10 Legal Framework Submission of EUROCONTROL to Provisional Council on PENS (required majority obtained 24 October 2007) Directive No. 07/70 of the Permanent Commission on the contractual relations necessary for the Pan-European Network Services (PENS) Project on behalf of the air navigation service providers of the EUROCONTROL Member States. 10

13 Agreement EUROCONTROL/ANSPs (Mandate)- (1) ANSPs who wish to participate in PENS will need to give a mandate to EUROCONTROL to: i) Manage and organise the tendering procedures with the objective of selecting a PENS Contractor (in accordance with EUROCONTROL Contract Regulations & Code of Conduct). ii) Sign a contract, and any amendments thereof, with the selected PENS Contractor in the name and on behalf of the ANSPs. iii) Manage the contractual relations with the PENS Contractor. 13

14 Agreement EUROCONTROL/ANSPs (Mandate) (2) Mandate refers to Governance with regards to process that allows ANSPs becoming PENS User (first step prior to the conclusion of the contract on their behalf). EUROCONTROL concluded the Contract with the PENS Contractor on behalf of the ANSP only when the ANSP provides agreement in writing (i.e. the signature of Mandate does not authorise per se EUROCONTROL to sign the contract on behalf of ANSP). Provisions on Management of contract (PMU). Cost and funding provisions: - Reference to PENS Charging for cost sharing. - Each Party bears its own costs, except for first 3 years of PMU. - Direct invoicing from PENS Contractor to ANSPs - Direct payments from ANSPs to PENS Contractor - Verification role of PMU. 14

16 HOW TO BECOME A PENS USER An Organisation interested in becoming a PENS user has to follow the following steps: STEP 1: Contact the EUROCONTROL Communication unit to get the needed information (pens@eurocontrol.int) STEP 2: Signature of Common Procurement Agreement (CPA) which allows EUROCONTROL to act on behalf of each signatory. STEP 3: Submit its application to the PSSG via PMU. STEP 4: If accepted, PSSG shall notify the PMU who will negotiate an amendment to the PENS Contract to extend the service to the candidate PENS User. STEP 5: Signature of PENS contract between PENS NSP and candidate PENS User. Copyright 2009 EUROCONTROL 16 16
