have bee completed. Iformatio about the completed measures (LU-1 through LU-4) is provided i Appedix H, Lad Use Alteratives. For each measure, the requested FAA actio is oted i the FAA Actio colum. The measures that are beig cotiued or cotiued with mior modificatio to update the laguage from the approved 1997 NCP do ot require FAA re-approval. The modificatio to the laguage does ot chage the itet of the origial measure. 9 4.3 NOISE COMPATIBILITY PROGRAM MAP The Future (2015) Noise Exposure Map (NEM) also represets the 2015 Noise Compatibility Program (NCP) oise exposure cotour because o procedures are beig recommeded that would affect the curret operatig coditios at Lambert Airport. Because o ew oise abatemet measures are beig recommeded i this NCP update ad o chages are expected to occur at Lambert Airport that would cause aircraft operatios to deviate from curret procedures, 5 the Future (2015) Baselie oise exposure cotour is the same as the Future (2015) NEM ad NCP oise exposure cotour. Whe the existig remedial lad use measures, as curretly approved, are fully implemeted, all housig uits withi the 65 DNL of the Future (2015) NEM/NCP oise exposure cotour would be cosidered mitigated. Table 4-2 presets a summary of the impacts (housig uits, populatio, ad oise-sesitive uses) located withi the 65 DNL of the Future (2015) NEM/NCP oise exposure cotour. There are 107 housig uits with a estimated populatio of 291. These housig uits are located withi the cities of Cool Valley, Ferguso, ad Kiloch. Of the 107 housig uits 17 have received, or are i the process of receivig, soud isulatio. Three uits have met iterior soud atteuatio requiremets ad the owers were grated participatio i the Limited Easemet Program. Forty-six uits are cosidered ieligible for the soud isulatio program because the property ower was ivolved i litigatio with Lambert Airport ad received a court settlemet 6 or the property was purchased after the date of the FAA approval of the 1997 Part 150 Study Update NEMs (Jauary 10, 1997). 7 See Exhibit 4-2, 1997 NCP Mitigatio Program Areas Durig the course of the preparatio of this study, the FAA s Air Traffic Origiatio (ATO) was i the process of developig ew Stadard Istrumet Departure (SID) procedures ad Stadard Termial Arrival Routes (STARs) for STL. While absolute fial desigs were ot available to icorporate ito the Itegrated Noise Modelig assumptios, the Lambert staff ad their cosultat coordiated with FAA ATO to review the draft desigs as they were made available. 16 4.4 NOISE COMPATIBILITY PROGRAM COSTS The direct costs associated with the recommeded NCP measures will be icurred by the STLAA, the FAA, airport users, ad local govermets, ad supplemeted by eligible fudig from the FAA. Costs for implemetig the NCP are estimated i 2010 dollars ad are preseted i Table 4-3. These costs are divided ito aual or oe-time expeditures, with the STLAA carryig the majority of resposibility for fudig the capital program measures. Aual costs cosist of the admiistrative expeses to implemet a cotiuig measure or to operate aircraft accordig to the recommeded measures. Oe-time costs iclude the expeditures to implemet mitigatio program upgrades to the Aircraft Moitorig System. The total estimated cost of the implemetatio of all recommeded measures i the NCP is $2,780,000, icludig cotiuig expeses. Followig the issuace of the FAA ROA, Lambert Airport may submit a applicatio to the FAA for fudig to implemet the approved NCP measures through the Airport Improvemet Program (AIP). However, a AIP grat does ot fud the volutary implemetatio of prevetative lad use policy measures (i.e., comprehesive plaig, zoig, subdivisio regulatios, ad buildig codes) that are the resposibility of the local jurisdictios. The STLAA ad the local jurisdictios that choose to udertake lad use plaig ad discretioary review may icur admiistrative costs associated with the developmet, implemetatio, ad maagemet of these recommeded lad use measures. 18 4.5 NOISE COMPATIBILITY PROGRAM IMPLEMENTATION I geeral, oise abatemet air traffic measures may be iitiated oce the STLAA adopts the NCP ad receives the FAA ROA o the NCP ad ay required evirometal review(s) has bee completed per the Natioal Evirometal Policy Act (NEPA). The FAA has previously approved the measures recommeded i the 1997 Part 150 Study Update ad the implemetatio of those measures may cotiue based o that approval. Lad Use Maagemet Measures, for which implemetatio is the resposibility of the local jurisdictios may be implemeted at ay time. Table 4-4 provides a geeralized implemetatio schedule for the recommeded NCP measures. (Note: A geeral rather tha specific schedule of implemetatio is recommeded due to the various parties resposible for approvals ad the cotiuig ucertaity of matchig fud availability.) As discussed i Appedix J Public Ivolvemet, Sectio J.3, Techical Cofereces, meetigs were coducted with the parties that would be resposible for implemetig the measures icluded i this 2010 Part 150 Study Update. A Noise Abatemet Techical Coferece was coducted with FAA Air Traffic Cotrol (ATC) persoel at the Lambert Airport FAA Air Traffic Cotrol Tower ad the T75 TRACON. 9 At the meetig with ATC persoel, the potetial modificatios to the existig oise abatemet measures were preseted ad discussed. These modificatios, which are recommeded for this NCP Update, were also reviewed at the fourth CAC ad TAC meetigs. The FAA ATC persoel idicated that the recommeded modificatios were acceptable. Because the modificatios will ot alter the curret operatig procedures at Lambert Airport, it was determied that o further cosultatio was warrated. A Lad Use Techical Coferece was held with the elected officials ad plaers from surroudig jurisdictios. At the meetig, a presetatio was give that icluded a discussio of compatible lad use policies, regulatios/ordiaces, ad codes that have bee used successfully i other commuities. It was recommeded that the local jurisdictios cosider implemetig similar policies ad lad use cotrols to prevet ew icompatible developmet aroud Lambert Airport. These lad use policies ad cotrols, which are recommeded for this NCP Update, were reviewed at the fourth CAC ad TAC meetigs.
