2 MUSKOKA ROAD #18 (MUSKOKA ROAD) TOWN OF GRAVENHURST ROAD CLOSURE Recommendation THAT Muskoka Road #18 (Muskoka Road) in the Town of Gravenhurst be temporarily closed on Saturday, November 27,2004 from Winewood Avenue to Phillip Street, between the hours of 12:30 p.rn. and 2:30 p.rn., in order to hold the annual Gravenhurst Santa Claus Parade BY-LAW NO "NO-PARKING - TOW AWAY ZONE" MUSKOKA ROAD #4 - WINDERMERE Recommendation THAT By-Law No , which established a "No-Parking - Tow Away Zone" on Muskoka Road #4 in the Village of Windermere be amended as per the report of the Director of Roads and Waste Management dated August 23, SPEED LIMIT - MUSKOKA ROAD #7 (NEAR PORT SANDFIELD) Recommendation THAT a by-law be prepared establishing a 60 km/hr speed zone on Muskoka Road #7 as per the report of the Director of Roads and Waste Management dated August 23, APPOINTMENT OF A CONSULTANT SALT MANAGEMENT PLAN Recommendation THAT the consulting firm of Giffels Associates Limited be engaged to carry out a Salt Management Plan as outlined in the report of the Director of Roads and Waste Management dated September 8, REALLOCATION OF CERTAIN CAPITAL BUDGET FUNDS Recommendation THAT a portion of the funds budgeted for the replacement of the Axe Creek/Buck Lake bridges be reallocated as per the report of the Director of Roads and Waste Management dated September 8, 2004; AND THAT for the purposes of Section 291 (1) of the Municipal Act, 2001, notice be given that the proposed amendment will be considered by Council at its regular scheduled meeting on October 4, 2004, by posting a notice on the District Municipality of Muskoka website commencing on September 16, 2004, and continuing until October 1,

Manager of Contract and Engineering Services DATE: August 31, 2004 SUBJECT: Dry Docking of the Lady Muskoka RECOMMENDATION None. Committee direction is sought in this matter. ORIGIN Transport Canada requires hull inspections to be carried out on commercial vessels every 5 years. Lady Muskoka Boat Cruises (LMBC) has requested to use the large lock to dry dock the Lady Muskoka for hull inspections and repairs. BACKGROUND The Lady Muskoka requires a hull certification to continue sailing next season.. The practice in the past was to remove the boat at the boat ramp at Rosseau in Humphrey Township. Redevelopment work scheduled for the fall precludes the use of the ramp and approaches for this season. Presently there is no marine railway facility on the Muskoka Lakes large enough to accommodate the Lady Muskoka, hence the request to use the locks.. In 1993, 1998 and 2003, the Muskoka Lakes Navigation and Hotel Company Ltd. (Navco) used the large lock to dry dock the Segwun. Remuneration for this privilege in 1993 and 2004 was based on the prevailing rates at the Port Weller dry docking facility.. The use of the lockmaster building, stop logs and pumps during this period and the person on site (if required) were deemed to be included in the dry docking rates.. Navco paid for all advertising associated with public notice during the summer months and the period immediately preceding the actual dry docking. They also paid for any additional hydro charges if the lock had to be heated during cold weather.. All costs associated with transportation and maintenance of pumps, stop logs and hoses and the costs for dewatering were borne by Navco.."...2 Managing Our Legac!j Togetner 42
5 - Page 2-, In 1998, when the Segwun and the Wanda III were dry docked, the Township of Muskoka Lakes was operating the locks under an agreement with the Province" At that time the Township decided not to charge for the use, but did receive a $500,,00 donation from Navco ANALYSIS The period requested by LMBC coincides with work already awarded and scheduled" In fact, a bylaw is in place closing the large lock for the period Tuesday, October 12th, 2004 to Friday, November 12th, 2004, for this purpose" The Lady Muskoka is too large to allow the repairs to the lock to proceed while the boat is in dry dock, thus additional closure time would be required" Closing the lock for an additional 5 weeks would almost certainly require that the locks be heated. This of course would be the responsibility of LMBC. The additional length of closure would disrupt barge traffic" The disruption to navigation would only affect contractors and barge owners using vessels too large for the small lock" The time would be late in the season and if the full five weeks were required, this would mean closure until December 17. Although we have operated the lock as late as December 23, there is a good chance that the lakes would be frozen by this date and neither barge owners nor LMBC could return to their home docks" ALTERNATIVES This hull inspection could be performed in the spring of 2005 shortly after the locks can be opened. The boat could be tied to the dock this fall until freeze up, then moved into the lock where it would spend the winter. When temperature permits in the spring, the lock could be dewatered and the inspection and repairs performed. This alternative might still require the lock to be heated, the timing is dependent upon the weather and before the lock could be reopened, barge operators might wish to use it This is also a busy time for the Transport Canada inspectors" FINANCIAL The disruption to navigation would only affect contractors and barge owners using vessels too large for the small lock" Based on 2001 figures, the anticipated loss of access for the fall period is 9 to 11 lockages (assuming the affected people do not reschedule around the closure), representing approximately $1,245"00,, It is estimated losses would be less during the spring because some of the work could be performed prior to the lakes being free of ice" On the revenue side, a fee would be charged for the period from when the stop logs go in until they are removed" The present rates for dry docking, provided by the Port Weller Dry Docks (A Division Of Canadian Shipbuilding & Engineering l.td.), are as follows: First Day (Docking Day):: Subsequent Days (Lay Days): $0,,60 per ton for the first 4000 tons and $0,,37 per ton over 4000 $0,,37 per ton. 6 kclr Pl~~t7f; PO Box 1327, Bracebridge, Ontario P1l1V4 Phone: Toll Free: (J~ District of Muskoka Attention: Kevin Austin Dear Mr. Austin, This will confirm our conversation on Friday, August 27,2004 wherein I related our desire to use the Port Carling Locks this year to satisfy out mandatory 5 year haulout of the Lady Muskoka for subsequent Coast Guard inspection. As I explained, we were planning to use Rosseau Town Dock as we did 5 years ago but we are now told this is not possible as restoration and development of the waterfront is beginning mid September and accordingly the site would not be available. For the record, I did extensive research in the past to find suitable haulout locations and found that Rosseau was perhaps the only alternative to the Port Carling Locks and at that it is still not totally suitable because of the dramatic grade of the ramp. We were considering a sizeable investment this haulout to back fill the approach to the ramp to attain a more suitable incline until we received the bad news that it was not available. This brings me to my request for use of the Port Carling facility. Our season runs until Oct 17 this year so we would like to begin our haulout closely following that date. We have a 90 ft + trailer that we will be modifying somewhat for the task which we intend to place in the lock to cradle the Lady Muskoka. This will entail use of cranes and barges to facilitate positioning the equipment accordingly. Depending on how the inspection goes, our goal is to re-launch the vessel 4 to 5 weeks following the haulout and return to her home berth in Bracebridge. The lagoon is currently at capacity and needs to be cleaned. A Request For Proposals (RFP) to conduct this cleaning operation was prepared and forwarded to firms known to have the equipment and expertise to carry out this type of work. An advertisement was also placed in the local newspapers. ANALYSIS A total of 2 bids were received in the amounts, inclusive of GST, listed hereunder. An evaluation of the bids was conducted to review the experience of the contractors and sub-contractors and to identify any irregularities with the submissions Contractor Region of Huronia Environmental Services Boldt's Liquid Waste Ltd.. Location New Lowell, Ontario -Port Elgin, Ontario Bid $86,670 $86,670 It is coincidental that both contractors submitted the same price, yet the proposed method for conducting this operation is completely different. Huronia's proposal is to spread the liquid biosolids as a soil conditioner on farmland in the Simcoe County area. Boldt's proposal was to dewater the biosolids at the lagoon site only. Transportation and landfill tipping fees would be an extra cost borne directly by Muskoka, It's estimated that these additional costs would be approximately $10,000. The parade is set for Saturday November 27 at 1 p.m. We will once again be asse at the Leisureworld Muskoka Nursing Home on Kelly Drive at 12:30 p.m, From Kell Drive the parade will travel up Pinedale Streetto First Streetto Winewood to Musk ka Road and back to Phillip Street. Enclosed is a map of the route. I have also enclosed proof of liability insurance for the parade. We will need barrie des set up at approximately 12:30 p.m. to be removed as soon aspossible asthe para e continues past the intersections. ANALYSIS When this by-law was implemented in 1999, there was a problem with vehicles being left along the roadway in the Village of Windermere over night.. It appears that this problem no longer exists, so the Township of Muskoka Lakes has forwarded a resolution of their Council requesting that a portion of the parking restrictions be removed. Staff has no objections to this request. Waters Director of Roads and Waste Management August 23, 2004 Speed Limit Muskoka Road #7 - Near Port Sandfield RECOMMENDATION THAT a by-law be prepared establishing a 60 km/hr speed zone on Muskoka Road #7 as per the report of the Director of Roads and Waste Management dated August 23, ORIGIN A number of complaints were received regarding the speed limit on a portion of Muskoka Road #7 near Port Sandfield. ANALYSIS After receiving the complaints, staff checked the portion of Muskoka Road #7 in question, and found that a 600 m section currently posted at 80 km/hr should actually be 60 km/hr. We therefore recommend that a 60 km/hr speed zone be created from the existing 50 km/hr speed limit east of Port Sandfield easterly 600 m. Waters Director of Roads and Waste Management September 8, 2004 Appointment of a Consultant - Salt Management Plan RECOMMENDATION THAT the consulting firm of Giffels Associates Limited be engaged to carry out a Salt Management Plan as outlined in the report of the Director of Roads and Waste Management dated September 8, ORIGIN The need to appoint a consulting engineering firm to undertake a Salt Management Plan as required by Environment Canada. ANALYSIS It is required that municipalities using more than 500 tonnes of salt per year, or that have vulnerable areas in their territory that could be potentially impacted by road salts, undertake a Salt Management Plan that will identify actions municipalities will take to improve their road salt management practices. This matter was discussed with the area Road Superintendents who concur that a single comprehensive Salt Management Plan, that looks at the needs of the District of Muskoka as well as the Area Municipalities, would be desirable. In discussions with municipalities across Ontario that have developed Salt Management Plans, it appears there are only a few Consultants currently doing these plans, of which none are local firms. In speaking with one County in particular, they have already gone through the Request for Proposals for a Salt Management Plan that would be nearly identical to what the situation is here in Muskoka. They have one upper tier and a number of local municipalities in their jurisdiction. I have spoken to the successful consulting firm, and they are prepared to undertake a similar plan for the District of Muskoka and the Area Municipalities at virtually the same cost, i.e. $31, plus tax, being the lowest price submitted. 26 Page 2 The cost to the local municipalities will be based on how much work is required in each, and is estimated to be between $1,000 and $5,000 per municipality. It is anticipated that the District of Muskoka's share will be the largest based on salt usage alone. It is recommended that Giffels Associates Limited, a well respected engineering firm, be appointed to undertake this plan for the District of Muskoka and the six Area Municipalities. ORIGIN Terry and Diane Madore appeared before the Committee on August 4,2004 to request that a by-law be passed to allow All Terrain Vehicles (ATVs) to use Muskoka District Roads in the Township of Georgian Bay. SUMMARY Muskoka has received a request for a by-law to authorize the use of certain of its roads in the Township of Georgian Bay by ATVs. As the main purpose of ATVs is to allow the operator to travel on "off-road" trails, it was expected that authorization could be given for the use of short sections of Muskoka's roads that may be required to connect disjointed trails. However, the routes requested are of significant length. Therefore, a more general authorization of use will be required to satisfy the requesters. Such a broad authorization may not be sustainable over the long term, either in the Township of Georgian Bay or elsewhere in Muskoka. A working group consisting of several stakeholders will be examining this issue in the Town of Huntsville in the near future. In the meantime; staff would appreciate feedback and direction from the Engineering and Public Works Committee. ANALYSIS On August 4, several committee members noted that the popularity of ATVs was growing rapidly and that they had the potential to add a significant boost to Muskoka's tourism industry. For this reason, there was general support for measures that would encourage the development of this relatively new recreational activity. However, some members also pointed out that damage to municipal property, complaints from property owners and liability issues needed to be taken into account when assessing requests for the use of road allowances. 28 - 2 - It was noted that ATVs are intended to be off-road vehicles and, accordingly, the use of municipal roads should be limited to linkages between trails. Comparisons were drawn with road crossings used by snowmobiles when travelling from one section of trail to another. It was agreed that ATVs should be treated in a similar manner to snowmobiles and that rather than granting a blanket approval to use Muskoka District Roads, site specific approvals should be issued based on the need to connect off-road trails. Staff were directed to consult further with the Madores and to report back to the committee. Following several discussions with the Madores it became apparent that the identification of relatively short sections of road required to connect off-road trails would not meet their requirements. A map of the sections requested by the Madores is attached as Appendix "A". Permission is being sought to run ATVs on approximately 1 kilometre of Muskoka Road 33, 2.5 kilometres of Muskoka Road 48, 6 kilometres of Muskoka Road 5 and the entire length (9.5 kilometres) of Muskoka Road 34. Some sections of these roads have generous shoulders and it is possible that ATV drivers will use them. This could be a blessing for other road users wishing to pass slow moving ATVs, but it could also mean significant damage to the shoulders. Most of the road sections identified in Appendix "A" do not have generous shoulders. Indeed, some have none at all (e.g. the majority of Muskoka Road 48). ATVs using the paved portions of these roads certainly don't present a threat of damage to the pavement, but they may be perceived to be a nuisance by operators of more conventional vehicles and other road users. Regardless of whether ATVs are looked upon favourably or not, it is hard to counter the argument that if they are properly licensed and insured, they are virtually indistinguishable from other motorized vehicles that are allowed to use municipal roads. Aside from the fact that they are intended for off-road use, there is little to support the notion that ATVs are so different from other vehicles that their use of municipal roads should be subject to special restrictions. That being said, most reasonable people would agree that there are some municipal roads where ATVs do not belong" Examples include the main streets of urban areas, streets on which hospitals, schools and other institutional buildings are located, quiet residential areas, etc. Conversely, there are other roads where ATV's would not likely be a problem. Indeed, on rural roads ATVs may be as much a part of the accepted scenery as farm vehicles. NEXT STEPS The Town of Huntsville is in the process of setting up a working group on ATVs which is scheduled to meet for the first time around September 22. The working group will include representatives of the Town, the Ontario Provincial Police, the Ontario Federation of All Terrain Vehicle Clubs, the Muskoka Snowmobile Region and Muskoka's Engineering and Public Works Department. Although the request from the Madores is concerned only with roads in the Township of Georgian Bay, Muskoka's response will have to be applied consistently across all six area municipalities. Therefore, it would be helpful if the working group were given an opportunity to meet at least once before any action is taken by Muskoka. Regardless of the approach that Muskoka may ultimately take to this issue, the wishes of the area municipality in which the affected roads are located should be taken into account. With this in mind, the granting of approval for ATVs to use Muskoka Distrlct Roads should involve a process similar to that used when authorizing parking/no parking zones, special events, etc. In these circumstances the authorization is granted either at the request of the affected area municipality or with its consent. The Phase I area was approved for 1,482,425 cubic yards of capacity of which 930,000 cubic yards would be waste. The Phase II development plan would be assessed later. In 1995, on behalf of the Town of Gravenhurst, TSH made application to the MOE for an amendment to the Certificate of Approval to reflect the current operations and to outline future cells. This amendment updated the operational plan of the site but did not include approval of the Phase I( remaining capacity as it was recommended at that time to review that at a later date. As Phase I approaches capacity and given that the Rosewarne Landfill site is expected to reach capacity in 2006, the approval of the Phase II remaining capacity is of utmost importance. To assess the remaining capacity in Phase II of the landfill, the bedrock contours must be accurately established. These contours would be compared to the original Phase I( assumptions on depth to bedrock and an actual remaining capacity estimate will be determined.. Once this is completed, the approval process c;an commence for the Phase II capacity. In addition to the capacity estimate, this contouring will assist in understarding the subsurface hydrogeologic systems at the site and allow further confidence in on-site compliance assessments. 31 Page2 FINANCIAL The District of Muskoka currently has Jagger Hims Limited under contract to provide Monitoring Reports for the District Landfills. They have provided a cost estimate on a worst-case basis. The worst-case costs for the drilling are $17, The drilling costs are based on the following quotations provided by Jagger Hims: Lantech - $52.50 per linear foot; Atcost Soil Drilling $64.44 per linear foot; and Geo-Environmental Drilling - $ per foot. Supervision, monitoring, and reporting costs are $15, As the information is geotechnical in nature and will be required to be reported on in our annual monitoring reports to the MOE, it is recommended that the Jagger Hims proposal be accepted. There are some water and sewer mains in the area which are identified for rehabilitation in the capital works budget. It would be advantageous to conduct these works now in conjunction with the Streets Improvement Program and minimize any future construction disruptions to the downtown business community. ANALYSIS A cast iron watermain on Manitoba Street adjacent to Ontario Street has been a source of trouble for several years. It has broken three times in the last four years. The short section of sewer main in this area has also given us difficulty; it has collapsed and plugged several times. To complicate matters further, the sewer line is very shallow and it is located directly above the existing watermain, making repairs very difficult. We propose to replace the sewer line and abandon this section of watermain. In an effort to reduce the remedial costs, yet maintain secure water services, it is proposed that ~II water laterals currently connected to the watermain that we propose to abandon will be switched over to an existing PVC trunk watermain located on the other side of the street.. Fortunately, the existing cast iron watermain further up the street has never had a break. Looping water lines helps to ensure a stable water supply so it is proposed to connect the remaining cast iron watermain to the PVC trunk line. Managing Our Legacy Together 71.../2
34 -2- All of the existing service lateral curb stops between Ontario Street and Taylor Road are very old and the long-term service life is questionable. Since most of these valves are currently located in the sidewalk, we also propose to have these replaced, avoiding future possible interference with the new sidewalks. Fowler Construction is the contractor for the Streets Improvement Program and, logically, they were asked to prepare a price submission to conduct these works. The cost submitted, on a-unit price basis, is $172,000, which is consistent with prices recently received for similar work. FINANCIAL CONSIDERATIONS A review of the current 2004 capital works budget for watermain improvements for the Town of Bracebridge reveals that we will be slightly under spent.
