3 2016 AGM by President Bob Ferguson On April 10, 2016 more than 40 of our Caledon Hills Bruce Trail Club members gathered at Caledon Village Place for the Annual General Meeting. The weather was cool but didn t stop those that started the day with a hike. A social time, business meeting and delicious pot-luck dinner rounded out the day. Having just completed my first year as Club President, I continue to be impressed with the level of commitment and interest from the many volunteers who make our Club a success. Every one of the directors and support volunteers make a significant contribution to the smooth operation of the Club that results in an enjoyable experience for close to 900 members. Special thanks to my predecessor Jean Kerins who has always been available to answer my many questions and provide encouragement. Jean has also continued to handle the busy Badlands file and she represents us to help ensure public safety and appropriate access to the Badlands area. Two of our directors are leaving their roles. Greg Huffman has been our Social Convenor and consistently organizes key events like the AGM. Robert Gillespie was our Secretary and has always offered value by clearly documenting our meetings, arranging meeting places, and contributing to the Budget Committee. We owe them both a big THANK YOU!!! I m delighted that some new recruits were elected attheagm! JackieClarkeisthenewSocialConvenor and Marisa Jokelainen is now a Director at Large which is an excellent way to get your feet wet. Marg Bonk takes on the role of Secretary. Congratulations to Marg, Jackie and Marisa and we welcome them to the team. The rest of our directors and support volunteers are set to continue to do a great job in their roles. 7 Supporting Ontario Trails Act 2015, Proposed Bill 100 Current Status: Second Reading Debate Recently there have been a number of media articles, letters to the editors and radio spots regarding Supporting Ontario Trails Act 2015 (Bill 100). The proposed bill covers a number of different areas relating to trails, including liability, trespassing and securing routes through an easement. The bill is very positive for landowners and trail groups but an issue that has been the subject of much concern relates to easements. It is extremely unfortunate that a group has spread misinformation about Bill 100, specifically about the nature of easements, under the guise of protecting landowners, which has in reality misinformed landowners and generated unwarranted concern. The intent of Bill 100 is to improve access to Ontario's trails and to improve the landowner's protection (not diminish it). To improve protection, the bill proposes to amend the Occupiers Liability Act to clarify that trail users are there at their own risk. The Trespass to Property Act will also be amended to strengthen the consequence of trespassing on private and agricultural land by increasing the maximum fine from $2,000 to $10,000, consistent with other provincial statutes. It would also remove the limit on the amount that landowners can recover as part of the prosecution for damages caused by trespassers. Raising the maximum fine would show that the province takes trespassing seriously and that the fine is meant to be a deterrent. To address the area of easements, the BTC has stressed to us, the Landowner Relations Directors of each club, that (with or without Bill 100) under no circumstances could a landowner be forced to turn a simple traditional handshake agreement into a permanent easement without their knowledge and willing consent. An easement is a complex legal arrangement that requires the consent of the landowner and the trail group, as well as the local municipality. Similar to buying and selling a house or property, there are legal papers to sign, cash transactions to negotiate and lawyers assisting both parties. To register an easement for a trail requires a survey and an application for municipal consent By Carol Sheppard which is by law a public process. There is no possibility of an easement being registered against land without the express knowledge and consent of the landowner, even if a verbal agreement has been in place for decades. In addition, easements involve the landowner and trail group to enter into an agreement which contains the terms under which the landowner and easement holder (e.g. BTC ) have agreed to before it is registered. The easement agreement will stipulate the purpose of the easement, what can and cannot be done inside the easement area and under what circumstances one could terminate the easement. It may or may not include the ability for the trail group to convey (through a sale or donation) the easement to another party. The easement agreement may stipulate instead that should the BTC want to dispose of the easement it must go back to the landowner. The easement may state that if the BTC isn't using it for the Trail or another agreed upon purpose then it may be terminated. The bottom line, an easement is a formal agreement between two parties that is registered on title through the municipal consent process for a specified duration of time. However, there will be terms under which the easement can be removed, but for as long as the terms are not contravened then the easement is protected. Currently, the BTC has about 20 easements in place which they purchased from a landowner or received as a donation. These landowners wished to help our organization to secure the Bruce Trail across their land in perpetuity for which the BTC and generations to come will be eternally grateful. More information can be obtained on the BTC website, under News: Bill 100 and Landowners along the Bruce Trail. If you are a landowner and would like more information, our Executive Director Beth Gilhespy would be pleased to speak with you. 8 Anatomy of a Hike: Among the Zapatecas in Mexico s Sierra Norte Mountains By Nicola Ross A hike is a hike is a hike. Right? Of course not. Anyone reading this publication will know there are as many types of hikes as there are models of hiking boots. There are day hikes and overnight hikes and long distance hikes. There are mountain hikes and valley hikes, inter-tidal hikes and smell-the-roses hikes. There are pilgrimages, rambles, tramps, treks, strolls; and the occasional slog. I like just about any hike, but my favourite is usually the one that I am currently hiking. And so it was in mid-february, when my partner Alex and I set out for a seven-day, village-to-village caminata among the indigenous Zapatecas in the Sierra Norte mountains in southern Mexico. Hiking in Mexico, you say? Yup, you heard right. We hiked in Mexico and we weren t robbed by bandits, stung by scorpions or kidnapped by drug lords. Just the opposite. Starting at over 3,100 metres (about 11,000 feet) in the village of Llano Plano, the route eventually took us down to about 2,000 metres in San Miguel de Amatlán. Along the way, we spent nights in Cuajimoloyas, Benito Juarez, La Neveria and Latuvi. The general direction may have been downhill, but don t be fooled. The route was up and down, providing us with spectacular vistas of layered green mountains, strolls alongside working farms; and walks near clear streams where the dappled sun illuminated the rainbow hue of the resident trout. At times, the scent of pine resin made us wonder if we were back in Canada. In all, we covered 73.7 kilometres for an average of 10.5 kilometres per day. No distance by Bruce Trail standards, but the Sierra Norte isn t the Summer Niagara Escarpment. In total, we climbed 4,215 metres and descended 5,175. Put it this way, when we arrived at our destination each afternoon, we were ready to unlace our boots and shed our packs. At night, clean, well-appointed cabins with crisp white sheets and a hot shower awaited, as did hearty Mexican meals made with local produce. The cooks joked as they turned out a seemingly endless supply of steaming homemade corn tortillas and large pitchers of fresh natural juice my favourite was cucumber and guava. In La Neveria, Josephina concocted a watercress frittata that would have passed muster at the best Canadian restaurant. At higher altitudes, the cabins had woodburning fireplaces that removed the chill as we tucked thick wool blankets under our chins. All good, but as anyone who has hiked above a certain altitude knows, a slope that would normally go unnoticed can make one s heart race. For the first three days, we remained at about 3,000 metres and I felt as though the fat circus lady s legs had been transplanted onto my hips. We were lucky to cover three kilometers in an hour. Then we dropped down to nearer 2,000 metres. The pine, spruce and oak forest gave way to foreign-looking hardwoods. Bromeliads, cacti and orchids clung to their hosts forming complete branch-top gardens. Each day we had a new guide who told us about the flora and fauna. We began to better understand their Spanish, a relief since we hadn t taken advantage of the offer of a translator. If a plant didn t have a medicinal use, it had a clever name. All the birds seemed to be brilliantly coloured but what would one expect in an area with more

9 than 400 species of birds, 350 different butterflies and more than 2,000 types of plants. So rich is the population of mushrooms that they hold a mushroom festival each year in August. Our favourite guide was Memo. He happily shared his stories and was delighted to teach us a few Zapateca words as we walked the 12.6-kilometre route between La Neveria and Latuvi. Upon arriving in Latuvi, Memo joined us for a meal and then walked all the way back home a good day s exercise for anyone, but Memo was 74 and this was his third round trip in as many days. Our guides, cooks, waiters and housekeepers were all volunteers. In the Zapateca way, they must complete three, oneyear terms of voluntary community service. In return, they receive land and standing in the community. This unpaid labour made the eco-tourism project, of which our hike was part, highly economical. Each of the villages shared the eco-project s revenue and the benefits were obvious: clean streets, new schools, tidy medical clinics and covered basketball courts. For us, this adventure was a perfect blend of wilderness and rural. One morning, Alex had to pinch himself because the lane where we walked might have been in England where he was born until that is, he spied Mexico s flag bird: the red, white and green trogon. We walked for five kilometers through a mystical forest of oak trees draped in Spanish moss that flowed in the breeze. Near metre-long, snake-like cacti populated a rock face, and delicate peach blossoms heralded the arrival of spring. We dropped into incised river valleys where the sun peeked through trees too tall by half and we seemed centuries apart from what was happening out there. Then we d come upon a small farm where a question about sheep or the difficulties of ploughing with bulls would transform a stern Zapateco farmer into our best friend. We had nature. We had culture. And the morning we soared with vultures on a kilometre-long zip-line, we had adventure too thereby demonstrating that a hike is not just a hike when it s a caminata in Mexico s Sierra Norte. 10 Theatre Night/Fundraiser at Theatre Orangeville Sold Out Success! By Janice McClelland, CHBTC Director of Fundraising Fifty members of the Caledon Hills Bruce Trail Club and friends enjoyed a Theatre Night/Fundraiser at Theatre Orangeville on Wed March 30th. The group was treated to the dress rehearsal of Mending Fences, a play by popular Canadian playwright, Norm Foster. Our group appreciated the fine performance of the actors and the humour of the story. Not only was it a pleasant night out, this event raised $1500 to help support the mission of the Bruce Trail Conservancy to buy land and secure the trail for future generations. Thanks to our members who supported this event and to Theatre Orangeville who originated the idea of a Community Give-Back Night whereby dress rehearsals are open to local charitable organizations for fundraising. It is a unique and valuable fundraising opportunity for the Caledon Hills Bruce Trail Club. We encourage all our members to check out the events at Theatre Orangeville and include the Theatre in your entertainment options. You ll be glad you did! For more information about the Caledon Hills Bruce Trail Club see Photo by David Lloyd, Quadrant Leader Sign Vandalism Along the Trail By Joan Richard, Trail Coordinator Summer One of the less happy encounters for trail maintenance volunteers is vandalism. Apparently there are people who walk the trails carrying marker pens, or worse, and are ready to use them. One example encountered recently contains comments that could be responded to if made in a different medium, for instance to our website. I very much doubt that any member reading our newsletter is responsible for writing on the sign located on the main trail just east of McLaren Road and Puckering Lane, but here we go. Since at least the 1990s, our club volunteers have been unable to keep blazes along the entire stretch of Puckering Lane, a bit more than a kilometre. This could be 15 to 20 minutes of walking without seeing a blaze. Hikers new to the area find this disconcerting. Someone continually paints over them no matter how highly placed. The reference guide on page 15-1 states in bold, Note: Blazes and signs from the park stile to McLaren Rd may not be visible due to ongoing vandalism. We have been a little vaguer on the sign saying due to circumstances beyond our control. Perhaps we should have been more direct. But defacing a sign is also vandalism, just as much as painting out the blazes entirely. Not helpful and not appreciated. If you see someone defacing our signs or blazes or see a vandalized sign or blaze, take a picture if possible. Send it to me and tell me the location so we can deal with it promptly. As for Puckering Lane, it remains unblazed. A few years ago a new trail captain blazed it the weekend before the Thanksgiving End to End. The blazes were all removed before the event. Hence the sign, our effort to aid hikers.
