5 4.1-3 This application is being reviewed and processed under the existing, in effect, policies and regulations of The Act and Regional bylaw Section 1.2 of the Retail Business Holiday Act has been proclaimed on December 31, 2016 Section 1.2 would allow a municipality to enact a by-law that states The Act no longer applies to a municipality after it passes a by-law which establishes its own retail closure regime Review of Section 1.2 and its impact on Region of Peel retail closures is still under review by Regional staff RBHA Exemption Application: P.A.T. 6 4.1-4 Applicants must demonstrate that: The exemption criteria outlined in the Act and accompanying regulation (O.Reg 711/91) have been addressed; and The exemption would assist in the maintenance or development of tourism. The applicant has included a Study with the submission of their application that illustrated how they meet the exemption criteria and how this establishment would contribute to tourism within the City of Mississauga RBHA Exemption Application: P.A.T. 7 4.1-5 A retail business establishment may be exempt if It is located within 2 km of a tourist attraction; and, It is directly associated with the tourist attraction or relies on tourists visiting the attraction for business on a holiday. 8 4.1-6 Input from Public meeting documented A report and by-law will be prepared for Regional Council consideration at a future meeting An adopted Regional by-law is required for approval. Any person who objects to the by-law may appeal Council s decision to the Ontario Municipal Board within 30 days. 11 : Presentation Overview P.A.T. Oriental Food Market seeks an exemption under the RBHA for the maintenance and development of tourism. The applicant seeks exemption for the following days: New Year s Day: January Good Friday: April Easter Monday: April Victoria Day: May Canada Day: July Labour Day: September Thanksgiving Day: October Proposed hours of operation are between: 9:00am 10:00pm

16 : Retail Business Holidays Act: 1990 An applicant may apply for a by-law to permit one or more Retail Business Establishments to open on a holiday for the maintenance and development of tourism. The Act stipulates that a retail establishment may be exempted if: It is located within 2 kilometers of a tourist attraction; and It is directly associated with the tourist attraction OR relies on tourists visiting the attraction for business on a holiday. A tourist attraction is limited to: Natural attractions or outdoor recreation attractions; Historical attractions; and Cultural, multi-cultural, or education attractions. Any retail establishments that uses a total area of 2,400 sq.m or more must in addition, provide goods or services on holidays primarily to tourists.
17 : Reasons for Application P.A.T. Oriental Food Market meets the tourism criteria under the Retail Business Holidays Act: Regulation 711/91. Section 2(1): A retail business establishment may be exempted if, a) it is located within two kilometers of a tourist attraction (Mississauga Chinese Centre and Square One Mall); and b) It is directly associated with the tourist attraction OR relies on tourists visiting the attraction for business on a holiday. P.A.T. Oriental Food Market will continue to promote holidays through various promotions and ethnic food choices. Sales of food products and prepared food will be available for statutory holidays and can be seen in the flyer samples provided by P.A.T. Oriental Food Market.

19 Reasons for Application External Tourism: Ministry of Tourism report notes that 7.3% of all overseas trips to Ontario are destined for Peel region. P.A.T. Oriental Food Market provides a superior selection of Korean groceries for the west end customers (Kitchener, Waterloo, Hamilton, Buffalo, etc.). Manager, Kwang Lee, has heard first hand that some customers have travelled all the way from Buffalo solely to get Korean groceries from this particular store. Internal Tourism: P.A.T. Oriental Food Market provides a superior selection of Korean groceries in the Region of Peel. Staycations require retailers to pull revenue opportunities from the local community rather than depending on outside tourism. Opening on holidays will provide a venue for these customers within Peel region. 23 : Tourism Activities P.A.T. Oriental Food Market is located within close proximity to some of Mississauga's leading tourist attractions, such as Mississauga Chinese Centre and Square One Mall. Additionally, the location of P.A.T. Oriental Food Market is in the middle of a number of green spaces allowing it to become a destination for tourists visiting these sites. They may promote very popular Korean BBQ goods and packages at discount prices on statutory holidays. Oriental Food Market for holidays will provide an additional amenity to meet the needs of these visitors.
25 Tourism Activities (contd.) Mississauga Chinese Centre Mississauga Chinese Centre is one of the North America's most remarkable tourist and architectural destinations. The Centre provides a unique glimpse into the fascinating architectural history and traditions of ancient China. The replicas of the Nine Dragon Wall, Soo Chow Garden pavilion, stone sculptures and fortress at the Great Wall attract local and international visitors daily. Some attractions on the premises are the only one outside of Asia. Source: Square One Shopping Centre Located in the heart of Mississauga, Square One Shopping Centre offers a shopping experience for the local communities and tourists alike with 1.7 million square feet of retail space. Square One attracts approximately 24 million visitors a year with more than 350 retail stores and services. Since receiving exemption under the RBHA in 2009 Square One continues to expand with numerous renovations and the opening of new retailers. Promote customer draw to the area to ensure that the dollars spent are being spent within the community Exemption would maintain common pause day principle and fully meet obligations under the Employment Standards Act. Its proximity and accessibility to community attractions and other tourist destinations in the Mississauga area make P.A.T. Oriental Food Market the primary caterer to customers with basic day to day needs, as well as last minute shopping ideas for those visiting the local tourist attractions.
