3 Merhant Shipping (Fees) Regulations 2017 Regulation 1 Statutory Doument No. 2017/0070 Merhant Shipping (Misellaneous Provisions) At 1996 MERCHANT SHIPPING (FEES) REGULATIONS 2017 Approved by Tynwald: 21 Marh 2017 Coming into Operation: 1 April 2017 The Department of Eonomi Development, with the onsent of Treasury, makes the following Regulations under setion 17(1) of the Merhant Shipping (Misellaneous Provisions) At Title These Regulations are the Merhant Shipping (Fees) Regulations Commenement If approved by Tynwald, these Regulations ome into operation on 1 April Interpretation In these Regulations agents fees means any fees harged by the vessel s agent in providing assistane to a surveyor when travelling to a vessel; Amerias zone means any of the ountries or offshore areas illustrated in Shedule 11 as being part of the Amerias zone; Asian zone means any of the ountries or offshore areas illustrated in Shedule 11 as being part of the Asian zone; Australasian zone means any of the ountries or offshore areas illustrated in Shedule 11 as being part of the Australasian zone; argo ship means any ship whih is not a passenger ship, pleasure vessel, fishing vessel, small ship or ommerial yaht; ertifiate of ompliane for a large harter yaht means a ertifiate of ompliane issued in aordane with the Large Commerial Yaht Code; ommerial yaht means a vessel whih is registered or to be registered in the Island under Part I or Part IV of the Merhant Shipping Registration At SD2017/0070 Page 3
4 Regulation 3 Merhant Shipping (Fees) Regulations and whih is or is to be ertifiated in aordane with the Large Commerial Yaht Code; Company means the owner of the ship; or any other organisation or person suh as the manager, or the bareboat harterer, who (i) (ii) has assumed the responsibility for operation of the ship from the owner of the ship; and on assuming suh responsibility, has agreed to take over all the duties and responsibility imposed by the ISM Code; Company ISM doument of ompliane audit or Company audit means an audit to verify a Company has and operates a safety management system in aordane with the requirements of the ISM Code; Company ISM doument of ompliane means a doument of ompliane issued in aordane with the ISM Code, Part B, setion 13; CSR means a ontinuous synopsis reord required by SOLAS Chapter XI-1 regulation 5; demise in registration means registration of a vessel under Part IV of the Merhant Shipping Registration At 1991 (the demise Register); demise out registration or demised out means registration of a Manx ship in a ompatible register in aordane with Part III of the Merhant Shipping (Demise Charter Register) Regulations ; Department means the Department of Eonomi Development; DMLC means a delaration of maritime labour ompliane issued in aordane with Part 20 or Part 21 of the Merhant Shipping (Maritime Labour Convention) Regulations ; European zone means any of the ountries or offshore areas illustrated in Shedule 11 as being part of the European zone; fishing vessel means a vessel registered or to be registered under Part III of the Merhant Shipping Registration At 1991; gt means gross tonnage; high speed raft safety ertifiate means a ertifiate issued in aordane paragraph of the International Code of Safety for High Speed Craft (HSC Code); IMO means the International Maritime Organization; 1 SD394/91 2 SD0234/13 Page 4 SD2017/0070
5 Merhant Shipping (Fees) Regulations 2017 Regulation 3 initial general inspetion means the inspetion required by regulation 7 of Merhant Shipping (Survey and Certifiation) Regulations ; interim MLC ertifiate means an interim ertifiate issued in aordane with Part 20 of the Merhant Shipping (Maritime Labour Convention) Regulations 2013 but does not inlude a DMLC; interim safety management ertifiate means an interim ertifiate issued in aordane with the ISM Code, Part B setion 14; interim ship seurity ertifiate means an interim ertifiate issued in aordane with the ISPS Code, Part A setion 19.4; ISM or ISM Code means the International Management Code for the Safe Operation of Ships and for Pollution Prevention (International Safety Management Code) inluding all amendments made to that Code up to and inluding those adopted by IMO resolution MSC.353 (92) on 21 June 2013 whih ame into fore 1 January 2015; ISPS Code means the International Code for the Seurity of Ships and of Port Failities as adopted by the IMO Diplomati Conferene on Maritime Seurity on 12 Deember 2002 inluding all amendments made to that Code up to and inluding those adopted by IMO resolution MSC.196(80) on 20 May 2005 whih ame into fore 1 January 2009; Large Commerial Yaht Code or LY3 means the Large Commerial Yaht Code published by the UK s Maritime and Coastguard Ageny in August 2012 and inludes the Isle of Man s National Annex to LY3; major onversion means a onversion of a vessel () (d) whih substantially alters the dimensions of a vessel; whih hanges the type of the vessel; the intent of whih in the opinion of the Department is substantially to prolong its life; whih otherwise so alters the ship that, if it were a new vessel, it would beome subjet to the relevant provisions of LY3 not appliable to it as an existing vessel; mandatory general inspetion means the inspetion required by regulation 7A of the Merhant Shipping (Survey and Certifiation) Regulations 1999; Manx ship has the meaning given by setion 1 of the Merhant Shipping Registration At 1991 and inludes a ship registered under Part IV of that At (the Demise Charter Register); Maritime Labour Convention or MLC means the Convention adopted on the 23 February 2006 by the General Conferene of the International Labour Organization in Geneva, as amended by the 103 rd session of the 3 SD352/99 SD2017/0070 Page 5
6 Regulation 3 Merhant Shipping (Fees) Regulations 2017 International Labour Conferene on 11 June 2014, whih ame into fore on 18 January 2017; Middle Eastern and Afria zone means any of the ountries illustrated in Shedule 11 as being part of the Middle Eastern and Afria zone; MLC ertifiate means a ertifiate issued in aordane with Part 20 of the Merhant Shipping (Maritime Labour Convention) Regulations 2013 and inludes a DMLC; passenger means every person arried on a ship other than a person who is employed or engaged or works in any apaity on-board the ship on the business of the ship; and a hild under one year of age; passenger ship is a ship whih arries more than 12 passengers; passenger ship safety ertifiate means a ertifiate issued in aordane with SOLAS Chapter I regulation 12; pleasure vessel has the meaning given by regulation 6 of the Merhant Shipping (Pleasure Vessel) Regulations ; pre-registration survey means the survey required by setion 7 of the Merhant Shipping Registration At 1991; Register means the register of ships kept in aordane with Parts I to IV of the Merhant Shipping Registration At 1991; safe manning ertifiate means a ertifiate issued by the Department in aordane with regulation 9 of the Merhant Shipping (Manning and STCW) Regulations ; safety management ertifiate means a ertifiate issued in aordane with the ISM Code, Part B setion 13.7; safety management system means a strutured and doumented system enabling Company personnel to implement effetively the Company safety and environmental protetion poliy; ship seurity ertifiate means a ertifiate issued in aordane with the ISPS Code, Part A setion 19.2; ship seurity plan means the ship seurity plan required by the ISPS Code, Part A setion 9; small ship means a ship registered or to be registered in the Island under Part II of the Merhant Shipping Registration At 1991; SOLAS means the International Convention for the Safety of Life at Sea 1974 as adopted on the 1 November 1974 by the IMO International Conferene 4 SD396/03 5 SD2014/0238 Page 6 SD2017/0070
7 Merhant Shipping (Fees) Regulations 2017 Regulation 4 on Safety of Life at Sea, as amended by the 1988 Protool whih ame into fore on 3 February 2000; tehnially managed from the Island means for ships of 500gt and over where the responsibility for the operation of the ship and all the duties and responsibilities imposed by the ISM Code are undertaken by the Company from the Island; or for ships under 500gt where the day to day operation of the ship is undertaken from the Island whih inludes (i) (ii) (iii) (iv) the statutory ertifiation of the ship; the operational safety of the ship; the manning of the ship; and anti-pollution measures. travel day means a day where a surveyor is travelling to the loation of the vessel or offie and during whih no survey work is undertaken; waiting day means a day where a surveyor has travelled to the loation of the vessel or offie and is unable to ommene work; working day means 10 hours in a 24 hour period or any part of 10 hours worked by a person; and wrek removal insurane ertifiate means a ertifiate issued in aordane with Artile 12(2) of the Nairobi International Convention of the Removal of Wreks 2007 adopted in Nairobi on 18 May Fees payable The fee payable for a servie or other funtion desribed in Shedules 1 to 11 is the fee speified in the shedule in relation to that servie or funtion; or otherwise determined under the shedules. 5 Revoation The Merhant Shipping (Fees) Regulations are revoked. 8 SCHEDULE 1 - CARGO SHIPS Merhant Shipping (Fees) Regulations 2017 ANNUAL REGISTRATION FEE SCHEDULE 1 - CARGO SHIPS (1) Subjet to paragraph (5), an annual registration fee is payable by all argo ships whih are on the Register on the 1 April of eah year in aordane with Table 1. (2) For a argo ship whih registers on a day other than the 1 April of a year, the annual registration fee is payable on a pro-rata basis alulated daily from the date of registration up to and inluding the next 31 Marh. (3) A disount of 10% is applied to the annual registration fee speified in Table 1 for a argo ship whih on the 1 April of that year exeeds the MARPOL Annex VI EEDI redutions fators speified in Shedule 10, Table 15. (4) The annual registration fee is non-refundable. (5) Paragraphs (1) to (4) of this Shedule do not apply to a demised out argo ship. (7) To avoid doubt, for a demised out argo ship whih registers on a day other than the 1 April, the annual registration fee is due on the next 1 April and is not payable on a pro-rata basis. (8) A disount of 50% is applied to the annual registration fee speified in paragraph (6) for a demised out argo ship whih is tehnially managed from the Island. 9 Merhant Shipping (Fees) Regulations 2017 SCHEDULE 1 - CARGO SHIPS PRE-REGISTRATION SURVEY, INITIAL GENERAL INSPECTION AND ADDITIONAL INSPECTION FEE (10) The fees to attend and arry out a pre-registration survey, initial general inspetion or additional inspetion will be harged in aordane with Table 2. (11) For the purposes of this Shedule, an additional inspetion of a argo ship is any visit to a argo ship to ondut any inspetion, verifiation or survey other than () (d) a pre-registration survey, initial general inspetion or mandatory general inspetion; an interim, initial, intermediate or renewal verifiation for ompliane with the ISPS Code; an interim, initial, intermediate or renewal verifiation for ompliane with the ISM Code; and an interim, initial, intermediate or renewal inspetion for ompliane with the MLC Convention. (12) If a surveyor has travelled to the loation of a argo ship, for eah day after 1 day that a surveyor is kept waiting and is unable to ommene work, an additional fee of 520 per day is payable. (13) The fees in Table 2 do not inlude agents fees. 10 SCHEDULE 2 COMMERCIAL YACHTS Merhant Shipping (Fees) Regulations 2017 ANNUAL REGISTRATION FEE SCHEDULE 2 COMMERCIAL YACHTS (1) An annual registration fee of 2,000 is payable by all ommerial yahts whih are on the Register on the 1 April of eah year. (2) To avoid doubt, for a ommerial yaht whih registers on a day other than the 1 April, the annual registration fee is due on the next 1 April and is not payable on a pro-rata basis. (3) A disount of 50% is applied to the annual registration fee speified in paragraph (1) for a ommerial yaht whih is tehnially managed from the Island. (4) A disount of 10% is applied to the annual registration fee speified in paragraph (1) for a ommerial yaht whih on the 1 April of that year exeeds the MARPOL Annex VI EEDI redutions fators speified in Shedule 10, Table 15. (5) The annual registration fee is non-refundable. FIXED FEE - NEW BUILD OR MAJOR CONVERSIONS Commerial yaht under 500gt (6) A new build or major onversion ommerial yaht under 500gt may elet to pay for the servies and ertifiates speified in paragraph (8) as a fixed fee. (7) The fixed fee will be harged in aordane with Table 3. (8) The fixed fee entitles the yaht to an initial visit by the Department to the yard; a mid-term survey visit by the Department at the yard; () a visit by the Department at the yard to ondut - (d) (e) (i) a pre-registration survey or an initial general inspetion; (ii) an initial survey for ompliane with the Large Commerial Yaht Code; and (iii) an inspetion for ompliane with MLC, the approval of the rew aommodation arrangements in aordane with MLC, an assessment of the proposal for safe manning; (f) the issue of (i) (ii) a ertifiate of ompliane for a large harter yaht; a safe manning ertifiate; and Page 10 SD2017/0070

(9) The fixed fee inludes the ost of surveyor s travel and subsistene exept for any port to ship or ship to port transfers; and any agents fees. (10) To avoid doubt, the fixed fee does not inlude any lassifiation soiety fees. (11) If a surveyor has travelled to the loation of a yaht, for eah day after 1 day that a surveyor is kept waiting and is unable to ommene work, an additional fee of 520 per day is payable. (13) The fixed fee will be harged in aordane with Table 4. (14) Subjet to paragraph (15), the fixed fee entitles the yaht to an initial visit by the Department to the yard; a mid-term survey visit by the Department at the yard; () a visit by the Department at the yard to ondut - (i) a pre-registration survey or an initial general inspetion; (ii) an initial survey for ompliane with the Large Commerial Yaht Code; (iii) (iv) (v) (d) the approval of an interim verifiation for ompliane with the ISM Code; an interim verifiation for ompliane with the ISPS Code; and an interim MLC inspetion, SD2017/0070 Page 11
12 SCHEDULE 2 COMMERCIAL YACHTS Merhant Shipping (Fees) Regulations 2017 (e) (i) (ii) the ship seurity plan; and the rew aommodation arrangements in aordane with MLC. an assessment of the proposal for safe manning; (f) the issue of (i) (ii) (iii) (iv) (v) (vi) a ertifiate of ompliane for a large harter yaht; an interim safety management ertifiate; an interim ship seurity ertifiate; the first Isle of Man CSR; an interim MLC ertifiate; and the safe manning ertifiate. (15) The interim ISM and ISPS verifiations and the preliminary MLC inspetion speified in sub-paragraphs 14()(iii) to (v) will only be arried out if the master and suffiient offiers are available on board the vessel to demonstrate that they are familiar with the Maritime Labour Convention, the safety management system, the ship seurity plan and the planned arrangements for their implementation. (16) The fixed fee inludes the ost of surveyor s travel and subsistene exept for any port to ship or ship to port transfers; and any agents fees. (17) To avoid doubt, the fixed fee does not inlude () any lassifiation soiety fees; the Company ISM doument of ompliane audit; or the Company ISM doument of ompliane. (18) If a surveyor has travelled to the loation of a yaht, for eah day after 1 day that a surveyor is kept waiting and is unable to ommene work, an additional fee of 520 per day is payable. 13 Merhant Shipping (Fees) Regulations 2017 SCHEDULE 2 COMMERCIAL YACHTS COMMERCIAL YACHT FEES SCHEME (19) A Manx ship whih is a ommerial yaht of 500gt or over after suessful ompletion of an initial ISM verifiation; or under 500gt after suessful ompletion of an initial MLC inspetion, will be entered into the ommerial yaht fees sheme and pay fees of 220 per month. (20) The ommerial yaht fees sheme entitles a yaht to () two inspetions by the Department in a 5 year period, to eah inlude (where relevant) (i) (ii) (iii) (iv) (v) the ondut of intermediate or renewal verifiations for ompliane with the ISM Code; the ondut of intermediate or renewal verifiations for ompliane with the ISPS Code; the ondut of intermediate or renewal inspetions for ompliane with MLC; the ondut of any single periodial or renewal survey for ompliane with the Large Commerial Yaht Code; and the ondut of a mandatory general inspetion, the issue of any ertifiate, doument of ompliane, report or DMLC assoiated with paragraph, exept for a CSR; and the issue of any ships statutory ertifiate replaing one previously issued by the Department, exept for - (i) (ii) a CSR; or the re-issue of a ships statutory ertifiate resulting from a hange to any of the partiulars reorded on the CSR. (21) The ommerial yaht fees sheme inludes the ost of surveyor s travel and subsistene exept for any port to ship or ship to port transfers; and any agents fees. (22) Fees paid under this Shedule whilst the yaht is in the ommerial yaht fees sheme are non-refundable. SD2017/0070 Page 13
14 SCHEDULE 2 COMMERCIAL YACHTS Merhant Shipping (Fees) Regulations 2017 (23) The ommerial yaht fees sheme does not inlude - () (d) the assessment and issue of any exemption ertifiate; the extension of any ertifiate; the assessment and issue of any letter of omfort, dispensation, waiver or alternative arrangement; or any ertifiate of finanial insurane for ivil liability for oil pollution damage (for example CLC or Bunkers) or a wrek removal insurane ertifiate. (24) If a surveyor has travelled to the loation of a yaht, for eah day after 1 day that a surveyor is kept waiting and is unable to ommene work, an additional fee of 520 per day is payable. OTHER INSPECTIONS, VERIFICATIONS AND SURVEYS (25) Subjet to paragraph (26), the fee to attend and arry out () (d) (e) a pre-registration survey or initial general inspetion; an interim or initial ISPS Code verifiation; an interim or initial ISM Code verifiation an interim or initial MLC verifiation; and the initial Large Commerial Yaht Code survey, will be harged in aordane with Table 5. (26) The fee in Table 5 inludes the ondut of any inspetion, verifiation or survey speified in paragraph (25) whih is arried out on a yaht during the same visit by the surveyor. (27) The fee to attend and arry out any additional inspetion of a ommerial yaht will be harged in aordane with Table 5. (28) For the purposes of this Shedule, an additional inspetion of a ommerial yaht is any visit to a yaht to ondut any inspetion, verifiation or survey other than () (d) (e) a pre-registration survey, initial general inspetion or mandatory general inspetion; an interim, initial, intermediate or renewal verifiation for ompliane with the ISPS Code; an interim, initial, intermediate or renewal verifiation for ompliane with the ISM Code; an interim, initial, intermediate or renewal inspetion for ompliane with the MLC Convention; the inspetion for ompliane with the MLC Convention speified in paragraph (8)()(iii) for a ommerial yaht under 500gt; or Page 14 SD2017/0070

(29) If a surveyor has travelled to the loation of a yaht, for eah day after 1 day that a surveyor is kept waiting and is unable to ommene work, an additional fee of 520 per day is payable. (30) The fees in Table 5 do not inlude agents fees. 17 Merhant Shipping (Fees) Regulations 2017 SCHEDULE 3 PASSENGER SHIPS ANNUAL REGISTRATION FEE SCHEDULE 3 PASSENGER SHIPS (1) An annual registration fee of 2,000 is payable by all passenger ships whih are on the Register on the 1 April of eah year. (2) To avoid doubt, for a passenger ship whih registers on a day other than the 1 April, the annual registration fee is due on the next 1 April and is not payable on a pro-rata basis. (3) A disount of 50% is applied to the annual registration fee speified in paragraph (1) for a passenger ship whih is tehnially managed from the Island. (4) A disount of 10% is applied to the annual registration fee speified in paragraph (1) for a passenger ship whih on the 1 April of that year exeeds the MARPOL Annex VI EEDI redutions fators speified in Shedule 10, Table 15. (5) The annual registration fee is non-refundable. VERIFICATIONS, SURVEYS, AUDITS OR INSPECTIONS (6) The fees for any verifiation, survey, audit or inspetion of a passenger ship will be harged in aordane with Table 7. (7) The fees in Table 7 do not inlude agents fees. (2) The fees in Table 9 only apply to a fishing vessel whih is under 15 metres length overall for work done - prior to registration; or as a result of a failure to omply with any of the requirements of the Isle of Man Code of Pratie for the Safety of Small Fishing Vessels.
