5 - 5 - PL MEMORANDUM OF ORAL DECISION DELIVERED BY S. W. LEE ON FEBRUARY 20, 2008 AND ORDER OF THE BOARD This decision addresses matters that were dealt with by the Board at a prehearing conference conducted on February 20 th, 2008, in connection with the incorporation of on-going development matters in the Board s disposition of the proceedings involving the new Toronto Official Plan. As with a number of earlier prehearing conferences, the Board received from the City a number of affidavits prepared by City planners supporting requests for approval of various modifications to the new Official Plan. The modifications as presented addressed the implementation within the Plan of various planning matters previously dealt with by the City or the Board affecting individual sites or areas. In one case, the affidavit was submitted to correct a mapping error affecting an individual property. The planning opinions provided by the affidavits in support of the modifications were not disputed and the Board found that approval of same constituted proper planning. Particulars of each affidavit and the related modifications as approved are summarized below: Exhibit Affidavit of Gerry Rogalski, Planner with the City of Toronto, in support of a modification to Subsection (a) of the Garrison Common North Secondary Plan required to correctly recognize and implement the previously approved policy of the Part II Plan of the Official Plan of the former City of Toronto addressing the allocation of permitted floor area within the Hanna Avenue Technology District. Exhibit Affidavit of Gerry Rogalski, Planner with the City of Toronto, in support of a modification to the North York Centre Secondary Plan to recognize the approval by the Ontario Municipal Board of a site specific development application on lands municipally known as 1-12 Oakburn Crescent and Oakburn Place; Exhibit Affidavit of Gerry Rogalski, Planner with the City of Toronto, in support of modifications to the new Official Plan presented in settlement of

The modification corrects the land use designation shown on the maps from Mixed Use Areas to Employment Areas; and Exhibit 205 Affidavit of Christian Giles, Planner with the City of Toronto, in support of a modification to the new Official Plan to add a Site and Area Specific Policy for Russell Hill Road to recognize the previous approval by the Ontario Municipal Board of a site specific development proposal on the subject lands. The appropriate adjustments to the attachments to the Board s previous Decisions/Orders approving portions of the new Official Plan will be implemented by a subsequent amending order. During the prehearing conference the Board was also advised by counsel for the City of the outstanding request by the counsel for Chilocco Development Corporation for a motion for reconsideration of the Board s previous approval of policies within the Official Plan as related to certain lands owned by the company. The next prehearing conference will be convened at the Board s chambers on Tuesday, May 20, 2008, commencing at 10:00 am.
