10 Narratives Subject: OVI/OPEN CONTAINER/LEAVING THE SCENE Type Date Time Author Approving Officer Facts Of Arrest 03/22/ BAUMAN, JOE B Dispatch advised of a crash at the intersection of State Route 4 and Perkins Avenue and it was unknown if there were injuries. Dispatch further advised the complainant stated the vehicle that struck him attempted to leave but then struck several vehicles in the parking lot of Victory Honda. While en route, dispatch advised a squad was being dispatched to the scene and several other calls were obtained advising the vehicle was a roll over crash. Upon arrival to the area, I was flagged down by a male subject and observed a black Ford truck up against a tree in the grass of Victory Honda. The vehicle was observed to be facing southbound and another truck was observed to be stationary at the intersection facing northbound. The other truck was observed to have heavy damage to the rear bumper. Upon exiting the police car, I observed a white female on the ground outside of the truck that was up against the tree, which was up rooted. The female was observed to be bleeding from the forehead. The female, later identified as Jacqueline K. Lapata, was advised several times to lay on the ground until the Perkins Township Fire Department arrived on scene. Ms. Lapata advised she wanted to leave and her head hurt. While continuing to reassure Ms. Lapata and telling her to lay still, a very strong odor of intoxicants was detected emanating from her person. Aux. Ofc. Nolder and Ofc. Pierson tended to Ms. Lapata while I made contact with the operator of the truck, Donald A. Gray. I advised Mr. Gray I wanted to speak to him by my police car which he was escorted to. It should be noted, Mr. Gray was very unsteady on his feet, his eyes were bloodshot and glassy, and his speech was slurred. A very strong odor was detected emanating from Mr. Gray as well. I asked Mr. Gray if he was injured with him advising he was not. I asked Mr. Gray how much alcohol he had consumed tonight with him stating "Too much." The interior of Mr. Gray's pockets were checked upon his consent and he was placed in the rear seat of the police car. Once Ms. Lapata was being tended to by members of the Perkins Township Fire Department, contact was made with the complainant, Jared W. Boesch. Mr. Boesch advised while stopped at the intersection of State Route 4 and W. Perkins Avenue, he observed the truck being operated by Mr. Gray to be approaching him very quickly. Mr. Boesch advised he was on the phone with his wife when he was struck. Mr. Boesch advised after being struck, the truck was observed to back into the Sunoco Gas Station and then proceed to travel southbound on State Route 4. Mr. Boesch advised the truck then struck the tree before occupants began to exit. It should be noted, tire tracks were observed in the grass from where Mr. Gray's truck was located all the way to W. Perkins Avenue, however, Mr. Boesch advised the truck never left the roadway until it struck the tree. I asked Mr. Boesch if he was injured with him advising the bottom of his head hurt but he did not feel he needed medical attention at this time. I was then advised a male subject, identified as Gary C. Feltner, was still in the backseat and was now being tended to as well. I responded to the driver's side of Mr. Gray's truck and observed Mr. Feltner to be laying on the floor in the backseat. Blood was observed on Mr. Feltner's face and his right eye was observed to be swollen shut. Several empty bottles of Miller High Life were observed in the backseat area of the vehicle along with several up front on the driver side floor. It should be noted, several of the bottles still had beer inside of them. A strong odor of burnt marijuana was also detected emanating from the vehicle as well. Contact was then made with Mr. Gray who was advised he was being placed under arrest for OVI. Mr. Gray was secured in handcuffs and advised of his Miranda Warning with him advising he understood his rights. I asked Mr. Gray why he left the scene of the first crash involving the other truck. Mr. Gray advised he was turning around to pull into the parking lot of Victory Honda. Ofc. Pierson and I were also advised by witnesses that another passenger fled from Mr. Gray's truck prior to our arrival. I asked Mr. Gray who the other person was with him stating something that was incoherent. I advised Mr. Gray he was going to be transported to the Perkins Police Station once his vehicle was towed to complete field sobriety tests with him stating "Ok." Once Ms. Lapata and Mr. Feltner were transported to the hospital, Mr. Gray's truck was searched due to the odor of burnt marijuana. Pictures were taken of the truck along with the beer bottles inside which were later confiscated. It should be noted Mr. Gray took responsibility for one of the open beer bottles. Mr. Boesch was provided with the appropriate information with him advising his wife was transporting him to the hospital to be evaluated. Mr. Gray was transported to the police station whereupon I asked if he would submit to field sobriety tests with him refusing. Mr. Gray stated "You already know I'm buzzed." Mr. Gray was then provided with a copy of the BMV 2255 form which was read to him with Aux. Ofc. Nolder witnessing. It should be noted, Mr. Gray was found to have

11 been convicted of OVI in 2011, 1998,1991, and Mr. Gray was advised of the consequences of refusing to submit to the state breath test or for providing a breath sample at or over the legal limit of.080%. While preparing the BAC Datamaster, I observed Mr. Gray to be chewing on something. I asked Mr. Gray what he was chewing on with him showing me a piece of gum. The time was 0230 hours and I advised Mr. Gray we would now have to wait 20 minutes before he could take the test, which he advised he would submit to. After the 20 minute observation period, the BAC Datamaster was prepared with Mr. Gray submitting a breath sample at 0254 hours. The result of Mr. Gray's breath test was.181%. Mr. Gray was shown his results and advised his license was now being placed under an administrative license suspension. Mr. Gray was advised he was being cited for failure to control, failure to maintain assured clear distance ahead, leaving the scene of a crash, and having an open container of alcohol in addition to being charged for OVI. Mr. Gray was provided with the appropriate paperwork, advised of his court date and time, and photographed prior to being released to Kristine L. Webster. Ms. Webster signed the adult release form to take responsibility for Mr. Gray. Mr. Gray's license plates were seized and placed into records pending a court release. OFFENDER: DONALD A.
