3 INFLATABLE WATERPARK REQUEST FOR PROPOSALS (RFP) 1.0 Introduction The Town of Osoyoos is seeking proposals from interested and qualified companies to enter into a commercial lease agreement for the seasonal installation and management of a modular inflatable waterpark. As shown on the map in the attached Schedule A, the waterpark will be located on the west side of Osoyoos Lake within the limit of our municipal lake boundaries, with shore access through the northern grassed portion of Legion Beach. The Town s existing splash park is located close by to the north. The waterpark would occupy a portion of the area currently contained with protective roped buoys as a public swimming area every summer. Lease revenues will be payable to the Town for use of public parklands and, as the upland property owner, for adjoining lake waters. The Town is seeking a three-year lease agreement with an option to renew for three more years by agreement of both parties. Community consultation will include an initial public open house and final Town lease approval will be subject to a public hearing for rezoning under our Foreshore and Lake Zoning Bylaw and Council bylaw adoption. The need for extensive public consultation together with Provincial approvals means that the earliest anticipated lease starting date will be the spring of The Legion Beach location was selected by Council after considering a range of options, shortlisting two alternative sites, and reviewing survey results from 249 respondents on their favoured site. The survey results may be viewed on the Town s website at Public Objectives The public objectives of this RFP are to offer the opportunity to a private contractor through a competitive process to seasonally install and manage an inflatable waterpark which maximizes community values for: Recreational access, enjoyment and safety of resident, tourist, and other visitor users; Maintenance of local environmental quality and the surrounding neighbourhood s quality of life; and Appropriate financial returns to the Town for use of valuable public resources. 3.0 Proposal Contents All proposals must demonstrate that the company will materially further the above public objectives and address all the following specific information requirements: RFP Inflatable Waterpark Page 3 of 6

4 .1 Lease Value a) Annualized lease payment offer for period of lease with GST and any terms and conditions..2 Business Particulars a) Scaled drawing showing the configuration, dimensions, and area of lease required for the waterpark and onshore facility, and access between the two; b) Projected customer numbers, demographic characteristics, and origin / travel status; c) Any plans to expand the capacity of the waterpark in the future; d) Proposed terms of lease including number of years, operating season / months, and opening hours; and e) Customer registration requirements..3 Equipment and Operations a) Capacity, layout, and dimensions of all waterpark modules; b) Product brand illustrations and quality specifications of modules; c) Integration of waterpark with remaining public swimming areas to the north and south, including relationship to protective roped buoys; d) Means of anchoring waterpark and seasonal installation and removal to minimize disturbance to lakebed and foreshore; e) Location of off-season storage for waterpark components; f) Siting, dimensions, and nature of small seasonal facility for customer registration and issuing of lifejackets, and any requirements for off-site storage; and g) Projected vehicle parking demands and anticipated locations..4 Safety, Security and Maintenance a) Provisions for customer safety, including company representative(s) present at all times and lifeguards with National Lifeguard (preferably with Waterfront Option) and Standard First Aid with CPR-C certifications; b) Range of available lifejackets for adults and minors; c) Security arrangements outside of operating hours; d) Garbage pickup provisions and end of season site cleanup; e) Environmental protection measures; f) Noise limitations including no music or loudspeaker advertising; and g) Response strategy for dealing with any extraordinary noise or other nuisance complaints..5 Legal and Regulatory Responsibilities The contractor should acknowledge their responsibility for the following, including but not limited to: a) Attendance at a public open house to present proposal; b) Liability insurance indemnifying the Town from damages; c) Application to the Town for amendment under our Foreshore and Lake Zoning Bylaw No. 1294, 2012, from W1 Public Water Use to W4 Commercial Moorage, and attendance at public hearing; d) Head Lease fees due to the Province by the Town, including but not limited to any fees possibly associated with the Town applying to convert the current Licence of Occupation to a Head Lease (e.g. survey of proposed lease area); RFP Inflatable Waterpark Page 4 of 6

5 e) Any property taxes due to BC Assessment for lease area; f) Application for change approval under Section 11 of the Water Sustainability Act; g) Signing of lease agreement with the Town including conditions; and h) Application to the Town for a business licence..6 Company Particulars a) Company background including experience with comparable projects; b) Number, experience, and qualifications of on-site staff, including name of main company contact; and c) Letters of reference from government clients for comparable projects, in addition to the Town undertaking its own inquiries. 4.0 Liaison The selected contractor will work under the general guidance of the Town s Waterfront Steering Committee, with the following membership: Councillor CJ Rhodes (Chair) and Councillor Mike Campol Barry Romanko, Chief Administrative Officer Alain Cunningham, Director of Planning and Development Services Gerald Davis, Director of Community Services Jim Dinwoodie, Director of Operational Services Engineering representative of TRUE Consulting Group (as required) 5.0 Proposal Review All proposals will be evaluated according to how well they will further the Town s public objectives and address all specific information requirements. The highest lease value proposal will not necessarily be selected. 6.0 Timing Six (6) copies of the proposal must be received by the undersigned no later than 2:00 PM Pacific Standard Time on February 1, 2017 in a sealed envelope clearly marked Proposal for Inflatable Waterpark.
