A detailed description of the activities claimed in support of due diligence: During the Period from July 1997 through July 2003, the Town, utilizing Town employees, has performed substantial repair, development and maintenance activities related to the Reservoir, and incurred costs for equipment, supplies and payroll. Approximately $17, 346 of such costs were incurred in the period of September 2002 to July 2003, a substantial potion of which funded construction of approximately 2500 feet of a new road, which when completed will extend from the Reservoir to two springs located on a hill above the reservoir The road will enable the Town to clean the springs and develop the spring flow into the reservoir from such springs, to enhance filling of the reservoir, to help ensure that an enlarged reservoir could actually fill. Such work also included improvements to the existing pipeline intake line and headgate to help increase inflow, thereby improving the ability to fill an expanded reservoir.
