1 OFFICE OF THE CITY MANAGER February 1, 2013 TO: FROM: SUBJECT: Honorable Mayor and City Council AT/al Alan Tandy, City Manager General Information Miscellaneous News Attached is information that shows the County of Kern understood, reviewed and accepted the Fire Fund calculations in 2005, then the paid the amounts for six years. Current staff now claims the calculations were done in error. As to our other dispute with the County we received documents from the new Auditor-Controller this week that clearly indicated her office unilaterally reduced the City s property tax allocation for the current fiscal year by approximately $483,000. This is the result of applying the County s new interpretation of the master tax split agreement on annexations dating back to FY Up to this point we were told this would be taking place, however this document confirms the amount. In addition, six other cities in the County have been impacted by this as well. In total, approximately $659,000 has been credited to the County s General Fund under this erroneous action. We continue to try to find solutions, but have been met with no substantial dialogue from the County which would lead to a potential resolution. Unilateral actions such as these do not help to that end! We are attempting to obtain funds from Caltrans, and, in turn, contract with the Homeless Shelter to perform freeway litter clean up. Dealing with Caltrans takes time, and the outcome is uncertain, but we are trying! As a precursor to the Community Services Committee discussion, a memo from the Public Works Department is attached. TRIP News Truxtun Avenue o Nighttime lane closures are planned for Truxtun Avenue, from Commercial Way to State Route 99, beginning on Monday, February 4, 2013, to allow the contractor for the Westside Parkway to install curb and gutter, complete remaining drainage work and pave the roadway, weather permitting. The closures will affect both eastbound and westbound lanes between the hours of 9 p.m. and 6 a.m. The outside eastbound lane will be closed from Commercial Way to State Route 99, and the outside westbound lane will be closed from Commercial Way to Empire Drive. At least one lane in each direction will remain open to traffic at all times; however, all lanes will be reopened in time for the morning commute. Lane closures in this area are expected to last through the end of February.
2 General Information February 1, 2013 Page 2 TRIP News continued Coffee Road o On Wednesday and Thursday, February 6-7, 2013, the outside southbound lane of Coffee Road, from Truxtun Avenue to Brimhall Road, will be closed between the hours of 9 p.m. and 5 a.m. while the contractor sets concrete girders for the Coffee Road Bridge widening across the Cross Valley Canal. Flaggers will need to intermittently stop all southbound traffic for up to 10 minutes while the girders are lifted off trucks and put into place. Northbound lanes will not be impacted by this operation. All lanes are expected to reopen in time for the morning commute. State Route 58 o Eastbound and westbound lane closures on State Route 58, between Real Road and the Cottonwood Road interchange, will continue at night for the next week to allow crews to drill for soil samples in support of the preliminary engineering and environmental work underway for the Centennial Corridor Project. The closures will remain in effect between the hours of 8:30 p.m. and 4:30 a.m. At least one lane will remain open to both westbound and eastbound traffic at all times; however, all lanes are expected to reopen in time for the morning commute. Shoulder closures may also be required while work is underway. State Route 99 o A similar nighttime lane closure is planned for alternating northbound lanes of State Route 99, between the Ming Avenue and White Lane/Wible Road interchanges, beginning February 7, The closure will happen on State Route 99 between the hours of 8:30 p.m. and 4:30 p.m. At least one lane will be open to northbound traffic at all times. Southbound lanes will not be impacted at this time. All lanes are expected to open in time for the morning commute. As always, more information can be found at:

24 PUBLIC WORKS DEPARTMENT MEMORANDUM TO: Alan Tandy, City Manager FROM: Raul Rojas, Public Works Director DATE: January 29, 2013 SUBJECT: Caltrans Freeway Litter Update In light of recent discussions both in the media and at our most recent City Council meeting, the Solid Waste Division has been asked to research some funding sources and identify parameters for removing freeway litter. After meeting with Caltrans, private sector sponsors, the Bakersfield Homeless Center (BHC) staff, and other partners, staff is prepared to propose a thorough freeway cleanup program at no cost to the City. Funding for this program is expected to come primarily from Caltrans, who have stated that around $250,000 is available annually for two years to Bakersfield in the event the City coordinates freeway cleanups in the City. Additional funding is anticipated from local private sector donors such as PG&E, Federal Express, Coca Cola, and Kyle Carter, among others, who have expressed an interest in contributing financially and otherwise to a solution. Private sector funding would be donated through the Bakersfield Foundation. Caltrans funding and private sector funding would then be used to contract with the Bakersfield Homeless Center. The City already has a very successful agreement with BHC for this type of service at the Mount Vernon Green Waste Facility. Both the City and BHC are prepared to change the agreement to allow BHC clients to perform freeway cleanups. Other cleanups groups such as the Mayor s Freeway Cleanups, Adopt-A-Highway volunteers, Kern County Probation Department and other sources can then be used to supplement and further improve upon this foundation. The Solid Waste Division, working with Keep Bakersfield Beautiful volunteers, is prepared to coordinate routing of crews. Agreement drafts are circulating with BHC and Caltrans at this time.

26 BAKERSFIELD POLICE MEMORANDUM Date: January 30, 2013 To: From: Subject: Alan Tandy, City Manager Greg Williamson, Chief of Police 2012 Crime Stats I have attached the Part 1 Crime Statistics for There was a 17.9% increase in overall crime from The overall crime rate in 2012 was 556 reported crimes per 10,000 citizens. The Part 1 Crime rate in 2012 is comparable to 2008 being 555 crimes per 10,000 citizens. The overall crime rate per 10,000 individuals for the previous five years is: There were 34 homicides in 2012; 15 were gang related. The average number of homicides per year over the past ten years has been 25. There were 1,141 aggravated assaults, a 9.5% decrease compared to There was an increase in the following reported crimes from 2011 to 2012: Rape 43.6%; Larceny 17.4%; Auto Theft 35.7%; Robbery 23.4%; and Burglary 15.6%. The rape category increased by 17 offenses for a total of 56, compared to 39 offenses in Fourteen of the 56 offenses were committed by strangers and one that occurred in the prior year was reported in Four of them were unsuccessful rape attempts. The Bakersfield Police Department is committed to reducing crime in our community. In an effort to combat crime, staff will proactively and aggressively pursue gang related crimes and use crime analysis to identify crime trends. The Bakersfield Police Department Crime Prevention Unit will continue to establish a positive working relationship with the community to effectively educate citizens on preventative safety techniques and encourage collaboration between the police department and the public.
