Kelly Sheri Perkins Public Meetings 1 st & 3 rd Wednesday of each month MINUTES Thornbury Township Board of Supervisors Meeting Wednesday, June 20, 2012 The Thornbury Township Board of Supervisors held a Work Session Meeting on Wednesday, June 20, 2012, at the Township Administration Building, 6 Township Drive, Cheyney, PA. Chairman Raith called the meeting to order at 7:00 p.m. with a salute to the flag. PRESENT: James H. Raith, Chairman James P. Kelly, Vice Chairman Sheri L. Perkins, Supervisor Jeffrey T. Seagraves, Manager Geoffrey Carbutt, Township Secretary Lindsey Price, Roadmaster Peter Barsz, CPA, Treasurer Robert Anderman, Esq. Elizabeth Catania, PE, Township Engineer Justin Scarth, PE, Township Sewer Engineer Number of Attendees: 11 Chairman Raith announced that that the Board previously held a brief Executive Session this evening regarding personnel. APPROVAL OF CHECK REGISTERS On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $62, for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $29, for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Sewer Expansion Fund check register in the amount of $33, for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Open Space Fund check register in the amount of $166, for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith commented on that it was the first of annual payments on the Cannon payment.

2 Minutes Board of Supervisors Work Session Meeting 2 June 20, 2012 On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Capital Improvement Fund check register in the amount of $12, for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Escrow Fund check register in the amount of $ for June 7, 2012 through June 20 th 2012, was approved. Chairman Raith called for public comment. There was no public comment. APPROVAL OF MINUTES On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Wednesday, June 6, 2012 Public Meeting minutes were approved as recorded. Chairman Raith called for public comment. There was no public comment. Vice Chairman Kelly clarified never having been in Maureen McCann s truck. AGENDA ITEMS On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the 1 year Scheduled Generator and Equipment Maintenance Contract from Mardinly Industrial Power of Broomall, PA, in the amount of $ , and the Specified Service Visits Contract in the amount of $446.00, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, Resolution amending the Township s Act 537 Plan to include the provision of sewer service via a low pressure sewer system to the residents along Fox Lair Lane, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Reverse Subdivision Plan for Purple Martin Drive and recommendation to record the same, was approved. Chairman Raith explained the process. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the extension granted on the "Wills" Subdivision, extending the present action date 90 days, from July 3, 2012 to October 1, 2012, was accepted and approved. Chairman Raith called for public comment. There was no public comment. STAFF REPORTS TOWNSHIP MANAGER'S REPORT- Jeff Seagraves The Township Manager s Report was submitted and is attached. There was no comment on the manager s report. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the appointment of Ted Cam to the position of Township Safety Officer was approved. Chairman Raith commented on the appointment and the benefits of having him in this position and then congratulated him.

3 Minutes Board of Supervisors Work Session Meeting 3 June 20, 2012 TOWNSHIP ROADMASTER S REPORT Lindsey Price The Roadmaster s Report was submitted and attached. There was no comment on the roadmaster s report. TOWNSHIP TREASURER S REPORT Peter Barsz, CPA The Treasurer s Report was submitted and attached. There was no comment on the treasurer s report. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the Treasurer's Report for May 31, 2012, was accepted. Chairman Raith called for public comment. There was no public comment TOWNSHIP SOLICITOR S REPORT Robert Anderman, Esq. The Township Solicitor s Report was submitted and is attached. There was no comment on the solicitor s report. Chairman Raith asked Mr. Anderman to move forward on a draft ordinance for outdoor dining in the township. On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the direction of the Township Solicitor to move forward on a draft ordinance for outdoor dining in the township, was approved. Chairman Raith called for public comment. There was no public comment TOWNSHIP ENGINEER S REPORT Elizabeth Catania, PE The Township Engineer s Report was submitted and is attached. There was no comment on the engineer s report. TOWNSHIP SEWER ENGINEER - Justin Scarth,PE The Township Sewer Engineer s Report was submitted and is attached. There was no comment on the sewer engineer s report. Chairman Raith congratulated Sheri Perkins on her recent appointment to the Delaware County Women s Commission. 4 MANAGER S REPORT We have made all of the preparations for the Annual Fourth of July Parade. The parade will start in its usual spot at Bethlehem United Methodist church at 10 am on Wednesday July 4, 2012 and will end at Thornbury Park. 2. We reviewed the sink hole that developed in front of 21 Wharton Drive. Our engineers have reviewed the problem and Orleans is resolving the problem. 3. We prepared the resolution for the Fox Lair planning module sewer expansion. 4. We held a senior event at the Township building on Sunday We showed the movie and prepared dinner for 14 senior residents in attendance. 5. I met with Ted Cam for the position of Community Safety Officer. I would like to recommend Mr. Cam for this position 6. I will be attended an open space meeting at the Brandywine Battlefield on Thursday June 7, The topic of discussion was the Battlefield preservation Plan. 7. We started our 4-day work week this week. As a reminder to residents, office hours will be from 7:30 am to 5:00 pm Monday through Thursday. 8. Plans for summer camp are going well. We acquired supplies next week for summer camp which started on Monday We had about 20 campers in the first session. Slots are still open for campers that wish to participate. 9. I attended an energy efficiency workshop at Lower Merion Municipal building. I am pleased to report that most of the suggestions that were made have already been implemented in our township. 10. We have a meeting scheduled with Ron Bovaso and representatives of Cheyney University to discuss the steps necessary for the occupancy certificate for the new dormitory. 11. I met with Ted Jacquet to discuss the Sewer Committee s plans for future sewers for the township. 12. We will hold our first Fourth Friday event this Friday. We are serving pizza and the Fabulous Greaseband will be playing from 6 to 8 PM at Thornbury Park.

5 THORNBURY TOWNSHIP Public Works Department Report Week Ending June 15, Routine maintenance performed throughout the Township, including mowing of parks. 2. Provided Township Solicitor with information for new ice and snow removal contract for upcoming winter season. Looking to get approval to advertise for bids at next BOS meeting. 3. Road edge cutback project remains ongoing. East side of Township is complete. West side of Township is underway. 4. Researching cost savings in purchasing AcrEase Rough Cut Mower to be attached to new Kubota for mowing open space throughout the Township. We spent $785 to mow Barrett s Meadow last year and $780 to mow Cannon property to provide parking for 325 Celebration. Cost to purchase attachment is approximately $4,000 (cost would pay for itself it no time) See attached.

6 Township of Thornbury Delaware County, Pennsylvania Solicitors Report June 20, 2012 The Township Solicitor, Robert P. Anderman, Esquire, reports as follows: I. The Solicitor and the Township Manager have met and discussed the need for various ordinances and specifically the revisions to the Proposed Sign Ordinance. It is our recommendation that the Board of Supervisors request the Planning Commission to review the Group Home Ordinance for possible revisions compliant with up to date State and Federal law. II. ASSISTANT TOWNSHIP SOLICITOR The Assistant Township Solicitor has terminated his relationship with the Township and therefore it is recommended that the Board of Supervisors consider appointing a new Assistant Solicitor and the Solicitor would like to meet and discuss the matter with the Board of Supervisors..

7 Catania Engineering Associates, Inc. Consulting Engineers 520 W. MacDade Boulevard Milmont Park, PA Phone ( ) Fax ( ) REPORT OF THE ENGINEER June Workshop Meeting June 20, 2012 Work completed for the period: Blantyre - Awaiting request for release of Municipal Improvement Funds. Project is complete. Andover - Housing construction is underway. Six lots are currently under construction. Completing sedimentation and erosion control inspections. Cheyney University - Construction of dormitory continues. Final grading at those locations needs to be completed. Wastewater Treatment Plant - We have received a submission and are currently reviewing. Wills - No further submission has been received. Gricco - Plans and calculations have been received and reviewed. There are some stormwater and other minor issues to be resolved. NPDES permit for percolation testing has been received and testing scheduled for Monday, June 18. Enterprise Pipeline - There has been clearing completed by the pipeline company on Locksley Road that is adjacent to the Gricco property. Working with the Pipeline Company and DCCD to have this property remediated. Planning Commission - working with members to address Ordinance revisions. PaDOT Liquid Fuels - Reviewed PADOT street list for accuracy. A few streets have been added. The Secretary is researching files for deeds of dedication. Glen Mills School - Purple Martin Drive Residences - Plans have been received for the land development revisions and has been reviewed. Road Program approval has been received from PADOT. Expect project start mid July. Cheyney Road Stormwater Piping Revisions - AF Damon has ordered the inlet and piping and is expected to complete work in the next two weeks. Mill Creek - Cutler Group representative has indicated he was instructed to rebid the final work at Mill Creek. There is no timetable available for start-up. Greenbriar Dallet 5 - Orleans continues work on the basin conversions and has started sidewalk and apron replacement in anticipation of street resurfacing. Lyons and Hohl have started but have not completed the additional stormwater pipe that is part of Squire Cheyney. ACT 167 Ordinance Revisions - the Act 167 Ordinance (StormwaterManagement) should be revised to reflect the new Model. This will need to be completed prior to September 2012.

8 FEMA Ordinance - FEMA/PEMA has forwarded revised ordinance language for the current floodplain management ordinance. Our current ordinance is not up to date and should be revised.

9 THRN June 14, 2012 ENGINEER'S REPORT REGARDING WASTEWATER ISSUES June 20, 2012 East Side Sewer System DELCORA repaired the hole in the Chlorine Contact Tank at the wastewater treatment plant. We are working with the Manager to develop different alternatives with their associated costs for replacement of the tank. The sewer laterals at 21 and 23 Wharton Drive were video inspected on June 14, There was no damage or ruptures in the pipe found that would have caused the sinkhole under the sidewalk. Further investigation through excavation when the sidewalk section is removed and replaced may reveal the cause. The pump at Creek Rd. East that failed due to faulty service has been reinstalled and is back in service. West Side Sewer District The 30 day review period for the Fox Lair project is complete, and the Planning Module is essentially ready to submit to the DEP. o It is recommended that the Township pass a resolution to amend the Township s Act 537 Plan to include the provision of sewer service via a low pressure sewer system to the residents along Fox Lair Lane. A draft resolution is attached for your consideration and approval. We are continuing to work with the Sewer Committee and the Manager to aid in the determination of need/desire for sewers in the Brinton Lake Colony and other areas in the Township. 10 TOWNSHIP OF THORNBURY DELAWARE COUNTY RESOLUTION No. of 2012 RESOLUTION OF THE SUPERVISORS OF THORNBURY TOWNSHIP, DELAWARE COUNTY, PENNSYLVANIA (hereinafter the municipality). WHEREAS, Section 5 of the Act of January 24, 1966, P.L. 1535, No. 537, known as the Pennsylvania Sewage Facilities Act, as amended, and the Rules and Regulations of the Department of Environmental Protection (Department) adopted thereunder, Chapter 71 of Title 25 of the Pennsylvania Code, requires the municipality to adopt an Official Sewage Facilities Plan providing for sewage services adequate to prevent contamination of waters of the Commonwealth and/or environmental health hazards from sewage wastes, and to revise said plan whenever it is necessary to meet the sewage disposal needs of the municipality, and WHEREAS, Pennoni Associates Inc. has prepared a Sewage Facilities Planning Module for Minor Act 537 Update Revision which provides for sewage facilities in a portion of Thornbury Township along Fox Lair Lane, and WHEREAS, the alternative of choice to be implemented is a low pressure sanitary sewer system. The key anticipated implementation activities/dates include final design 8/2012; Part II Permit 10/2012; start construction 01/2013; and complete construction 07/2013, and WHEREAS, Thornbury Township finds that the Facility Plan described above conforms to applicable zoning, subdivision, and other municipal ordinances and plans and to a comprehensive program of pollution control and water quality management. NOW, THEREFORE, BE IT RESOLVED that the Supervisors of the Township of Thornbury hereby adopt and submit to the Department of Environmental Protection for its approval as a revision to the Official Sewage Facilities Plan of the municipality the above referenced Sewage Facilities Planning Module. The municipality hereby assures the Department of the complete and timely implementation of the said plan as required by law. (Section 5, Pennsylvania Sewage Facilities Act as amended).
