3 1. INTRODUCTION Public company Motorways in 1.1. About us Public company Motorways in Federation of Bosnia and Herzegovina, ltd Mostar, is registered in a court in Mostar on in accordance with the Law on roads (''Official Gazette FBiH'', No. 12/10 and 16/10), the Law of Management company ('' Official Gazette FBiH'', No.23/99,45/00,2/02,6/02,29/03,68/05,91/07,84/08,88/08 and 7/09) and the Decision of status issues of Public company Motorways in Federation of Bosnia and Herzegovina ltd Mostar adopted by the Government Federation of Bosnia and Herzegovina (Decision V No.593/10 from ) at its 149 session held on 1.July in Sarajevo. Activities of Public company Motorways in FBiH are defined by statute of Public company as jobs and tasks on motorways and express roads in FBiH and: - Preparation long-term, medium term and annual plans and development programs, maintenance, protection, reconstruction, construction, reconstruction of roads and structures on the roads as well as reports on implementation of these plans and programs; - Perform of maintenance and protection; -Investor transactions for studies and projects, renovation, construction, reconstruction and maintenance on roads and buildings; - Proposing financial plans and improve ways of raising funds intended for the road; -Keeping database of roads, buildings, traffic signs and equipment on roads and road cadastre land belt; - Assignment of work on reconstruction, construction, rehabilitation and maintenance of roads; - Preparing and monitoring the implementation of measures and activities to promote safety traffic on roads managed by; - Prepare the basis for granting concessions and ensuring professional and technical supervision; - Organization of toll collection system - Gathering data and informing the public about the condition of roads and method of traffic flow; - Taking the necessary measures to preserve and protect the environment - Organizing and providing services to users of motorways and express roads, etc.. The Government of the Federation of Bosnia and Herzegovina at its meeting held , on the proposal of Federal Ministry of Transport and Communications, made the decision to appoint a proxy Assembly representing the Company in accordance with the Regulation on the exercise of powers authority Federation of Bosnia and Herzegovina in 3

4 companies with state capital and The decision to appoint a temporary supervisory board of Public company FBiH (''Official Gazzette FBiH'' No.88/10). On a session of the Assembly Public company Motorways FBiH was held in the presence of a notary where the Statute of Public company Motorways FBiH has been adopted. At the same day there was also a meeting of the Supervisory Board of Public company Motorways FBiH at which approval was given and adopted Rules of Procedure of Public company Motorways FBiH and Regulations on internal organization affairs Public company Motorways FBiH. In this way they acquire all conditions to stop work Federal Authority for the construction, operation and maintenance of motorways on day and to start with work of Public company Motorways of the Federation of Bosnia and Herzegovina. In accordance with provisions of the Law of the roads of the Federation of BiH, Public company Motorways in FBiH take all equipment, emloyees and records of the Federal directorate for construction, operation and maintenance motorways or Public company motorways in FBiH is the legal successor of the Federal directorate for construction, management and maintenance Project description At Conferences held in Crete and Helsinki in 1994 and 1997, ten trans-european transport corridors were identified as routes in Central and Eastern Europe that require priority investments. Corridor V (Five), linking Kiev in Ukraine to the Adriatic Sea via Lvov and Budapest(Hungary) was one of them. Consisting of three branches, the Vc branch follows Europian route E73 from Budapest to Ploče (Croatia) via Osijek (Croatia) and Sarajevo. Bosnia and Herzegovina contains the longest section of the Vc branch. With a total length of approximately 340 km, the driving force behind construction of the Corridor Vc motorway is to improve connectivity of BiH with its neighbouring countries and to enhance its potential for economic development. The project has strong support from the government and is expected to enable BiH to integrate better with the European economic and social structure. Corridor Vc motorway in BiH includes four main sections (known in Government documents as Lots ), as follows: Lot 1: Svilaj on The Sava River (connection to Corridor X) - Doboj South; Lot 2: Doboj South - Sarajevo South (Tarčin); Lot 3: Sarajevo South (Tarčin) - Mostar North; Lot 4: Mostar North Bijača on the southern border with Croatia. 4

5 Implementation of the construction is on entities level. The Government of Federation of B&H has already completed construction of 37 km long section of motorway in Lot 2 north of Sarajevo on the section between Sarajevo (Jošanica) and Kakanj. Part of the Corridor Vc, in lenght 8 km (Sarajevo bypass) is under construction and expected date of completion is end of 2014 year. Project is financed by the loans of EIB, EBRD, OPEC and WB. The EIB and EBRD are financing four new sections within the four above mentioned Lots which are marked as high priority sections by Government of Federation B&H. These sections are as follows: Section 1: Drivuša to Kakanj, section within Lot 2 (15,2 km); Section 2: Vlakovo to Tarčin, section within Lot 2 (20 km); Section 3: Pocitelj to Bijača (southern Border with Croatia) within Lot 4 (20 km); Section 4: Odzak to Svilaj (northern border with Croatia) Lot 1 (10 km). Section 1 is entirely located in one Canton (Zeničko-Dobojski), traversing through the southern half of the Municipality of Zenica and a south-western section of the Municipality of Kakanj. With a right of way of approximately metres, the Corridor in section 1 follows the narrow Bosna river valley, wich is characterized by undulating hillsides and minimal forest coverage. Corridor Vc in Section 1 largely follows existing infrastructure including main road M17 and, in certain sections, the railway Vrpolje to Sarajevo. Section 2 is located in two cantons ( 90% in Canton Sarajevo and 10% in Middle Bosnia canton), traversing through the western and than southern part of the capital Sarajevo passing through urban and industrial area (Vlakovo and Rakovica) of Canton Sarajevo. The Corridor, in this part, starts its way through mountain area of Federation of BiH. Thus, this section will already have over 6 km of tunnels. In this direction except the highway will be the existing main road M17. Section 3 is entirely located in two cantons (The Herzegovina-Neretva Canton and West Herzegovina Canton) traversing roughly the northern and western part of Municipality Čapljina and Ljubuški. According to the plans this part of the Corridor Vc will also be a part of Adriatic Ion motorway. It will improve connection between B&H and Croatia on the south and the Adriatic sea. 5

6 Public company Motorways in Section 4 is entirely located in one Canton (Posavina Canton) connecting northern part of BiH with Croatia and Corridor X. In addition it is also a continuation of the completed section of Corridor Vc coming from Hungary and Croatia. This area is mostly flat, there is no important structures on the motorway beside 660 m long bridge over the river Sava and border crosing. It is planned to complete all these four sections up the end of 2014 when total constructed length of Corridor Vc in Federation BiH will be 125 km. Part of the construction is also the Zenica baypass (section from Drivuša to Donja Gračanica, 8 km long section whitin Lot 2). This section will be finaced partly by Kuwait Investment Fund. LOAN AGREEMENTS In a purpose to create stabile financing structure Public company Motorways in Federation of Bosnia and Herzegowina contact international financing institutions for support of these project through loan agreements. First requests have been made in May 2007 and up to date two loan agreements have been signed. First loan agreement was signed in October 2008 with EBRD in amount of 180 millions Euro for: Section Kakanj Drivuša Section Vlakovo Tačin Sections Počitelj Bijača and Svilaj Odžak 60 million Euro 60 million Euro 60 million Euro Second loan agreement was signed in December 2008 with EIB in amount of 75 millions Euro for: Section Kakanj Drivuša 75 million Euro Third loan agreement is going to be signed with EIB in amount of 166 millions Euro for: Section Vlakovo Tarčin and Section Svilaj Odžak Financial proposal for this amount has been submitted to Federation of BiH end of November Financial negotiation are expected to be in July. Signing this Loan agreement is expected in September. The fourth Loan agreement is planned to be signed with EIB in amount of 60 millions Euro for section Počitelj - Bijača after confirmation of final location for the bridge Počitelj by the Parliament. 7

8 3. PROCUREMENT PLAN Public company Motorways in Federation of Bosnia and Herzegowina prepared estimated procurement plan. The estimated values are planned but real values will be determined after completion of the main project and tender procedure. 11 4. MAIN DESIGN Execution of the main design is divided into three parts. The reason of this is the that the main design was started to be prepared before Public company Motorways in Federation of Bosnia and Herzegowina was fully established and completed delivery of all works related to the Corridor 5c. 12 5. LAND ACQUISITION Activities on this item started on five sections. Section Kakanj - Drivuša is completed, and sections Vlakovo - Tarčin and Bijača - Počitelj subsection Bijača Zvirovići are in progress. Land aquisition for sections Donja Gračanica Drivuša and Svilaj Odžak started in September. The following table 3 shows the activities on land acquisition and progress on it. 13 6. CONSTRUCTION PERMITS In accordance with Law of land planning and land use in Federation of B&H it defined a procedure of issuing preliminary construction permit and final construction permit. For issuing of preliminary construction permit it is necessery to collect 17 approvals, while for final construction permit requires preliminary construction permit, completed land acquisition and completed and revised main design. It has obtained a final construction permit for section Kakanj Drivuša. For subsection Kakanj Binješevo in April 2010 and for subsection Bilješevo Gorica and Gorica Drivuša in Jun The tables in Appendix 1. shows physical progress for obtaining urban approval and construction permit per section. 7. PREPARATION ACTIVITIES FOR CONSTRUCTION PROJECTS In the following paragraphs are presented preparatory activities for construction projects devided into sections and subsections. Section Počitelj Bijača is devided into four Lots: Lot 1 Subsection Bijača Kravice Urban planning permit is expected in early July. Land acquisition is finished Opening of financial bids were on 10th May The contract was signed Contractors were introduced into the possession and works begin in late September Preliminary values of works is ,00 Euro (with VAT) The deadline for the work is 10 months 13

14 Lot 2 Subsection Kravice Zvirovići Prequalification documents are opened in October 2010 Urban planning consent was released Acquisition of land is finished. Opening of financial bids was in Mostar Arithymetic error control of offered price have been made. Evaluation of tehnical and financial part of the bid is pending Start of construction is scheduled for March 2012 Preliminary values of works is 45 millions Euro (without VAT) The deadline for the work is 24 months Tender procedure for Supervision for Lot 1 and Lot 2 are finished. Contract was signed The same contractor signed a contract for both lots. For Lot 3 Počitelj - Zvirovići and Lot 4 Bridge Počitelj the procedures for selecting contractors have not started yet. The reason is that it has not adopted a spatial plan and the route of the motorway in this area. Section Vlakovo Tarčin is devided into three Lots: Lot 1 Subsection Tarčin Suhodol Land acquisition and collection of documetation for urban development approval and construction permit is in progress Oppening of finnancial bids was held in Mostar on Procedures of land acquisition and collecting of urban pllaning permit and construction permit is in progress Arithymetic error control of offered prices and evalutation of technical and financial parts of the tender is scheduled for January 2012 Start of construction is scheduled for March 2012 Preliminary values of works is 57 millions Euro (without VAT) The deadline for the work is 36 months Tender procedure for Supervision for this section is still in progress. Technical and financial bids are received Evaluation of technical offers is ongoing until After that follows opening of financial bids and start of the negotiations with the best bidder. 25 10. ENVIRONMENTAL IMPACT Until the end of June, the Federal ministry of Environment and Tourism issued three environmental permits. The first was issued in February 2009 for sections Kakanj Drivuša and Vlakovo Tarčin, while the second was issued in September 2010 for section from Svilaj (including part of the bridge which belongs to the Bosnia and Herzegovina) to Doboj South (Karuše). Environmental permit for section Mostar North Southern border, subsection Bijača Zvirovići was issued in December During the normal cycle of maintenance (September- December) we performed cleaning of the closed drainage system drains and drainage separators on the motorway route Kakanj Jošanica. During this action we have cleaned 76 separators 22 concrete, 11 steel and 43 polyetylene separators. In same period, we performed activities in tendering and signing of contract to provide services on monitorning air, soil and water quality. We tested water quality at 76 outlets in the environment in accordance with enivronmental permit. This activities continued troughout December. This material is very large and we will include it in Progress report No 8 with complete testing results containing conclusions and measures to eliminate any possible irregularities and deficiencies. When we talking about air and soil quality, it is important to mention that we took 10 samples of air and 6 samples of soil. Analisys are in progress. In the section Bijača Kravice we performed preventive archeological reserching during period September December. We found two archeological sites on this route. Also, we made relocation and protection of this sites and artifacts during December. On the same section we made management plan for construction plan same as plan for monitoring of air and soil quality during construction stage. It's performed inital examination and first results will be known in January

26 11. MISCELLANEOUS Section Zvirovici Bijaca is a part of the corridor Vc motorway. The aligment is located south of Mostar, on the southern border of Bosnia and Herzegovina with the Republic of Croatia. Construction works will be paid from EBRD loan. This contract was awarded to BH Joint Venture and supervision to Roughton international Ltd. Construction period for this contract is 10 calendar months. Contract 1 consists of the construction of the subsection of motorway between Kravice and Bijača which starts on the rest area at Kravice and finishes on the south border with Croatia in village Bijača, beyond the new border crossing facility, which is to be constructed as part of separated contract. Subsection Kravice Bijača is 4,06 km long excluding border crossing facility. Construction on this section includes: The main alignment with new double carriageway motorway over 4,06 km The overpasses, one in Podine,72 m long and a second one, 90 m long at Zvirići Interchange Three underpasses : Dol, Sulet and Galići One interchange Zvirici Frontal toll station A center for maintenance and traffic control During the period November December earthworks as excavation and embankment on the whole section, bulk in the plateau zone COKP Zvirići and excavation at position underpassing Sulet and Galici. Control drilling were carried out at locations of underpasses foundation. Also, underlying concrete has been set for the fundamental lanes. Beside this the preparations for making external drainage system and relocation of existing water and electrical installations. During December the Contractor has stressed the earthworks activities on 5 fronts whilst culvert construction progressing is much better since their design changed. 26
