1 ~L Clause I, Report No. 23, 1990 BY-LAW NO A BY-LAW TO AMEND BY-LAW NO "RESTRICTED AREA (ZONING) BY-LAW OF THE CORPORATION OF THE CITY OF KINGSTON" (ALLOW APPROXIMATELY 0.08 ha PARCEL OF LAND LOCATED ON THE NORTHWEST CORNER OF CLERGY AND QUEEN STREETS TO INCLUDE OEFICES FOR OR IN CONNECTION WITH BUSINESSES OR PROFESSIONS AS PERMITTED USES) PASSED: March 6, 1990 The Council of The Corporation of the City of Kingston enacts as follows: I. By-Law No of The Corporation of the City of Kingston, entitled "Restricted Area (Zoning) By-Law of The Corporation of The City of Kingston," as amended, is hereby further amended as follows: A. Section 132 of By-Law No is hereby repealed and the following substituted therefor so that Section 132 of By-Law No 8499 shall now read as follows: "132. On the approximately 0.08 ha parcel of land located at the Northwest corner of Clergy and Queen Streets and designated A.132 on a copy of Zoning Map No. 18 attached to and forming part of By-Law No as Schedule "A", the permitted uses shall also include offices for or in connection with businesses or professions, subject to the following regulations: (a)_ All uses shall be conducted entirely within the building existing as of the date of the passing of this by-law; (b) NO extension or enlargement of the existing building shall be permitted; (c) Parking shall be supplied in accordance with the minimums required in Section 5.3 of By-Law No. 8499, to a maximum of sixteen (16) parking spaces.".../2

2 In this By-Law "ha" shall mean "hectare" or "hectares" and "du" shall mean "dwelling unit". 3. This By-Law shall come into force and take effect on its passing, provided that Official Plan Amendment No. 100 is approved by the Minister of Municipal Affairs and provided that no Notice of Appeal is filed to this By-Law, all in accordance with the provisions of Section 34, Subsections 19 and 31 of the Planning Act, GIVEN FIRST AND SECOND READINGS February 27, 1990 GIVEN THIRD READING AND FINALLY PASSED March 6, 1990 CITY CLERK MAYOR

EXPLANATORY NOTE CONCERNING BY-LAW NO AREA AFFECTED - The subject property, consisting of approximately hectare (834m2), is located on the northwest corner of Queen and Clergy Streets and is known municipally as Queen Street. The property is occupied by an existing two storey limestone building which at present houses lawyers' offices and an accountant's office. The rear portion of the property is used for parking for the offices. PURPOSE The purpose of By-Law No is to expand the list of permitted office uses from the existing lawyers' offices to offices for or in connection with businesses or professions. The new zoning regulations will also prohibit expansion or enlargement of the existing building and will require the provision of parking to a maximum of sixteen (16) spaces. EFFECT The effect of By-Law No is that all office uses for or in connection with a business or profession will be permitted on the site. The office uses will be permitted only within the walls of the existing building. No expansion or enlargement to provide additional office space will he permitted under the new zoning. The owner will have to maintain the existing off-street parking spaces in order to meet the By-Law regulations for off-street parking.
