Gerhart Monday through Thursday, closed Friday Hours: 6:30 a.m. 4:30 p.m. Meeting: First Monday, 7:00 p.m. SUPERVISORS MEETING July, 2, 2012 The regular meeting of the Providence Township Board of Supervisors was held in the Township Municipal Office on Monday, July 2, Present were Chairman Gregory Collins, Vice Chairman William H. Schall, Member David Gerhart, Road Master Jim Grube, Zoning Officer Connie Peiffer, Secretary Vicki Eldridge and twenty one (21) observers. The meeting was called to order by Mr. Collins at 7:00 P.M. Mr. Schall offered prayer; followed by the Pledge of Allegiance. Don McNutt, District Administrator of the Lancaster County Conservation District presented information regarding conservation plans for farms located in Providence Township. Wayne Herr, Providence Township Representative to Solanco Safety Committee provided information from the May committee meeting. PUBLIC HEARING At approximately 7:15 p.m. the meeting was turned over to Mr. Newcomer to conduct a public hearing. The public hearing was held to consider the adoption of Ordinance No , amending the rules and regulations governing real property owned and operated by Providence Township as a recreational area. Mr. Newcomer opened the floor for public comment. The following comments were made. Clair Charles expressed concerns over prohibiting hunting on the trail. He expressed concerns over the trail improvements. Brian Longenecker asked if the discharge of guns is allowed on the trail. Merv Conrad asked if you are permitted to carry a gun on the trail. John Kirk stated that trail signage may ask that guns not be carried on the trail. Tracey Nettke is in favor of banning hunting on the trail. Ron Munro asked how many permits have been issued for hunting on the trail. John Kirk stated this ordinance was discussed at great lengths at the parks/rec committee. He stated that hunting is a family sport. Following the public comment period, Mr. Gerhart made a motion, seconded by Mr. Collins to adopt Ordinance No , amending the rules and regulations governing real property owned and operated by Providence Township as a recreational area. The motion carried with two (2) favorable votes. Mr. Schall opposed the motion. Mr. Collins explained that each Supervisor received a copy of the written minutes from the June 4, 2012 Board of Supervisors Meeting. With no additions or corrections to the minutes, Mr. Gerhart made a motion, seconded by Mr. Collins to approve the minutes. 2 Mr. Collins explained that each Supervisor received a copy of the written minutes from the June 11, 2012 Board of Supervisors Public Workshop. With no additions or corrections to the minutes, Mr. Schall made a motion, seconded by Mr. Gerhart to approve the minutes. The motion was carried unanimously. FINANCIAL REPORT Vicki Eldridge read the financial report. Mr. Schall made a motion, seconded by Mr. Gerhart to ratify payment of June bills in the amount of $81, from the general account and $2, from the state account. The motion was carried unanimously. REVIEW OF BUDGET Mr. Gerhart stated he is pleased with how the budget is tracking year to date. Revenues and expenses are on target for our year to date projections. PUBLIC COMMENT Clair Charles stated he has attended several parks/recreation committee meetings and has offered suggestions to the committee. Mr. Charles feels his comments have fallen on deaf ears. Bob Ray had questions regarding the proposed conservation zoning classification for Snyder Hollow Road. Wayne Sponseller expressed appreciation to the road crew for helping with various trail items. John Kirk had questions about the 100 foot buffer zone along farm fields. He also said he is gathering information regarding a possible timber harvest for the trail. Brian Longenecker expressed appreciation to the road crew for helping with the various trail items. Tracey Nettke expressed concerns regarding a pipe under Main Street that outlets in her back yard. She also asked for an update regarding truck traffic on Main Street. PARKS/RECREATION REPORT John Kirk, chairman of the parks/recreation committee shared his monthly committee report. He expressed concerns over some washout areas on the trail. He expressed appreciation to the township road crew for the assistance they have given to the committee. He did ask which police department would cover issues on the trail. OLD BUSINESS: Following a brief discussion regarding the zoning ordinance and future land use map, the supervisors agreed to schedule a workshop to further discuss the zoning ordinance and future land use map. The public workshop will be held on Monday, July 30, 2012 at 7:00 p.m. Mr. Collins announced that the agricultural security area seven year review process has begun. Following a brief discussion regarding the cost proposal for the Cohen Law Group to represent Providence Township in renewing the cable franchise agreement with Comcast, the supervisors asked to have more time to review the proposal. Mr. Newcomer will contact the solicitors for Martic and Conestoga Township s to determine their interest in the proposal. Providence Township 2

3 Mr. Collins announced the township was not awarded a Lancaster County Smart Growth Transportation Grant to install a foot bridge on the trail over Route 222. Mr. Gerhart had questions regarding the structure of the bridge. Following discussion regarding the placement of an electric pole in the Providence Township Park, the supervisors agreed to table their decision until the August meeting. Mr. Schall gave an update on the emergency management agreement with Martic and Pequea Townships. The board members plan to take time to review this document. The supervisors would like to talk to the Quarryville Fire Company and representatives from Eden, Colerain, East Drumore and Quarryville Borough to inquire about their efforts to regionalize emergency management. NEW BUSINESS: Mr. Collins made a motion, seconded by Mr. Gerhart to reactivate the winter services agreement with PennDOT for the winter seasons. The motion was carried unanimously. Mr. Collins announced the township offices will be closed to celebrate Independence Day on Wednesday, July 4, Quarryville Borough Police Report: conducted hours of speed enforcement. Officers wrote 26 citations and issued 1 warning. Top speeds: Route mph; Main Street 43.4 mph; Cinder Road 59.2 mph; Pennsy Road 55 mph. Following discussion regarding reinvesting a $106, certificate of deposit coming due at Susquehanna Bank, the supervisors asked the secretary to explore some other options with the bank. Mr. Gerhart asked Mr. Collins to give an update of the meetings of the Southern Lancaster County Intermunicipal Committee. ZONING REPORT: OLD ZONING BUSINESS: Tracey Nettke, 65 Main Street, chickens: Mrs. Nettke was in attendance at the meeting. She stated the chickens are still at her place of residence, 65 Main Street. Mrs. Nettke also stated she intends to apply for Zoning Hearing Board approval to allow the chickens to remain on site. Mrs. Peiffer said the completed application and fee for the Zoning Hearing Board submission must be received by the Township on or before July 19, NEW ZONING BUSINESS: Zoning Hearing Board, July 10, 2012: The Board will hear one variance request for Peter Morss, 84 Hawthorne Circle, pertaining to the construction of a residential addition within the side yard setback area. Robert L. Ray, 287 Snyder Hollow Road, variance of Flood Plain Ordinance: This request is concerning the construction of a detached garage within the Flood Plain District at 287 Snyder Hollow Road. The request previously received Zoning Hearing Board approval. Mr. Ray, property owner, was in attendance to explain the proposed garage structure project. After discussion, a motion was made by Mr. Collins and seconded by Mr. Schall to grant a variance, as per Section 126 of the Flood Plain Ordinance, Chapter 8 of the Township Code of Ordinances, for the construction of a detached garage structure to be located on property at 287 Snyder Hollow Road, within the designated Flood Plain. The variance is granted with the condition of compliance of provisions outlined in the May 9, 2012 letter received and signed by the property owner, Providence Township 3

4 Robert L. Ray. The motion was carried unanimously. Michael & Ruth Ann Huber, 12 Birch Interval, Enforcement Notice: This notice was sent pertaining to unlicensed vehicles and accumulation of junk. Glenn Robinson property, 479 W. Fourth Street: A letter was sent to Mr. Robinson to contact the zoning officer concerning a pool located on the property, without the proper permits. Kerrick S. Nettke, 65 Main Street, Enforcement Notice: This notice was sent pertaining to an above ground pool located on this property, without first obtaining the proper permits. NEW SUBDIVISION BUSINESS: Benuel S. Beiler, Land Development and Lot Add-On Plan, 174 & 198 Cinder Road: Craig Williams, from Strausser Surveying and Engineering, was present to introduce this new plan to the Board. The plan shows the location of a grocery store at 174 Cinder Road and the adding of acreage to 198 Cinder Road from 174 Cinder Road. The property at 174 Cinder Road would be reduced in size to approximately 5.8 acres. The plan has been to the Township Planning Commission twice and reviewed twice by RAV Associates. The use of the grocery store on the property, which is zoned Agricultural, was discussed at length. Mr. Newcomer explained the use has already been approved by the Township Zoning Hearing Board. After further discussion, Mr. Williams, acting on behalf of the owner, granted the Board of Supervisors a 30 day extension of time to act on the plan, thereby extending the time period until August 12, Noting the extension of time, the Board tabled any action on the plan, at this time. SEWAGE OFFICER Marvin Stoner completed one perc and probe test and issued one sewage permit with a total of $ remitted for the month of June. MONTHLY REPORTS Secretary: Receipts totaling $171, were recorded in the month of June. Road Master: Mr. Grube reported that in July the road crew will be installing pipe and inlets in the 300 block of Truce Road. Pipes will be replaced on Clearfield Road, Woods Drive and Fairview Road. During the month of June, storm clean up and filling washouts took up much of our time. Bank removal and shoulder widening was completed on Truce Road. Brush was cut to clear sight distance at various intersections. The second round of road bank mowing has begun. Dave Gerhart expressed his appreciation to Jim Grube for managing his budget very well.
