Karl Bolognese called the November 9, 2000 Board of Supervisors meeting to order at and asked everyone to rise for the Pledge to the Flag. Terry Rarick made a motion, seconded by Karl Bolognese approving the October 12, 2000 Board of Supervisors meeting minutes. Motion carried. POLICE REPORT Ruth Manmiller read the October Northern Berks Regional Police Department activities report. TOTAL CALLS 617 MAIDENCREEK ONTELAUNEE LEESPORT CALLS CRIMES/OFFENSES FINES COLLECTED $ $ $ ROAD REPORT Terry Rarick gave the Operations Director s report for October: EQUIPMENT REPORT 1. The mowing equipment will be serviced and stored. 2. Unit #3 tailgate has been installed. 3. The backhoe the township has been testing for the past week is in the garage for inspection. ROAD CREW COMPLETED THE FOLLOWING 1. Crack sealing is in progress. Grove Road, Hoch Road, E. Wesner Road, Hill Road and Lee Spring Road will be completed this fall. 2. All new road index signs have been installed. 3. Numerous potholes have been repaired. 4. Mowing is completed for the season. DRIES ROAD The Engineer reported Penn Dot should grant approval for the stormwater agreement by the end of the year. The Supervisors agreed to wait for the approval to arrange a meeting with Ontelaunee Township Supervisors. Ontelaunee Township agreed to pave Dries Road and Maidencreek Township agreed to install storm water improvements. EMERGENCY GENERATOR Terry Rarick made a motion, seconded by Karl Bolognese, authorizing the Operations Director to proceed with the Emergency Generator Project by purchasing the Emergency Generator from Grainger for $13, Motion carried. The Maidencreek Township Building, the Andrew Maier Elementary School, and the Blandon Fire Company are designated emergency headquarters for Maidencreek Township. This would improve the township building in case of an emergency

2 Terry Rarick made a motion, seconded by Karl Bolognese, to add David I. Brown to the Part Time Employee list for snow removal during Motion carried. Terry Rarick made a motion, seconded by Karl Bolognese, to purchase a Case Backhoe form Powerco for $56, The Board agreed the liability issues, concerns of repair, general usage and maintenance they would purchase the backhoe, rather than purchase the backhoe jointly with the Maidencreek Authority. Motion carried. TREASURER S REPORT Ruth Manmiller read the Treasurer s Report for October and requested approval of the following payouts: GENERAL CHECKING $103, PAYROLL $ 16, GOLDEN MANOR III IMPROVEMENTS $ 2, RECREATION TAX CHECKING $ 5, TRAILS, INC. $ 1, Terry Rarick made a motion, seconded by Karl Bolognese, approving the Treasurer s Report for October Motion carried. BLANDON FIRE COMPANY REPORT Daniel Miller reported Fire Company activities for October 2000: Fire Calls 1 Accident Calls 9 AFA Calls 6 Other Calls 3 TOTAL CALLS 19 Fire Police Calls 15 Training Hours 270 PUBLIC COMMENT Fay Isamoyer, Allentown Pike, expressed her safety concerns for a section of Allentown Pike located in front of her home. She stated vehicles traveling in the center left turning lane at a high rate of speed making it difficult for residents to exit from their properties. She feels the development of Maidencreek Township has contributed to the unsafe conditions along this section of highway and any additional development such as the proposed development of the former Schaeffer property will only make it worse. She asked that the Police monitor this section of highway. Keith Hartman and Elizabeth Hartman, Allentown Pike, agreed with the previous comments made by Fay Isamoyer. They hoped the Board would take their safety concerns into consideration when the proposal for the zoning change of the Schaeffer property is considered. Karl Bolognese stated he would ask the police department to monitor this section of the Allentown Pike for any traffic violations

3 Terry Rarick agreed the conditions along the Allentown Pike (SR 222) are unsafe in many areas. Penn Dot is in the process of conducting a study of this area. The length of time to complete the study and the improvements will not be happening in the near future. The developments may have contributed to the traffic problems, but the majority of traffic on the Allentown Pike is through traffic, not residents from the developments in Maidencreek Township. Heather Quillman, a member of the Park and Recreation Board, questioned why $20, in wages came out of the Park and Recreation Budget. When will the Board make a decision to increase the recreation fee for developments? Terry Rarick explained the budgeted $20, for payroll in the Park and Recreation Budget pays employees when work is completed in recreational areas. Work in recreational areas includes mowing, and general maintenance of the areas. The Board will act on the increase of the Park & Recreation Fee in the near future. Increasing the Park and Recreation Fee for residential areas is not the problem; the Board must examine their options to assess Commercial development Nancy Werner, Troxel Road, asked about the status of the proposed Noise Ordinance and will any existing problems be grandfathered in this new ordinance? The Board informed Nancy Werner there were several issues that must be addressed before adoption of the proposed Noise Ordinance. No areas will be grandfathered. Marty Buck, Troxel Road, feels the residents of Troxel Road are being picked on because they received notices to change their addresses. He is very unhappy that he was not made aware of the address change before it occurred and being forced to comply will be very costly. Ruth Manmiller explained address changes have been in the process for the past three years. All planning has been in conjunction with Berks County Communications, the Post Office, and the township. Maidencreek Township residents receive mail service through six different post offices. Starting January 2000 each postal area has been notified of the new addresses. Address corrections and/or adjustments should be completed by December 31, Notification of address changes and/or corrections have been in the Township newsletter for the past three years. Carol Kopher, Pleasant Hill Road, is concerned about the increase of traffic and everyone s disregard for safety. Her husband on numerous occasions must move large farming equipment through the intersection of Allentown Pike and Pleasant Hill Road. Should another development be approved (Schaeffer property) traffic would become worse. Her concern for her husband s safety when crossing Allentown Pike has caused her to seriously consider calling the police to stop traffic. Terry Rarick stated the traffic congestion is caused for the most part by through traffic, not development traffic. Karl Bolognese advised Carol Kopher to call the police, if she thinks it is necessary to stop traffic when her husband must travel through the Allentown Pike and Pleasant Hill Road intersection. Cindy Stump, Maidencreek Road, has concerns about the increased traffic on the Allentown Pike. She questioned why zoning rules and regulations are adopted, if they are changed so easily

4 Lynford Weber, Hoch Road, stated the developments have caused an impact on the roadways in this area. He can remember riding bike or taking a walk on Hoch Road and not be concerned about traffic. He feels he no longer can safely walk or ride bike on Hoch Road. Harold Burgert, East Wesner Road, questioned with all the homes built in the past three years, where are all the cars coming from? He wants to know when the Board will draw the line to stop the developments or at least slow them down. He feels the Board is inviting developers to the township. Karl Bolognese and Terry Rarick agreed the Board is doing all they can to preserve the agriculture areas by increasing the Agriculture Security areas. However, the Board can not control what a property owner does with their land. If they choose to sell their property to a developer, the only thing the Board can do is make sure the project conforms to all subdivision and zoning regulations. Ernie Marshall, Troxel Road, did not understand the reasoning behind the recent notice to change his address. He is unhappy with the inconvenience the changes will cause him, but he will comply. Tina Poole, Lee Spring Road, is concerned about the on-lot sewage problems on the Martin Retirement Village property. She stated the sewage is on the surface causing odor and possible contamination. She questioned if an inspection had been made and will Mr. Martin be forced to pump the septic tank. She felt he should pump the tank on a regular basis out of respect and courtesy to the neighbors. The Engineer informed Tina Poole the SEO had inspected the septic tank and surrounding area upon receiving a call from Terry Manmiller. Details are being discussed about having the system pumped and if Mr. Martin, owner of Retirement Village, does not comply he will be cited. Terry Rarick made a motion, seconded by Karl Bolognese, authorizing the Solicitor to inform Mr. Martin he has ten (10) days to clean up the area or he will be cited. Motion carried. Terry Manmiller was advised to inspect on a regular basis to make sure this would not happen again. As Phase II of Retirement Village nears final approval and completion, the sewage problems will be corrected. Larry Kunkel, 5 Lake Shore Drive, questioned the results of the lighting problems at Tom s. The Engineer stated he would have a report by the December 14, 2000 Board of Supervisors meeting. Gary Rollman, Orchard Road, requested permission for his Bike Club to use the roadways behind Lake Ontelaunee for time trials in Spring of The Board thanked Gary Rollman for advising the Board of his event and asked that he comply with all notifications, as he had in the past. Randy Wolfe, West Walnut Tree Drive, questioned if the tax revenue received through the millage increase is deposited in a separate account. He requested emergency headquarters information to be published in the next newsletter. The Board informed Randy Wolfe tax revenue received for Park and Recreation is deposited in CD s and a checking account at the First National Bank in Leesport Bank

5 Daniel Miller, Blandon Fire Company Chief, informed Mr. Wolfe, the type of emergency and location would determine which emergency command center would open. He asked the Board to consider amending the Burning Ordinance to reflect, no burning in any residential area. It no longer is safe to burn in any of the residential sections of the township. ENGINEER S REPORT MARTIN RETIREMENT VILLAGE: Terry Rarick made a motion, seconded by Karl Bolognese to approve the review extension to 2/21/01 for Martin Retirement Village. Motion carried. A permit to dig under the railroad must be obtained and language in the sewage connection agreement is in review by DEP. GOLDEN MANOR REVISION: Terry Rarick made a motion, seconded by Karl Bolognese to approve the review extension to 12/31/00 for Golden Manor revision. Motion carried. BLANDON MEADOWS V, PHASE II: Robert Ludgate, Jr. presented a final plan with the addition of the alley and necessary corrections for plan approval. The developer will proceed with the installation of the pedestrian bridge and sidewalk. A fee-in-lieu of Open Space will be paid to the Township. Upon completion, the developer will be reimbursed for his costs to install the bridge and sidewalk from the funds on account with the township. Terry Rarick made a motion, seconded by Karl Bolognese, to approve Blandon Meadows V, Phase II - Final plan. Motion carried. A GPA permit has been applied for to address the storm water problem in Phase I of Blandon Meadows V. PENN BIOMEDICAL, Land Development: Terry Rarick made a motion, seconded by Karl Bolognese, granting waivers to 504.A.5 allowing driveway width of 20, and to Section 406.A.2. Preliminary plan requirement to final plan review per 10/26/00 Planning Commission letter. Waiver of 515. F. & G screening requirements was rejected. Motion carried. EAST WESNER ROAD, STREAM RELOCATION: Terry Rarick made a motion, seconded by Karl Bolognese, authorizing the Chairman to sign the contracts for relocation of the stream along East Wesner Road, contractor must start with in the next ten (10) days. Motion carried. SUBDIVISION IMPROVEMENTS AGREEMENTS LOC/ESCROW RELEASE LETTERS: Terry Rarick made a motion, seconded by Karl Bolognese, authorizing the Chairman to sign the Subdivision Improvement Letters of Credit for payment of $44, Motion carried. SEO REPORTS AND CONSTRUCTION STATUS REPORTS: The Engineer distributed SEO reports and development/construction status reports to the Board. SOLICITOR S REPORT SCHAEFFER PROPERTY REZONING REQUEST: The Albert Schaeffer property is located at the intersection of Allentown Pike and Schaeffer Road. The developer plans for the 145-acre tract of land include a 270-lot residential subdivision and commercial development of property fronting along Allentown Pike. Zoning changes requested are A Agriculture to C-1 Commercial and A Agriculture to R-2a Residential. Terry Rarick made a motion, seconded by Karl Bolognese authorizing the Solicitor to advertise a Public Hearing for the above Zoning request to be held November 30, 2000 at 7:30 PM. Alternate date December 18,

6 RESOLUTION Amending the fee schedule for performing various plumbing services within Maidencreek Township. Terry Rarick made a motion, seconded by Karl Bolognese to adopt the new fee schedule for various plumbing services with in Maidencreek Township. Motion carried. RESOLUTION Establish the standard for construction specifications for building sewer and water connection lines pursuant to CABO. RESOLUTION Dedication of Calabria Drive, Carmen Drive, Venice Drive and Riviera Drive located in Shadow Ridge I. Terry Rarick made a motion, seconded by Karl Bolognese to accept dedication of Calabria Drive, Carmen Drive, Venice Drive and Riviera Drive located in Shadow Ridge I. Motion carried. OLD BUSINESS Terry Rarick made a motion, seconded by Karl Bolognese authorizing the payment of $ to the Tri-Valley YMCA for recreation night held at the Fleetwood Community Center. Motion carried. Michael Weiser, Chief of Police conducted a traffic study in the area of Wales Way and Cassidy Court, as requested. During periodic studies of the area the Chief has determined installation of a stop sign is not necessary. Gloria Kemmerer asked the Board, should they consider purchasing the commercial property located at the intersection of Park Road and East Wesner Road to be included in the Community Park, would they conduct a public hearing? Terry Rarick stated there would be no public hearing should they decide to purchase the land located at the intersection of Park Road and East Wesner Road to be included in the Community Park. NEW BUSINESS The Board was waiting for reports from Berks EIT to move forward on the completion of the 2001 budget. It has been determined there would be no tax increase for Another budget meeting will be conducted 11/13/00. SECRETARY S QUESTIONS SHADOW RIDGE STREET LIGHTS: Terry Rarick made a motion, seconded by Karl Bolognese authorizing the preparation of a resolution from GPU to activate the streetlights on Calabria Drive, and Riveria Drive in Shadow Ridge II. Motion carried. Terry Rarick made a motion, seconded by Karl Bolognese authorizing the Secretary Treasurer to make final payment on the loan at the First National Bank in Fleetwood for the loader and 2000 GMC truck.
