GRANGER ON FEBRUARY 1, 2008 AND ORDER OF THE BOARD This is a pre-hearing conference regarding all phases of the hearing of appeals of the Central Waterfront Secondary Plan. These procedures relate to the management of the appeals from a decision of the City of Toronto (City) to approve a proposed amendment to the applicable City of Toronto Official Plan (OPA 257) on April 30, 2003 to designate lands identified as the Central Waterfront. Consolidated with these appeals are appeals from a decision of the Minister of Municipal Affairs and Housing (MMAH) to approve, in part, the New Official Plan (New OP) for the City of Toronto related to the Central Waterfront. The appeals of By-law (By-law) enacted by the City on September 27, 2006 to implement the East Bayfront West Precinct Plan area are also consolidated with the above noted appeals. Counsel for the City updated the parties regarding the settlement of appeals related to the east Bayfront West Precinct area south of Queen s Quay East and adjournment of the hearing of appeals regarding the area north of Queen s Quay East to facilitate further study leading to the resolution or narrowing of issues. This work is still anticipated to be complete by the end of June An update regarding the source remediation agreement reached between the parties was provided by telephone conference call on January 7, 2008 and the City will continue to provide monthly updates as requested by the affected parties.

4 - 4 - PL Issues related to archaeological and heritage issues have been adjourned to facilitate efforts to resolve or focus issues based on the City s archaeological management plan. The parties remain optimistic that these issues may be fully resolved. In light of the agreement reached between the parties, that has resulted in the compatibility issues with Redpath remaining outstanding, the parties have now agreed to a revised schedule to address the next phase of appeals in accordance with the City s and Waterfront Toronto s timing commitments set out in Exhibit No. 20 related to the East Bayfront (East) Precinct. The Board notes that the East Bayfront (East) Precinct will now be included within the broader North Keating Precinct that is generally described as the area east of the existing Parliament Street slip, south of the Lakeshore Boulevard/Railway corridor, west of the existing Don River course and north of the existing Keating channel. A Precinct Plan, Environmental Assessment Master Plan and implementing zoning by-law for this area are now in the works. With the full consent of the parties and as requested by counsel for the City, the Board directs the following: 1. The next pre-hearing conference is scheduled for Monday, July 28, 2008 at 10:00 a.m. at the Ontario Municipal Board, 655 Bay Street, 16 th Floor, Toronto. The agenda for this pre-hearing conference will include the following: a) The presentation of any settlements. The Board may be spoken to with respect to accommodating earlier dates to address matters that have been fully settled between the parties. b) The setting of a final Fall 2008 hearing date, hearing length and outstanding issues for the East Bayfront (West) Precinct. c) To hear updates from all parties affected by the agreed North Keating Precinct planning process as set out in Exhibit No. 20 and address preliminary procedural matters leading up to a hearing of the related appeals anticipated to commence in February d) All parties are reminded of the obligation to properly address any

5 - 5 - PL changes to outstanding issues as they have been confirmed and attached to the Board s Decision/Order 1119, issued April 24, No further notice is required. 3. This Board Member continues to be seized of all appeals related to the Central Waterfront Secondary Plan. The Board continues to encourage the spirit of settlement that has now become well established between the parties to the Central Waterfront Secondary Plan area. The Board so Orders. D.R. Granger D.
