1 TOWNSHIP OF NORTH HUNTINGDON, BOARD OF COMMISSIONERS SPECIAL MEETING, THURSDAY, JANUARY 12, 2017, 7:00 P.M Center Highway, North Huntingdon, PA Presiding Officer Tony Martino, President, Board of Commissioners CALL TO ORDER Commissioner Martino called the meeting to order at 7:02 P.M. ROLL CALL Commissioner Herold Present Also Present: Commissioner Haigis Present John Shepherd Commissioner Bertani Present Solicitor Bruce Dice Commissioner Gray Present Andrew Blenko Commissioner Faccenda Present Commissioner Kucera Present Commissioner Martino Present PLEDGE OF ALLEGIANCE CITIZENS INPUT 1. John Hynes 850 First Street states he has called a couple times about First Street at the bend where water is coming out on the street and freezing. Two times he slid coming around the bend and he is concerned there is going to be a bad accident. He states it seems the water is coming out of the hill but is not sure if it is a water line or the resident s line. He states Public Works repaired the front of his yard and he appreciates that. The drain was moved to the other side but now water is ponding in front of his mailbox. 2. Marian Parker 354 First Street asks if signs are permitted in residential districts such as Shuster Construction signs. She states kids stand behind the signs and she cannot see them when coming around the bend. She asks if the signs are allowed to be there and how can she get them removed. RESPONSE TO CITIZENS INPUT 1. Commissioner Herold states that Manager Shepherd will check with Rich Albert, Public Works. 2. Manager Shepherd states they will look at the signs and locations to determine if they are causing visibility issues. Work Sessions Discussion Topics *there are no work session discussion topics.
2 PLANNING / ENGINEERING TOPICS: 1) S / SP NTB Site Plan & Lot Consolidation, 9160 Route 30, C-1 Zoning Mr. Blenko states this is a subdivision and related site plan for a National Tire and Battery for an 8 bay store located on the site of the old Long John Silver. Wendy s restaurant had an L shaped lot and a rear parking lot at Long John Silver that was accessed from the Wendy s side. Wendy s agreed to sell the lot to National Tire and Battery and combine two lots. There are no issues on the lot consolidation just need to make sure all the proper language is on the recorded plan. National Tire and Battery will have four bays on each side of the building and parking on the west side. The biggest problem the Planning Commission had was trying to get tractor trailors in and around this site and will be very, very tight. Their original submission showed that a forty foot trailor could make it, but about eight percent of the tractor trailors are forty feet. They relooked at their plans and now believe they can get a forty five foot trailor in the site. Mr. Blenko states his concern is when doing this on a drafting table, if you hit the building, you can back up and do it again, but not in a real truck. Landscaping was something asked to get more of. They are proposing a row of trees on the side of the building and trees along the back, but only grass in the front. They agreed to put a three foot row of shrubbery in front of the building. Because the site is so tight, they are proposing the four parking spaces at the front of the building would be eight feet from the building instead of the required ten. The Planning Commission was ok with the reduction of two feet in exchange for the three feet of shrubbery in front of the building. The building will be masonry and metal panels. Mr. Blenko states the engineer who designed the site is present at the meeting. His name is Rado Nedkov. Rado Nedkov states he is from Scanton, PA. He states he will make the frontage look decent with landscaping. Mr. Nedkov states they do not plan on a driveway for reasons from PADot. The right of way will be grass. Mr. Blenko states the approval recommendations from the Planning Commission are contingent on erosion control and stormwater management plan approval by the Township and Westmoreland County, approval of an HOP from PADot, a commercial developers agreement to allow inspection of stormwater facilities as needed and resolution of any engineering comments. If the Board is ok to move forward, will put together a Resolution for next week. Commissioner Herold asks what if a truck longer than forty feet to come in. Mr. Blenko states a box truck would be ok. Signs would need to be posted at the entrance. Mr. Nedkov states the template is conservative but a forty five foot truck would be the maximum. Mr. Blenko states that could be made a condition that the site would be posted that no trailor longer than forty five feet would be permitted. He states the Planning Commission also heard a rezoning request and will have a Public Hearing next month.
3 FURTHER BOARD COMMENTS Commissioner Bertani states he wants to discuss the Hollybrook Plan. He states the Board agreed there are some safety concerns with the entrance on Clay Pike. He asks Mr. Blenko that since the entrance will be a Township road, can a condition be put on how the entrance will be done. Mr. Blenko told him anything to do with the entrance will be with the County. Commissioner Bertani states he spoke with Ted Kopas and he told him the exact opposite. He asks is it the Township or the County. If the Board agrees, he would like to have the developer discuss if they would be willing to put an island in the middle of the entrance where you could only make a right turn out of the plan and a right turn into the plan. He asks if this is something the Township can do or is it the County. Manager Shepherd states that Mr. Blenko is correct in the standpoint of the HOP is controlled by the County, but he says to assume the plan was already built and later the Township wanted to limit turning out of the plan, he thinks you could do that but will refer to the Solicitor. He feels it would be a legal issue because the plan has already been approved. There would have to be safety criteria. Solicitor Dice states there are two matters going on. One legal and other practicality engineering. From a legal standpoint, is the no left turn sign going to be on a Township road. Manager Shepherd states it will be on a Township road intersecting with a County road but will be controlling Township traffic. Solicitor Dice states the Township could limit turns. The HOP entrance is controlled by the County. Mr. Blenko states they submitted plans to the County and was issued the HOP based on those plans. The County may be agreeable to the island but if they don t amend their HOP based on revised plans, the Township cannot go in to change the entrance. Solicitor Dice recommends to ask the developer. Mr. Blenko states he does not think the problem is turning out of the plan. His concern is people coming South on Clay Pike wanting to turn left into the plan. Commissioner Martino states to go back to the developer and ask. Manager Shepherd states that if the plans are to go to the developer and limit the access, the developer will not agree to that. He states they can talk to the developer about other safety enhancements or improvements. Commissioner Kucera states his concern is forcing the buses to stay out on Clay Pike unless they turn around.
4 Commissioner Haigis agrees to go to the developer but the plan has already been approved. He states they can ask for other safety options. Manager Shepherd states they will talk about it internally then go to the developer. He feels they will have better success on options not restricting the turning movements.
