What legal liability, contract drafting, and tax issues are associated with these new techniques? This session aims to explore the growing number of diverse techniques being implemented at North American airports, in an effort to become more financially sustainable entities. With the use of case studies, a wide variety of topics (including creative debt financing, bank loans, AMT vs. non-amt bonds, revenue diversion issues and the use of separate corporations for nonaeronautical businesses) will be scrutinized in order to enhance our collective understanding of these evolving financing approaches. Included in this overview will be a discussion of the legal framework within which airports operate, focusing upon the potential role of labor peace agreements, how they are affected by living wage ordnances, a brief overview of the National Labor Relations Act as it applies to employee groups at airports, and some recent examples of how these laws often interact. Panelists will compare and contrast laws enacted that impact airports, and how airports deal with their particular situations, including: who is covered, how are living wages calculated, benefits as part of wages, a discussion on the potential impact of the Affordable Care Act, and other legal, regulatory and business consequences. The recent court decision on the Sea-Tac ordinance in King County, WA will also be discussed. Breton K. This session will look at the legal implications of this new and innovative approach at airports.
