2 MINUTES OF MEETING COMMON PROPERTY AND FOREST COMMITTEE August 4, 2014 The regularly scheduled meeting of the Common Property and Forest Committee was held on August 4, 2014, at 1:30 P.M. at the Coronado Center. Those attending were: Bill Wood, Chairman Bruce Caverly Dan Webb Fred Jonas Steve Romine Joe Burleigh Frank Shandor Mike Medica, Board Liaison Mary Ann, Village Voice Beverly Ellison, Manager, Permitting & Inspections Brenda Pate, Secretary, Permitting & inspections I. INTRODUCTION OF GUESTS: Bill Wood welcomed Norman Bushee, Property Owner, Linda Mayhood, Asst. General Manager POA, Bill Walker, property owner and retired Forester to the meeting. II. APPROVAL OF MINUTES: Bruce Caverly moved to approve the minutes for July 7, Dan Webb seconded the motion and the motion passed unanimously. III. IV. CHAIRMAN REPORTS: None STAFF LIAISON REPORTS: Fall Bow Hunt was discussed. There are currently people pre-registered for the hunt. A press release will be sent to the paper to clarify the requirements for the hunt and clearly explain the rules. V. BOARD LIAISON REPORTS: Mike Medica briefed the committee on recent Board issues. COMMITTEE MEMBER REPORTS: None NEW BUSINESS: Barcelona 11 Barcelona Way - Request to identify beetles and cause of dying tree Joe Burleigh inspected beetles and found common beetles and tree was not severely damaged by insects. No further action needed and file can be closed. 2. Emerald Ash bore Beetle There was discussion regarding the possibility of the ash borer beetle in HSV. Joe Burleigh advised that he has not known of any instances of the beetle in the area. Since there are not many ash trees in HSV, it should not be a problem here. 3. Balearic Road Complaint of cutting trees on common property without a permit Bill Wood and Bruce Caverly visited the site and presented pictures of the cleared area for the committee to review. Mr. Bushee spoke to the committee regarding the cutting and advised that wrong doing was not intentional. He would like to work with the POA to resolve the issue and do what is best for Hot Springs Village. Mr. Bushee explained that he bought the reserved property from Cooper Communities, Inc. (CCI) and cleared the trees for a road to the new property. Mr. Bushee stated that he was working as a contractor for CCI to build the road. He explained that his property was land-locked and he needed access from Balearic Road to the property. Discussion followed regarding the encroachment of the road being built through common property and why so much land was cleared to build the road. Since CCI hired Mr. Bushee to build the road, does CCI have the right to build a road through common property without permission from the POA? Mr. Bushee assumed that CCI had the authority to build the road through common property, since they are the developer of the village. He also advised that he intends to landscape and screen the area to make it attractive. He also plans to apply for a sign permit and a permit to install a gate. The committee tabled the matter until the following items are completed: 1.) Legality of CCI having authority to cross common

4 property; 2.) If the road is allowed, Mr. Bushee will be required to submit a plan outlining the phases of his intended building project; 3) Plan of how the common property will be replanted, landscaped, and screened. IX. OLD BUSINESS: Hendaye 16 Hendaye Way Class I permit approved and expired Applicant requested an extension to complete the job. The golf course has agreed to do some of the cleanup on the golf course side, but the area has been too wet to do the cleanup. The committee agreed to extend the permit for 60 days Murillo 43 Ola Way Class 1 permit approved ; Final inspection completed by Dan Webb and found work completed as permitted. The file was closed Peral 12 Bolada Lane Class 1 permit approved July 10, 2014, to trim branches from 15 tall trees that are blocking the applicant s view. Customer has decided that trimming the branches will not improve the view and are now asking for a class II permit to cut the trees. The logs will be cut into smaller sections and left lying on the common property to prevent erosion. The committee closed out the class 1 permit and agreed the applicant should reapply for class II permit. X. PENDING BUSINESS Ladera 24 Tranquillo Lane Complaint of abuse of common property Common property was cleared without a permit; the owner submitted a landscape plan of including gravel, 10 crape myrtle trees, and three Bradford pears to restore the common property. The committee approved the plan, with the exception of the gravel being installed only in the ditch area; the other area of common property past the ditch area must be seeded with grass. After a site inspection, it was found that there was gravel installed where grass was supposed to be planted , the Committee agreed that there was no issue with the gravel area. Since the trees that were planted are so small or appear to be dead and were planted in the wrong place, the committee is requiring trees to be replanted in the area marked with orange paint. This area is described as being on the inside row of the existing tall trees. The trees are required to be a 5 gallon root ball, 6 tall trees of the flowering type or otherwise the trees have been planted and the property line was found. This item will remain in the pending section until August Teruel 27 Alina Lane Complaint of clearing common property without a permit Complaint was investigated and violation found. Bill Wood and Bruce Caverly visited the site on July 23 and found the common property cleaned behind the owner s home. No action will be taken against the homeowner since the work done on common property would have been approved as a class 1 permit, if a permit was applied for. A letter was sent to the owner advising that no further cutting will be allowed on the common property without a permit. The committee also extended an offer for the applicant to apply for an annual maintenance certificate. The file may be closed. XI. OTHER BUSINESS:

5 Discussion regarding letting new property owners being informed what the common property guidelines and regulations. In the past, CPFC has made copies of the guidelines and gave copies to the Chamber of Commerce, realtors, and title companies to let new owners know what the regulations are. The information should be on the POA s webpage also. Discussion regarding the Balboa Beach being common property and members getting complaints that some people are going to the beach that are not property owners nor have proper authorization to be at the beach. XII. ADJOURNMENT: The regular meeting was adjourned at 2:53 p.m. The next regular meeting will be held on Monday, September 8, 2014 at the Coronado Center.
