5 This task aims t facilitate the Member States the identificatin f the legal prvisins such as United Natins and IMO Cnventins and Reslutins, and Eurpean Guidelines and Standards that culd be applied in scenaris where accidents may ccur. A rapid and easy query f these Standards culd initially help t guide the curse f actin f the State Member in rder t demand accuntability t the ship-wners and the crew r the lader, as applicable, fr the pssible lss f lives, the damage the accident may cause t the health f peple n bard and castal ppulatin, the damage it may cause t the territrial sea and the exclusive ecnmic zne f the Member State, and the pssible pllutin f the marine, terrestrial r atmspheric envirnment. Based n the previus, this task is rientated t identify the tls that Internatinal Standards ffer t the State Member, which cmplement thse (t be) included in Task Prcedures after the accident, in rder t help identifying and delimiting the liability f the casualty. This dcument cntains general infrmatin abut the bligatins cncerning the crew and the state f the vessel, giving in sme ccasin illustrative examples f casualties in which these bligatins were nt fulfilled with heavily negative cnsequences. In additin, lists f the relevant directives, standards, regulatins, cnventins, etcetera, have been included regarding different aspects f them, such as inspectin and survey, type f vessel, marine equipment, bligatins f the parties, pllutin and thers. Finally, an Annex is attached t this reprt, where the main Cnventins and Agreements cntained in this cmpilatin are develped in terms f what is cntemplated in these pages. INTERNATIONAL REGULATIONS AFFECTING THE STUDY PURPOSES 5

6 1. OBLIGATIONS OF THE CREW OBLIGATIONS INCLUDED IN SOLAS AND MARPOL CONVENTIONS In this sectin, the fulfilment f the bligatins that the SOLAS Cnventin, Chapter III part B, rule 19 requires the crew will be analysed. Regardless the fllwing paragraphs, the checking f the existence f training manuals and auxiliary means fr the n bard training (accrding t Rule 35) wuld be bligatry, as well as the existence f instructins fr the n bard maintenance f rescue devices (Rules 36 and 37) Regarding training, peridical exercises fr emergency and maintenance f lifesaving devices. Training It is necessary t check that each member f the crew t whm any duties in case f emergency has been assigned is familiar with them befre starting the trip. Training will be given t all new emplyees n bard as sn as pssible, n mre than tw weeks after jining the ship, n the use f lifesaving appliances, included the equipment f survival vessels and fire extinguishing devices. Hwever, if the crew member is assigned t the vessel accrding t a regular shifts prgram, he will receive training n mre than tw weeks after the date f the first incrpratin in the ship. Instructins fr the use f fire-fighting devices and devices fr salvage f the vessel and fr survival in the sea will be at the same intervals that the exercises. The instructin can be given separately n different parts f rescuing and extinctin f fire devices, but trainers must encmpass all within a perid f tw mnths. It shall be verified that all crew members have been instructed, at least n: The handling and the use f the inflatable survival crafts f the ship; The prblems caused by hypthermia, first aid indicated in case f hypthermia, and ther cases where it is apprpriate t give first aid; The use f the life-saving appliances the ship carries in case f bad weather and bad sea; The handling and use f fire extinguishing devices. At regular intervals, nt exceeding fur mnths, training shall be prvided n the use f lifebat davit rafts n bard f any ship equipped with such devices. Whenever pssible, this wuld include the inflatin and launching f a lifebat. This may be a special survival craft intended nly 6

7 t prvide training and nt t be part f the equipment f salvage f the vessel; in such case this shuld be clearly marked. Exercises ü Checking the existence f a list f bligatins nbard. ü Checking that all crew members have taken part in exercises f abandnment f the ship and fire emergencies each mnth, accrding t A.690 (17) Reslutin - Peridical inspectin f abandn ship and fire drills n passenger ships. Regarding the abandn f the ship drill Checking that passengers and crew have been instructed n the prper apparel; the crrect placement f the lifejacket and that passengers understand the call t the meeting pints. Checking that the crew have participated in at least ne abandn f the ship drill and ne fire drill per mnth; at least nce lsened ne f the lifebats after the necessary preparatin fr setting it aflat; made the lifebat engine wrk; activated the davits used t set the lifebats aflat; carried ut the training exercises fr search and rescue f the passengers trapped in their cabins, and if necessary, given instructins abut the utilizatin f the radi life-saving appliances. Althugh when it cmes t elabrate this reprt, the causes f the lss f lives at the accident f the Suth Krean vessel Seawl are unknwn, it is indeed knwn that passengers did nt take the lifebats and did nt attend the meeting pints. In an accident like this, it wuld be necessary t check the prtcls previusly mentined. Checking that each f the lifebats has been put aflat and maneuvered in the water by the crew assigned fr handling at least nce every three mnths during an abandn ship exercise. Checking that all lifebats, at least nce every three mnths, have been lsened, and at least nce per year launched and maneuvered in the water. Checking the emergency lighting at the meeting pints f the passengers and the abandnment f the ship n each abandn ship exercise. On fire-fighting exercises It shall be verified that fire-fighting exercises are planned cnsidering the standard practices fr different emergency cases that may take place depending n the type f ship and carg. Checking that the fllwing actins in each practice f firefighting have been cnsidered: 7

8 G t the psitins and get ready fr the tasks required t each member f the crew. Start a fire pump using at least the tw jets f water required, in rder t verify that the system wrks prperly; Checking the fireman's equipment and ther individual rescue equipment; Checking the relevant cmmunicatins equipment; Checking the peratin f the watertight drs, fire drs, fire prtectin butterfly valves and the inlet and utlet keyhles f the ventilatin systems; Checking the necessary prvisins fr the subsequent abandnment f the ship. Equipment used in the exercises shall immediately be back in cnditins f peratin and any faults r defects discvered during the perid shall be slved as sn as pssible. Carg It shall be checked whether it has cmplied with the prvisins f the SOLAS Cnventin. Chapter VI, part A; rules 2 and 5. In case f dangerus gds, applicatin standards are arranged in Chapter VII f the SOLAS Cnventin part A fr dangerus gds in packages and part A-1 fr slid dangerus gds in bulk. Check if the shipper prvided apprpriate infrmatin abut the lad s that yu can take the necessary precautins fr its prper stwage and transprt withut risk. Checking if the shipper prvided apprpriate infrmatin abut the lad s the relevant precautins fr its prper stwage and risk free transprt can be taken wuld be necessary. It must be checked if lading units and transprt units carried n deck r under deck were stwed and fastened in accrdance with the Reslutin A.714 (17) amended. It will be verified that the lading, unlading and stwage f bulk carges have fllwed the cde f safe practice in accrdance with the Reslutin A. 862 (20), amended by MSC 238 (82). Checking wuld be necessary, in case f transprt f grain, that the prvisins f the Internatinal Cde fr the Transprt f Grain have been fllwed and that the ship has the authrizatin dcument required by the cde. Anntatins The entries in the lg bk abut the details f the exercises f abandnment f the ship and fight against fires, the exercises with ther devices fr rescuing and training n bard shall be checked. If at the prearranged time it is nt perfrmed in its entirety a meeting, an exercise r a 8

9 training sessin, this shall be recrded in the ship s lg, indicating the circumstances that came tgether and the scpe f the meeting, the exercise r the training sessin that tk place With respect t the maintenance and inspectin f the lifesaving appliances. SOLAS Part B, Rule 20. It shall be checked that instructins fr n-bard maintenance have cme frm the life-saving appliances referred t rule 36 f this SOLAS chapter and peacekeeping peratins will be carried ut in accrdance with them. Yet the lg bk will be analyzed t verify that the inspectins listed belw have been registered in the mentined ship s lgbk. In general the existence f technical manuals f peratins and maintenance n bard must be checked. Maintenance f strips It shall be verified that the strips used in launching devices have been inspected regularly, paying particular attentin t the areas which pass thrugh pulleys, and that they have been renewed when it has been necessary due t its deteriratin r at intervals nt exceeding five years, if this perid is shrter. The existence f spare parts and repairing equipment fr the life-saving appliances and cmpnents f these subject t intensive wear r deteriratin shall be checked and have t be replaced peridically. Weekly inspectin It shall be verified that each week the tests and fllwing inspectins are carried ut and the reprt n the inspectin shall be included in the lg bk: All survival crafts, rescue bats and launching devices have been subjected t a visual inspectin in rder t verify that they are ready t be used. This inspectin will analyze the State f hks, attachment t the lifebats and the release with charging mechanism being prperly and cmpletely tight; That each engine f the lifebats and rescue bats have been put n during a ttal perid f at least three minutes (r the time prescribed by the manual f the manufacturer), prvided that the temperature is abve the required minimum temperature fr starting the engine. At the same time the transmissin and the gear train engaging have t be checked. Lifebats, except free-fall nes, f carg ships will be mved away frm the stwage psitin, with n ne abard, as far as necessary t demnstrate the satisfactry peratin f the launching devices, whenever the weather cnditins and the sea state allw this; and the general emergency alarm system shall be tested. 9

10 Mnthly inspectins That all lifebats, except free-fall nes, have been mved away frm the stwage psitins, with n ne abard, at the expense t the weather and the sea cnditins. That every mnth an inspectin f the life-saving appliances has been carried ut, including lifeguards and bats equipment in rder t verify that they are cmplete and in gd cnditin. The reprt f inspectin shall be included in the lg bk. Other inspectins It shall be checked that the service maintenance f inflatable survival crafts, inflatable lifejackets and marine evacuatin systems, and maintenance and repair f the inflated rescue bats has been perfrmed The maritime Safety Cmmittee cnsidered at its eighty-third sessin perid (3 t 12 Octber 2007) a recmmendatin abut the need pinting ut t all stakehlders, the imprtance f the crews f the vessels having access t technical manuals f peratins and maintenance f nbard updated, accurate and easy t use, in particular regarding maritime equipment essential fr safety. In additin, the Cmmittee tk nte f the recmmendatin N. 71 f the IACS (in September 2000), entitled Guide fr the Develpment f Shipbard Technical Manuals (Guide fr the preparatin f technical manuals n bard), and agreed that this guide is a useful reference fr the peple respnsible fr drawing up such manuals. It is recmmended that the technical manuals f peratins and maintenance n bard are available in the wrking language f the ship and, if this language is nt Spanish, French r English, it shuld include a translatin int ne f these languages; and t encurage designers and builders f ships prvide diagrams and drawings in which the functining f the integrated systems f vessels are explained, as well as the peratin f such systems in case f emergency, taking int accunt that it is pssible that the ships systems are cmpsed f different equipment, and t pint ut the abve t the attentin f ship-wners, captains, shipyards, recgnized rganizatins and, in particular, maritime safety-critical equipment manufacturers Synthesis bligatins under the SOLAS Cnventin The reality f the vessel must crrespnd with the cnfrmity f materials, equipment, installatins and machinery cvering the certificates issued by the Administratin. Indeed, the issuance f a certificate crrespnds t the lcatin f the ship at the time it is extended. The cnsistence f the cnditin f the ship with the actual validity f these certificates shuld be supervised by the crew. 10

11 The ship and its equipment cnditin being maintained s as t cnfrm t the prvisins f these rules must be checked, in rder t ensure that the ship remains, in every sense, able t sea withut danger fr itself r fr the peple n bard It shall be verified that as the surveys f the ship pursuant t rules 7, 8, 9 r 10 1 take place, n changes in the structural layut, machines, equipment and ther cmpnents that were the subject f survey, withut prir authrizatin f the management 2, have been carried ut. It shall be checked if the stwage f the lad was adequate and whether the cnsignr, in his case, gave the infrmatin necessary fr its prper stwage and transprt withut risk. There shuld be emergency planning n bard in case f cntaminatin by hydrcarbns and harmful substances liquids. The industry standard that shall be applied t a vessel in emergency includes the cmpliance with the relevant prvisins f the Internatinal Cnventin f Safety f Life At Sea (SOLAS) and the Emergency Plan abard the MARPOL Cnventin fr cases f cntaminatin by il and nxius liquid substances. These plans must be used by the staff in land f the wner and must be understd by the captain and crew f the vessel thrugh practices and training aimed t verify the functinality f the plan. Fr example, in the ral hearing f the Prestige case the fllwing defaults t the pllutin emergency Plan by hydrcarbns were demnstrated: Cmmunicatins did nt cmply with the methd f reprt r the scpe f the infrmatin. The Prestige cmmunicatins with the Spanish authrities were unsatisfactry: The type f lad/cnditin f the ship - prbing/transfer capacity was nt reprted in an apprpriate r accurate way. The stability f the vessel r the nn-damaged side tanks ballast was nt reprted in an apprpriate r accurate way. The state f the spaces fr lad and ballast (tank by tank) and state f the fuel tanks were nt defined. 1 Rule 7, surveys f passenger ships; rule 8, survey f rescue devices and ther equipment f carg ships; rule 9 survey f radi facilities in carg ships; rule 10, survey f the structure, machines and equipment fr carg ships (when the ship is in a prt ruled by anther Cntracting Gvernment, the master r wner shall als immediately reprt t the prt State authrity, and the inspectr appinted r the recgnized rganizatin t check if that reprt has been well perfrmed) 2 Chapter I, Rule 11: maintenance f cnditin checked in the survey. Whenever the ship suffers an accident r that a defect is discvered and ne r the ther affect its safety r efficiency r integrity f its salvage r ther equipment devices, the master r the wner f the ship must infrm as sn as pssible the Administratin, the Inspectr appinted r the rganizatin recgnized respnsible fr issuing the relevant certificate, wh will make that the research aimed t determine fllwing actins begin. 11

12 The status f the main machine and auxiliary machinery, including steam bilers in the machinery deck were nt identified. The nn-wrking f the emergency twing and the lack f thrwing devices were nt reprted. Neither a cmplete descriptin nr the cnditin f the crew was prvided. N advice t the authrities n cntracts fr respnse/supprt was prvided. N lad specificatins were cmmunicated t help cntain pllutin by castal State plan. In additin, the Captain did nt gather his respnse team fr the Ship Oil Pllutin Emergency Plan (SOPEP) and pted t evacuate it. This deprived the ship f the staff necessary n bard t respnd apprpriately t the pllutin incident and t cllabrate with immediate rescue effrts, leaving the ship appraching dangerusly t the cast. These actins r missins by the shipwner settled Spain, the castal State, at a clear disadvantageus place regarding the infrmatin relating t the State and the ship cnditin. The cmmunicatins and actins taken at the beginning f the Prestige incident, shw that the shipwner did nt fllw the guidelines f the Ship Oil Pllutin Emergency Plan (SOPEP). As a result, Spain, as the castal State affected, faced a severely cmprmised vessel and withut means t have access t critical infrmatin and cntrl f the situatin Obligatins under MARPOL synthesis. Regulatin f the Annex I: Regulatins fr the Preventin f Pllutin by Oil: Whenever an accident ccurs t a ship r a defect is discvered which substantially affects the integrity f the ship r the efficiency r cmpleteness f its equipment cvered by this Annex the master r wner f the ship shall reprt at the earliest pprtunity t the Administratin, the recgnized rganizatin r the nminated surveyr respnsible fr issuing the relevant Certificate, wh shall cause investigatins t be initiated t determine whether a survey as required by paragraph 1 f this regulatin is necessary. If the ship is in a prt f anther Party, the master r wner shall als reprt immediately t the apprpriate authrities f the prt State and the nminated surveyr r recgnized rganizatin shall ascertain that such reprt has been made OBLIGATIONS CONTAINED IN THE AGREEMENT OF TRAINING AND WATCHKEEPING (STCW AGREEMENT) Verify that the fllwing functins are carried ut by the staff n bard: 12

13 The fficer in charge f the deck watch shall: make runds t inspect the ship at apprpriate intervals; pay particular attentin t: the cnditin and securing f the gangway, anchr chain and mrings, especially at the turn f the tide and in berths with a large rise and fall, if necessary, taking measures t ensure that they are in nrmal wrking cnditin; the draught, under-keel clearance and the general state f the ship, t avid dangerus listing r trim during carg handling r ballasting, the weather and the sea state the bservance f all regulatins cncerning safety and fire prtectin; the level f water in the bilges and tanks, the water level in bilges and tanks; all persns n bard and their lcatin, especially thse in remte r enclsed spaces; and the exhibitin and sunding, where apprpriate, f lights and signals; in bad weather, r n receiving a strm warning, take the necessary measures t prtect the ship, persns n bard and carg; take every precautin t prevent pllutin f the envirnment by the ship; in an emergency threatening the safety f the ship, raise the alarm, infrm the master, take all pssible measures t prevent any damage t the ship, its carg and persns n bard, and, if necessary, request assistance frm the shre authrities r neighbring ships; be aware f the ship s stability cnditin s that, in the event f fire, the shre firefighting authrity may be advised f the apprximate quantity f water that can be pumped n bard withut endangering the ship; Offer assistance t ships r persns in distress; take necessary precautins t prevent accidents r damage when prpellers are t be turned; and Enter, in the apprpriate lg-bk, all imprtant events affecting the ship. Officers in charge f the engineering watch shall: 13

14 In emergencies, give the alarm when, in his view, the situatin s requires and take all pssible measures t avid damage t the ship, peple that are n bard and the lad: in emergencies, raise the alarm when, in their pinin, the situatin s demands, and take all pssible measures t prevent damage t the ship, persns n bard and carg; be aware f the deck fficer s needs relating t the equipment required in the lading r unlading f the carg and the additinal requirements f the ballast and ther ship stability cntrl systems; make frequent runds f inspectin t determine pssible equipment malfunctin r failure, and take immediate remedial actin t ensure the safety f the ship, f carg peratins, f the prt and the envirnment; ensure that the necessary precautins are taken, within their area f respnsibility, t prevent accidents r damage t the varius electrical, electrnic, hydraulic, pneumatic and mechanical systems f the ship; and Ensure that all imprtant events affecting the peratin, adjustment r repair f the ship s machinery are satisfactrily recrded. 14

ANALYSIS OF THE STATE OF THE VESSEL This sectin aims t make a quick draw f the rules that the ship shuld meet t facilitate the wrk f the fficials f the Member State when it cmes t analyzing the physical situatin f the ship in accident and cmpare it with which it shuld have accrding t the rules in which is statutrily subjected. It shall be checked that the vessel cmplies with the rules f the Reslutin A 1053 (27) and with the mdificatins apprved by the IMO, which are cnsequence f the Internatinal Cnference n the Harmnized System n Survey and Certificatin (HSSC), 2011 held in Lndn in the mnths f Octber and Nvember S the vessel will be subjected t: The Internatinal Cnventin fr the Safety Of Life At Sea, 1974, and the Prtcl f 1988 relating t the Internatinal Cnventin n Lad Lines, 1966,(LLC1966 and Prt LLC 1998) Apprval, by Reslutin MEPC.39 (29), amendments t intrduce the HSSC in the Internatinal Cnventin fr the Preventin f Pllutin frm Ships, 1973 MARPOL, amended by the Prtcl f 1978 (MARPOL 73/78) Adptin, by Reslutin MEPC.132 (53), amendments t intrduce the Harmnized System n Survey and Certificatin in Annex VI f the MARPOL Cnventin; and Apprval by the amendments f Reslutins mentined belw aim t intrduce, the HSSC in the fllwing Cdes: Internatinal cde fr the cnstructin and equipment f vessels carrying dangerus chemicals in bulk (cde CIQ), (Reslutins MEPC.40 (29) and MSC.16 (58)); Internatinal cde fr the cnstructin and equipment f ships carrying liquefied gases in bulk (IGC Cde) (Reslutin MSC.17 (58)); Cde fr the cnstructin and equipment f ships carrying dangerus chemicals in bulk (cde CGrQ) (Reslutins MEPC.41 (29) and MSC.18 (58) GENERAL INFORMATION ON INSPECTION AND SURVEY OF THE SHIP It shall be verified that the inspectin f the ship have been made by designed Administratin fficials r recgnized rganizatins apprved by it. The specific cmmands assigned t inspectrs appinted r recgnized rganizatins and the cnditins in which the authrity has delegated the surveys. 15

16 Based n the abve, it must be checked, if it is the case, that the repairs required by the inspectrs f the Administratin r recgnized rganizatins have been cnducted. It must be checked if the bat has gne sailing after an inspectin in which it was ruled that the ship culd nt g t sea withut danger t the ship r persns n bard unless the ship went t repair t a shipyard withut danger t the ship r persns wh are n bard. It must be checked that surveys f rescue devices and ther equipment f carg ships have been carried ut. It will be verified that radi facilities and radar surveys have been cnducted n carg ships. It must be checked that the inspectin f the hull, machines and the equipment fr carg ships have been carried ut. It will be verified that the prper maintenance f the state f the ship after the inspectin has taken place in a way: T be sure that the cnditin f the ship and his team ensure that the ship remains, in every sense, unable t sea withut danger fr itself r fr peple wh may be n bard. T be sure that n change in the structural arrangement, machines, equipment and ther cmpnents that were the subject f survey, withut prir authrizatin frm the Administratin is made. It must be checked that, if the ship has suffered a previus accident r if frm this accident it is deducted that the captain knew any defects that culd affect their safety, efficiency r integrity f its salvage r ther equipment devices, the master r the wner f the ship reprts t Administratin (inspectr r recgnized rganizatin) GUIDELINES FOR THE INSPECTION AND SURVEY OF THE SHIP Check that surveys were cnducted fllwing the guidelines apprved as fllws: GUIDELINES TO CARRY OUT THE SURVEY UNDER THE CONVENTION SOLAS Guidelines under the SOLAS 1974 Cnventin, amended by the Prtcl f 1988 Guidelines t carry ut the examinatins required fr the equipment fr the carg ship safety certificate 16
