1 PRESENT CALL TO ORDER APPROVAL OF AGENDA PUBLIC WORKS REPORT (Issue # ) File #: The Council of the County of Wetaskiwin No. 10 met in the Council Chambers commencing at 10:00 a.m. on September 14, 2010 Present were: Reeve G. Dearing and Councillors B. Shantz, K. Ball, W. Meyers, L. McKeever, N. Watson and B. Dunn. Also present were: Frank Coutney, County Administrator; Dave Dextraze, Director of Public Works, Recording Secretary Dea Reid and Intern Iain MacLean. Reeve G. Dearing called the meeting to order at 10:02 a.m. Resolution #PW MOVED: by Councillor W. Meyers that the agenda be approved as presented. Water Systems: Daily Checks of the four water plants, 18 lift stations and entire sewer systems are completed throughout the County and North East Pigeon Lake. A storm on August 15, 2010 caused a power outage in Mulhurst Bay and a Contravention report was sent to Alberta Environment due to loss of pressure at the Mulhurst Water Plant. The system was flushed and a Bac T sample was taken to the Provincial Lab in Edmonton. All results were good. Sewer Systems: Installed new pump guide rails at the Gwynne Lift Station Pre-discharge samples from the Mulhurst lagoon were sent to Kaisen Lab in Calgary for analysis. The storage cells are near overflow situation due to 1/3 more sewer trucks dumping at the lagoon and over 20 inches of rain in the region throughout the summer months.

2 Pervez Sunderani of Alberta Environment was sent notice advising of the County's situation and the discharge was approved as it meets the Code of Practice for lagoons within the province of Alberta. Lambourne Environmental was contacted to perform a sludge study of the anaerobic cells at the Mulhurst Bay lagoon because some draining problems have been occurring due to high sewer truck volumes at the the lagoon. The Falun Sewer lift station was powered down for 4 hours while Dart Electric hooked up the power at the new skating rink behind the elementary school. Jim's Septic was called in as sewer levels at the lift station rose to high levels. Transfer Stations: Checked operations at the Bear Hills, Winfield, West Buck Lake and Mulhurst Transfer Stations. Alberta Environment was advised of the problem and the fish were disposed of at the West Dried Meat Lake Regional Landfill. Notices were handed out to Viola Beach residents advising that pick-up services for disposal of the fish found on properties within the sub-division would be every morning, Monday through Saturday before 11:00 a.m. beginning August 20, 2010 until further notice. Bags would be provided and replaced upon pick-up. Similar provisions were also made to pick-up the dead fish at Mulhurst Bay. ASB and Public Works staff picked the fish along County properties and shore line adjacent to County road ways. The fish die off has ended and daily inspections/pickup terminated first week of September. Page 2 of 29

4 Month Pre-Inspection Post Inspection Approach Inspection July August A fall discharge will be completed at the Mulhurst Lagoon, as it has been extremely busy and there has been lots of sludge building up. Winfield Lagoon will also be completing a fall discharge. Winfield lagoon is still "whaling" (bubble in the storage cell liner)and Administration is thinking this might be due to ground water, not a leak in the lagoon. Administration is looking into possible fixes such as weeping tile to help rectify this issue. Tests are being completed to verify that there is no leak in the liner and that it is ground water causing the problem. Council reviewed the shoulder pull recently completed on Range Road 272, including the review of before and after pictures which were attached for Council's review. Rate payers have been commenting on the recent shoulder pull and Administration believes this upgrade was a success. D. Dextraze reitterated that shoulder pulls are part of a good maintenance program. The feed lots using this road in all weather conditions create a large amount of heavy traffic that other local roads are not subject too. This road may have to be shoulder pulled every 5 years or more. Councillor McKeever commented that the road was rough. Council also discussed other shoulder pulls in their divisions and the input they have had from rate payers being very positive. The sand hauled to build up the Winfield rodeo grounds was in conjunction with funds from Winfield Agriculture Society. Public Works crews are waiting to finish the gravel projects,dry weather is required to be able to complete the projects. Council Discussed the following: RR 63 and Lakeshore Drive through Buck Lake both have large pot holes that need repairs. Councillor Dunn presented the concern that there is damage to the roads from frac trucks and well servicing rigs that the post well drilling road inspections are missing. Administration will do an investigation for discussion in strategic planning sessions. Councillor Watson requested that the pavement adjacent to the water reservoir in Winfield be repaired. Administration will do interim repairs and budget for dig outs and repairing in Councillor Shantz commented that Range Road 240 adjacent to the Johnson's is pot holing. Administration recommends that Council approve the August 2010 Public Works Report as presented. Resolution #PW MOVED: By Councilor L. South ditch along Viola Beach Road from West turnaround to the Lake Front Municipal Reserve will be addressed when crews work the the road in that area. Mrs. Tyner is concerned about the steepness of the ditch across from her property as it does not drain properly and has become a mosquito breeding ground. McKeever and John Skinner Mr. Skinner advised that 80th Ave. in Pigeon Lake Haven at Mulhurst Bay gets very soupy when wet with very little gravel showing. Conduct an inspection AFTER August 7, 2010 to ensue gate/fence has been removed on the government road allowance at RR 52 and TWP 460. Provide comments to Administration. Murfitt reported that there was no gate on west entrance from TWP 452 & RR 65 On July 16/10 please inspect west entrance on gov't road allowance north of the N1/ W5M. Advise administration if gate is still there. July 12/ Completed July 20, 2010 Road was in good condition Request for gravel in cul-de-sac - not graveled for many years. July 22/ Completed July 21, 2010 Temporary stop sign erected with brushing to follow. Stop Sign is missing at intersection of TWP 464 and RR 63. Brushing is required as well. 9 PIGEON LAKE REGIONAL WASTEWATER PLANNING COMMITTEE - REQUEST FOR GRANT EXTENSION (Issue # ) File #: REVISIT KISKAYO TRAIL SOCIETY - DEER TRAIL (Issue # ) The Pigeon Lake Regional Wastewater Planning Committee is comprised of the municipalities of the County of Wetaskiwin, County of Leduc, the Summer Villages of Ma-Me-O, Sundance, Grandview, Norris, Poplar Bay,Crystal Springs, the North East Pigeon Lake Regional Services Commission, and the Pigeon Lake Indian Reserve #138A. The Committee exists to address wastewater issues surrounding Pigeon Lake, and the associated environmental and health concerns by constructing and operating a Regional Wastewater System to service the growing population around the Lake. The Planning Committee successfully applied for funding under the Regional Partnership Initiatives Exploration Grant in order to fund a governance study to determine the best structure to build and maintain a regional wastewater system around Pigeon Lake. The Regional Partnership Initiatives Grant was approved with a date of final project completion and reporting of June 30, While the initial study was completed prior to this deadline, more work exists with the governance structure, which is ongoing due to negotiations with additional stakeholders around Pigeon Lake. With that in mind, the County, as managing partner of the Committee applied for an extension on the end date for the RPI grant. On August 18th, 2010 a letter was received from Alberta Municipal Affairs advising that the request for a time extension for the Pigeon Lake Regional Wastewater Planning Committee's exploration grant was approved with an amended completion date of June 20th, An amending conditional grant agreement was provided requiring signature by signing officials for the County. Administration recommends Council ratify the Alberta Municipal Affairs Regional Partnerships Initiative 2008/2009 Amending Conditional Grant Agreement for the Pigeon Lake Regional Wastewater Planning Committee project as presented with an amended completion date of June 20th, Resolution #PW MOVED: By Councillor N. Watson to ratify the Alberta Municipal Affairs Regional Partnerships Initiative 2008/2009 Amending Conditional Grant Agreement for the Pigeon Lake Regional Wastewater Planning Committee project as presented with an amended completion date of June 20, At the July 6, 2010 Council for Pubic Works meeting Council reviewed the request from Kiskayo Trail Society regarding Deer Trail and at that time Council decided to table discussions pending the outcome of the proposed Paul Norris subdivision approval on NE W5M regarding trail development plan, the initial construction costs and responsibilities. Administration informed Mr. Hall that the issue was tabled until the August 4, 2010 Council meeting awaiting the outcome of the development discussions. (Resolution # , Issue # , Page 14 of 16) At the July 8, 2010 Planning and Economic Development meeting Council reviewed the issue further and resolved to approve the work to be completed within Crystal Springs subdivision, in which to allow work to be completed on County Municipal Reserve (MR), to develop a walking trail subject to proper agreements and supervision by County staff and that no costs will be incurred by the County other than Administration's time. 10 Following the Planning and Economic Development meeting which reviewed the Paul Norris Sub-division, Administration prepared a Right of Entry Agreement which was sent to Ms. Sylvia Roy, Summer Village of Crystal Springs Administrator. On August 25, 2010 Administration ed Ms. Roy requesting information on the status of the Right of Entry Agreement for the construction of 1,000 feet of walking trail near Pigeon Lake. On August 26, 2010 Ms. Roy ed the following response: "We have an entirely new Crystal Springs Council as a result of the recent municipal election. The new Council have indicated that they do not want to further develop this portion of trail nor do they intend to expend any funds to do so. I'm not certain of what their position will be in the future, but this is their current position." Therefore, Administration recommends that Council rescind Resolution #PD of the July 8, 2010 Planning and Economic Development meeting which reads: "MOVED: by Councillor L. McKeever that Council approve work to be completed within Crystal Springs subdivision, in which to allow work to be completed on County Municipal Reserve (MR), to develop a walking trail subject to proper agreements and supervision by County staff and that no costs will be incurred by the County other than Administration's time. (Resolution #PD , Issue # , Page 29/30 PD)" 2011/2012/2013 THREE YEAR BRIDGE REQUEST LIST - ALBERTA TRANSPORTATION RESPONSE (Issue # ) File #: At the May 18, 2010 Public Works Council meeting, D.Dextraze, Director of Public Works reviewed the Three Year Bridge Plan with Council providing explanation of the priority ratings for Council's review and approval. At that time Council resolved to approve the Three Year Bridge Plan for submission to Alberta Transportation. (Ref: Issue# ; Resolution#PW ; pages 16 &17 of 22) Correspondence was received on August 30, 2010 from Alberta Transportation regarding the status of funding for the 2011/12/13 Bridge Request List. The letter clarified that this list does not constitute formal funding approval as the funding is subject to provincial budgets. The 2011 projects will be confirmed through Bridge Authorizations which will be sent at a later date. The following projects have been tentatively scheduled: Page 10 of 29

In addition, due to the low traffic volumes, short detour length and proximity to Hwy 792, funding for this structure is a low provincial priority. BF 01547, Muskeg Creek near Westerose, INE W4M Funding for an assessment or replacement at this time is considered a low provincial proirity. BF 73311, Washout Creek near Alder Flats, WSW W5M Repairs on this structure are a low provincial proiority. BF 77843, Bigstone Creek near Falun, WSW W4M The existing culvert is in fair condition and functioning as intended, We suggest you continue to monitor the sag and potential seam infiltration on the regular BIM inspection cycle as this structure is a low provincial priority for funding. BF 01825, Battle River near Westerose, ISW We suggest the County complete the minor repairs recommended in the current BIM inspection. It would appear that this culvert is nearing, but not at the end of its service life. We would suggest reducing the BIM inspection cycle to 12 months and monitoring the structure. BF 06769, Poplar Creek near Winfield, SSW W5M We suggest the County carry out the culvert strutting recommended in the 2004 engineering assessment. The culvert replacement is considered a low provincial priority. BF 80997, Lloyd Creek near Hoadley, WSW We would suggest monitoring the structure on a reduced BIM inspection cycle. Replacement of this structure is considered a low provincial priority. BF 75450, Horseshoe Creek near Alder Flats, INW W5M Considering the low traffic volumes and the 1 km detour length, funding for a replacement structure is a low provincial priority. BF 75497, Watercourse near Hoadly, WSW W5M Due to the low traffic volumes and short detour length, funding for this culvert is a low provincial priority. BF 763, Watercourse near Wetaskiwin, SW W4M The existing culvert is in fair condition and functioning as intended. We suggest you continue to monitor the corrosion in the floor and culvert shape through the regularly scheduled BIM inspection. BF 2122, Watercourse near Brightview, SW W4M Funding for this structure is considered a low provincial priority. BF 7312, Watercourse near Westerose, NW W5M Funding for the design of the replacement of this structure is a low provincial priority. We suggest the County follow the maintenance recommendations on the recent BIM. BF 8191, Watercourse near Brightview, NW W4M Funding for this structure is considered a low provincial priority. We suggest that the County repair the backwall sheathing. BF6830, Pipestone Creek near Millet, SE W4M Funding for level 2 coring is a low provincial priority. We suggest that the County monitor the condition of the bridge on a reduced BIM cycle. BF 8525, Watercourse near Brightview, NW W4M Funding for level 2 coring is a low provincial priority. 13 Alberta Transportation welcomes the opportunity to discuss the bridge requests further if necessary. Administration expressed their frustration with the current bridge funding program and declining provincial support for local bridge infrastructure. Administration recommends that Council accept the 2011/2012/2013 Three Year Bridge Request List - Alberta Transportation Response as information. Resolution #PW MOVED: By Councillor B. Shantz to accept the 2011/2012/2013 Three Year Bridge Request List - Alberta Transportation Response as information. BRIDGE FILE TODD'S CROSSING MONUMENT - DEDICATION (Issue # ) File #: PWBF349 S. Radis, Communications Officer entered the meeting at 10:40 a.m. The replacement of Bridge File 349, funded 2/3 by the Canada Alberta Municipal Rural Infrastructure Fund (CAMRIF) is complete. A requirement under the CAMRIF program for this project was that aboriginal consultations be carried out with the Four Bands due to their proximity to the structure and the possibility of historical trails or other items of significance to the Bands. Upon consultation, the Samson Cree Nation filed a concern that this area was of historical significance. The requirement under the CAMRIF guidelines is to address these concerns before the project could proceed. Having good relations with the Samson Cree Nation allowed for a quick meeting and resolution to these concerns so CAMRIF would approve proceeding with the project. The agreement at that time was to erect a monument and have a dedication ceremony. Mr. Harvey Buffalo, Archival Researcher, advised that the site was known as "Todd's Crossing", a river crossing which in the early 19th century was home to an overnight lodge of sorts which was utilized by travellers passing through the area. Direct descendents of the Todd's were located, and together with Harvey Buffalo the inscription was written for the commemorative monument recognizing the history of Todd's Crossing. The dedication ceremony, held Tuesday, September 7th, on site, included participants Reeve Garry Dearing, Harvey Buffalo, Archival Researcher, Wilson Okeymow, Traditional Speaker and Elder Samson Cree Nation and his assistant, Blaine Calkins, Member of Parliament and Audrey Poitras, Metis Nation of Alberta. The dedication was well received by the community and the Todd Family, who had 21 members attend and all were extremely grateful for the recognition of their family and the metis community. Through this process the County Administration team met the guidelines of the CAMRIF program and have fostered the relationship with the neighboring community of First Nations, a relationship that will continue to be fostered as both parties strive to acknowledge and preserve history in the County of Wetaskiwin on future projects. In acknowledgement of the traditional participation from Wilson Okeymow and his assistant, as well as Harvey Buffalo, honorariums were paid personally by Frank Coutney, in the amount of $ s have been received from Todd Family members following the event, as follows: Page 13 of 29

14 Glorie Veenstra - Thank-you once again for the beautiful ceremony honoring our family, it truly was one of the highlights of my life. This section of road with-in the Curilane Beach subdivision requires culvert replacement do to water flowing over the road and flooding Mr. Yee's property. The road is narrow (approximately 5 meters) and will be widened when the culvert is replaced. Currently there is no drainage easement through Mr. Yee's property to protect the off site drainage flowing through this property. The County and the owner do hereby mutually covenant and agree each with the other as follows: That the county will remove the trees and shrubs from the road way and fence line That the county will remove the wood on the road right of way. That the county will not be responsible for replacing the fencing. That the county will install a 600 mm culvert diagonally to the south east corner of the property. The county will extend the 600 mm culvert on the property parallel to the east property line for approximately ten meters to the existing drainage channel and supply an extra seven meters of culvert to be installed by owner. That the owner shall enter into an agreement with the county for a five meter drainage easement. There will be no compensation other than that mentioned above for this Right-of-Entry Agreement. The following Right of Entry Agreement requires Council approval: Right of Entry Agreement with Elizabeth and Andi Pallas to allow traffic to detour through the Pallas's property (SW W4M) while County Crews are completing center line culvert replacement on the local road located in the Curilane Beach subdivision adjacent to Mr. Star Yee's property located at SE W4M (lot 4, block 3, plan 4922KS) in Curilane B. The Curilane Beach subdivision has only one entrance/exit suitable for local traffic and therefore an alternate route is required for local and emergency access to the western portion of the subdivision. The County and the owner do hereby mutually covenant and agree each with the other as follows: That the County will detour the local traffic through the property. That the County will be responsible for damages due to traffic. There will be no compensation other than that mentioned above for this Right-of-Entry Agreement. Page 15 of 29

RIGHT OF ENTRY AGREEMENT - ALAN GILCHRIST - SW W4M (Issue # ) Roll #: County crews inspected the above noted property and the ditch along Range Road 274 north of Highway 13 is in need of drainage improvements due to depressions and an uneven grade which holds back water. The Maintenance Budget has allocated money to complete minor ditch and back sloping repairs when necessary. County crews will be completing minor ditch and black sloping repairs for approximately.5 mile to improve the drainage to prevent any damage to the County's local road road. Whenever County staff or Contractors enter private property, a Right of Entry Agreement is entered into to clearly state the intentions of the County. The following Right of Entry Agreement with Alan Gilchrist requires Council approval to allow the County crews to complete back sloping in the ditch. The County and the owner do hereby mutually covenant and agree each with the other as follows: That the County shall back slope the ditch That the County shall not be responsible for the re-seeding the area back sloped There will be no compensation other than that mentioned above for this Right-of-Entry Agreement. DAVID BLADES AND STEVE MAJEK-REQUEST TO REGISTER A ROAD PLAN FOR TWIN LAKES ROAD (Issue # ) Roll #: Steve Majek, Director of Agricultural Services entered the meeting at 11:01 a.m. On September 5, 2010 the County received a fax from Gail Platz, Algola Holdings Ltd. Shareholder requesting that the Twin Lakes road become a registered road plan which would then provide access to the bottom half of the Platz property at NW W5M. At the August 6, 2003 Council General meeting Council reviewed a request from Algola Holdings Ltd. to utilize the road on County property at Twin Lakes to access a proposed development. At that time Council denied the request due to liability, costs for changes required and vandalism at Twin Lakes Park. (Ref. Page 2003/181 C) Page 16 of 29

17 Algola Holdings Ltd. appealed the decision of Council, a request was presented at the Sub-division appeal board hearing on September 25, At that time the SDAB approved the request subject to the following conditions: Building not to encroach on Registered Right of Ways or Utility Service Lines. Location and use of proposed development shall be as specified by documents submitted by applicant. The Developer shall obtain a building permit and any other permits or approvals required pursuant to the requirements of the Safety Codes Act, and shall have such permits in place prior to commencement of the work authorized under each permit. It shall be the responsibility of the Developer to provide the County with a copy of the Building Permit and plans PRIOR to the commencement of any development. A list of agencies authorized by Alberta Municipal Affairs to issue permits and conduct inspections is attached. The Developer is to have the sewage disposal system inspected by an accredited agency authorized to carry out plumbing inspections within the County of Wetaskiwin. If the system does not meet current standards the Developer must upgrade it. Evidence that this condition has been met must be provided to the County. The applicant shall contact Lee Bowman at Alberta Transportation ( ) to determine access requirements including upgrade specifications from Highway 13. The applicant shall be responsible for one of the following options: a)register and rebuild a road to County Standards on NE W5M; as well as upgrading Road Plan 1389NY to County Standards; b)build a road to County Standards on the government road allowance on the west boundary of the Algola Holding Ltd. property; as well as upgrading Road Plan 1389NY to County Standards; c)build a laneway on Algola Holding Ltd. property 7. Should the applicant choose options 6a) or b) they shall be required to construct a turnaround on the south boundary of the road plan 1389NY and move the gate from Highway 13 to the turnaround. (Ref. Page 2003/48 SDAB). Steve Majek, Director of Agricultural Services provided the following comments: The access gate to Twin Lakes is locked throughout the winter months and access is only granted to three scuba diving clubs but there is a key in the community which is held by Mike Hussey. Allowing the road to be registered and used year round may present seasonal maintenance issues due to steep grades and if the gate were to be relocated to behind Algola Holdings Ltd. approach the approximate cost to construct a turn around and relocate the gate would be $15, Steve Majek, Director of Agricultural Services recommended that Council adhere to the resolution regarding the appeal of the Development Approval 03/115 including all of the seven conditions stated. There is currently access to Algola Holdings Ltd. property off of Highway 13 and the current road is meeting the needs of summer access to Twin Lakes Park. This road is on County property and is not within a designated road right of way. If Council chooses to designate a registered road right of way by Road Plan, legal survey's would be required and obstructions (the gate) removed. Past issues with people wishing to develop their property included a minimum 50% contribution from the land owner. Page 17 of 29

18 Public Works Administration recommends that the Twin Lakes road be left as a private road due to the steep grade, sharp curves and steep side slopes that presents maintenance challenges in the winter due to snow and ice. The road is not developed to County standards at this time. If this road was to become registered the road would need improvements to meet County road standards which would include side slope improvements and guard rail. Option A) Council to deny the request to have Twin Lakes road become a registered road plan due to the sub standard road and no funds allocated in the 2010 operational budget. Option B) Council to recommend Administration bring the request to have Twin Lakes road become a registered road plan to the 2011 Strategic Planning and budget deliberations. Option C) Council to approve the request to have Twin Lakes road become a registered road plan and budget for legal survey, road improvements and increase maintenance. Administration recommends that Council deny the request to have Twin Lakes road become a registered road plan due to the sub standard road and no funds allocated in the 2010 operational budget. Resolution #PW MOVED: By Councillor N. Watson to table the request from Algola Holding Ltd. to have Twin Lakes road become a registered road plan. TABLED S. Majek left the meeting at 11:02 a.m BRIDGE MAINTENANCE PROGRAM - TENDER RESULTS (Issue # ) File #: As per the 2010 Strategic Planning and Budget approval, Council determined to maintain consistent budgeting despite lack of approved bridge projects by Alberta Infrastructure & Transportation and have now generated a bridge reserve that allows for future bridge repair/replacement. The 2010 Funded Projects Budget included $2,641,397 total budget for bridges capital and repairs with $650,000 coming from the 2010 operational budget. Not all the 2010 bridge replacements and repairs will be completed in 2010 due to no approvals from Alberta Transportation or land acquisition problems therefore leaving a surplus in the operational funds that in past have been placed in bridge reserves. There is currently $79, remaining in the Miscellaneous Bridge Repair Budget with approximately $200,000 from projects that will not be completed in In an effort to further reduce costs Administration has tendered the 2010 Bridge Maintenance Program which invited contractors to quote on eleven bridge repair projects. The list of bridges could possibly be done in-house but due to the back -log of Bridge Maintenance issues that may require specialty repairs, Administration felt that some of the repairs could be better completed by Bridge Specialists. NOTIFICATION OF PIPELINE CONSTRUCTION (Issue # ) Roll #: On August 4, 2010 Administration received a Notification of Pipeline Construction from a Land Agent for Fairborne Energy Ltd, proposing to install a pipeline from the soon to be drilled well at W4M to a pipeline at W4M. The proposed pipeline tie-in is to be located at NW W4M; the Mulhurst Transfer Station. The Notice of Pipeline Construction Tie-in and Alberta Right of Way Agreement was attached for Council's information. The fee associated with the 15 meter pipeline tie-in by Fairborne Energy Ltd. will be in the sum of two thousand and five hundred dollars ($2,500.00). An additional fee of one hundred and fifty dollars ($150.00) will be required for a 10X50 meter temporary work space, both as one time payments. The proposed pipeline will require a 15 meter Right of Way (ROW) for a pipeline that will be used to transport sweet natural gas. The proposed pipeline tie-in does not interfere with current transfer station infrastructure or does not conflict with future expansion of the transfer station. Administration recommends that all salvageable wood be bucked and stacked and the remaining debris be cleared off site. Options for Councils Consideration are as follows: 1. To not approve the proposed pipeline tie-in. Should this occur, it would be considered to be an objection to the Energy Resources Conservation Board (ERCB). A mediation process could also be initiated. Alternatively, Fairborne Energy Ltd. may abandon the proposal with the County. 2. To approve the Fairborne Energy Ltd. request to construct a pipeline from the soon to be drilled well at W4M to a pipeline at W4M and that the County enter into the Alberta Right-of-Way Agreement with Fairborne Energy for two thousand and five hundred dollars ($2,500.00) as a one time payment, along with an one time payment of one hundred and fifty dollars ($150.00) for temporary workspace (10X50 meters). With the additional condition to the Alberta Right-of-Way Agreement: All salvageable wood be bucked and stacked and the remaining debris be cleared off site. Page 20 of 29

21 Any easement request on County owned property requires Council's approval. D. Dextraze explained on the map where the easement is requested for a sweet gas line and that Administration does not see any interference with the transfer station or future development. Additional conditions will be added to the agreement such as the work area to be seeded back to grass when complete, wood to be bucked up and stacked into 16" lengths and at the request of the County Fairborne Energy shall locate and expose the pipeline to facilitate any County construction, site developments or crossing. Administration recommends that Council approve Option 2 for Fairborne Energy's Ltd. request to construct a pipeline from the soon to be drilled well at W4M to a pipeline at W4M and that the County enter into the Alberta Right-of-Way Agreement with Fairborne Energy for two thousand and five hundred dollars ($ ) as a one time payment, along with an one time payment of one hundred and fifty dollars ($150.00) for temporary workspace (10X50 meters).with the additional condition to the Alberta Right-of-Way Agreement: All salvageable wood be bucked and stacked and the remaining debris be cleared off site. At the February 11, 2010 Council for Planning & Economic Development Meeting the well site for SW W4M was approved by Council (Ref Issue # , Resolution #PD ). Administration is presenting the following information to Council for consideration regarding the proposal by Quicksilver Resources Canada Inc. The Notice of Proposed Pipeline Tie-in and Alberta Right of Way Agreement is attached for Council's information. The fee associated with the above noted pipeline tie-in by Quicksilver Resources Canada Inc. will be six thousand eight hundred twenty five dollars($6,825.00). The proposed pipeline will require a minimum of 12 metres Right of Way (ROW) for a pipeline that will be used to convey low pressure sweet natural gas from coal (NGC).
