I apologise for the delay in responding to you. I note that on 22 October 2014 you asked for a review of your request as Police Scotland had failed to respond within the prescribed timescale under the Act. On the same date I informed you that your request was delayed and that no review would be conducted at present because an answer had not been provided. On 10 December 2014 a response had still not been provided to you and again you requested a review of your request for the same reason as previously. I can now provide you with the following response and in terms of Section 21(4)(c) of the Act the response provided below forms the formal response to your request for review. 2 Please find attached a copy of the Police Scotland Standard Operating Procedures (SOP) in relation to Gifts, Gratuities, Hospitality and Sponsorship. Could I please have a copy of the gifts and hospitality register for senior staff in Police Scotland For the purpose of this request senior staff includes any police officer of the rank of or above, whether substantive, acting or temporary and any equivalent civil staff member on the Executive Team. The period in question is from the appointment of the Steve House in the summer of 2012 to date. Firstly, please note that Police Scotland was not formed until 1 April 2013 however, the Executive rs for Police Scotland were appointed on various dates after the appointment of the, Sir Stephen House on 1 October Therefore, the information requested relates to 1 October 2012 onwards. On the date of your request the information recorded in terms of Gifts and Hospitality for Executive Staff in Police Scotland, from the official implementation of Police Scotland (1 April 2013) is documented in Table 1 below. Information from the period 1 October 2012 to 31 March 2013 is detailed in Table 2. Please note that with regards to the process of recording gifts, you will see from the tables below that some of the information recorded is more than what is required in terms of the SOP. Whilst there is an expectation that staff will follow the prescribed procedures, it is recognised that every eventuality cannot be covered and accordingly, officers are required to exercise their professional judgement and common sense when making a decision to accept or decline a gift or hospitality. Any subsequent analysis of actions, for example, acceptance of gifts/hospitality under Section 7 of the SOP Acceptance Not Permitted, will be judged on the grounds of reasonableness in the light of all the facts and circumstances rather than solely on non-compliance with the relevant SOP. The reason for this was that although the Police Scotland Executive Team were appointed between this period, there was no formal Police Scotland gift/hospitality register kept until the establishment of Police Scotland on 1 April Furthermore, as the information was kept on eight different systems and there is currently no central database from which historical information can be extracted, we cannot account for any information that was recorded at the time but may have been lost in the transition of the systems. As you can appreciate, each former force recorded such data in a variety of ways and adhered to different procedures however in terms of your request, a reasonable search has been undertaken to establish any data that may be recorded.
