5 Page of BUTLER TWP PD MONTGOMERY MARTINDALE On Sunday, September 24, 208, at 033 hours, I was dispatched to Frederick Pike at Martindale Road on a suspicious circumstance reference a car on a boulder. I arrived in the area at 032 hours and started checking the area. I found the listed vehicle on Martindale Road in the culvert at 65 Martindale Road. The vehicle had apparently been traveling westbound on Martindale Road, went off the right side of the road, along the culvert, and then struck the wooden fence and a boulder belonging to 63 Martindale Road. The vehicle was stuck on the boulder and part of the fence was down. The front end of the vehicle was disabled from striking the boulder. I checked the vehicle and found it was empty. I saw that both front airbags had deployed, and there was spider web cracking of the windshield in front of the passenger's seat, which indicated an occupant had struck the windshield. I did not see any blood inside the vehicle. I called for Busy Bee Towing to respond to remove the vehicle. I requested dispatch to have the agency of jurisdiction check the registered owner's address for the owner. I began photographing the scene. I noticed that the driver of the vehicle had apparently driven around the curve and went straight into the culvert. There was no evidence of braking, and the vehicle traveled approximately 50 feet before striking the fence and boulder. While working on the scene, a driver with Englewood Towing arrived and said the owner had requested him to remove the vehicle. He was supposed to call the owner when he arrived so he could bring the key to the vehicle. I had him call the owner, and when he did, he asked if police were on scene. The driver said no. I told the driver he could leave since I had my tow on the way. I began my tow inventory and located an empty baggy in the driver's door compartment. This baggy contained flakes of marijuana but not enough to measure. I did not locate any other contraband or evidence. A short time later, the owner of the vehicle, Jesse Norman, arrived. His grandmother had bought him back to the scene. Mr. Norman approached me, and I could smell the odor of an alcoholic beverage on his breath. His eyes were bloodshot and glassy, and he was impaired. I asked him what happened, and he said a deer came out into the road. He said the driver swerved to miss it and crashed. He said he was not the driver, but he was the passenger. He said he had just met the driver that evening, and they were headed to his house, but he did not know his name. He said after the crash, the unknown driver ran from the scene. I examined Mr. Norman and could not see any signs of impact with the windshield. He was obviously lying about being in the passenger side at the time of the crash. I re-verified his story, and he still denied driving the vehicle. I asked him if he was okay from hitting the windshield, and he said he did not because he was wearing his seat belt. I allowed him to continue his untruthful statements, and we started walking around the scene. I explained I was going to seek his DNA and asked if he would submit. He said he wanted to speak to a lawyer before doing that. I pointed out I was placing a hold on his vehicle, collecting DNA from the airbags, and was going to obtain a search warrant for his DNA. As we walked back through the scene, Mr. Norman explained that "he" was driving then had to suddenly swerve to miss the deer. He used his hands to demonstrate turning the steering wheel. He caught himself at that point and said he meant the guy driving had to swerve. At that point, I pointed out the windshield and explained I knew he was lying. I explained to him I wa going to go through all of this time consuming process to prove he was lying to me, and I would be Ofc. John Rieder 5

6 Page 2 of BUTLER TWP PD MONTGOMERY MARTINDALE able to prove the driver of the vehicle. At that point, he apologized to me for lying and said he was the person driving the vehicle. Mr. Norman said he was driving about 42 miles per hour, when the deer jumped into the roadway. He said he swerved to miss it and drove off the roadway. He said he called Englewood Towing and his insurance agency. He said his insurance agency said he did not need a report so he was just going to call and have it towed. He also added that he was completely sober and had consumed beer after he got home, while waiting for the tow driver to call. Ofc. John Rieder 5

7 BUTLER TWP PD MONTGOMERY MARTINDALE I asked him about the passenger, and he told me he had really just met him that night and did not know his name. He said he was a black male, and he took off running, apparently uninjured, after the crash. He had no idea who he was. Mr. Norman said this crash had occurred about 030 hours and that was when he last saw the passenger. Mr. Norman provided his insurance card. I issued him a citation for failure to control and explained the court date. He indicated that he understood. I warned him for the drug paraphernalia since the bag was empty. He elected to have Busy Bee tow his car to his house so I released the police tow. It should be noted that I have no information concerning the passenger, and at this time, I wa not going to attempt to identify the passenger since I had the driver identified and his insurance information.
