5 Generl Operting Instrutions & Complex Generl Avition GAR Prt 91 & 125 Pge 1 Prt 91 Requirement Prt 125 Requirement Suprt A Generl 91.1 Purpose Purpose Note: in this presenttion of GAR 91 nd GAR 125, ll GAR 91 prgrphs lso pply to GAR 125, exept when in the sme row different GAR 125 requirement ppers, whih then pplies nd overrules the orresponding GAR 91 requirement. The requirements of this Prt over opertion nd piloting of irrft, the rrngements for the plnning nd preprtion for flight, nd the mintenne nd equipment of irrft. These Requirements onstitute instrutions given y the Diretor under setion 39 of the Air Nvigtion (Biliwik of Guernsey) Lw, 2012 ("the Lw"). These Requirements re not in themselves Lw. Filure to omply with these Instrutions my onstitute n offene under nd in ordne with rtile 74 nd the provisions of rtile 185(1) of the Lw. These Requirements enompss nd mplify mny of the provisions of the Lw, inluding the Rules of the Lw set out in Shedule 4 to the Lw. Therefore, filure to omply with these Requirements my: 1 onstitute reh of one or more provisions of the Lw; nd 2 result in proeedings for rehes of the Lw; or 3 result in the refusl of n pplition for renewl of ertifite; or 4 result in tion to suspend or revoke ertifite The Lw estlishes the si legl oligtions governing the opertion nd piloting of irrft, the plnning nd preprtion for flight nd the mintenne nd equipment of irrft ut speifies these oligtions in rther generl terms. Therefore Setion 135 of the Lw requires the Diretor to pulish Requirements to ugment, mplify nd detil more preisely the mnner in whih these oligtions shll e met. The Requirements re the mens y whih the opertor of n irrft or the pilot will e le to stisfy the Diretor s to the fulfilment of the oligtions in respet of the opertion of n irrft or their respetive entitlement to hold ertifite. d The issue of ertifite indites only tht the holder is onsidered ompetent to seure the sfe opertion of irrft. The possession of suh doument does not relieve the opertor of n irrft, or the pilot-inommnd, from the responsiility for ompline with the Lw nd ny other legisltion in fore. Neither does it relieve them of their responsiility for the sfe ondut of ny prtiulr flight, s the ultimte responsiility for the sfety of flight opertions lwys rests with the opertor nd the pilot-in-ommnd. e Other GAR Prts my impinge upon tivities onduted under this Prt.
