4 OPEN SCORECARD GUIDE Introduction Oakland s Moment is Now 1 Oakland is a city with both a rich history of progressive politics and tremendous unrealized potential. The grassroots movements that have emerged from this city have been an inspiration to people around the world. Today, we are one of the most diverse and progressive communities in the country, but our political leadership does not always reflect the strong progressive values of our communities. Many politicians start out with promises to make Oakland a safe, affordable city. They often promise jobs and quality schools for working families, people of color, immigrants, youth, seniors, and all those whose needs are usually ignored. As time goes by, donations from big businesses and big developers cause many officials to abandon their progressive values. We only need to look at the poverty, homicide, and environmental health crises that have gripped Oakland to see that it is time for our city to change. But what can we do to change politics as usual? Many elected officials claim to represent progressive values, but how do the people of Oakland really know who is standing up for our communities? We can look at elected officials actions and votes. Which of our elected officials are taking the lead from the community by demonstrating leadership on progressive issues? Who is balancing the needs of the most vulnerable and marginalized communities with the need for economic development? The media and government have failed to keep the community informed about the critical decisions being made by our local elected officials. As a result, the community has formed a new network OPEN: the Oakland Progressive Empowerment Network.

5 OPEN SCORECARD GUIDE OPEN is a city-wide network of organizations that have come together to ensure that a truly progressive vision drives the future of Oakland. Each year, OPEN develops a Progressive Platform of policies that help make that vision a reality. We use our platform to create the OPEN Scorecard that tracks the votes and official actions of our leaders. The annual OPEN Scorecard is a way to keep Oakland residents informed about the key decisions made by our locally elected officials. The Scorecard lets the people of Oakland decide who are the real progressives and who are the pretenders. parents and youth; African Americans, Indigenous people, and other communities of color; labor, environmental, and immigrant justice advocates; and more. Currently, the combined members of OPEN represent more than 28,000 Oakland residents and more than 44,000 people in the region. If you aren t a member of a community organization, join one. 6 OPEN SCORECARD GUIDE OPEN Scorecard Point System In our first year, OPEN tracked the votes and official actions of the City Council in 2006 (for information about what the City Council does, see page 17). In future years, we will expand the OPEN Scorecard to include more decision-making bodies such as the Oakland School Board, the Mayor, the Planning Commission, the Port Commission, etc. We used the following criteria to determine which official actions would be included in the scorecard: The issue was reflected in the 2006 OPEN Progressive Platform. The issue was voted on or officially acted upon by the Oakland City Council. Elected officials who had been in office at least six months earned points by voting in favor of and/or publicly supporting the policies and values of the OPEN Progressive Platform. Elected officials earned points in three ways: Zero points for abstentions, absences, or votes that did not support the OPEN Progressive Platform. One Point for votes that supported the OPEN Progressive Platform. One Bonus Point for authoring, introducing, publicly endorsing, or implementing OPEN policies; bonus points were also earned when a motion and second motion were made to defeat a policy OPEN opposes. OPEN GRADING SYSTEM The highest scoring elected official established the top of the grading scale. 8 OPEN SCORECARD GUIDE Protect and Restore the Environment Limiting the Use of Styrofoam PASSED Food Service Ware Ordinance Seven City Council members voted Yes, and one opposed this resolution, on June 27, Polystyrene, more commonly known as Styrofoam, is not biodegradable or compostable. It is also produced using petroleum products, and research shows that cancer-causing toxins from a Styrofoam container can leach into the food or drink it s holding 1. This resolution prohibits restaurants and other food vendors in Oakland from using Styrofoam containers, cups, or trays to pack their prepared food. Instead, prepared food must be stored in safe, biodegradable or compostable products (exceptions will be allowed if the City Administrator proves there are no affordable alternatives). This ordinance passed the City Council with a 7 1 vote. Jean Quan and Ignacio De La Fuente each earned a Bonus Point for introducing this policy. 9 Reducing Oil Usage OPEN SCORECARD GUIDE PASSED Resolution for an Oil Independent Oakland by 2020 Task Force All City Council members voted Yes on this resolution on December 5, Burning fossil fuels is one of the main causes of global warming, and as such our oil consumption threatens the living conditions of present and future generations. Climate research shows that the ten hottest years in recorded history have all happened in the last fifteen years 2. Oil, and U.S. dependence on oil, also plays a major role in international peace, politics, and security. To address these issues, the City Council unanimously passed a resolution to create a task force that will research and make recommendations for significantly reducing local oil usage by the year Nancy Nadel earned a Bonus Point for introducing this resolution. 10 OPEN SCORECARD GUIDE Protect and Restore the Environment Decreasing Waste PASSED Zero Waste Resolution Six City Council members voted Yes, and two were absent, on March 7, Over the past several decades, we have massively increased the amount and toxicity of our waste. Simultaneously, local governments have found it more expensive, complicated, and hazardous to dispose of these large volumes of waste. With this resolution, the City Council adopted a Zero Waste by 2020 goal for the City of Oakland. Zero Waste means designing products that can be repaired, reused, or recycled. It also means that the manufacturer of a product must take responsibility for the life of a product from its production to its use to its disposal and ensure that it is not a threat to human health or the environment 3. This resolution is part of an emerging movement to position Oakland as a leader in the Green Economy, combining the goals of environmental sustainability, economic growth, and job creation. 11 Toxic Cleanup in Uptown OPEN SCORECARD GUIDE PASSED Brownfields Grant Program for Environmental Remediation of the Fox Courts Site in the Uptown Area On September 19, 2006, all City Council members voted Yes to accept this cleanup grant. It has been widely documented that poor people of color bear more of the brunt of pollution and environmental toxins at school, home, and in the workplace. What does this mean for Oakland families? In West Oakland, for example, it means seven times higher rates of hospitalization for children with asthma, increased lead poisoning, and three times the amount of illegally dumped garbage 4. This resolution accepts $200,000 from the Environmental Protection Agency to clean up hazardous materials around San Pablo Avenue, 18th and 19th Streets, and Telegraph Avenue. 12 OPEN SCORECARD GUIDE Responsible Development The Oak to Ninth Housing Development PASSED Oak to Ninth Community Benefits Agreement All City Council members voted Aye on this agreement on July 18, Like many urban centers, Oakland must balance the critical need for affordable housing with environmental protection and economic growth. The Oak to Ninth housing development is situated on prime waterfront land and embodies these multiple community priorities. The project has been the subject of heated debate and illustrates the vast complexity of local laws, funding, and development. It also highlights the lack of guiding principles or process for equitable and genuine community engagement with city officials and developers. The City Council unanimously passed the Community Benefits Agreement, stating that the land will be sold at below-market rates to Oakland Harbor Partners, LLC. The agreement requires the project to include 465 housing units priced for low- and extremely low-income seniors and families and to provide 300 entry-level construction jobs for Oakland residents. $1.65 million will also be provided for job training in the building trades to immigrants and individuals who have been formerly incarcerated. The Oak to Ninth Community Benefits Agreement is the result of years of organizing and the participation of more than 700 residents from the Eastlake and San Antonio neighborhoods. It addresses questions such as: What do we want our waterfront to look like in 5 10 years? How can a city fairly demand that developers share in both the burden and rewards of a development project? While many progressive organizations came to support the Oak to Ninth Community Benefits effort, disagreement arose over different demands. Because of the lack of consensus on this issue within the OPEN Network, we have not designated the correct vote." Important lessons about how to build a diverse progressive movement have been, and continue to be, learned from this effort. 13 Preserving Industrial Land and Quality Jobs OPEN SCORECARD GUIDE NOT PASSED Industrial Land Policy On September 19, 2006, seven City Council members voted to allow the Planning Commission to go through its due process; one Council member opposed. Manufacturing and industrial activities have historically been a source of high quality jobs in Oakland, particularly for workers without formal education or training 5. With the recent housing boom, there has been increased pressure on the City Council to allow residential developers to convert industrial land for residential development. Already, several thousand units of housing have been approved for construction on formerly industrial land. In the fall of 2006, the City Council attempted to pass the Industrial Land Policy, which would have allowed them to skip over the Planning Commission s usual process for studying and publicly considering the conversion of certain industrial areas of the city. Due to pressure from progressive organizations and community residents, the City Council did not bypass the Planning Commission s Process. Seven City Council members voted to allow the Planning Commission to go through its due process. Jean Quan and Nancy Nadel each earned a Bonus Point for making and seconding the substitute motion that sent this industrial land policy back to the Planning Commission. Later the Council withdrew this item entirely. 14 OPEN SCORECARD GUIDE Responsible Development Enforcing Oakland s Local Hiring and Contracting Policy When the City of Oakland contributes public money to a development project, there are requirements about hiring and training local residents and contractors. This ensures that our tax dollars are being used to help Oaklanders. The policy s minimum requirements 6 of development projects include: 50% of the workforce hours must be worked by Oakland residents. 20% of the hiring uses local, small, and certified firms. 15% of the total work hours are worked by Oakland apprentices. City Council member Nancy Nadel earned a Bonus Point for enforcing the implementation of local hiring and contracting requirements for the Uptown Project, a development project that received $60 million from the city. In July 2006, Nadel requested a review by the City Administrator s Contract Compliance and Employment Services Division. Voting by the City Council was not necessary on this matter, because Nadel was enforcing an already existing policy. In accordance with the OPEN scoring system, she earned a Bonus Point for implementing a policy endorsed by the OPEN Platform. 15 Affordable Housing OPEN SCORECARD GUIDE Creating New Affordable Housing NOT PASSED Inclusionary Housing Requirement A resolution to create a Blue Ribbon Commission was passed instead on October 31, There is an affordable housing crisis in Oakland. A study by the City s Housing Element shows 7,700 homes need to be built, and 3000 of these homes need to be affordable to low- and very low-income people 7. But history shows us that most for-profit or market rate developers do not build affordable housing units unless they are required to by the city. It would have required that 15-20% of the total units in future developments be affordable to low- and moderateincome families. In February 2006, Nancy Nadel earned a Bonus Point for inviting recommendations from Oaklanders for Affordable Housing, the community coalition advocating for this policy. Before the City Council could vote, Desley Brooks introduced a substitute motion to create a Blue Ribbon Commission to study the policy further, delaying the vote. Four City Council members voted for inclusionary housing, creating a tie. Mayor Jerry Brown cast the deciding vote in favor of a Blue Ribbon Commission. 16 OPEN SCORECARD GUIDE AFFORDABLE HOUSING ADDENDUM Though not explicitly on the 2006 OPEN Progressive Platform, we are including the following two affordable housing issues because of their alignment with OPEN s values and commitment toward preserving and creating more affordable housing in Oakland. Affordable Housing for Chinatown Seniors In 2003, the owner of the Pacific Renaissance Plaza in the heart of Chinatown, attempted to evict the predominantly low-income elderly tenants of 50 affordable housing apartments. This was devastating to the elderly tenants who relied on the linguistic and cultural accessibility of medical and social services provided within Chinatown. The investigation into the eviction ultimately uncovered illegal and highly unethical activities by the Pacific Renaissance developers. Tenants and community members initiated a lawsuit to demand justice, and a community advocacy campaign resulted in a separate lawsuit by the City of Oakland. In May 2006, the City Council voted in closed session on a tentative settlement agreement negotiated between the City, the community and tenant plaintiffs, and the Pacific Renaissance developers. Because the vote occurred in closed session, we don t know how each Council member voted. 17 OPEN SCORECARD GUIDE Keeping Oakland Affordable and Diverse NOT PASSED Changes to Conversions to Homeowner Condominiums Laws On December 5, 2006, this item was taken off the City Council agenda and forwarded to the Blue Ribbon Commission. Oakland s current condo conversion law states that for every apartment that is converted into a condo and sold, a new rental apartment needs to be created (except for buildings with less than four units). This helps ensure there is a stable supply of rental homes in Oakland. In 2006, over 300 units were converted from rental housing and sold as condos for an average price of $350, ,000, much higher than average renters can afford. The revised ordinance would have allowed landlords to convert up to 800 apartment units without building any new rentals by paying a fee of about $10,000-$15,000 per unit. This fee would cover only 10% of the cost to build new rental homes. Because condo conversions do not create affordable homeownership opportunities for Oakland renters, this revised ordinance, if passed, would have generated a wave of evictions and displacement. Nancy Nadel and Jean Quan each earned a Bonus Point for their public positions against the changes to the Conversions to Homeowner Condominiums law. After hearing tremendous concern from the community, this item was pulled off the agenda and forwarded to the Blue Ribbon Commission. All eight City Council members voted in favor of sending it to the Blue Ribbon Commission. We are not issuing points for this vote because the proposed changes to the condo conversion ordinance would be harmful to Oaklanders and should not be considered by the City Council. 18 OPEN SCORECARD GUIDE Clean Government More Voters, More Justice PASSED Instant Runoff Voting Six voted in favor of placing Instant Runoff Voting on the ballot, two voted against, on July 19, Low voter turnout often reflects alienation and disenfranchisement from the political system; this is a critical issue across the U.S., particularly in communities of color. In the June 2006 primary election, California suffered its lowest voter turnout in 25 years. Less than 30% of the eligible voting population made decisions for all of California 8, and some of Oakland s elected officials won with as low as 29% support from voters 9. Instant Runoff Voting (IRV) is a system that allows increased voter participation and ensures that our elected officials have majority voter support. It allows voters to rank candidates in order of preference (for example, a first choice, second choice, and third choice), so that a majority winner can be determined in one election (instead of the usual two for city elected officials). Oakland voters passed Measure O in November 2006, mandating that all city-level (not county) elections implement IRV. This will eliminate the spring primary, electing Oakland officials solely through the November general election. This will ensure higher voter turnout since an average of 55% more people vote in November than in June. IRV also saves money Oakland will save between $140,000 and $225,000 per year with one less election 10. 19 Clean Government OPEN SCORECARD GUIDE Curbing Corruption in Elections NOT PASSED Proposition 89, Clean Money and Fair Elections Initiative This initiative did not pass. It received about 26% support. The Oakland City Council did not publicly take positions on this proposition, and therefore no points were earned. Corruption between politicians and big businesses who seek to win favor through big contributions has dirtied politics and demoralized voters more than ever. The California Nurses Association launched a statewide Clean Money and Fair Elections initiative as an important step in remedying this problem. This initiative, known as Proposition 89, would have required candidates to collect a minimum number of $5 contributions and signatures (for example, 750 for a State Assembly candidate, 25,000 for a candidate for governor). Candidates would have agreed not to accept private money and once qualified, clean money candidates would have received a baseline amount to run their campaign. Increasing corporate taxes from 8.84% to 9.04% would have raised the funds to publicly finance candidate campaigns. 16

20 OPEN SCORECARD GUIDE What Does the City Council Do? Oakland s City Council is the legislative branch of local government and is responsible for responding to the collective will of the people. A responsive City Council person will spend a lot of their time in meetings with community residents, local business people, and other people from their district and throughout the city, listening to problems and brainstorming solutions together. Recibió como el 26% del apoyo. Los miembros del Consejo Municipal de Oakland no tomaron posiciones públicas sobre esta proposición, y por lo tanto ninguno de ellos ganó puntos. La corrupción entre los poíticos y los negocios grandes que buscan favores a cambio de sus donativos ha ensuciado la política y ha demoralizado a los votantes más que nunca. La Asociación Califomiana de Enfermeras ha lanzado por todo el estado una proposición llamada EI Dinero Limpio y Las Elecciones Justas como un paso importante para corregir este problema. La ley actual de Oakland referente la conversión a condomínios declara que por cada departamento convertido en un condomínio y vendido, hay que crear un departamento nuevo para alquilar (con excepción de los edificios con menos de cuatro unidades). Esto ayuda a asegurar que exista una fuente estable de hogares para alquilar en Oakland. En el 2006, más de 300 unidades se convirtieron de viviendas rentadas y se vendieron como condomínios por el precio promedio de $350,000 $400,000, representando mucho más dinero de lo que disponen los inquilinos comunes. 32 Conservar el Terreno Industrial y los Empleos de Calidad NO APROBADA La Política para el Terreno Industrial El 19 de septiembre del 2006, siete miembros del Consejo Municiapl votaron para permitir que la Comisión de Planificación llevara a cabo su proceso debido; un miembro del Consejo se opuso. Las actividades industriales y fabricantes han sido una fuente de empleos de alta calidad en la historia de Oakland, sobre todo para los trabajadores sin educación ni entrenamiento formal 5. Con la reciente demanda alta de viviendas, el Consejo Municipal ha sentido más presión para permitir que los urbanizadores conviertan el terreno industrial en terreno para desarrollar las viviendas. Varias miles de unidades ya han sido aprobadas para construirse en terrenos designados anteriormente sólo para uso industrial. En el otoño de 2006, el Consejo Municipal intentó aprobar la Política del Terreno Industrial, que les hubiera permitido eliminar el proceso normal de la Comisión de Planificación para estudiar y hablar públicamente acerca de la conversión de ciertas áreas industriales de la ciudad. El desarrollo de viviendas de las calles Oak a la Nueve está ubicado sobre terreno ribereño excelente é incorpora a estas prioridades multiples de la comunidad. El proyecto ha sido el tema de discusiones apasionadas, é ilustra lo complicado que son las leyes, los fondos, y el desarrollo. También llama la atención a la falta de princípios para guiarnos, y de un proceso para la colaboración equitativa y genuina de la comunidad con los oficiales de la ciudad y los urbanizadores. El Consejo Municipal aprobó por unanimidad el Acuerdo de Beneficios para la Comunidad, declarando que el terreno se venderá a precios por debajo del mercado a la Sociedad del Muelle de Oakland, LLC. El arreglo requiere que el proyecto incluya 465 unidades de viviendas a precios alcanzables para las familias y los mayores de edad de bajos y extremamente bajos ingresos, y para proveer 300 empleos de entrada en la construcción para los residentes de Oakland. También se proveerá $1.65 millones de dolares para entrenar en los oficios de construcción a los inmigrantes y a los indivíduos que han sido anteriormente encarcelados. Ha sido ampliamente documentado que las personas pobres de color aguantan lo más récio de la contaminación y las toxinas ambientales en la escuela, el hogar, y el trabajo. Qué significa ésto para las familias de Oakland? En Oakland del oeste, por ejemplo, significa tazas siete veces más altas de hospitalización para los niños con el asma, un aumento del envenanmiento del plomo, y tres veces más la cantidad de basura tirada ilegalmente 4. Esta proposición acepta $200,000 de la Agencia para Proteger al Medio Ambiente para limpiar los materiales peligrosos cerca de la Avenida San Pablo, las Calles 18 y 19, y la Avenida Telegraph. 37 LA GUÍA DE LA TARJETA DE PUNTAJE DE OPEN Proteger Y Restaurar El Medio Ambiente Limitar el Uso del Icopor APROBADO El Decreto para Envases de Servicio de Comida Siete miembros del Consejo Municipal votaron Sí", y uno se opuso a esta proposición, el 27 de junio del Polistirena, conocido más comunmente como el Icopor, no es biodegradable, ni tampoco es convertible en abono. También se produce utlizando los productos petroleros, y las investigaciones demuestran que las toxinas que causan el cancer en el embalaje del Icopor, pueden contaminar a la comida y la bebida que contiene 1. Esta proposición prohibe a los restaurantes y a los vendedores de comida en Oakland utilizar los contenedores, las tazas, ó las bandejas del Icopor para empacar la comida preparada. Como alternativo, la comida preparada debe guardarse en productos seguros, biodegradables, ó convertibles en abono (se permitirán excepciones si el Administrador de la Ciudad compruebe que no hay alternativas económicas). 39 LA GUÍA DE LA TARJETA DE PUNTAJE DE OPEN El Sistema De Puntos en la Tarjeta de Puntaje de OPEN En nuestro primer año, OPEN viligiló los votos y las acciones del Consejo Municipal del 2006 (para información acerca de lo que hace el Consejo Municipal, véase la página 17). En los años por venir, ampliaremos la Tarjeta de Puntaje de OPEN para incluir a más organizaciones que toman decisiones como la Junta Escolar de Oakland, el Alcalde, la Comisión de Planificación, la Comisión del Puerto, etc. Utilizamos la siguiente critéria para determinar cuales de las acciones oficiales serían incluidos en la Tarjeta de Puntaje: EI asunto fué tratado en el Programa Electoral Progresiva de OPEN del EI asunto se votó, ó el Consejo Municipal actuó oficialmente para tratarlo. Los oficiales quienes habían estado en sus puestos durante por lo menos seis meses ganaron puntos al votar a favor de y/o al apoyar públicamente a las políticas y a los valores de la Plataforma Electoral Progresiva de OPEN. Los oficiales elegidos ganaron puntos de tres maneras: Zero Puntos por las abstenciones, las ausencias, ó los votos que no apoyaron al Plataforma Progresiva de OPEN. Un Punto por los votos que sí apoyaron al Programa Electoral Progresiva de OPEN. Un Punto Bono por escribir una moción, someter una moción a votarse, ó apoyar públicamente a las políticas de OPEN. Los puntos bonos también se ganaron al someter una moción y apoyarla para derrotar una política a la cual OPEN se oponía. Sistema de Calificaciones de OPEN El oficial elegido con la calificación más alta estableció la cima de la escala. Los movimientos populares que han surgido de esta ciudad han servido como una inspiración a la gente alrededor del mundo. Hoy, nuestra comunidad es entre las más diversas y progresivas el el país, pero nuestro liderazgo no refleja siempre los fuertes valores progresivos de nuestras comunidades. Muchos políticos empiezan con promesas para convertir a Oakland en una ciudad segura y económica. Acostumbran prometer empleos y escuelas de calidad a las familias que trabajan, a la gente de color, a los inmigrantes, a la juventud, a los mayors de edad, y a todos los cuyas necesidades normalmente se ignoran. Al pasar el tiempo, los donativos de los negocios y los urbanizadores grandes causan a muchos oficiales abandonar a sus valores progresivos. Sólo basta mirar la pobreza, el homicidio, y la crísis de salúd del medio ambiente que han afligido a Oakland para ver que ya es tiempo para que nuestra ciudad cambie. Pero qué se puede hacer para hacer un cambio de la política rutina? Muchos oficiales elegidos dicen representar a los valores progresivos, pero cómo sabe la gente de Oakland quienes realmente están protegiendo a nuestras comunidades? Podemos mirar las acciones y los votos de los oficiales elegidos: Cuáles de nuestros oficiales elegidos están tomando la delantera de la comunidad al demostrar el liderazgo en los asuntos progresivos?
