1 City of Burlington By-law Description A by-law to amend By-law , as amended, being a by-law for the regulation of traffic. Report TS-7-16 (DA-18-16)File Preamble Whereas pursuant to subsection 11(3), of the Municipal Act, 2001, S.O. 2001, c. 25, highways, including traffic on highways, is a sphere of jurisdiction assigned to an uppertier municipality non-exclusively and therefore, both the upper-tier municipality and its lower-tier municipalities have the power to pass by-laws under that sphere or part and; Whereas pursuant to subsection 27 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, a municipality may pass by-laws in respect of a highway only if it has jurisdiction over the highway and; Whereas pursuant to section of the Highway Traffic Act, R.S.O 1990, c. H.8, the Council of a municipality may by by-law designate a part of a highway under its jurisdiction as a community safety zone if, in the Council s opinion, public safety is of special concern on that part of the highway Now therefore the Council of the Corporation of the City of Burlington hereby enacts as follows: Content 1. Schedule 13 (Section 17) of By-law , as amended, is hereby repealed, and Schedule 13 to this by-law is substituted therefor. 2. No particular provision of this by-law shall become effective until the sign or marking applicable to such particular provision has been erected and is on display.
