1 DRUNKS AND THIEVES 2018 Part 8 December 26, 2018 By John Hoffmann DRUNK DRIVER ALL OVER THE ROAD LEAVES COURTROOM WITH NO POINTS BUT IS FINED FOR ILLEGAL PARKING: On May 29, 2016 at 2:30 AM Kevin Mueller, now 36-years-old of Ballwin, was driving his black 2012 Chevrolet Cruze at a high rate of speed west bound on I-64. He was also weaving from lane to lane. Town and Country Police Officer Becker estimated the car was going 75 MPH approaching a construction zone with narrow lanes before Mason Road. Mueller approached a police car on the side of the road, slammed on his brakes and continued. Officer Becker then clocked him driving 70 MPH in the 50 MPH construction zone. Mueller exited at Hwy 141 and while exiting he was partially driving on the shoulder. He was then stopped on SB Hwy 141. This is from Officer Becker s DWI report describing Mueller initial appearance and condition: Mueller admitted drinking beer at a bar that he could not remember the name of the bar and then going to Talayna s in St. Louis. He failed several field tests and a field breath test showed his BAC level that indicated he was drunk. He was arrested and at the police station he agreed to take an official breath test. That test showed his BAC level to be.142%. 1
2 Kevin Mueller Kevin Mueller s eyes OUTCOME: Despite speeding before a construction zone and then speeding in the construction zone and then weaving off the road, Mueller was given a deal by Town and Country Prosecutor Ed Sluys and Judge Niehoff. Mueller as officially charged with Speeding in a Construction Zone and DWI. Sluys reduced the Speeding charge to a Parking Violation with a $225 fine, but no points on his record. Then Judge Niehoff gave him a SIS probation term with No-Fine, No-Points and No Jail, which vanishes off of Mueller s public record at the end of the probation period. Sluys Niehoff 2
3 WIFE ARRESTED FOR ASSAULTING HER HUSBAND AND GRANDMOTHER: On Saturday December 30, 2017 at 8:17 pm Chesterfield Police Officers Thomason and Wood responded to a call of a Domestic Disturbance in progress that was updated to a Domestic Assault at 1939 Dovershire Court. On the officers arrival a female, Lyric Mitchell walked outside and proclaimed, we both put our hands on each other. She was referring to her husband Lamont Flemon. Her husband Lamont Flemon walked outside, turned his back toward the officers and put his hands behind him. When asked why he did that by the officers, Lamont said he thought he would be arrested since he put his hands on Lyric. It turned out the Lyric was the one arrested. There were three people at the house; 20-year-old Lyric Mitchell AKA Lyric Ryan- Nicole, her husband, Lamont Flemon, 21 and her grandmother, Carol Mitchell. Carol Mitchell and her late husband have owned the house on Dovershire for over 25-years. Once statements were taken from everyone it became clear what happened. Lyric and her grandmother were in the kitchen and Lyric was screaming and swearing at her grandmother. Lamont was in another section of the house, heard this and went to the kitchen and told his wife you can t be yelling at Granny like that! 3
4 He then grabbed Lyric around the waist and took her down a hallway toward a bedroom. She broke loose scratched his face, found a metal mob handle and struck him in the face leaving a one-inch cut on the bridge of his nose. Granny Carol then came into the room to try and stop the assault and Lyric hit her on the wrist causing swelling. After booking Lyric was release pending warrant application. The County Prosecutors staff declined to file charges and recommended that charges be filed in Chesterfield Municipal Court. Two city assault charges were issued. OUTCOME: On June 12, 2018 Lyric Mitchell pled guilty in Chesterfield Municipal Court and was placed on a 1-year SIS (No Fine No-record at end of probation) probation. BARTENDER IN ONE-CAR ACCIDENT. TOTALS CAR AND FLEES SCENE! On a Friday night into Saturday morning on October 28, 2017 Town and Country Police Officer Lauren Becker was dispatched to a one car accident at the NB I-270 ramp to WB I-64. The time of the dispatch was at 4:18 am and Officer Becker arrived six minutes later. This is what she found: 4
5 The totaled 2015 Toyota was present but there was no driver to be found. 5
6 The car was registered to Michael Gundlefinger (Gundlefinger per report; Gundelfinger per court files), a 37-year-old at the time of the crash who worked at the Village Inn bar and grill on Manchester Road in Des Peres and lived at the Raritan Apartments off of Manchester Road in Rock Hill. Gundlefinger made no attempt to notify the police the next day. Instead he called McNamara s towing about getting his car released. He was told McNamara s would not release the wrecked car until they received clearance from the Town and Country Police. Gundlefinger and his lawyer, Sean Rapp, went to the Town and Country Police Department on Monday October 30m 2017 at 2 PM. Keep in mind this accident clearly happened when Gundlefiner was going NB on I-270 and exiting to go West on I-64. Here is the statement Gundelfinger gave: Yes he claimed he was coming from the north and going to the east. The facts and evidence say otherwise. His lawyer would not let him answer any questions, like where the hell he went after the crash and how he got home or how drunk he was. 6
7 OUTCOME: The lawyer moved the case from Town and Country Muni Court to the Associate Circuit Court in Clayton. On May 31, 2018 Gundlefinger pled guilty to Improper Lane Use and was fined $196. He pled guilty to Leaving the Scene of an Accident and was placed on a 2-year SIS No-Points, No-Fine Probation with the record being erased from public view in 2-years. GAS STATION FAIL TO PAY CASE SPANS OVER SIX YEARS: The Chesterfield Police were called to the Mobil station at 1789 Clarkson Road concerning a failure to pay. The suspect, Chavell Davis was still there on the officers arrival. The year was Chavell Davis Davis claimed she planned to pump $1 worth of gas into her 2005 Chevrolet Malibu. When she started pumping gas without swiping a credit card the clerk from inside the Mobil on the Run on the intercom told her to pay inside when she was finished. She said she didn t know the gas pump was working. (apparently it was very quiet that day), Davis said she went inside to purchase some other items and was told she owed $51.81 for the gas. This was an amount that Davis said she did not have. It turned out a month earlier she tried the same scam at the same Mobil on the Run. When the police were going to be called she found the money for the gasoline. 7
8 In this case after the police arrived Davis agreed to sign a form and payback the company at a regional office by October 7. She never contacted the office or made payment. After being contacted by Chesterfield Police Officer Martin, she agreed to turn herself in. She did so on October 8, 2012 and was issued a summons for stealing $51.81 of gasoline and released. She never showed up to court and a warrant was issued for her arrest. On June 16, 2017 Davis was arrested by the Florissant Police on the Chesterfield warrant. However, Davis claimed to be having medical problems and rather than have the city pay for treatment, Davis was released on another summons ordering her to court on August 22, Guess what? She didn t show and another warrant was issued. This time she was arrested by the Hazelwood Police on December 27, This time she was held on a $350 bond. She was given a new court date of February 13, She didn t make that one either. But she did show up on June 12, She was apparently represented by a lawyer as despite her avoiding court for six years, Chesterfield Prosecutor Tim Englemeyer amended the charge to Littering. Davis pled guilty to Littering and was fined $227. 9 05/03/18 Judgment back rent $5,670 (not yet paid) St. Louis CO We found 16 different active arrest warrants for Davis after she failed to appear in court. There were 10 other warrants she was arrested on and then failed to appear at the new court date. We found about $8,000 in court judgments against Davis for non-payment of bills. You feel sorry for some people as all the Davis charges are for status offenses such as having no license plates, no insurance or a revoked license. We did not find any cases dealing with dangerous driving. However you lose sympathy if Davis crashes into your car with an unlicensed and uninsured car. WITNESS STOPS 23-YEAR-OLD DRUNK DRIVER FROM LEAVING SCENE OF ACCIDENT. DRUNK IN A MERCEDES WAS SPEEDING AND WEAVING ON I-64 AND ON EXIT RAMP. SHE PLEADS GUILTY AND GETS NO POINTS AND NO FINE: It was 3-days and 90-minutes before Christmas and all through the city almost no one was stirring after 10 o clock in your eyeglass lens, except on I-64 where a red hair girl was speeding and weaving in a Mercedes Benz. On Thursday night December 21, 2017 at about 10:25PM the dispatch center began receiving calls from motorists on I-64 about a speeding Mercedes Benz that was also weaving almost hitting other cars and a median wall. Chesterfield Officer Donald Schlemmer was responding to report of the dangerous driver when he saw a Mercedes with extensive damage stopped it at the end of the I-64 WB exit ramp and Olive Blvd with another car in front of the Mercedes and a man talking to the driver. Officer Schlemmer contacted the man outside of the Mercedes, who stated he was trying to make sure the driver did not leave the scene of the crash she just caused adding that she was drunk. The witness said the driver of the Mercedes had been speeding and weaving from lane to lane almost colliding with cars and median walls. He stated that the Mercedes then exited I-64 at Olive and there was a line of cars stopped for the red light. He continued the driver was going too fast to stop behind the cars and swerved to the left driving on the grass and avoiding a number of cars, but then returned to the road and crashed into a 2010 Subaru Forrester. 9
10 The driver of the Mercedes was still behind the wheel with the engine running. She was identified as Mary Elizabeth Flickinger, 23, of 1440 Bald Eagle Road in Wildwood. Officer Schlemmer got the keys from her and observed that she was indeed drunk. There was a strong odor of booze on her breath, her eyes were dilated and bloodshot, her balance was poor and her speech was slurred. She failed several field sobriety tests. She refused to take a field breath test. She was arrested and taken to the Chesterfield Police Station. 10
11 An official breath test at the station showed her BAC to be.150% Mary Elizabeth Flickinger Mary Elizabeth Flickinger s eyes OUTCOME: On June 19, 2018 Flickinger pled guilty to DWI and was placed on a SIS No-Fine, No-Points, No Public Record Probation by Chesterfield Judge Rick Let em Loose Brunk. Yes she was drunk, she was speeding, she was weaving all over the road and then crashed into an innocent citizen causing enough damage that both cars had to be towed away just before Christmas, but she has no fine and no points for driving drunk. I kind of knew when I read she was driving a new Mercedes that nothing was going to happen to her in the hands of prosecutor Tim Engelmeyer and Judge Rick Brunk. Also Flickinger had a moving violation in Ballwin that Chris Graville, the Chesterfield City Attorney and Ballwin Prosecutor reduced to a Parking Violation on 03/07/18 ignoring the Chesterfield DWI wreck. Flickinger was fined $225 for a parking violation she never committed. Back in Chesterfield Engelmeyer and Brunk ignored the Ballwin offense when they gave the rich kid from Wildwood the No-Points, No-Fine deal for DWI. 11
12 SHOPLIFTER STEALS LOW END DRESS AND GETS HIGH END FINE. CHESTERFIELD MUNICIPAL COURT DESCRIMINATED AGAINST SUSPECT FOR NOT HIRING A LAWYER : The best we can tell is that Kellie O Neal was not represented by a lawyer so she was not magically turned into a defendant who could plead guilty to Littering or Illegal Parking. On Tuesday October 18, 2016 O Neal, 20, of Overland, Missouri along with two other females were in the Charlotte Russe Store which was then located in Chesterfield Mall. (The San Francisco base company has since moved the store to the Chesterfield Premium Outlet Mall.) They were observed stealing and store staff was sure at least one dress was taken. At the same time the Charlotte Russe staff was calling the Chesterfield Police Retail Patrol Unit, Officer McBride observed three Black/females matching the description from the shoplifting enter the Macy s Store. Officer McBride radio ed another officer in a patrol car to head to an exit from Macy s onto the parking. A Macy s employee told Officer McBride that they had seen the three suspects running toward an exit door. Chesterfield Officer Paubel saw the three women in a green Ford Taurus speeding down the wrong way of a parking lot lane. The car had a temporary tag on it instead of a license plate. A check of the tag revealed it was fake and the car was stopped on Chesterfield Parkway at South Forty Outer Road. By this time a Charlotte Russe employee had described the person stealing the dress as one wearing a grey sweat suit. Kellie Y. O Neal fit that description. O Neal admitted stealing the dress and putting under the front seat. In doing so the security sensor which was still attached to the dress had pulled and torn the dress. O Neal was arrested for Stealing and Destruction of Property. 12
13 Kellie O Neal Thanks to the aftermath of the Ferguson riots, many municipalities no longer require cash bonds on charges in Municipal Court. O Neal was released on two summonses. She didn t show up for court and warrants were issued for her arrest. On January 2, 2018 she was arrested as a Fugitive from Chesterfield by the St. Peters Police Department. OUTCOME: On February 13, 2018 O Neal pled guilty to both charges. O Neal had no prior record and no pending charges. You might think she would be eligible for probation or a reduced sentence. But you would be wrong because O Neal did not hire a lawyer. If she had hired a lawyer the charges most likely would have been reduced to a non-criminal charge like Littering and the fines likely would have been less or a probation sentence might have been offered. But if you don t hire a lawyer and plead guilty in Chesterfield Municipal Court you have offended both the prosecutor Tim Engelmeyer and Judge Rick Brunk. After admitting to the theft and immediately giving the stolen $24.99 dress to the officer, she was fined $ for Stealing plus $26.50 in court costs. On the Destruction of Property Charge she was fined $ plus $26.50 court costs. 13
14 Engelmeyer Brunk WOMAN TARGETS TARGET: A 36-year-old Chesterfield resident Martina Trubacikova, who lives on Schoettler Valley Drive, went to the Target Store in Chesterfield Valley on Monday November 6, 2017 with no intention of buying anything. Trubacikova with a male accomplice prowled the isles of the Target Store with security watching them. Store security called the Chesterfield Police Retail Squad and several officers responded with one going to the security office and watching Trubacikova on video and also in person. She took off her coat and covered her purse and the items she was stealing. Trubacikova was observed in the Electronics Department where she was placing Apple accessories in her purse or covered by her purse. She then went to an area of the store where Halloween costumes were marked down and on sale. After she left the area for the women s department, the costumes were checked and store security sensors cut off of items were found hidden in the costumes. She and the male with her left the store without buying anything. She put on her coat and took her purse out of the empty shopping cart. She was stopped by two Chesterfield Police Officers. A search of her purse revealed $245 in stolen property. She stated that she also discard several damaged items in the home décor department. Those were found and determined to be too damaged to sell. (Often shoplifters will damage items they are trying to steal while removing security sensors.) Trubacikova and the male with her declined to make any other statements. 14
15 Mug Shot facebook OUTCOME: On February 13, 2018 Trubacikova pled guilty to a charge of Trespassing, reduced from Stealing by Chesterfield Prosecutor Tim Engelmeyer. She was fined $ plus $36.50 in court costs. TROY MISSOURI MAN STEALS TOOLS FROM LOWES. CLAIMS HE HAD NEVER STOLEN ANYTHING BEFORE. It was St. Patrick s Day, Friday March 17, 2017 when Michael Pribble almost successfully stole $578 worth of tools from the Lowes store in Chesterfield Valley. On the following Monday a fill-in Loss Prevention Supervisor was reviewing video in the tool department after an apparent loss and discovered Pribble stealing a mechanic s took set, power drill, and two 20 volt cordless brushed motor combo set. 15
16 Michael Pribble The recorded video surveillance had a good likeness of Pribble and the Chesterfield Police were called. Officer Dammrick took the image and entered it into a police system of mug shots to attempt and identify Pribble. The search was successful. On March 21, Officer Dammrich called a phone number connected to Pribble and spoke with him. He admitted stealing the tools and added he had never done anything like that before. We have a feeling he had never BENN CAUGHT doing that before. Pribble said the tools were in a truck belonging to someone else that had been towed by the St. Peters PD in connection with an arrest of the driver. He added he would attempt to get the tools and return them. He agreed to turn himself in at the Chesterfield PD. He turned himself in at the Chesterfield PD on 03/24/17. He admitted the theft, saying he was going to steal from the Lowes in Wentzville, but became afraid and drove to the Lowe s in Chesterfield. He was issued a summons for stealing and released. Pribble didn t show up for court in Chesterfield and a warrant for his arrest was issued. On 11/11/17 he was arrested by the St. Louis County Police and picked up by Chesterfield Officer Young. Once again Pribble did not show up for court and another warrant was issued. He was arrested on the warrant by the St. Peters Police on February 28, For the third time he did not appear in Chesterfield Court and on May 15, 2018 he was again arrested by the St. Peters Police and picked up by the Chesterfield Police. 16

Pribble pled guilty before Judge Brunk who simply sentenced Pribble to 4 days in jail and then gave him credit for the time he sat in jails waiting to be picked up by Chesterfield officers. These articles we post are called Drunks and Thieves and normally involve drunk drivers and thieves. In the next two reports alcohol is clearly involved but no one is arrested for DWI. A NIGHT OF ULTIMATE FIGHTING ON TV IN A BAR LED TO PARKING LOT FIGHT. On Saturday night November 4, 2017 Jesse James Cullom and a friend went to the Twin Peaks, a sports bar in the old Romano s Macaroni Grill at 963 Chesterfield Center off of Chesterfield Parkway near the Chesterfield Mall. They went to watch the rather sadistic Ultimate Fighting on large screen televisions. During one of the fights Cullom and his friend got into an argument and went outside, follow by some of the patrons. As they began to fight on the parking one of the onlookers began to record the fight on his cell phone. Cullom took exception to being recorded on a cell phone, walked over and slugged him in the face. The assault was seen by several others who completed written police witness statements. Cullom then got into a white car and drove away prior to the arrival of the police. 17
18 The victim did not have immediate clear injuries and he declined immediate medical treatment, but a later examination revealed a bruise jaw and possible mild concussion. The victim reported the medical findings to the police but did not supply them with a written report from the doctor. 19 OUTCOME: On May 21, 2018 Jesse Cullom pled guilty to the assault in Chesterfield Municipal Court and was fined $500. (I worked for 10 years as a police officer in Liberty, Missouri near the Jesse James family home and the location of the first daylight bank robbery in the United States where one citizen trying to stop the robbery by the James gang was shot and killed and the Clay County Sheriff was shot and survived. I was always amazed at the number of people who would name a son Jesse James in honor of the outlaw. It was no surprised that we arrested a number of them.) VERY DRUNK CUSTOMER AT THE HAUS PIZZA AND PUB JOINT GOES NUTS AFTER BEING CUT OFF. On Saturday night May 6, 2017 around 1pm and Martin Andrew Schmitz, 22, of 570 Briarwyck in Ballwin was very drunk. He was so drunk that the management of the Haus Pizza Pub had quit serving him sometime earlier. This caused Schmitz to walk to other tables trying to steal customers drinks. The caused the owner to throw him out, escorting him outside to a patio area and parking lot. Once on the parking lot Schmitz got involved in a fight with two other males and the police were called. By the time the police arrived the other two men were gone and Schmitz was bleeding from his nose onto his chin. Schmitz in a very loud and slurred voice told the first officers on the scene that he did not know who he was fighting with. He stated that an unknown male walked up to him and punched him in the nose. Since Schmitz was bleeding fire district paramedics from Metro West were dispatched. When they arrived Schmitz began yelling at the paramedics, get the fuck out of here. I don t need to go to the hospital. Guess what? The paramedics didn t treat him and left. He then changed his story about the unknown male hitting him, but said he wasn t a snitch. He then began to yell police officers threatening to assault them and demanding to know why they were not arresting the person who Schmitz refused to name. Usually when you are drunk and you threaten to injure a cop you are going to get arrested. This is what happened to Schmitz. 19
20 Martin Schmitz Schmitz s eyes On the way to the police station Schmitz spit at the arresting officer from the back seat of the cage car. He also kicked at the plastic divider between the backseat and the driver and then hit his head against it while yelling physical and sexual threats against the officer. Meanwhile at the Haus Pub another officer contacted the owner who said he did have video surveillance camera, but would not give the recordings to the police. He then changed his mind and told the officer he would have a recording the next day. What the owner said the next day set off my BULLSHIT DETECTOR and made me not want to try the Haus Pub. He claimed video was stored on Cloud and he could not record the stored video. Then he did a 180 turn from the night before where he claimed he had cameras that would have recorded the fight and claimed he had no cameras aimed at the parking lot.
