Follow Bradley CEO S REPORT The review of the Liquor Control Act is the first opportunity in 7 years that the industry has had to present critical recommended changes to Western Australia s liquor licensing system. The AHA(WA) s membership accounts for 80% of licensed public venues of which the sale, supply and service of liquor is a key component. It was therefore vital that our submission on behalf of members was comprehensive and provided a clear position to each of the Independent Review Committee s 141 recommendations to Government. Each of the AHA s recommendations have been subjected to member consultation in 2013 and then careful and critical analysis to ensure the interests of a responsible, wellregulated hospitality industry is represented. The AHA has also ensured that the process is not co-opted by the tax-payer funded public health lobby or used as a tool to attack responsible hospitality businesses and implement an anti-alcohol agenda. The AHA(WA) industry response to the review has been the product of many months of work and this initial stage is now complete with a 70 page document now with the Minister for Racing, Gaming and Liquor for consideration. Key priority issues of significant concern have been identified which include opposing the proposed Hospitality Venue Tax (HVT) eliminating additional red tape and compliance and limiting licensees compliance and exposure to liability. The AHA(WA) has also spoken out on the attempts of other groups to skew the Act away from facilitating the proper development of a responsible, well-regulated industry and towards implementing an unwarranted attack on licensees and campaigns against alcohol. The submission of the report by no means marks the conclusion of the review process; indeed this is just the beginning. We ve been through a gruelling pre-season training and preparation regime; we ve selected our team and only now are we ready to play our first game. Now we all need to work together to ensure a united industry voice is heard. Congratulations to the AHA(WA) staff involved in the delivery of the 2014 Hospitality Expo and Conference and for delivering a fantastic event. The AHA(WA) is fortunate to have a professional, committed team of staff with a very low staff turnover rate of less than 10 per cent per annum. 5 General News AHA SECURES CHEFS ON SKILLED OCCUPATION LIST The Federal Government has reinstated chefs to the Department of Immigration and Border Protection Skilled Occupation List after AHA advocacy. Chefs will be re-instated to the Skilled Occupation List (SOL) from 1 July 2014 to help meet the skills needs of the Australian economy, as announced by the Minister for Trade and Investment, the Hon Andrew Robb MP and the Assistant Minister for Immigration and Border Protection, Senator the Hon Michaelia Cash. There has been a national shortage of qualified chefs throughout the Australian Hotel and Hospitality Industry since they were removed from the Skilled Occupation List by the Labor Government four years ago. In Western Australia as a result of these changes, pubs, taverns, restaurants and small bars have struggled to fill chef job vacancies and the salary expectations of employees have been unrealistic because of what chefs can make in the mining industry. The AHA(WA) therefore welcomes the Commonwealth Government re-appointment of chefs to the Department of Immigration and Border Protection Skilled Occupation List. The AHA has advocated a return of chefs to the Skilled Occupation List but with greater checks and balances to ensure demonstrated competencies and qualifications are met. We all know that there are skilled people who are willing to come and work in the industry where they are needed, it is great the government has acknowledged this and amended the list accordingly. AHA(WA) members and industry will now have greater flexibility to recruit skilled chefs from overseas when they cannot source these skills locally. This will be especially welcomed in regional areas, where there is a known deficit of skilled workers in the hospitality industry. This is an issue that the AHA(WA) has worked on tirelessly to ensure the best possible outcome for its members and the industry. AHA(WA) efforts have even extended overseas where in 2012 the AHA travelled to Dublin to encourage experienced Irish hospitality workers to fill over 5,000 jobs and spend up to two years working in Western Australian pubs, hotels and restaurants. Free seminars were held, where the AHA outlined the opportunities for chefs and Irish people under 30 years of age to travel and work in Western Australia. The Assistant Minister for Immigration and Border Protection, Senator the Hon Michaelia Cash, has been instrumental in this process and has consulted with industry to understand the needs of Western Australia s Tourism and Hospitality Businesses. The AHA(WA) and industry will continue to address the shortage of young people taking up training and apprenticeships in the hospitality sector. 6 Inside News PRESIDENT S REPORT The first half of 2014 has all but been and gone and what a start to the year it has been. The AHA(WA) has been busy advocating on behalf its members, we ve held three very successful events, managed a purpose built online portal system to monitor room availability for MH370 victims families and we continue to fight for the best deal possible out of the Liquor Control Act review. The 2014 Hospitality Supplier Awards were held on 12 May 2014 and showcased the high calibre products and services available to the Western Australia Hotel and Hospitality industry. Almost 500 guests attended and experienced a signature dish from Perth s premier, world renowned Japanese Restaurant, Nobu, and many experienced Japanese Sake for the first time, tasting Go-Shu Sake from Sun Masamune Brewery and toasting Kanpai with Master Sake Sommelier Mr Ad Blankestijn from Daishichi Sake Brewery in Fukushima and Mr Shinichiro Honda from Honda Shoten Brewery in Hyogo Prefecture. Ladies throughout the room were dressed in kimonos from Perth Kimono Club. Lion, one of Australia s major brewers, was again a standout this year collecting five awards including WA s Best Hotel & Hospitality Supplier for the third year in a row. The awards also recognise the relationships between industry and suppliers that maintain important local jobs, business reputation and strength. WA hospitality icon, Mr Edward Schimmel, from Advans Exhibition Services was recognised for his four decades of service to WA s conference exhibition and hospitality sector and was presented the WA Hospitality Industry Achievement Award. Hospitality Expo and Conference 2014 was a great success with almost 3,000 delegates attending over two days. Feedback has been positive and several exhibitors and suppliers have passed on their thanks even saying that it was the best Expo ever. Visitors to the Expo had the opportunity to attend a variety of free master classes across the two days which included lessons on Agave from Café Pacifico s Phil Bayly, mixing rum and whisky, the art of brewing, appreciating sake and learning how to create meals through sensory awareness with Kevin Cherkas from Cuca in Jimbaran Bay, Bali. Voted by attendees, Mega Vision Sound and Lighting took out the best booth product display, Amici Fine Foods was voted best new exhibitor and LRS Australia was voted best overall booth. Thank you to all of the exhibitors, conference and master class speakers and delegates who made this year s Hospitality Expo and Conference such a success. On a personal note, I am pleased to have been re-elected on the AHA(WA) board for another term. The election results were announced in May and you can read more about your representatives on page 13. 7 General News HOTELS CRITICAL ROLE IN MH370 Perth Accommodation Hotels thanked by the WA Government. Perth Accommodation Hotels have played an important role accommodating military, aviation personnel and government officials working on the search as well as ensuring forward room availability data was accessible to the Western Australian Government. The diligent assistance to this process enabled the AHA(WA) to provide a high level of support to Malaysia Airlines, Australian and Malaysian Government Agencies. The Chief Coordinator of the Joint Agency Coordination Centre (JACC), Air Chief Marshal Angus Houston AC AFC (Ret d), wrote to the AHA(WA) and said I would like to extend my particular thanks for the AHA WA s considerable logistical support in monitoring and making information available about hotel room availability. The AHA WA s support was of great value to the JACC in developing Australia s reception plan for any future services and rituals held in Perth for the families of the missing passengers and crew. The Department of Premier and Cabinet has thanked the Perth Hotel Accommodation Industry; saying the contribution of the Australian Hotels Association (WA) and its members to WA s preparation for this event, through developing and maintaining the database of hotel room availability, is much appreciated. International media coverage has shown the compassion and empathy Western Australians have afforded those affected as well as our ability to host and care for a sudden influx of guests. The Perth Hotel Accommodation Industry has been promoted in media all over the world, especially in the Asia-Pacific region. AHA(WA) CEO, Bradley Woods, has conducted interviews with Hong Kong s South China Moring Post, Malaysia s Sin Chew Daily, the China News Service, China Daily and CNN. All of these interviews are available in the News & Information section of the AHA(WA) website. Efforts to find the missing plane have moved exclusively below the surface. The work continues to review and analyse all available data and information relating to the likely flight path of MH370, together with the information acquired in the course of the search to date. 8 General News ANTI ALCOHOL MESSAGES Anti-alcohol rhetoric continues despite overall national alcohol consumption falling for the sixth year straight. Australians are drinking less alcohol overall than at any time in the previous 15 years, according to figures released by the Australian Bureau of Statistics (ABS). Across all alcoholic beverages, there were 9.9 litres of pure alcohol available for consumption in for every person in Australia aged 15 years and over - the lowest level since the mid-1990s. The ABS says that the decrease is mainly due to a continuation of the downward trend in apparent consumption of beer, at the same time as a flattening out in wine consumption. In terms of pure alcohol, consumption of beer has more than halved since the peak in the mid-1970s, and is now at the lowest level since For wine, there has been a stable increase in consumption over the long term but recently this trend has plateaued, and in fact, per person consumption of wine has decreased slightly over the past three years. Ready-to-drink beverages have also seen a drop over the past five years, while consumption of spirits has remained relatively steady. E x c l u s i v e t o So when the ABS announces that Australians are drinking less alcohol overall than at any time in the previous 15 years, 9 days later the Western Australian Police announce a strike team weekend blitz. Despite the WA Police Commission efforts to dampen community and industry sentiment issuing public statements with terms such as strike team weekend blitz on the Easter Long Weekend; Licensed premises and their staff will work professionally to support the community s efforts to serve and consume alcohol responsibly. The unfair portrayal of drunken violence in war-torn Perth is disappointing. Perth s licensed venues remain the safest place to drink and socialise and our offer is world class. The efforts of licensees and their staff should be recognised instead of trodden on whenever there is a public holiday or special event. Indeed at the most recent Perth liquor accord meeting, Police Liquor Enforcement Unit Officers said that stats inside licensed premised were down over the last three years. This is good to know and licensees are to be commended. Bars, Pubs and Hotels don t like drunks either; people who present themselves at venues after consuming alcohol excessively in private residences will not be welcomed in WA licensed premises on any day or any night.

9 General News CLUBS ASSOCIATION SEEKS MORE BENEFITS Clubs WA are launching fresh attacks on the viability of regional hotels and pubs as they campaign to be allowed to throw open their doors to the public, in direct competition with pubs and hotels. With the State Government currently considering recommendations of the Review Committee s report on the operation and effectiveness of the Liquor Control Act 1988, Clubs WA are mounting a renewed push for less restrictive licence conditions to grow clubs commercial liquor sales at the expense of tax-paying hotels and pubs. Traditionally, Club licences recognise groups that have been formed by local people as a way of bringing together shared interests where the sale and supply of liquor is secondary to pursuing the sporting, social, political, literary or other legitimate aim of the club. This restricts them from offering their facilities for non-member related commercial use for functions and events or to sell take-away liquor to the public. Clubs WA s Fair Go for Clubs campaign seeks to relax these conditions to allow clubs to: 1. Extend the authorisation to sell liquor to temporary members; 2. Include the authorisation to sell take away liquor and on premise bar sales to tourists; and 3. Allow non-private club member functions arranged by other community associations, to be allowed on their premises. The AHA(WA) supports the Review Committee s dismissal of arguments presented by Clubs WA to these recommendations. The Review concluded that the suggested amendments regarding club functions and the sale of liquor at non-member functions was not appropriate but resolved to amend the Act to authorise clubs to conduct up to 12 non-member functions per year, without the need to apply for an extended trading permit. In relation to proposals that venues should be able to sell liquor to tourists, the Review determined that it was inappropriate as existing guest provisions were adequate in enabling clubs to offer hospitality to genuine tourists. Further recommendations provided for amendments allowing persons assisting a guest/competing club to become temporary members and the development of guidelines reinforcing lowered training requirements for club approved managers. Clubs WA have expressed their dissatisfaction with the outcome of the Review and will be campaigning to persuade key decision-makers to reverse the position of the Committee. The AHA(WA) has significant concerns about the implication of allowing the 979 registered clubs across Western Australia to compete against and undermine the viability and operation of 732 commercially licensed hotels, pubs and taverns. As part of the AHA s response to the recommendations of the Review, we strongly opposed any changes that would allow a club licence to focus on commercial licenced premise activities. 10 Inside News A MIDDY WITH MIKE Over our last Middy I raised the issue of distinguishing between alcohol-related violence, a-hole fuelled violence and the apparent neglect of the Health Lobby, mainstream media and police to acknowledge illegal drugs as a prime and increasing cause of violence. We ve seen it all before, selective statistics and finger pointing to denigrate licensees. The Western Australian Police have happily told The West Australian that alcohol retailers are irresponsible and motivated only by profit and meanwhile, new waves of retailers appear to be being ignored. When it comes to Police statistics on drug-related crime the only drug mentioned is the legal one, Alcohol. My question is why? And judging by the number of comments and s I receive from members; many of you share the same question. So, I thought it worth while to revisit the drug-related crime issue with some statistics of my own to back up my rant with a few carefully sourced facts. The West Australian newspaper recently outlined Western Australia s drug problem in an article entitled Perth drug use rivals Kings Cross. The article reported that, according to The Australian Institute of Criminology (AIC), almost half those arrested over crimes in central Perth this year have taken amphetamines, a result second only to Sydney s Kings Cross. Further, an AIC search manager told The West Australian that the latest positive amphetamine test results at WA s main lockup was a significant increase after rates had stayed between 27 per cent and 37 per cent 10 HOSPITALITY WA from late 2011 to the end of last year. He said given that amphetamine use, in particular methamphetamine use, was associated with an increased risk of violence and aggression, a rise in use among Australian detainees was concerning. What I m wondering now is, how many of those arrested and found to be under the influence of drugs were recorded as alcohol-related crimes; statistics to be trotted out at the next press conference and used against licensees when they apply to renew their ETP or any other application that invites an intervention. This most recent data is consistent with figures from the 2011 Education and Health Standing Committee Report Changing Patterns in Illicit Drug Use in Western Australia, that outlined Western Australia has one of the highest rates of drug and amphetamine consumption in the world for people aged years. In my view, and based on the above data, there is clearly problem in Western Australia with drug-related violence that may or may not be associated with the consumption of alcohol. Regardless of alcohol being a factor, it s about time the Western Australian Police acknowledge these statistics and stop pointing the finger directly at licensed premises. Maybe next time Police conduct Operation Unite, instead of initiating, and I quote, a weekend blitz on drunken violence with strike teams, joining hundreds of Police the extensive WA Police media team might want to consider WA s drug problem too. In a 345 word Booze Blitz press release, nowhere was there mention of the word drug ; despite of course violent behaviour being 6.2 times more likely to occur when using methamphetamines. All of this begs the question, what are we doing about this? Well the Australian Crime Commission s Illicit Drug Data Report gives an overview of recent law enforcement initiatives relating to illicit drugs in Australian states and territories. The report outlines initiatives from NSW, ACT, VIC, NT, QLD, and TAS and there is some great stuff happening all over the country but with one notable exception Western Australia. So the answer to my question appears to be not much. 11 Regulations & Compliance COUNTERFEIT BANKNOTES PROTECT YOUR BUSINESS The AHA(WA) is committed to ensuring its members are equipped to deal with all of the issues that may present on a daily basis. It is most important that businesses and their staff are aware of the security features included on Australia s banknotes so that suspect or counterfeit notes are indentified and dealt with appropriately. All Australian banknotes have similar security features, though their location can vary. To determine if a suspect banknote is a counterfeit, it is best to compare it with a banknote that is known to be genuine. Important points for your business: You are well within your rights to refuse to accept a banknote if you have concerns about it. CoulD you spot a CounterFeit banknote? Always check a range of features don t rely on only one or two Under no circumstances should you take actions that may jeopardise your safety or that of others. If you come across a banknote that you suspect is counterfeit: Handle the suspect banknote as little as possible and store it in an envelope. Note any relevant information, such as how it came into your possession. Report the matter immediately to State or Federal police. Find out more about spotting a counterfeit banknote by visiting It can be useful to compare a suspect banknote with one you know is genuine and look for differences All Australian banknotes have similar security features, though their location can vary on the banknote. 1Is it plastic? Australian banknotes are printed on plastic and have a distinct feel. A suspect banknote may feel excessively thick or thin compared to a genuine banknote. It is difficult to start a tear along the edge of a genuine banknote. You can also try scrunching the banknote in your hand a genuine banknote should spring back. 3 Look for the star Diamond-shaped patterns are printed inside a circle on both sides of the banknote. If you hold the banknote up to the light, the patterns should line up perfectly to form a seven-pointed star. 2 Look for the Coat of Arms If you hold the banknote to the light, you should see the Australian Coat of Arms. Check the clear window 4The clear window should be an integral part of the banknote and not an addition. Check that the white image printed on the window cannot be easily rubbed off. Also look for the embossing there is a wave pattern in the window of the $10 banknote, and the value of the banknote in the windows of $20, $50 and $100 banknotes. Other security features to check if you suspect a banknote might be counterfeit 5Feel the dark printing It is produced with a special raised ink that can be felt with 6 your finger. Check the print quality The background printing should be sharp. Check for irregularities such as less clearly defined patterns, thicker or thinner lines, or colour differences. 7Look for the microprinting Under a magnifying glass you will see tiny, clearly defined words on the top left corner of the $5 banknote and near the portraits on the other banknotes. 8Look at the banknote under UV light Most of the banknote should not fluoresce. The exceptions are the serial numbers, a patch on the $5 banknote and a patch on the $20, $50 and $100 banknotes that also shows the value (e.g. 50). HOSPITALITY WA 11

12 Inside News No one begrudges an Australian a public holiday or decent wage; but for hoteliers across Australia, Sundays and public holidays are far from a fair go. A FAIR GO FOR ALL Today s consumer expects to have good access to hospitality during their days off. Unfortunately, hoteliers are under pressure from the high level of penalty rates for Sundays and Public holidays. Especially on Public Holidays, the penalty rates that must be paid have the effect of some businesses not opening. This is no good for the business or employees and it is crazy that businesses can t afford to open when employees want to work. The AHA will be seeking change in the Hospitality Industry (General) Award, which is due for review by the Fair Work Commission later this year. We have recently seen quite a favourable decision regarding the Restaurant Industry Award. In the restaurant award Sunday rates were reduced by 25% for casual introductory, level one and two workers. For casual introductory, level one and two employees the Sunday penalty rate for those under the Restaurant award is now the same as Saturday. In our submission to the Fair Work Commission we will seek similar treatment for hotels. The AHA is also concerned by the growing number of public holidays each year. Under the National Employment Standards (NES) the Commonwealth Government legislates eight public holidays. In addition to those eight National public holidays, each State and Territory may legislate public holidays of their own. A key issue is when public holidays fall on a Saturday and the following Monday is granted penalty rate status as well. It has become all too common for States and Territories to show disregard for the plight of hotel owners by announcing 12 and 13 public holidays a year. For example, the ACT next year is facing having to pay penalty rates on 15 days. With the G20 in Brisbane this year, hotels in the CBD will be stuck with another Friday public holiday and penalty rates. This has a devastating effect on all business because not only do businesses have to pay employees to have the day off, those casual employees that do work are paid penalty rates of 275%. A recent survey by the AHA has found that 60% of services were impacted over the 2014 Easter weekend because the high cost of penalty rates made them unsustainable. This not only affects the services available to the public, but also has a knock on effect to many casual employees though the loss of work opportunities. With the Hospitality Industry (General) Award being reviewed by the Fair Work Commission later this year, AHA will be pushing for a penalty rate scale that enables business to open and employ more people. We will also be seeking for public holiday penalty rates to be capped to 11 days a year in each State and Territory. We will also be seeking to find as much common ground as possible with the key hospitality union, United Voice. However, where we can t agree, we will need to put our case to the Fair Work Commission. For our arguments to be successful at the Fair Work Commission, they have already said we must demonstrate that any change will generate increased employment and increased industry output. The Commission has also said we will need to demonstrate a cogent, comprehensive and probative evidence base to prove our case. To do that we will need to gather evidence from you. I understand that this may result in some work on your behalf; but we hope that it drives a great result where we can demonstrate to the Commission that employers and employees all benefit. The outcome of the 2014 election of the Board of the WA AHA has been declared by the WA Electoral Commission. The Board of the AHA consists of 17 members, 6 elected from the state wide general membership and 11 Divisional Presidents to represent geographic or operational style venues. 16 Event News AHA & 14 MAY CROWN PERTH &conference The 16th annual AHA Hospitality Expo kicked off in style with the AHA Banktech Gala Dinner and presentation of the 2014 Bendigo Bank WA Hospitality Supplier Awards with the following two days showcasing the best of hospitality. The evening of Monday 12 May saw The Astral ballroom at Crown Perth lit in red and pink hues, cherry blossoms adorning the the evening was the presentation of this year s WA s Hospitality Industry Achievement Award to Edward Schimmel of Advans Exhibition Advisor Bruce Strickland delivered the importance of catching and stopping fraud in your business, followed by industry legend Phil Bayly, owner of tables and kimonos floating through the room of 450 guests celebrating a night dedicated to WA s best Hospitality Industry Suppliers. Shoji inspired screens showcased scenes of Mount Fuji and bonsai and guests were treated to a menu from Nobu. Lion took out five awards including WA s Best Hotel and Hospitality Supplier, for the third year in a row. The final award and highlight of 16 HOSPITALITY WA Services, recognising 40 years of dedicated service to the industry. See all the winners on page 14 and 15. The 2014 Hospitality Conference took place on Tuesday and Wednesday morning, featuring interstate and international speakers that inspired delegates, presented new tools, ideas and innovations. Attendees on the first day heard from Department of Racing, Gaming and Liquor Director General Barry Sargeant and AHA(WA) CEO Bradley Woods in a fast paced and fiery uncensored liquor licensing session. AHA Membership BEST BOOTH - LRS Café Pacfico, on his journey through the hospitality industry and shared his hard-learnt lessons. Day two of the Conference commenced with AHA Workplace Relations team Ron Ballucci and Dalton Ryan exposing valuable tools to avoid employee payouts. International Chef Kevin Cherkas followed with his life journey from Spain s El Bulli to his very own Cuca in Jimbaran Bay Bali, and how digesting his mistakes can assist others. With almost 3,000 visitors coming through, once again the AHA(WA) has put together Western Australia s best annual hospitality industry expo. A new addition to Hospitality Expo this year was the 92.9 Master Classes interactive sessions. 18 Venue News LUCK OF THE IRISH An around-the-world trip inspired owners Edward and Peta Janiec to create an Irish Pub in their home town of Mandurah, encompassing the friendly and charming atmosphere they experienced in Irish Pubs from across Europe, USA and Asia. After months of research, planning and studying existing census information, a position in the local market became apparent which saw Murphy s Irish Pub open their doors in late A few months prior to opening, Rodney Cream was brought into the venue s partnership having worked in businesses previously with Edward and Peta Janiec. The experience Murphy s aims to deliver to their patrons is a welcoming and hospitable one with a fun and laidback feel. Their fundamental purpose is to serve the best of everything, including great food, the perfect pour of Guinness, friendly staff and great craic. 18 HOSPITALITY WA Murphy s is a social hub in Mandurah for locals and tourists. Patrons can enjoy drinks overlooking Mandjar Bay in the boardwalk alfresco with livestreamed Irish radio, dance the night away to live bands, watch matches in the sports lounge or dine in the main restaurant area. In the cold winter months, the venue emphasises a cozy pub feel with patrons seated on leather couches in front of the fireplace with an Irish coffee, or indulging in a hearty meal in the heated dining area. During summer the restaurant s bifold doors, extending the width of the venue, open to reveal the new modern-breakaway boardwalk alfresco and their latest investment, a $20,000 9m umbrella. The alfresco has an unrestricted view of Mandjar Bay and is enjoyed all year round, day and night. Through years of collecting, the venue showcases some unique features including handcrafted ornate carved bars that are fitted with two custommade brass Dublin Ha penny Bridge fonts. The large round bar at the rear of the pub is the focal point and main feature of the pub. It is nicknamed Rosie s Bar as it is the original bar from the old Rosie O Grady s at Hurlingham Hotel in South Perth. Their prized possessions include traditional stained glass panels and windows, rustic Irish treasures in display cabinets, and above the main bar the etching There are no strangers here, only friends who haven t met inscribed in Gaelic. Murphy s is a proven popular destination for diners with a menu serving between 9,000-10,000 covers per month. Our menu consists of Irish, Australian and European cuisines reflecting the variety of patronage we have and is continually adjusted to suit tastes, said Irish Head Chef Nadine McAllister. Murphy s entertainment line-up is extensive and includes free trivia nights on Mondays, acoustic sessions on Tuesday and Sundays, Karaoke and Lip Sync Battles on Wednesday and Thursday nights, Live bands on Friday and Saturday nights and small bands and acoustic sets on Sunday afternoons. Murphy s is also very well known for their St Patrick s Day event which includes an extended beer garden that holds an additional 200 patrons. The venue won the AHA s 2013 WA s Best Community Service Award. The venue s biggest achievement is Murphy s Charity Golf Days, held twice a year. In December 2013 they completed their 4th Charity Golf Day to benefit Mandurah Womens and Childrens Refuge (Pat Thomas House) raising funds for Christmas gifts and food hampers. They also sponsor and support as many local sporting events and groups as possible. Mandurah is a bustling regional city with the heart of a country town. My wife Peta and I have owned and operated businesses in Mandurah for over 30 years and with Murphy s growing success, it has allowed us to give back to the community which my family and I have called home for so long, says Edward Janiec. The goal posts are always moving as the industry and patrons desires evolve but Murphy s goal is focused on continuing to refine each aspect of their venue to ensure they are serving the best food, beverages, entertainment and customer service. The owners are continually exploring new ideas and products to for their community to enjoy. 20 Corporate News BUDGET UPDATE Since the release of the 2014 Federal Budget, it can be difficult to make sense of what it could mean for you. As the dedicated super fund for your industry, HOSTPLUS is committed to helping you navigate these changes. So we ve outlined below some of the key outcomes of the budget announcement that may impact your retirement. Age pension qualifying age From 1 July 2025, the qualifying age for the Age Pension will increase by six months every two years, from 67 to 70 years by 1 July People born before 1 July 1958 will not be affected. Superannuation Guarantee (SG) rates The schedule for increasing the Superannuation Guarantee (SG) rate has been changed. Rates will not increase for three years from the financial year (previously two years from ). Final details of the policy will be settled following consultation with key stakeholders in the superannuation industry. Changes to pension payments and eligibility From 1 September 2017 the Age Pension will be indexed by the Consumer Price Index (CPI). Currently, this payment is indexed in line with the higher of the increases in the CPI, Male Total Average Weekly Earnings or the Pensioner and Beneficiary Living Cost Index. The Budget has also tightened rules on eligibility; freezing indexation of income and asset thresholds for 3 years commencing Untaxed superannuation income will also be assessed when considering a person s eligibility for the age pension from 1 January Deeming thresholds for pension assessments Deeming thresholds used in the pension assets test will be reset to $30,000 for singles and $50,000 for couples from 20 September Individuals and families Family payment benefit Various reforms to the family tax benefit (FTB) part A and part B payments will be introduced. The income limit for families receiving the Family Tax Benefit Part B (FTB B) will be decreased from $150,000 per annum to $100,000 per annum for the primary earner, from 1 July The FTB B will also be limited to families whose youngest child is younger than six years of age from 1 July As a transitional arrangement, families with a youngest child aged six and over on 30 June 2015 will remain eligible for FTB B for two years. Current Family Tax Benefit (FTB) payment rates will be maintained for two years from 1 July Under this measure, indexation of the maximum and base rates of FTB Part A, and the rate of FTB Part B will be paused until 1 July First home buyers The First Home Savers Account Scheme will be abolished from 1 July High income earners Australians earning over $180,000 will be subject to a 2% temporary levy (the Temporary Budget Repair Levy) on their taxable income for a period of three years from 1 July 2014 until 30 June A number of other tax rates that are currently based on calculations that include the top personal tax rate will also be increased. With the exception of the fringe benefits tax (FBT) rate, these tax rates will be increased for the same period that the Temporary Budget Repair Levy is in place. Education The income threshold at which students commence repayment of their Higher Education Loan Programme (HELP) debts will be reduced with effect from 1 July In addition, HELP debts will be indexed at a rate equivalent to the yield on 10-year government bonds (up to a 6% maximum) instead of CPI from 1 June Loan fees for undergraduate FEE-HELP and VET FEE-HELP will be abolished. Health Australians will be paying at least $7 for GP visits, blood tests and X-rays as part of the government s new Medicare co-payment scheme. General patients will also pay $5 more and concessional patients 80 more for prescription drugs. Employers As an incentive to increase opportunities for older workers, $10,000 payments will be offered to businesses that employ workers over 50. Infrastructure An 11.6 billion dollar infrastructure growth package was announced to drive prosperity. This may present opportunities for super funds to increase their investment in Australian infrastructure assets. 21 Event News WA S BEST STEAK SANDWICH COMPETITION Now in its seventh year, the AHA s WA Best Steak Sandwich Competition continues to recognise WA s best Aussie icon. The ten finalists were determined by consumers through an online voting system. The metropolitan and regional winners receive automatic entry as a finalist in the AHA-Aon Hotel & Hospitality Awards for Excellence WA s Best Steak Sandwich category. Regional Matso s Broome Brewery was awarded the title of AHA s Best Regional Steak Sandwich for Head Chef, Sebastian Schacher attributed Matso s success to the sandwich s secret ingredient - a homemade Tomato Chutney, which has been passed on for years from Head Chef to Head Chef. German born chef, Schacher has worked at Matso s for almost two years and represents the increasing number of overseas trained and experienced chefs who have chosen to work in regional Western Australia. 22 Regulations & Compliance CHANGES TO ACCEPTABLE FORMS OF AGE IDENTIFICATION There have been a number of changes to documents that can be accepted as forms of identification to prove a person is 18 years and above for the purpose of entering licensed premises. From 1 July 2014 the Department of Transport will introduce a Western Australian Photo Card which will serve as an official identity card for people who do not have an Australian driver s licence. As a result, the Proof of Age Card will no longer be issued but will still be accepted as an authorised form of identification. To reflect the changes, the Liquor Control Regulations will be updated from 1 July to prescribe the WA Photo Card. This will make the new identification card a document that can be accepted to prove the age of a person wishing to enter licensed premises where that person is suspected of being a juvenile. It is important to note that the WA Photo Card can also be issued to people under the age of 18, that is, people aged 16 and 17 it is therefore imperative that authorised persons inspect the card carefully to ensure the holder is not a juvenile attempting to enter licensed premises. The Racing and Gaming Minister has also approved amendments to the Regulations to expand the range of documents to also allow Proof of Age Cards issued by other liquor jurisdictions across Australia to be accepted as evidence of proof of age for people entering licensed premises. 24 General News INAUGURAL AHA INTERNATIONAL GREAT WAITERS RACE A SUCCESS Crowds turned out for what was a spectacular day of racing around East Perth s picturesque Claisebrook Cove. The inaugural AHA International Great Waiters Race was held on Sunday, 27 April 2014, at East Perth s Claisebrook Cove. It was an action packed day where 62 waiters raced around Claisebrook cove contending for the title of Perth s fastest, most skilled waiter. Italia reigned supreme on the day with the winner and runner-up hailing from two of Perth s premier Italian restaurants, Perugino s and Villa D Este in West Perth. Benoit Rivault from French restaurant Bistro Guillaume came in at a close third. Perugino s Pavel Parihuzic worked consistently in the heats and won the final race, receiving a $2,500 travel voucher for his efforts. Villa D Este s Roberto Notarnicola took out the 2nd prize of a stunning Oris watch from Watches of Switzerland. The Royal Hotel did very well on the day with Claire Pye, Josh Morgan and Brant Bebbington winning the Little Creatures Team Trophy for the fastest team competing in the event. There were plenty of opportunities to cheer on the waiters participating in the event with the finish line situated in the Gourmet Village at Victoria Gardens where 20 different food and wines stalls exhibited a range of international cuisines, locally sourced produce and fine wines. This not-for profit event was organised by the Rotary Club of West Perth to support the McCusker Alzheimers Research Foundation and the West Australian Neuroscience Research Institute (WANRI). 24 HOSPITALITY WA

25 General News 5,000 MEALS PROJECT With WA VET students working alongside industry professionals, the 5,000 meals program develops, produces and delivers nutritious meals to people in need using surplus, rescued and donated food. The 5,000 meals program is a school-based project that brings together students, teachers, leading WA chefs and apprentices. Together they produce healthy, nutritious meals for those who need it most by using surplus and donated fresh produce. Last year s pilot project was hugely successful. 450 students from 14 WA metropolitan and regional schools took part in producing more than 6,000 meals with the help of 54 Crown Perth apprentice chefs, 30 of WA s leading chefs and many tonnes of fresh surplus produce. An aim of the program is to provide school students with skills and knowledge that will assist them to pursue a career within the hospitality industry once they have completed their studies. The project also benefits many groups within the community by bringing together chefs in various stages of their hospitality careers, creating an awareness of the surplus food that is available in the community and directly feeding people in need with healthy food. This year, students from 17 schools will be joined by chefs and apprentices to produce 10,000 nutritious meals for those in need. The first training session was held in March and students were lucky enough to learn from and engage with WA Food Ambassador, Don Hancey, one of Australia s most celebrated Indigenous Chefs, Mark Olive, Master Butcher, Graham Martin, from Linley Valley Pork and the King of Oysters, Jerry Fraser. 29 Workplace Relations News NATIONAL MINIMUM WAGE On Wednesday 4 June 2014 the Fair Work Commission handed down its annual wage decision and increased the Federal Minimum Wage by 3%. This affects hospitality businesses that are constitutional corporations within the national industrial relations system who employ staff under the Hospitality Industry (General) Award 2010 and Restaurant Industry Award The increase takes effect from the first full pay period on or after 1 July 2014 and will see the minimum wage rise by $18.70 a week. The AHA argued for a wage increase of only $8.50 per week whilst the unions and the ACTU lobbied for a $27.00 a week pay rise. In its decision the Fair Work Commission made reference to strong economic growth on a global level and the 2.9% CPI increase for the December 2013 March 2014 quarter. Nationally the AHA provided a detailed submission to the Commission which was taken into consideration in the decision. In its decision, the Fair Work Commission Full Bench stated: We have decided that the range of considerations we are required to take into account favours the award of an increase which will result in a modest improvement in the real value of modern award minimum wages. There has been almost no growth in the real value of award rates over a period when other employees have had substantial wage increases in circumstances in which the economic environment has been sound. The deterioration in the relative living standards of award-reliant workers; the needs of the low paid; the recent widespread improvement in labour productivity growth; the historically low levels of real unit labour costs; and the absence, in aggregate, of cost pressures from the labour market are all factors favouring a real increase in minimum wages. The AHA(WA) will provide new annual wage schedules for the Hospitality Industry (General) Award 2010 and Restaurant Industry Award 2010 as soon as the calculations have been completed by the Workplace Relations Team. 30 Workplace Relations News FWO MEMORANDUM OF UNDERSTANDING The AHA has successfully renewed its Memorandum of Understanding (MoU) with the Fair Work Ombudsman. The AHA is the only employer organisation to have this type of relationship with the national regulator. The relationship between the AHA and the Fair Work Ombudsman will be based on the principle of no-surprises, constructive engagement, working collaboratively to create and maintain fair and productive workplaces, ensuring a level playing field for all businesses in the hospitality sector. The purpose of this MoU is to provide a framework for the AHA and Fair Work Ombudsman to enhance our strong relationship and promote best practice to improve compliance within workplace laws. This is achieved through a number of avenues which include meeting twice a year to discuss feedback and common issues regarding compliance and feedback received on issues raised by our members on any policies, procedures and initiatives undertaken by Fair Work. It has also allowed us to discuss issues that particularly concern the hospitality sector. As most members are aware, this MoU has allowed the AHA to have our yearly wage schedules confirmed as true and correct before being sent out to ensure there is little confusion over correct wage levels. This has been an enormous benefit to the AHA and its members. This is demonstrated through high levels of compliance from Fair Work Ombudsman audits in the hospitality industry throughout 2012/2013. As the hospitality industry leader, the AHA and the Fair Work Ombudsman have agreed to undertake joint education initiatives through assisting in the formulation of tools to assist the hospitality sector. The AHA and the FWO will work collaboratively to equip workplace participants with the information they need to understand their responsibilities and rights under Commonwealth workplace laws. This may occur through consultation on the Fair Work Ombudsman s website and mobile products tailored for the hospitality sector as well as co-production of educational, promotional and communication activities. These initiatives may include but not be limited to: a. on-line education products; b. employer and employee fact sheets and guides and other educative information for distribution by the AHA and the FWO; c. development of mutually agreed award interpretation and wage rate documentation; d. provision of speakers for appropriate conferences and other events; e. contributions to newsletters, AHA Yearbooks and electronic communication channels; and f. communication campaigns. Being the only employer association to have an agreement of this nature with the Fair Work Ombudsman is both a privilege and significant value adding measure for AHA members. Any further increase has been frozen by the Federal Government and will not occur until 2018 as detailed in the 2014 Federal Budget. 31 RESTAURANT OPERATORS FINED $334,000 Workplace Relations News The operators of two Melbourne restaurants who gave teenage employees pizza and soft drink instead of their correct wages have been fined a total of $334,818. The relationship between the AHA and the Fair Work The Fair Work Ombudsman found that 111 employees had been underpaid a total of $258,000 between 2009 and 2012 when they worked at La Porchetta franchise outlets in suburban Melbourne. The companies which operate the restaurants have each been fined $139, The two companies were ordered to back pay more than $79,000 in outstanding entitlements to those employees not yet fully reimbursed. The Fair Work Ombudsman began investigating the La Porchetta franchises after receiving a single complaint from a parent of one young staff member. The Court heard that the employees were given half-priced pizza and soft drink, which was being offset against their wages and entitlements. There were also serious recordkeeping contraventions. The underpayments were also caused by employees being paid flat hourly rates that were below the minimum they were entitled to, apprentices and trainees not being paid for the minimum number of hours they were employed to work and underpayment of leave entitlements. The employees, part-time and casuals were employed as cooks, kitchen attendants and food and beverage service employees. The Court dismissed the businesses submission that many of the individual underpayments were relatively small. It found that the amounts involved may seem trifling to some but they were required to be paid to young employees for whom they were far from trifling and for which they ve had to wait. The Court said; one of the principal objects of the Fair Work Act 2009 is the maintenance of an effective safety net of employer obligations, and effective enforcement mechanisms. The failure to keep records by the respondents, which is admitted, arguably undermines and frustrates the attainment of that objective. The perfect host.
