This letter describes the assessment requirements for flora and fauna in relation the above development. The land has previously been cleared of most native vegetation for agricultural purposes and only scattered regrowth and occasional remnant paddock trees remain. threatened ecological communities or threatened flora or their habitat were observed during the site inspection. One threatened bird species, being Pomasmus temporalis temporalis (Grey-crowned Babbler), which is listed as ulnerable under the NSW Threatened Species Conservation 1995 ( ) was observed within the road reserve vegetation along Hoad Lane adjacent the subject site. Based on results from the deskp review, site investigation and impact assessments, the proposal will not result in a significant impact on threatened species, populations or ecological communities listed under the or the Commonwealth Environmental Protection and Biodiversity Conservation 1999 ( ). Therefore, a Species Impact Statement and a referral the Commonwealth is not. 2 1 Methodology The subject site (Figure 1) is defined as the area likely be directly impacted by the proposal, whereas the study area is defined as the subject land and any surrounding lands which maybe be indirectly impacted. The locality is defined as the land within a 5 km radius of the subject land. 1.1 Literature review and database search A database search of the BioNet Atlas of NSW Wildlife and Protected Matters Search Tool was conducted in January 2017 identify state and federally listed threatened and migrary species previously recorded, or considered potentially in the study area. An area within a 5 km radius of subject land searched for records of state and federally listed threatened species. An assessment of the likelihood of rence for the threatened and migrary species identified in the database searches was made and was used guide the site inspection. Aerial phography of the study area was used identify landscape features, the extent of vegetation cover, and guide the site inspection. 1.2 Site inspection A site inspection was undertaken by ELA Ecologist Lily Gorrell, on 3 rd February 2017 assess the ecological values present and the potential impact of the proposed works on flora and fauna within the subject site. The site inspection involved a random meander of the subject site validate previous vegetation mapping and record any important flora or fauna habitat features (such as hollow-bearing trees, scats/scratches). A list of flora and fauna species identified during the site inspection is provided in Appendix A. A final assessment of the likelihood of rence was completed following the site inspection which was based on database or other records, presence or absence of suitable habitat, features of the study area, results of the site inspection and professional judgement (Appendix B). 6 2 Results 2.1 Literature review and database search Seven (7) threatened ecological communities (TECs) were identified within 5 km of the study area. Records of 13 threatened flora species and 73 threatened fauna species were returned by the BioNet Atlas of NSW Wildlife. The database results have been considered in a likelihood table (Appendix B) which assesses the potential for those threatened and migrary species on the subject site and be impacted by the proposed works. Based on the likelihood of rence analysis, the following fauna species were identified as potentially ring within the study area: Phascolarcs cinereus (Koala) Pomasmus temporalis temporalis (Grey-crowned Babbler). 2.2 Site inspection egetation The majority of native vegetation within the study area has been previously cleared and the present vegetation is dominated by cropping pasture species. A few scattered, isolated paddock trees comprising of Eucalyptus populnea (Poplar box) were present. A list of flora species observed on the subject site is provided in Appendix A, however this is not an exhaustive list as full flora surveys were not undertaken as part of these works. Of the threatened flora identified in the database review, none were considered on site due the degraded condition of the soil and persistent and extensive cropping. Approximately 95% of the subject site comprised of cropping land (Plate 1) consisting of Triticum sp. (Wheat) and various exotic woody herbs such as Lepidium africanum (Common Peppercress), Sida rhombifolia (Paddy s Lucerne), Aster subulata (Aster Weed), Conyza sumatrensis (Tall Fleabane) and erbena officinalis (Common erbena). A small portion of the site (5%) along the southern boundary bordering Hoad Lane comprised of a few native species interspersed with the above exotic woody herbs and included Euchin sphaericus (Star Cudweed), Wahlenbergia sp. (A Bluebell) and Xerochrysum viscosum (Sticky Everlasting), Austrodanthonia sp. (Wallaby grass) and ittadinia sp. (A Fuzzweed). Canopy species present included four mature E. populnea (Poplar Box) as isolated paddock trees and a scattered semi-mature and juvenile E. populnea along the south-western corner of the site (Figure 2) (Plate 2). Along the eastern fenceline, the species Lycium ferocissimum (African Boxthorn) is present. This species is a Class 4 xious Weed within Gunnedah Shire Council under the xious Weeds Under this act the growth of the plant must be managed in a manner that continuously inhibits the ability of the plant spread and the plant must not be sold propagated or knowingly distributed. Locally Controlled Weed. Site investigations confirmed that due the composition of the vegetation present, no threatened ecological communities listed under the or within the study area. Page 6

8 2.2.2 Fauna During the site inspection three fauna species were identified including Corcorax melanorhamphos (White-winged Chough), Cracticus tibicen (Australian Magpie) and the listed ulnerable species Grey-crowned Babbler. This species was observed in a group of approximately eight individuals within vegetation located outside of the site within the road reserve along Hoad Lane. As E. populnea is considered be a Koala feed tree, the site was surveyed so as identify presence of these species, however no evidence of scats or scratches were observed on any of the trees within the subject site, or along Hoad Lane. Based on the understanding of the habitat values at the site, a list of threatened species known or with potential utilise the study area either regularly or on occasion is provided in Appendix B. 2.3 Impact Assessment Following the site inspection, it was determined that any impacts highly mobile species or species that use the habitat intermittently would be considered minimal due the highly modified nature of the area and small size of the impact area. Additionally, the location for the proposed Chemical Industries and Works (Precursor Facility) has been situated so as avoid clearing of any trees within the paddock (Figure 2 and Figure 3). Due the scale and type of facility proposed, it is likely that security fencing will be constructed directly around the facility for safety purposes and as a means limit fauna from accessing the site. Marginal foraging habitat is present within the subject site, mainly comprising of the E. populnea trees, however based on the current development footprint, these trees are remain and will continue provide potential foraging resources for threatened fauna such as Koala and a range of other highly mobile threatened species likely utilise the site such as Grey Crowned Babblers. As such, no Assessment of and Significant Impact Criteria Assessment have been undertaken for and listed species as the impact these species and their habitat is considered minimal. Indirect impacts may include short term noise impacts in the general locality of the subject site which are considered be minimal. 2.4 Mitigation measures The following safeguards are designed minimise or mitigate the potential impacts of the proposed works on native vegetation, or any potential threatened species with potential in areas adjacent works, and include: ensure protection of native vegetation outside of the construction footprint. Limit construction duration where possible reduce indirect impacts native fauna. control of noxious weeds prior development avoid the spread of these in adjacent native vegetation, specifically management of African Boxthorn present within the subject site. 12 Appendix B Appendix B: rence An assessment of likelihood of rence was made for threatened and migrary species identified from the database search. Five terms for the likelihood of rence of species are used in this report. This assessment was based on database or other records, presence or absence of suitable habitat, features of the proposal site, results of the field survey and professional judgement. The terms for likelihood of rence are defined below: yes = the species was or has been observed on the site likely = a medium high probability that a species uses the site potential = suitable habitat for a species s on the site, but there is insufficient information categorise the species as likely, or unlikely unlikely = a very low low probability that a species uses the study area, and no = habitat on site and in the vicinity is unsuitable for the species. An assessment of significance was conducted for threatened species or ecological communities that were recorded within the study area or had a higher likelihood of ring and were not recorded during the site visit. It is noted that some threatened fauna species that are highly mobile, wide ranging and vagrant may use portions of the study area intermittently for foraging. For these fauna species, the habitat present and likely be impacted is not considered be important the threatened species, particularly in relation the amount of similar habitat remaining in the surrounding landscape. As such, an assessment of significance in reference State or Commonwealth legislation was not considered necessary te, that assessments for the likelihood of rence were made both prior field survey and following field survey. The pre-survey assessments were performed determine which species were affected species, and hence determine which sorts of habitat look for during field survey. The post-survey assessments determine final affected species were made after observing the available habitat in the study area and are depicted in the table below. The information provided in the habitat association column of the table below has been obtained from the NSW Threatened Species Profiles and Protected Matters Search Tool. Page 12

Other tree species may in the tree canopy but are not dominant, including Acacia salicina (Cooba), Acacia stenophylla (River Cooba), Casuarina cristata (Belah), Eremophila bignoniiflora (Eurah), Eucalyptus camaldulensis (River Red Gum) and Eucalyptus populnea (Bimble Box). The mid or shrub layer may or may not be present. Ground cover lifeforms typically comprise native graminoids, other herbs, chenopods and other low shrubs that are typically under 50 cm tall. Fuzzy Box Woodland on alluvial Soils of the South Western Slopes, Darling Riverine Plains and Brigalow Belt South Bioregions E3 Tall woodland or open forest dominated by Eucalyptus conica (Fuzzy Box), often with Eucalyptus microcarpa (Grey Box), Eucalyptus melliodora (Yellow Box), or Brachychin populneus (Kurrajong). Allocasuarina luehmannii (Buloke) is common in places. Shrubs are generally sparse, and the groundcover moderately dense, although this will vary with season. Inland Grey Box Woodland in the Riverina, NSW South Western Slopes, Cobar Peneplain, Nandewar and Brigalow Belt South Bioregions E3 E Fertile soils, often of Tertiary and Quaternary alluvial origin. Generally s where average annual rainfall is mm. Includes those woodlands in which the most characteristic tree species, Eucalyptus microcarpa (Inland Grey Box), is often found in association with E. populnea subsp. bimbil (Bimble or Poplar Box), C. glaucophylla, B. populneus, A. luehmannii (Bulloak) or E. melliodora (Yellow Box), and sometimes with E. albens (White Box). Shrubs are typically sparse or absent, although this component can be diverse and may be locally common, especially in drier western portions of the community. A variable ground layer of grass and herbaceous species is present at most sites. Site not representative of this community. Myall Woodland in the Darling Riverine Plains, Brigalow Belt South, Cobar Peneplain, Murray- Darling Depression, Riverina and NSW South Western Slopes bioregions E3 E Typically, it s on red-brown earths and heavy textured grey and brown alluvial soils within a climatic belt receiving between 375 and 500 mm mean annual rainfall. The structure of the community varies from low woodland and low open woodland low sparse woodland or open shrubland. The tree layer grows up a height of about 10 metres and invariably includes Acacia pendula (Weeping Myall or Boree) as one of the dominant species or the only tree species present. The undersrey includes an open layer of chenopod shrubs and other woody plant species and an open continuous groundcover of grasses and herbs. Site not representative of this community. Page 14

Semi-evergreen ine Thicket in the Brigalow Belt South and Nandewar Bioregions E3 E In NSW, s mainly on hills and flattish footslopes, on deep, loamy, high nutrient basaltic soils and sandy loams. Dominated by a variety of low tree and shrub species. Characteristic canopy species include Elaeodendron australe var. integrifolium (Red Olive Plum), Ehretia membranifolia (Peach Bush), Geijera parviflora (Wilga), telaea microcarpa (Native Olive), Pouteria cotinifolia var. pubescens (Yellow Lemon) and Pitsporum spinescens (Wallaby Apple).
