Yearsley, AICP, Acting Planning Manager Approval with condition Infill Site Visit: January 21, 2016 Property Description: The subject property is ±0.72 acres and is developed with a commercial building that has a gross floor area of 3,585 ft 2, three drive-thru lanes, and a parking area that contains 12 parking stalls. This building was constructed in 2002 and was previously occupied as a bank. The subject property has frontage along SE 41 st Street and SE 41 st Terrace, which are classified as local roads, and Del Prado Boulevard South, a major arterial. Currently, driveway access to the property is from SE 41 st Street and SE 41 st Terrace. The subject property has a Commercial/Professional (CP) future land use classification and a P-1 zoning designation. Properties north, south, and east of the subject parcel also share the same future land use and zoning designations. Immediately west of the subject parcel is a property with a Public Facilities (PF) future land use classification and Worship zoning that supports a church. The immediate surrounding

2 Page 2 of 4 SE January 28, 2016 area is primarily developed with commercial uses and a church located to the west of the subject parcel. The nearest single family home is located ±50 feet to the southwest of the subject site. Request: The applicant requests a Special Exception to utilize the existing building as a pharmacy, which will include one drive-thru lane. No major improvements to the site are proposed by the applicant. Most construction activities needed to accommodate the proposed use involves interior building renovations. Parking for supporting this use will be located to the north and south of the existing building, which collectively consists of 14 parking spaces. Analysis: The Planning Division has reviewed this application based on LUDR, Section 2.7.9, the P-1 District, and the five (5) standards outlined within Section 8.8.5a-e which covers special exceptions, and offer the following analysis for consideration: 1. Generally The subject property has P-1 zoning, which is consistent with the CP future land use classification. Pharmacy uses are allowed as a special exception within the P-1 District. The City defines a pharmacy as an establishment wherein the principal use is the dispensing of prescription and patent medicines and drugs and related products. The subject property is ±0.72 acres that is developed with a building that complies with the regulations of the P-1 zoning district. Based on the site plan submitted by the applicant, no major physical improvements to the site or building is proposed. 2. Compatibility The subject property is located along a commercial corridor, Del Prado Boulevard, which includes several nearby properties that support medical-related uses. The nearest residential property is located about 50 feet to the southwest of the subject parcel, across SE 41 st Terrace. According to the authorized representative, hours of operation for the pharmacy will be Monday through Friday, 9am to 5pm, and Saturday, 10am to 2pm. Since this establishment is not anticipated to have extended hours of operation, this use should not have a disruptive effect on residential or church uses in this area. According to the Institute of Transportation Engineers (ITE), the estimated trip generation level for the proposed pharmacy use is 348 trips a week. In comparison to traffic generated by the surrounding commercial uses, the proposed use is not likely to have a significant impact on current traffic conditions. Therefore, based upon the aforementioned factors Staff concludes that the special exception use will be compatible with the neighboring area.

3 Page 3 of 4 SE January 28, Minimum Lot Frontage; Access The subject property has ±104 feet of frontage along Southeast 41 st Terrace and ±98 feet of frontage along Southeast 41 st Street. In addition, the property has ±200 feet of frontage along Del Prado Boulevard. Driveway access currently exists from Southeast 41 st Terrace and Southeast 41 st Street. No additional driveways along either street is proposed. Within the subject site itself, an existing drive-up window along with two drive-thru lanes are located along the northern side of the building. The applicant proposes to utilize only one drive-thru lane, however, for the pharmacy. The building has a square footage of 3,585 ft², therefore a minimum of 18 parking spaces are required to support the proposed use. A total of 12 parking spaces exist on the subject property. Based upon the proposed site plan two additional parking spaces will be located to the north of the existing building; as a result, a total of 14 parking spaces will be provided. In a separate request, the applicant is also seeking a parking deviation (DE ) for a reduction in the number parking spaces required. This deviation can be administratively reviewed and approved by the DCD Director. 4. Building Location; Setbacks The applicant proposes to utilize the existing building with no expansions or major structural improvements. Based upon the site plan, the existing building meets the City s setback requirements for the P-1 District. 5. Screening and Buffering A site visit conducted by Planning Staff revealed that the subject property contains several mature trees. Landscaping on the site includes canopy and palm trees along the north, south, and west property lines. Shrubs are well established along the west property line but are relatively sparse in number along the east property line. Additional landscaping located near the building itself is also present on this property. The property was developed prior to the adoption of the most recent major revisions to the City s landscaping requirements in Therefore, since modifications to the existing building primarily consists of interior renovations, the subject property is exempt from the City s current landscaping requirements. However, the property is subject to the landscaping requirements that were in place at the time the building was established. Several trees and shrubs have been lost over time since the approval of the original landscaping plan for this development. Therefore, Planning Staff recommends that this site be brought into compliance with the landscaping plan that was approved in 2001.

4 Page 4 of 4 SE January 28, 2016 Recommendation: The Planning Division recommends approval of the request for a special exception with the following condition: 1. The property shall be brought into compliance with the approved Landscaping Plan, prepared by David M. Jones Jr. and Associates, Inc. dated All missing landscaping that was shown on this plan shall be installed and inspected by the City prior to the issuance of a certificate of use for the pharmacy. Public Notification This case will be publicly noticed as required by LUDR, Section as further described below. Publication: A legal ad will be prepared and sent to the New Press announcing the intent of the applicant to operate a pharmacy use as described within this report. The ad will appear in the News Press a minimum of 10 days prior to the public hearing scheduled before the Board of Zoning Adjustment and Appeals. Written notice: Property owners located within 500 feet from the property line of the subject property will receive written notification of the scheduled public hearing. These letters will be mailed to the aforementioned parties a minimum of 10 days prior to the public hearing scheduled before the Board of Zoning Adjustment and Appeals. Posting of a Sign: A sign will posted on the subject property a minimum of 10 days prior to the public hearing scheduled before the Board of Zoning Adjustment and Appeals.
