5 SES Legal Framework SES Regulations are the legislative package of the EU modernizing ATM network and restructuring of airspace 549/2004 Framework regulation 550/2004 Service provision regulation 2096/2004 Common requirements regulation 551/2004 Airspace regulation 552/2004 Interoperability regulation SES regulations require the ANSP to become certified that means the SATCOM service provider should be certified as well. 5

7 Air Navigation Service Provider ANSP is any private or public entity providing AN Services for general air traffic Air Traffic Services (ATS) Communication Navigation Surveillance Services (CNS) Aeronautical Information Services (AIS) and Meteorological Services (MET) 7

9 EASA EASA is the responsible body in the EU for the common standards and safety for the civil aviation Extension of EASA competences to ATM is the top item on the agenda of EC EC is expected to deliver in 2009 a second SES legislation package, which should designate the EASA for the certification of air navigation services and systems Designation of EASA as certification authority is highly recommended 9

14 Costs Set-up Costs Experience has shown that the effort for an organisation with about 25 persons and depending on the initial state/maturity is about EURO ,-- to ,-- including internal and external costs and costs for training measures but excluding the costs for insurance and excluding the costs for implementing the contingency measures Maintenance Costs Experience shows that about 70% of the initial costs are needed to maintain the certificate. 14

15 Duration Set-up time frame A usual average timeframe would be about one year and it will also depend on the timeframe needed to acquire the required competence mainly related to safety. Oversight Frequency of ongoing oversights could be every 2 years, which could last 1 to 3 months, according to the size and complexity of the provided services. 15

16 Liability Chicago Convention In application of Article 28 of the Chicago Convention, States are responsible for the safe provision of air navigation facilities and services in their airspace. Liability models across Europe State Primary Responsibility (Germany, Austria) State Ultimate Responsibility (Switzerland) ANSP s Exclusive Responsibility (United Kingdom) It is unlikely that the introduction of the SATCOM services would change the present liability system in air navigation 16

17 Financial Risks Montreal Convention on Air Carrier Liability Airlines are liable for damages up to 100,000 SDR For damages more than SDR the airlines may avoid liability by proving that the damage was not due to their negligence The burden of proof is on the carrier SCSP must cover its liability arising from damages 17

19 Key points SCSP under SES regulations The scope of SES is both service provision and system design & development Iris as a pan-european project needs a pan-european certification authority Involvement of EASA as certification authority in early stages of Iris project SCSP as a certified ANSP (UI) or approved subcontractor (IC) 19

21 Conclusions The two key aspects for the certification of SCSP are: 1- The implementation of the Common Requirements. 2- The assessment and demonstration of compliance. SCSP can act either upfront as ANSP or as external service provider to ANSP. The designation of the EASA as the certification authority is highly recommended. The provision of SATCOM service in ECAC is subject to different responsibility regimes but in application of Article 28 of the Chicago Convention, the ultimate responsibility lies by States. 21
