4 I hope you remember me as you were helping me by informing me to wait on receiving from you my Letter of Determination (for which I already paid a couple years ago) due to the fact that Supervisor Chiu introduced legislation which, if passed, would be a godsend to my 1887-built-for -a-hundred-years-legally commercial building it was de-zoned for commercial use by the planning commission back in the day when they didn t value the charm of mixed use buildings and neighborhoods - approximately 1979-ish. Since that time, thankfully, it is my understanding that Planning has been influenced by Architectural Historians who now, nearly to a man, say that in cities all over the world everybody s favorite neighborhoods to visit are the mixed use ones such as our own beloved North Beach. Anyway, did the legislation pass which was introduced to allow a building which had once been built for legal commercial use and had never been modified to residential or other to regain it s former permitted commercial status? PLANNING OEPP,RTMENT Dear Sirs, BL 4260/!-T C-Oi I am hoping to reinstitute the commercial zoning which was in force at 1300 Rhode Island Street from 1887 until 1979 at which time, the elderly couple (in their 70's & 80's) the Rasmussens, were told by the City that their zoning was being taken away from them. They were not educated in matters to do with such a sweeping change and how to protect themselves and their property from it. Mr. Rasmussen's own father built the first floor of 1300 Rhode Island Street as a Saloon in 1887, with a 'game' room and stables next door. Around the time of Prohibition, the Business was changed to a Corner Market to serve the neighborhood's grocery needs. When the Planning Dept decided to take away the charming mixed use of the Potrero Hill area where 1300 Rhode Island St is located, the elderly Rasmussen's didn't know how to fight it. The commercial zoning lapsed. In 1987 they sold their building to me after it had been in their family for one hundred years. Their Realtor represented it to me as a Commercial Building. I believed him. Only when I went to open up a Sidewalk Cafe with the famous Enrico Banducci as my partner was I told the building was no longer zoned commercial. I was shocked! It sure looked like a commercial building. I got over my disappointment and went on with my life. I rented the building to others
8 and moved home to live next door to my mother on the north side of town. A tenant of mine set the five adjacent garages on fire working on his car. During the permit process, I was cruelly fought by my neighbor, Jon Pon who did not want me to rebuild my garages. During the permit fight, which I won, the issue of the "3" unit building came up as the Storefront had never been 'rezoned' after its ninety plus years of legal commercial use was taken away from it's elderly owners. The Storefront was just in some kind of "no man's zone". Mr. Passmore wrote on the initial 1995 permit that it could only be used for Storage "until further review". Jim Miller wrote that the Storefront could be annexed into the upper apt by use of an existing interior staircase, be made part of that residential unit and be used as to house a business as long as a) the business was owned by the person(s) who lived upstairs and b) there was no sign put out. I had a few tenants along the way who intended to open up a Gallery to show Art and to have Private Parties inviting people to come see the art for sale. Another one who wanted to have a private yoga lesson studio. Another one who wanted to have "house parties" for jazz musicians, dutch treat where each person coming to the party paid into a pot to cover the musicians (there were other ideas too). Recently along came a lovely lady who along with living upstairs intends to open a Pet supply service, delivering for free, pet food and supplies to residents of Potrero HilL. She has obtained her Business License, is busy beautifying the interior of the Storefront, being congratulated by her friendly neighbors etc. But ohh, ohh: Along comes my adversarial neighbor Jon Pon tellng her she cannot open her Pet Supply delivery service. I clearly remember Jim Miller saying a business
9 could be housed there IF it belonged to the upstairs resident and IF no sign was put out. I went to Planning today in hopes of helping to protect her from this neighbor. To my great disappointment I was told that Jim Miller (who was familiar with my case) had retired two months ago. Mr. Passmore also is retired. Therefore i am writing this request for a Letter of Determination. I am hoping to ask you to reconsider the taking away of the commercial use permit of the Storefront at 1300 Rhode Island way back in 1978 and to consider re-instating that very zoning which it had from 1887 until then. I recently saw a show on PBS extolling the virtues of mixed-use commercial/residential districts. The architectural historian who was hosting the documentary stated in so many words that in "everybody's favorite cities" throughout the world, "everybody's favorite neighborhoods" are always the Mixed Use neighborhoods. He went on to describe how vibrant the mixed use neighborhoods are, how they add so much 'local color' which tourists love (take our beloved North Beach for example). I would hope that since the Rasmussen's were elderly and uninformed back in the day when they were deprived of their commercial zoning which had legally been in their family for ninety plus years, and that the area where the beautiful 1300 Rhode Island Street building is, would be greatly served by having a local business there, and that our economy is mostly made up of small business people, and that a place such as thhis where the Shopkeeper lives above the Store is an American tradition dating back to our beginnings as a free enterprise country, that you will please reconsider this re-zoning, which, in my opinion, was done in error.
10 The elderly couple had no way of combating such a ruling not being lawyers themselves nor schooled in the multitudinous zoning regulations and business rules of that day. The ruling to take away the century old commercial zoning did not enhance the neighborhood but rather deprived it further of local color, services needed and charm. Please consider re-instating the Commercial Zoning that was in force from 1887 until 1978 as the couple who owned the business at that time had no way of protecting themselves from such a deprivative ruling.
