8 Introduction The Right to Information and Protection of Privacy Act (RTIPPA) is a provincial law that came into force on September 1, 2010, replacing the Right to Information Act and the Protection of Personal Information Act. RTIPPA gives people the right to request access to information held or controlled by public bodies. It also provides privacy protection by placing on public bodies obligations regarding the collection, use, disclosure and retention of personal information. As such, RTIPPA aims to strike a balance between the public s right to know and individuals right to privacy. Definition of Public Body RTIPPA applies to most publicly-funded bodies within the New Brunswick provincial public sector. These are called public bodies in the Act and include: Departments, Secretariats and Offices of the Provincial civil service; Schools, School Districts, and District Education Councils; Regional Health Authorities and other health care bodies; Agencies, Boards, Commissions, and Crown Corporations; Universities and Community Colleges; Municipalities, Municipal Police Forces, Local Service Districts, Rural Communities, and other local government boards and commissions. RTIPPA specifically excludes the following New Brunswick bodies from the scope of the Act: the office of a Member of the Legislative Assembly; the office of an Officer of the Legislative Assembly; the Court of Appeal of New Brunswick, the Court of Queen s Bench of New Brunswick, or the Provincial Court of New Brunswick. In addition, publicly-funded organizations within New Brunswick that come under federal jurisdiction, such as the RCMP J Division, are covered by the federal Access to Information Act (R.S.C., 1985, c.a-1) and the federal Privacy Act (R.S.C., 1985, c.p-21), not RTIPPA. Similarly, the federal Personal Information Protection and Electronic Documents Act (S.C.2000, c.5) would apply to all private organizations in the province, including business, non-profits, and professional organizations. Contacts within Public Bodies Each public body has a Head who is responsible for all decisions made under RTIPPA relating to their public body. Public bodies will also often designate a staff member to serve as Coordinator to assist the head in the day-to-day administration of the Act. It is the Coordinator who is usually responsible for processing individual information requests. The Coordinator also serves as the main point of contact between right to information applicants and the public body. This Directory of Public Bodies provides information for anyone wishing to contact a specific New Brunswick public body on access to information and protection of privacy related issues. Wherever possible, the name of a designated Coordinator is given. If this information is not available, anyone contacting the public body should emphasize that the issue relates to the Right to Information and Protection of Privacy Act this will help ensure that the matter is quickly transferred to the proper staff member.
